Twentyfive is an ordinance to amend chapter 19 b. Of the ministry of code governing the citys acquisition, retention, and use of Surveillance Technology to allow the acquisition and retention of Face Recognition Technology under certain conditions, to preclude legal relief for alleged violations of chapter 19 be that the city timely cured following notice, and two authorizes a debated administrator to adopt implementing standards to guide departments in compliance with chapter 19 b. s restrictions on the acquisition, retention, and use of Surveillance Technology. Supervisor peskin . Thank you. This legislation trails the ban on the city use of facial Recognition Technology that we, the board of supervisors, passed earlier this year. I have a couple of nonsubstantive amendments that boil down to a semantic distinction between the purchase of devices or software that may have facial Recognition Technology bundled in them, and the prohibited acquisition of facial Recognition Technology. In either event, the city must make written findings that the city would never use that technology. This legislation also strengthens the citys ban on facial Recognition Technology by creating a means market for dark market to do not have this technology embedded in aunt. The changes are at the bottom of page two and the top of page three. They are the exact same insertion of language that says i Software Product or device that includes, and that it appears in subsection g. , and the two succeeding clauses. Twentyseven is an ordinance to amend to administrative code to apply eviction controls to units that are exempt from rent increase limitations because they first received a certificate of occupancy after june 13th, 1979, or have undergone a since of substantial rehabilitation. Supervisor haney . Thank you. Thank you to the rules committee for unanimously supporting this ordinance. For 40 years, the San Francisco rent ordinance, which our city has a set of laws which govern renters rights, has treated tenants differently based on when theyre building was built. If youre building was constructed before 1979, you have the benefit of rent control and protection from arbitrary eviction. If youre building is any newer than that, you simply dont. We have little data on what happens to tenants in the post 17 1979 buildings. Fifteen of renters reported they were threatened with eviction in the previous five years. Over the past decade, the number of Homeless Individuals reporting that eviction is the primary cause of homelessness has more than doubled. Now is the time to correct this inequity and treat all units the same when it comes to eviction protections. That is exactly what this universal eviction protection legislation will do. Earlier this year, we passed the tenant protection act of 2019 that establishes just because eviction protection in every California City starting on january 1st, as well as implement a statewide rent cap. This is a huge werent win for tenants statewide. We have an opportunity to go even further. Our legislation will close the gaps in the state law and build off of San Franciscos rent ordinance to ensure tenants and buildings constructed after 1979 , including tenants who just moved in and those that live in singlefamily homes, and those that are built in the last 15 years are protected by strong eviction protections and Relocation Assistance if they are subject to a nofault eviction. After the ordinance goes into effect, the rent board will have the opportunity to provide support and oversight over these buildings in a way that they have not up until this point. I want to thank the organizations in the antidisplacement coalition, especially the San Francisco Tenants Union for bringing this proposal forward and partnering with us to expand it, and also to my cosponsors who also a special thank you to Courtney Mcdonald from my office for all of her hard work. This is a huge expansion, one of the biggest, if not the biggest expansion of eviction protections in San Francisco in the last 40 years, and it is critically needed at a time when we know that many folks, regardless of when theyre building was built, are living under threat of arbitrary eviction. This will finally change that. Okay. Thank you. First of all, i want to thank supervisor haney for picking taking the initiative on this ordinance. While i will be supporting this item today, i would like to implore this board and the city to do more when it comes to educating and providing resources for small Property Owners. Many of whom are immigrants or limited english speakers. With the passage of a. B. 1482, there has been a lot of confusion and misguidance for landlords and Property Owners. Im deeply concerned that people are being misled and we are getting the unintended consequences of an eviction. This is not what we want to see happening. We need all the housing we can get and we know that many small Property Owners have provided the stock. It is unacceptable for us to assume that every landlord has knowledge or resource to understand complex tenant laws, especially in San Francisco. I know this conversation comes at a time comes up time and time again, but i have not seen any demonstration of proactive outreach and education to these types of landlords so that we can prevent evictions and disputes from happening in the first place. We need to empower communities to support each other. We want landlords to be fair counterparts so they can keep tenants housed in safe conditions. I am looking for innovative ways we can be working with our communitybased organizations and city departments like the rent board, or even the assessor Recorders Office to educate and consult with Property Owners. I look forward to working with all of you during the bridget process to ensure that these resources are provided and that they are implemented in culturally competent ways throughout San Francisco. Supervisor ronen . Thank you. I am so excited to be here today after two years of studying and visioning and planning how to fix the growing Mental Health crisis in San Francisco. Supervisor haney and i reached an agreement last month with mayor breed to implement Mental Health s. F. In collaboration with her and the department of public health. I am thrilled to be voting today on Mental Health s. F. Instead of taking it to the ballot in marc. I want to thank all of my colleagues for your unanimous cosponsorship. The legislation before you reflects our joint commitment to solving our Mental Health crisis on the streets with particular attention paid to the intersections between homelessness, Mental Health, and Substance Abuse. San francisco will soon have access to a comprehensive Mental Health care program. We designed the system to provide access to Mental Health services, Substance Use treatment psychiatric medication to vulnerable residents, specifically those who are homeless, and insured, or enrolled in medical or healthy San Francisco. Mental health s. F. Includes a number of components. A 24 7 Mental Health service center, at 24 7 street Crisis Response team, a drug a sobering center, and an office of coordinated care. Increased beds at every level of the system, as well as case managers for every person who is eligible for services and who needs them. And office of Privacy Health private Health Insurance accountability for those residents who do have private insurance, but are unable to access family care. I want to thank the hundreds of frontline workers, labor unions , and advocates including nurses, Mental Health workers, and social workers, family members, and consumers of Mental Health services themselves for believing that we can do better and for partnering to make this solution. Of course, a very special thank you to my colleague, matt haney, are fighting alongside me every step of the way and to our incredible Mental Health s. F. Committee who worked so hard on every single detail of this legislation. I also wanted to give a very special thank you to supervisor Shamann Walton and gordon morrow and Assembly Member phil tang for their unwavering belief in our solution. Finally, thank you to mayor breed and her staff for her willingness to work with us to find unity and to dr. Colfax and his staff for the collaboration. And then, of course, i want to thank carlee nomar ellis and caroline from my office who spent a year living and breathing this legislation alongside me, as well as abigail from supervisor haneys office. We did it, we did it now that we have developed this thoughtful and exciting new Mental Health plan, we plan to move forward with the appointment of all members of the Mental Health s. F. And limitation commendation working group as soon as possible early next year. I thank you, president yee, for waiving the 30 day rule so we could get this rolling and get to work right away in january. The mayor has committed to hiring the director of Mental Health s. F. By next summer, and expediting major renovations of the citys current Behavioral Health Access Center so it can be transformed into the new 24 7 Mental Health s. F. Service center. Most other aspects of Mental Health s. F. , however cannot move forward until we have identified a long time Funding Source for the measure. I am thrilled to have the strong commitment for mayor breed to identify at least 100 million per year in new funding to fully realize Mental Health s. F. Through our efforts to reform the citys business tax or through other revenue measures. You heard that commitment again from her today. It is much appreciated and muchneeded. I will not rest, and i know that my colleague matt haney will not rest until we have the funding that we need to fully realize Mental Health s. F. And we will continue to explore every possible option for funding, including the idea of an excessive c. E. O. Salary tax if we need that. We have a lot of work ahead of us implanting this piece of legislation, but with the passage of Mental Health s. F. , we have the blueprints, we have the overarching vision, we have the structure on how we are going to effectively reform our Mental Health system. Thank you. [please stand by] lati. Supervisor haney and they shaped this into something that was truly connected to the actual needs within the system and on the ground, and so were confident that it can be successful, but were also very sure that theres a lot of work left to do. Its not fully funded yet. We have a commitment from the mayor, but we need at least 100 million a year, including startup costs, to be able to implement this. Its going to take a lot of work from the implementation committee, oversight and working together, potentially needed additional revenue from the public. So i know that the public is excited about this i hope they are, but theyre asking, well actually be excited the most about this when we see it bringing a change in our communities, and so thats going to be the next steps once it passes today. Im grateful for everybodys support and for everybodys leadership, and im excited about seeing this fully implemented and funded and lastly want to give, as supervisor ronen did, give a shout out to our staff, carolina in supervisor ronens office and abbie in my office. Must have seen this for the last seven months, and truly would not have gotten to this point without them, and the leadership of the Mayors Office in getting this down. This is the end of this part of it and the beginning of the next part of it. This truly transforms our works for everyone whos in need of Mental Health treatment, Substance Abuse treatment, or health care. On the east side of San Francisco, there are several amazing nonprofit organizations that help stablize these buildings through acquisition and property management, but on the west side, we simply do not have the organizational capacity to meet this need. This funding will help us change that, and im so proud of Assembly Member phil ting for his commitment to preservation of Affordable Housing on the west side. President yee supervisor mar . I just would like to thank supervisor fewer and assemb assemblyman ting for securing this state funding to support the growth, expansion and creation of a west sidebased Nonprofit Community organization dedicated to preserving and expanding Affordable Housing. In my word to aggressively expand Affordable Housing in my district, the lack of housing organizations has been challenging. We are grateful for the support of some organizations we have been able to partner with, like the Mission Economic development agency, which we work with to preserve housing for a dozen lowincome seniors in outer taraval through the first small sites acquisition in the sunset, but to move as aggressively as the resolution requires, we need more organizations focused on Community Development in the west side with understanding, relationships, and commitments to our neighborhood, so thanks again to supervisor fewer and assemblyman ting, and id like to be added as a cosponsor to this item. President yee supervisor fewer . Supervisor fewer thank you, supervisor yee. This legislation is a small tweak to proposition e, which is passed by over 76 of voters in this most recent election. I would first like to thank my cosponsors of the initiative, supervisors peskin, haney and walton, as well as the mayor and all of my colleagues on this board for passing prop e and make sure the voters overwhelmingly passed it. We all know in this Housing Affordability crisis, we desperately need to create housing in all parts of the city. We are falling far short of our goals for low and moderateIncome Housing. In order to close this gap, we have been working to provide more funding for Affordable Housing and make it easier and faster to build. This board has been aggressively pursuing new Funding Sources for Affordable Housing. This includes legislation that i recently authored that all of you cosponsored which allocates 50 of excessive eraf funds for Affordable Housing. This will continue to add tens of millions more each year. We also unanimously passed legislation from supervisor haney to increase the job housing linkage fee and provide hundreds of millions in funding for Affordable Housing over the next ten years, and in this most recent election, we call worked with president yee and the mayor to put a 60 0 millin housing bond on the ballot, all of those approved by voters. That will help address the number one barrier to Affordable Housing funding. We worked with stakeholders to develop and pass Affordable Homes in educator and families now initiative, which later became prop e which made it easier and faster to build Affordable Housing in all neighborhoods across San Francisco. Oroffice began working on this legislation earlier this year to make it easier to build housing in all neighborhoods, building off the success of the sally legislation that former supervisor jane kim passed last year to make Affordable Housing a principlely permitted use in districts. We also worked with united educators of San Francisco to develop a Pilot Program for educator housing in San Francisco on land owned by the School District or city college. No one understands the actual needs of our educators better than the educators themselves, and we are proud to have partners with them on this initiative. In order to assure that these project serve the diverse Housing Needs of educators, the ordinance currently requires at least 30 of the unit in an educate Housing Project, 30 of units are two bedroom units and 20 are threebedroom units. The legislation before you today changes the unit mix so that 50 of all units will be two bedrooms or larger, rather than requiring a set percentage of threebedroom units. This will allow for more Design Flexibility while still assuring that projects are not just for single educators. I am excited to see new Funding Sources becoming available to build housing for educators including at the state level and in our local Affordable Housing bond, and i cant wait to see more Affordable Homes being built in my neighborhood and every neighborhood across San Francisco. So i want to thank [applause] president yee so i want to thank supervisor fewer for her leadership in passing proposition e on the ballot in november, and for this legislation to ensure that the firstever educator Housing Project is able to benefit from the streamlining to get these units online. My own reservation is the bedroom trailing unit in this legislation is not as Family Friendly as what was passed by the voters in prop e or even what the city has previously adopted in programs like homesf in which at least 10 of the multiroom units would be would have at least three bedrooms. I recognize there are Market Conditions that make it challenging to build multiroom units, but developer have told me that they do this in every other city, why not San Francisco . On world tours day, mayor breed and San Francisco announced that we would launch a child and youth friendly initiative. If we want San Francisco to be a child and youth friendly city, we have to start setting standards for ourselves. With that said, the s the ciy has been working with us in this. Theres no reason why 100 Affordable Housing and housing on educator land should have less familyfriendly elements than other projects. Therefore, i would like to duplicate this file so we can continue to improve on our Housing Projects. So i would like to duplicate a file clerk mr. President , thats a sole president yee oh, okay. I just wanted to make some remarks on this item. This legislation will require the Planning Department to produce an annual jobs housing fit report, providing important new data and analysis to inform our citys efforts to truly address the Housing Affordability crisis in a more thoughtful, strategic, and impactful way, the annual jobs housing fit report will analyze the alignment or misalignment job growth by wage level. Planning commissioners have been asking for this for years, so i commissioned the first ever fit report in october. This initial report found that we need to build 18,000 affordable units for low and moderate income households while we have already over entitled high Income Housing through 2026. So in short, the Housing Affordability crisis is worsening, the status quo is increasing, and we are failing low and moderate income wage earners and their family. Not enough attention is being paid to now rapid job growth drives Housing Demand and the affordability crisis. We need jobs housing fit data to ensure that the houses thats approved and built in the future more directly addresses the Housing Needs of our workers and communities rather than only the financial bottom line of private developers. We also need jobs housing fit data every time the Planning Commission and the board of supervisors consider a Major Development projector area plan. Its time we face the data when making Economic Policy and land use decisions, and its time to confront the housing and other impacts of these decisions on low and moderate wage workers and families. Id like to acknowledge my cosores, supervisors haney, fewer, safai, and walton and urge them to pass the housing job fit legislation here today. Thank you. Earlier today, House Speaker nancy pelosi introduced articles of impeachment to impeach president donald john trump. Donald trump solicited the interference of a Foreign Government to influence the 2020 United States president ial election and in so doing, used the powers of the presidency in a manner that compromised the National Security of the United States and undermined the integrity of the United States democratic process. His actions have undermined our security and threatened our 2020 elections and violated his oath of office. As elected officials, each of us took an oath to uphold in true faith the constitution of the United States of america. The constitution provides the house of representatives the sole power of impeachment and provides that the President Shall be removed from office on impeachment for and conviction of treason, bribery or other high crimes and misdemeanors. San francisco has led the resistance to Donald Trumps policies. Now the time has come for our city and us as elected officials to do our constitutional duty and stand in support of the house of representatives effort to hold donald trump accountable. Supervisor mar thank you, chair fewer. Colleagues, i believe we are all aware of the drastic cuts at city college for the spring 2020 semester. For the past several weeks, weve all been deluged by extremely compelling and extremely heartbreaking stories about these cuts and the impact on their lives. I propose to reinstate the suspended spring 2020 classes that supervisor walton is introducing and speaking to today. I also believe we need a comprehensive and longterm solution to the budgetary problems facing city college due to State Government under funding of our Community Colleges in all Public Education going back to prop 13. But the funding challenges facing city college of San Francisco are also the result of a change in the state funding formula for Community Colleges that devalues Community Serving classes and prioritizes funding for classes that lead more directly to degrees and transfers to fouryear colleges. So today, i am announcing that i have directed the City Attorney to draft legislation to expand the citys public Enrichment Fund to provide ongoing funding for city college of San Francisco, to restore and expand critical Community Serving classes and student services. As a nation, we have decided that Public Education should be free and available to all students regardless of socioeconomic status. In 2004, San Francisco voters reafirmed that notion and approved proposition h, a gamechanging measure that established the Public Education Enrichment Fund during a period in which state and federal funding was decreasing for our schools. In 2014, the Public Education Enrichment Fund was renewed by voters for 25 more years. This year, the peef is providing 25 million for preschool funding and education in our city, including support for the San Francisco unified School District for programs not funded by the state. Given the ongoing budgetary challenges of city college of San Francisco due to lack of ongoing state funding, i believe its both timely and crucial that we provide funding to peef. In the midst of these drastic class cuts, ive actually launched an expansion of city College Classes in my district, the sunset, starting in january, with six new classes serving working adults, seniors, english learners, and high school students. These classes were developed through broad based community input, including convening a town hall meeting and collecting over 400 interest surveys. The City College Sunset initiative has received enthusiastic support from my conti constituents, and it shows how popular city College Classes are for the city. And more significantly, we are expanding city College Classes in the sunset through an add back modification. I want to make it clear that the proposal to expand peef, including will include new revenue sufficient to cover the new supplemental funding to city college with no reduction in funding to preschools to 12th grade education that peef currently supports. Id like to thank the many city leaders for working with me on this, including tom temprano, and many student groups. Today along with cosponsors supervisors walton and fewer, i am creating legislation to create additional districts in districts 9, 10, and 1 additional commercial districts in districts 9, 10, and 1. Speaking for my own district, without doubt, the Mission Bernal corridor and cortland and portola are facing huge obstacles and shouldering heavy burdens to keep their doors open. This legislation will create a framework for us to promote these as vibrant small businesses. If needed, we will work with merchants and local communities, consider neighborhoodspecific controls for these m. C. D. S through separate legislation in the future. Ive also been working on legislative changes that will make it easier for people to start businesses and keep them thriving, encouraging Property Owners to keep storefronts occupied is essential. In march, voters will be asked to vote on supervisor peskins storefront vacancy tax, which i was happy to sponsor. We are introducing these planning code amendments today to ensure that if voters pass the measure, the m. C. D. S will be in place at the time of the alex so that the tax strategy will be applicable to the m. C. D. S as they are to the 30 named commercial districts throughout the city.
