Ontario Court Justice Randall Lalande took the action Tuesday because the accused, Kevin Rayner, disputed the facts of the case as read in by a Crown prosecutor.

“The court cannot proceed unless the facts are agreed to,” Justice Lalande said.
Rayner, however, indicated he still wanted to continue, but Lalande would have none of it.
“Your plea is not accepted, sir,” said the judge.
Lalande said the guilty plea had to be struck and he ordered a trial. As a result, the case is now headed to Ontario Court assignment court on July 28 to possibly set a date for trial.
