Says the other 80 of the antibiotics are dished out to factory farm animals allegedly to prevent them from getting sick in the horrible conditions but the antibiotics are also used to accelerate growth and enters have warned that we are moving from a small cut of antibiotics that wont be able to treat the infection. One such superbug mrsa already plagues our nations hospital. Over 100,000 americans die each year from what are called hospitalacquired illnesses. President yee, i am happy to address at least the state part which is the real focus of this resolution as there is a discussi discussion happening right now with advocates and lawmakers in sacramento about the potential for a statewide millionaires tax which would be independent of any efforts and i would defer to supervisor haney to address the local efforts that he has been leading around the c. E. O. Tax. But these would be two distinct things although i think that with the resolution is certainly to be targeted with high income earners for greater taxation. Supervisor haney. Supervisor preston, what is the what are the thresholds . Do you know, i mean, a millionaire doesnt take much to be a millionaire now days. So do you know that the particular advocates are talking about . Is it i know that supervisor haney and proposal and has something to do with if you make a certain amount over your employees and that that and do you know the specifics of this particular revenue measure . And so based on the same sort of calculation . What are the levels . When does it kick in . And can you give me some and i was talking to supervisor haney about this and i just wanted to know how this is different than something else. Again, i will lever to my colleague supervisor haney and not purport to speak on the local effort, but on the state effort which prompted this resolution and so i think it does take a lot to be in this income tax bracket. This is incomes over a million. I think there is a very serious conversation for us to be having sort of beyond the scope of this resolution around taxation of wealth. And better ways to get at that, right . But this measure targets about an effort right now that is understoodway to create an effort that is underway to create a 2 increase on taxable income. So this is folks whoever an annual income of 1 million or more. I want to be clear there is not a current bill proposing this so those details can change. There is a conversation about attack of nature at the state level and income tax that we are not free to levy straight up and in that way and on the state income tax and that is happening and moving forward and in support of that type of tax targeting and i am happy you are muted. And supervisor haney, i think your c. E. O. Tax is what is sometimes referred to as a millionaires tax but this is really about c. E. O. S and make so many and over 1,000 times more than the employees. Is that correct . And so that the overpaid and is on companies who have a ratio that is a tax on the with the individuals and ours is not an income tax at all and they dont. Supervisor safai, aye. That includes your legislative aid and that includes all the city workers and we are talking about police and fire and i understand. But at this point, i think, that i would like to question the legality of whether or not i may rescind that vote. However, i am open to now having a conversation with mohcd immediately if they would like for me to rescind my request to rescind the vote. Through the president to supervisor fewer, because the interim bucket is no longer before the board, it does not mean that you cannot engage in conversations perhaps at a later meeting about this very issue, but the budget itself to ask to rescind your vote, i am afraid is not possible tonight, but it doesnt mean you cant have the conversation. Today my guest is anastasia klaste and were going talk about how the pandemic has affected our school community. Welcome to the show. Hi thank you. I understand that our students and teachers have adopted Video Conference as Distance Learning tools to be able to continue studying remotely and this is clearly new for everyone. Do you have some suggestions to students and perhaps their parents that could help them manage this new approach . I think the best advice i can give students and parents is to really be gentle on yourselves during this time. The thing we dont really want to do is increase stress and anxiety amongst our students because they know it is a scary, uncertain time aside from the work. So, we are engaging in Distance Learning and providing work for students to engage in. The Mental Health of students and their wellbeing and safety is really at the forefront of our minds and so were asking parents to keep an eye on their kids and also asking kids to speak up and let us know if theyre having trouble f they need to talk to someone, if they need to take a break or they need more time to do work. Because that is really whats most important for us. Right. And what would you say to teachers having a hard time adjusting as well . I think our faculty is really lucky in that we were already utilizing google classroom in all of our classes. So the switch from inperson to online is not as extreme as it may have been to some other faculties in other schools. That said, most of us had never engaged in Video Conferencing or done any sort of daily online lesson planning. So, i think the same thing i say to parents and students i say to teachers is to just be gentle and give yourself space and know its ok to make mistakes and its ok if youre not perfect and were all sort of learning and doing at the same time. So, that can also be anxiety provoking and that can be hard for taoefers that are used to being really good at what they do and knowing what exactly to say and how to do it every day are grappling with new technology and theyre finding that students [inaudible] what they do in person. Are there concerns about College Admissions for High School Seniors and juniors . I think at first there was a lot of sort of confusion and anxiety for juniors and seniors about colleges. And now that the system has come out with some guidance and we understand that, you know, the s. A. T. And a. C. T. Tests wont be required for the next year, we know that universities have only agreed to accept credit or no credit or passno pass grades and looking at students across the country knowing that were in unprecedented situation now that weve got guidance of clarity around that. Students are feeling a lot more comfort. Comfortable. For our current seniors, most of them got their College Acceptances in february and march so those things shouldnt be changing that much. For juniors, you know, now that they know that they have to step it up for the next year because the grades that theyre getting this semester may not be letter grades, it might be a passno pass, creditno credit. But it seems from everything that i read or hear, theyre working really closely with School Districts to make sure that no student is, you know, adversely affected by the pandemic because of this sort of universal experience for all students. Indeed. I heard that some kids are worried that they may have to make up the work or retake the whole year . How likely are those scenarios and how will grades be assigned for this semester . Well, San Francisco unified has made a decision through the board of ed that there will be a signing. Creditno credit for 6 through 12th graders and that means that basically they will either full credit for the glass or wont receive credit for class, based on the work that they do and that goes into a gaap of neutral so it shouldnt raise or lower any specific students g. P. A. , but just give them credit toward graduation. From what i can tell, california has been pretty clear that no student will have to retake this year. As educators, we do acknowledge that thereby a little bit of catchup happening in the fall. Right. Have your students had a variety of different experiences during this pandemic . Yes. I would say definitely. Our school serves a big atrisk group of kids. We have students from every zip code and city, basically. And students from all sorts of backgrounds and socioeconomic statuses so on one hand they have their high speed wifi and its no problem for them to hop on a zoom call or get their google docs turned in and then we have a lot of situations where they may not have wifi so theyre delivering hotspots or they have a device but it is shared among several siblings or the parents are using it during the day and the kids have only a certain amount of time that they can engage. So, you know, something that the teachers have talked about being mindful of and im definitely being mindful, as a principal, is that our students are in various situations and we cant assume anything about their access in their ability to [inaudible] right now. For some of them, theyre caring for siblings or grandma, living at home. Many of them have family members affected by covid and so theyre in a space where theyre really just trying to take care of those around them. And academics are sort of on the backburner and for right now thats ok. You know, we sort of support them in whatever way they need. I understand. Have you been able to provide any Technical Assistance to your students or faculty . Yes. The School District had hotspots so i personally delivered about 50 chrome books to students and now were getting hotspots, which are wifi devices that utilize cell phone coverage in an area so homes that dont have wifi or homes that have spotty wifi can use these hotspots and the kids are saying that they work really well and now the district just got a bunch of them so were able to list them. So any family that needs them right now, which is really great. Now all of our faculties have access to high speed wifi and technology at home. We are providing them with the technology that they need to be engaged in this. I see. And finally s there any news about Summer School . There is. Sort of. Its happening. In some way, shape or form. But we dont really know how or where. Im assuming it will be online and, as usual, seniors or kids about to graduate will be prioritized so therell definitely be some Summer School, im just not sure where or what at this point. But theyre going to share information about that pretty soon. Unfortunately all the fun summer programs and jobs, the arts programs and language programs, the acceleration programs are probably not happening. They dont say the many great stuff that was just said a few minutes ago. If would be great if departments could have that information, postit clearly on their websites. I mean no disrespect to epic or the department of Public Health, and i understand that the representation from the department of Public Health is that this donation was not solicited, but this is a company that was doing a very that is doing a very extensive project for the city and county of San Francisco. Im reticent to accept a grant like this. It seems to me if a charitiable donor wants to make a donation to the city and county of San Francisco, the best way they can do that is by reducing the price of their services, and we, in turn, can then spend the unspent general fund dollars on what we choose to appropriate it to. And i realize this budget is only 105,000, but im uncomfortable with it. I mean no disrespect to d. P. H. Or epic. Given everything thats going on, i wanted to express my discomfort with it and the fact that im not going to be able to vote for it, and im sorry, mr. President , for my problem with the mute button. So there was some discussion on these two items last week and not so much on the items themselves, but in terms of what we can and cannot do in terms of the vote, and i believe theres some clarification that as we vote on this, one can vote no on this, and if the majority of the vote is in favor of passing these items, then it will pass, even though its a no vote. Deputy City Attorney pearson, is that correct . Yes, president yee, that is correct. Okay. Thank you ve. President yee thank you very much. Supervisor preston, did you want to speak . Supervisor preston you know, i wanted to speak on the standards, but you clarified that, and also, thank you to the controller for walking me through some of my concerns. I continue to be concerned with a budget that contains police funding, but i thank the controller for taking the time to discuss the budget with me this past week. Thank you. President yee thank you. Supervisor ronen . Supervisor ronen thank you. I just wanted to thank my colleague, supervisor preston, for finding this conundrum that were in, for pointing it out in this budget process. I am on the budget committee, and i am ashamed to say that i did not notice this increase spread when we were in committee, but it really does bother me. Either were going to be serious about reenvisioning Police Reform in our city and diverting that money into other areas and into the black community, into better ways of dealing with homelessness and Mental Illness or were not. I see no reason to be increasing the Police Budget by close to 50 million and then decreasing it in a month. You know, it again, like, we should be consistent, we should be sending a clear message, and we should be serious about that. So im also going to be joining my colleague, supervisor preston, in voting no on this interim budget. Im serious about Police Reform. Im thrilled that the mayor and supervisor walton are taking the lead on diverting funds from the Police Department into the black community, and i see no reason to increase the budget now, only to be decreasing it later. I think that sends mixed messages. Thank you. President yee okay. Supervisor walton. Supervisor walton thank you, president yee, and i am going to briefly state, like i said in last weeks Board Meeting, i cannot in good conscience support a budget that has increases for the Police Department when we have made it clear the board of supervisors, that we have made it clear as a city that we will be redirecting money from the Police Department to invest in the city. I will not be supporting this budget as it is today. President yee okay. Thank you, and thank you for comments, colleagues. It is kind of strange that this is supposed to be an interim budget thats basically looking backwards and projecting forward. Even during a rebalancing activities, that you would think that the budget for the Police Department would go down and not up. It is strange. I also know that this is an interim budget thats pretty much not used it will not be used for necessarily for next years budget, so im comfortable that the impact on this year, it sends the wrong message is pretty nil. I will vote in support of it for the rest of the budget. Okay. Roll call, please. Clerk thank you, mr. President. And i will say that should item 7 and 8 be approved, my staff will do something a little different. They will be preparing the interim budget to move to the mayors desk sooner rather than later as the controller has mentioned the time sensitivity on the budget. Clerk item 9 is a Charter Amendment to amend the charter of the city and county of San Francisco to authorize youths aged 16 and 17 to vote in municipal elections at an election to be held on november 3, 2020. President yee colleagues, today, i am proud to join supervisors fewer, walton, haney, supervisor, preston, safai, and mandelman to extend Voting Rights in municipal elections to 16 and 17 year olds. I would like to thank the San Francisco Youth Commission and youth advocates who have been working to make San Francisco the first city to allow 16 and 17 year olds to vote in municipal elections. I want to thank you for your tireless effort. It is so important at this time in our city and country we take steps to secure our democracy and take steps to ensure we have a government that works for everyone. It is essential that young people develop a habit of voting as young as possible and continue to participate in our democracy throughout our lives. Voting in the United States is far lower than other established democracies, and turnout is lowest among voters from 18 to 29. So when you look at that subgroup, only 30 of those voters actually vote, which is really low, and so theres also evidence that other cities and countries, they have set the minimum voting age at 16 show that lowering the voting age increases the voting turnout among young voters and even encourages parents to vote at higher rates. In San Francisco, voting turnout is lowest in the two neighborhoods with the highest number of youth and children. Thats bayview and visitacion valley. We know that on issues we vote on as a city dont just impact everyone anyone thats just 18 and over, they impact our young people also. 16 and 17yearolds dont have a say in the decisions that we make about their education system. 16 and 17 year olds can be tried as adults, but they dont have a say in our criminal justice system. And 16 and 17 year olds can get a job and pay taxes, but they dont have a say in our voting results. They can have a say in education, transportation, housing, policing, and Economic Development, and they deserve to have a say. Over many decades, they have had the opportunity to live and work in San Francisco, and weve seen that they can and want to navigate complex issues. They are at the forefront of local national and global movements, movements to end gun violence, reform our communal justice systems, and confront the challenges of Climate Change are being led by our youth. Earlier this month, 10,000 people joined a youthled protest at Mission High School to demand justice for george floyd and end the systemic oppression, racism, and other problems that communities of color continue to endure. Young people are capable of changing the world for the better, and we will stand alongside them and let their voices be heard. The struggle of equal Voting Rights extends back to the earlier days of our nations history where our right to vote belonged solely to white adult males. We have come a long ways but still have to ensure that everyone who has been afforded a right to vote in this country is able to cast their ballot on election day, and we have a long way to go to ensure that groups who have not yet been afforded the opportunity to vote but so greatly deserve to do so by extending their rights. That is what this fight is about. This is about moving us forward as a city and sending a message to our country at a time when we are confronted with division, gridlock, and so many seemingly intractable problems. It is about recognizing that our youth have always, always pushed our city and country forward, and it is about recognizing that our democracy is stronger when everyone is informed, engaged, and able to participate in decision making. And i just realized recently that even the state is almost following suit by allowing 16 and 17 year olds to vote in state elections. Clerk item 11 is an ordinance approving an easement deed and agreement between the city and county of San Francisco and Millennium Tower association for certain surface and subsurface rights in a portion of the sidewalk on the Southern Side of Mission Street at the intersection of mission and fremont streets and on the eastern side of fremont street at the same intersection, for 0 to allow a structural upgrade of the 301 Mission Street highrise building, known as the Millennium Tower, contingent on a number of events, including Court Approval of a Class Action Settlement of the Millennium Tower litigation, waiving requirements of adtrition code, authorizing the director of property to execute real estate documents, make certain modifications, and take actions in furtherance of this ordinance, as defined here in, adopting environmental findings, and adopting findings that the easement is consistent with the general plan, and the eight priority policies of planning code. Clerk item 12 is an emergency ordinance to delegate board of supervisors Approval Authority under charter section 9. 118 and administrative code section 23. 30 to the Mayors Office of housing and community development, mohcd, and to the Real Estate Division to amend certain existing leases regarding residual rent payments by providers of 100 Affordable Housing projects, in response to the Public Health emergency related to covid19, and to authorize the director of mohcd to amend certain existing loan agreements and policies without review by the citywide Affordable Housing Loan Committee under administrative code chapter 120. And mr. President , pursuant to charter section 2. 107, this matter requires the affirmative vote of two thirds of the board of supervisors, eight votes, with one read. President yee okay. Thank you, madam clerk. Supervisor peskin . Supervisor peskin thank you, president yee. As my colleagues know, ive had trouble with this measure actually in an earlier incarnation that was actually permanent legislation and not an emergency ordinance lasting for 60 days primarily as a matter of overarching checks and balances, and i think our decision not to delegate authority under charter section 9. 118 come before the board for our and public scrutiny. There was a long period of time where, due to no mal intent, these instruments or many of these instruments, particularly loan instruments, were not brought before the board of supervisors, and i understand there is an appropriate desire to clean those up, but i think theres a much better way of doing this that is much more transparent that does not devolve the board of supervisors oversight role. To that end, i had a conversation last night with the mayors director of the office of housing, eric shaw, and indicated my willingness to work with him to figure out a better way of doing this. This is actually a concept that has been kicking around since before mr. Shaw got his current position. I also visited with the chair of the budget committee, supervisor fewer, to indicate my desire to send this back to committee, and particularly at a moment in time where yesterday the controller released his report relative to the allegations at the department of public works where the board, the supervisors voted unanimously. Although i expressed public concerns, i was amongst those votes to stream line that process around the creation of navigation centers. It appears that because we got rid of that oversight and the appropriate checks and balances and the appropriate public process, mr. Nuru allegedly not allegedly gave a number of contracts to friends and associates, including mr. Walter wang, who was arrested by the federal bureau of investigation and is being investigated by the United States attorney. I dont think this is the time to get rid of the boards oversight, if there was ever really a time. And quite frankly, disguising this as a covid19 emergency is offputting. I have actually communicated with some nonprofit Housing Developers that have a stake in this legislation, and while they do have cash flow needs, they are not imminent. I think theres plenty of time to recraft this legislation in a way to keep the board of supervisors oversight and accomplishes the policy goals here but without getting rid of the checks and balances that are near and dear to government. So i would like to make a motion to send this back to the budget and finance committee of the board of supervisors. President yee motion made by peskin. Is there a second . Supervisor walton second. We just had a hearing on mohcd at the budget committee, and the questions we had during the hearing in terms of transparency lends a lot of support to what supervisor peskin is saying, so i would fully support this motion. It is important to carefully consider important issues such as Housing Affordability and neighborhood character and how they interact together. Its also important we allow for meaningful neighborhood input into landuse decisions. This can help to shape projects and ensure that they are enhancing the quality of life in our neighborhood. I want to thank you for the oneweek continuance which allow me time to facilitate additional dialogue between the project sponsor and the appellant. While this dialogue unfortunately did not result in a compromise agreeable to all parties, i want to thank everyone for their willingness to engage in constructive discussion about the project and i will hold off on further comments until after the presentation. The appellant believes the house is [indiscernible] even though the house was built in 1907 and mobile service did not begin until 1919. Second, the house is on a commercial corridor, even the businesses are clustered around 19th avenue and the lower great highway. There is no code requirement for commercial and there are already three commercial vacancies on this block alone. Third, this house is on the west side. There is a perception that the city doesnt give equal weight to Historic Resources on the west side despite how few of them there are. I will launch now into the powerpoint presentation. That should bring it up. Is that up . Okay. Lets start. I see them coming here. Okay. I think it is there. Okay. Thank you. Okay. The negative impact on the project. It eliminates Affordable Housing the replacement project or placement project is market rate it negatively impacts neighborhood character and destroys a rear Historic Resource the process for the peel started with board of supervisors petition and then it moved onto a signature of the neighbors. That is why its here. Its a petition by the neighbors and what are the issues of the project. There are issues with the planning code and other issues. This is the house. They are very narrow. They are vertical windows and they are therefore, light and air. The next thing, is okay. I was at the meeting. These concerns were about the tenants. There are three and they are all aware they need to move. The architect advised that a consultant had concluded that the house was a nonHistoric Resource. Bin lee was also there. These concerns with the side facing windows on taraval in apartments one and three. The concern was whether these windows would be blocked by the proposed project. They are narrow and vertical. It should be noted also that all of the tenants the meeting report was then submitted. Okay now, what the report said, and it states general discussion of the plan rather than specifics. Okay. The next one these are issues that we believe are inconsistent with the planning code about cultural and Economic Diversity of the neighborhood, about the discouraged demolition of existing housing, unless the demolition results in a net increase of Affordable Housing. The next one is about preserved mental units, especially rentcontrolled units. [indiscernible] this goes into the naturally occurring Affordable Housing in the definition of that and the next one is that the appellants believe that 1420 taraval is not affordable based on the issues here about the property tax, the assessed value, what each tenant is paying the Square Footage they have and also the amenities and the displaced tenants. Even though the proposed project would cover them up, the 1420 design is code compliant for that reason. This is the row of the housing houses. The far house is the only surviving one. This is the builder here, who also built the grateful dead house. The Planning Department team gave it a number of positives in terms of historic presentation preservation. The staff, however disagreed with the consulting report that was done by them, that the house was not a Historic Resource. One minute left. Okay they have supported new construction of a preservation and we are supporting so many other things. Theyre concerned about the layering graffiti if the project is not built right away. It will decrease the value of our property. We have to ask they have completely broken our windows. There is 3 feet of space outside our windows. Our tenants tony lee was there instead. Im also the coauthor of the citys parkside district Historic Context statement. Heritage supports this appeal to deny the project at 1420 taraval street. It would destroy an excellent example of one of the districts in the few surviving early houses. We agree the planning staff, would recognize the significant guidelines were saved for Historical Resources and called it an early and rare example of an early 20th century new neighborhood. But, we strongly disagree with the subsequent categorical exemption from ceqa and the determination that it lacks the integrity to be considered a Historic Resource. The alteration to the building are minor and reversible. Consisting of replace windows and porch fillers. The integrity of property in a historically workingclass neighborhood needs to be considered contextually with simple changes such as the replacement of windows that becomes a threshold for determining loss of integrity, it just reinforces the perception that the only civic structure and residences of the wealthy elite are worthy of recognition and protection. Heritage is committed to the preservation of the unique architectural and cultural identity and every corner of the city. Neighborhoods such as the bayview, the excelsior and the parkside are woefully underrepresented on the official inventory of historic property. Two Additional Market rate units would not move the needle on Housing Affordability, but this proposed project would destroy one of the last best Early Buildings on the parkside districts main street. Yes, ladies and johns men of the board, i am here to speak in support of the proposed project. I am understanding that others had very valid concerns. At the end of the day, we are dealing with a very old and outdated home, which the Planning Commission had conducted a detailed hearing and has made a determination the project is moving forward as the investigation has completed. Its extremely important to note i did write a letter of support, ladies and gentlemen, that the number of units is suboptimal. We need to start somewhere. I understand the comment that three condos may not make a difference in terms of moving the needle, but we have to start somewhere. We continue to make the argument that it wont move the needle then no project will continue to be built. It is an excellent project. Three quality condos which will be available to members of the public, as well as additional commercial storefronts to support revitalization of the area. I believe the Planning Commission has done a very Detailed Analysis and there is no reason why this project should not move forward as it has been determined it should. Thank you. I would wholeheartedly and would have for years supported replacing the house. And i think that the concept of condos and commercial fits very well with the modernization that has taken place on taraval for the last 10 years. So were very supportive of this project. We think that the group that is developing that have very high character. And a longstanding multigenerational san franciscans with three kids that theyve raised here. They have nothing but the best interest of the city at heart. I have three kids. Im sorry, three more condos could help. They cant even afford the rent here. So anything that has to do with multifamily dwellings and supports the stay. And i think that the design and the concept of what the Developers Want to do at 1420 taraval really fits in well with whats happened on the street in the last 10 years. And their message is pretty clear do not tear down this building. And i feel that the board is not listening to the community. This house is not only historic, but its also naturally Affordable Housing. And the result of careful planning by San Francisco City Planners some time back. And given how expensive San Francisco has become, its really very important to kind of save as much Affordable Housing stock that we can. San francisco, as we all know, is probably some of the most expensive housing cost in the world. So destroying this house will remove desperately needed Affordable Housing stock in San Francisco and replace it with marketprice housing and housing that only the wealthy can afford. You know, there are thousands of apartments right now that are available, more than 3,000. And almost all of them are market price. So definitely more expensive than this home that is being proposed to be torn down. And the commission is asking not only to remove the rental property but not replace it with rental property but instead condos that will likely be affordable to only a few people that will be wealthy enough to be able to afford them. This is also an historic house, one of the few Historic Houses left in this part of the city. It needs to be saved. And theres no guarantee that if its torn down that we wont be left with a hole if the ground because maybe the economy turns in a different direction and all of the best wishes for putting up Something Different may not necessarily materialize if the economy doesnt stay moving along the way that it is. And its hard to tell if its going to continue moving along given how the economy has been impacted by the coronavirus right now. Thank you for taking my call and listening. Im the manager of the legislative affairs and a liaison. Ill present this case for the Planning Department. And im accompanied by linda, the planner for this project, and alex vanderslice who worked on the determination for the subject property. The decision before you is whether to uphold or overturn the Planning Commissions approval of the conditional use authorization for the demolition of the existing 2,170squarefoot Single Family home and construction of a new fourstory mixsuse building with three dwelling units and ground floor commercial. It has a mix of three, approximately 1,600squarefoot, three bedroom, two bath units. The building was proposed at 25 feet in height and a 65foot height district. The 20 feet below the 65foot high district. However, the Commission Approval reduced the overall height by 22 feet for a total of 42. 5 feet. Proposed project is on a major transit corridor, and it is also located in the neighborhood without a uniform architectural expression. The appellant raises four issues under the Planning Department purview in their written appeal. The first is that the proposed project is not consistent with the objectives two and three of the housing element. The poord Planning Section 101. 1. And the second issue is that the proposed project decreases the naturally Affordable Housing in the parkside district. And the project destroys a rare Historic Resource and negatively impacts the look, feel and character of the parkside district. And, finally, the project will block Property Line windows. In response to the first issue, on balance the Planning Commission found that the proposed project was consistent with the general plan. In granting the c. U. Approval they acknowledged the loss of rental housing, likely subject to rental control. And however, found the project to be consistent with numerous other octives and policies of the housing element, recreation and open space element, the transportation element and the urban design element. And when making planning general planning consistency findings, the Planning Commission must balance the competing policies and come to a decision as to whether or not the proposed project is on balance consistent with the general plan. In this case the commission did come to that conclusion. In addition to finding consistency with other policies in the general plan, the Commission Also found the resulting project would have an increase of two new dwelling units and a net addition of season bedrooms, furthering the goal to increase the supply of housing, in particular the lowrise smaller apartment buildings with three to four units. And in response to the second issue, the proposed project decreases naturally Affordable Housing. The Planning Commission found that the project benefits outweighs the negative impacts with the loss of the existing housing. And the project removes the older dwelling unit which is considered more affordable in new construction and the project will add two familysized dwelling units to the citys housing stock. This results in three, threebedroom units of 1,500 to 1,600squarefeet each. And its more affordable in design because of the proposed Square Footage. In this instance, the Planning Commission found that the proposed budget benefits outweigh the negative with the existing houses. And in response to the third issue that it destroys a rare historical resource, it does not have integrity. Further appeals of the historic determination are adjudicated through the ceqa appeals process. That said, the subject project was found to be significant under criterion one as part of the early Residential Development of parkside. And the latter evolution to accommodate the commercial uses. And its also found to be significant under criterion three as a rare example of early 21st century architecture in the parkside. However, the subject property does not maintain integrity with significant alterations, including from the vacant commercial space. Further, the subject building is not eligible for listing in the california registry as part of the historic district. The contrast, the project at 1409 taraval is significant as well. However, at 1409 taraval is more of an examine of Single Family residential architecture from the Early Development in parkside. Finally in response to blocking Property Side windows, most of San Francisco is zone lot zero. And they will consider the Property Line windows if they are the only windows to a bedroom and the removal prohibits them from being used as a bedroom. The windows on the adjacent property do not meet this criterion. In coon collusion, the Planning Department recommending to uphold the planning boards decision to adopting the motion, approving the conditional use authorization for this project. Good afternoon, president yee and supervisors. Justin zucker, on behalf of peter mandel, the Property Owner of 1420 taraval street. First we want to thank supervisor mar and his legislative aide daisy kwan for their tireless efforts to address concerns raised in this appeal. With the conditional use the Planning Commission found the project to be necessary and desirable. And the appeal is meritless, should be denied, and the Planning Commissionary decision upheld. On balance the mixeduse projects, the affordable bydesign units were found to outweigh the loss of the existing twobedroom Single Family home. While we appreciate the appellants recent engagen enga, that doesnt work. It would likely want allow for the construction of one familysized three bedroom unit and results in the loss of a new ground floor commercial space and a neighborhood commercial district. Being along the corridor, the property is an excellent opportunity site for this development. And it is anticipated that the commercial space will be highly attractive. The appellants arguments regarding the historic status of the property are inaccurate. The property has been determined by the Planning Department to not be an Historic Resource. The property has lost its integrity due to numerous alterations and modifications over the years. It has a category that has no ceqa classification. This is not the proper forum to discuss the status of the property as mentioned by planning staff. Not withstanding their attack on the resource classification, appellants have no credible evidence that counters the substantial evidence relied upon by the Planning Department in determining the property is not an Historic Resource. The Planning Commission analyzed whether the project is necessary and desirable, and compatible with the taraval street and they found that it is. In making the required conditionaluse finding, the Planning Commission found the project to be consistent with the general plan. Appellant appear to argue and oppose the project on behalf of the existing tenants of the singlefamily home. But as indicated in their letter submitted to the board, the tenants are supportive of the project, recognizing it tripled the number of dwelling units at the property while also providing a ground floor commercial space. Theyre not being evicted. While this is a small project this moves us incrementally in the right direction towards addressing the citys housing crisis. As for the concerns raised regarding the neighbors windows, subsequent to the preapplication meeting, peter has met with the neighbors sheriff times to address their concerns. Most recently with supervisor mar. The window will be lost in two rooms and the two impacted rooms have large bay windows for light and air. And though declined, the mitigation offers have been made in a goodfaith effort. Including assisting in installing a sky light and interior lighting and other nonproject related repairs to their building. We respectfully request you to deny the appeal and allow this to proceed. Now ill turn it over to peter to give history on this project. Peter, you might be on mute. Is that better . Yep. Okay, peter mandel here. I have known the existing building since 2004. Before that my father owned it for several decades. I have lived in the house for about 28 years. First with my two high school roommates. And then with my wife and kids from 1980 to 2008. I did move out in 2008 as the house was very small in the interior and into a more suitable house for my wife and three kids. I am a native san franciscan who grew up in the sunset district and now live near westportal. Im not a developer but i own my own Remediation Company and have been busy for the last 16 year. My objective is to increase the housing availability in the neighborhood which is in my opinion one of the most important things at this time, along with maybe creating a few jobs during these difficult times. During some of the Planning Commission hearings and many of the appeal documents, i have read i have heard from those opposing the project, many references to the porch being authentic. But this is invalid. If you look at the photos closely, that porch is complet completely an addition to the original. And i know that for firsthand because i had to rebuild that porch, okay, with some its all made out of pine and back then they didnt use pine, they used redwood. So that is an addition. Also i have heard from those opposing that the current tenants that are in the building will be displaced and evicted but those same tenants approved this project with a written statement to supervisor mar. And so they are for this project, the tenants are. Likewise, a host of individuals recently have just sent in letters of support. A p petition is created by the merchants two blocks up and two blocks down, and everyone that knows about this project are in support of the project. You know, i regrettably have heard about statements such as fraudulent, corrupt, about the work that both bill and i, my architect, have done. And, you know, we presented everything in a concise and truthful manner. The leads themselves went to a meeting between bill and i at bills office and we presented everything on the drawings. And an hour later, you know, we did present what maybe will help to close up the windows and the skylight that opens for fresh air. And we shook hands and then they left. And two months after the Planning Commissions second meeting, which everything was approved, i got a call in saying that, you know, the rents might go down and thats when this all started about the windows. So, you know, i do look at all of the motor homes there on winton boulevard, and i am saying to myself this city needs something done. So it needs more Affordable Housing. The office space down below more than likely i will my business will be moving into that. And i do respect the opponents right to appeal. But, again, this project is exactly what this transportation corridor needs. So on some, you know, this house has no historical to it. I mean, they mentioned the grateful dead, but, you know, i dont think thats really valid here. So i i want to approve this project and i thank you for your consideration and time. Thank you. Because how come they indiscernible the meeting. We are complaining of that. And the rentals, i have to protect the life of my tenants.
