CBS8, the attorney representing the Zahua family filed an amended complaint in the family's lawsuit against the San Diego County Sheriff's Department.
The County of San Diego filed a demurrer, asking the judge to dismiss the lawsuit and the amended complaint seeks to keep it alive.
The family will continue the ongoing lawsuit against the sheriff's department over the release of investigatory records in the case.
