The project sponsor is an equity applicant by the city of cannabis. No other Cannabis Retailers within 600 feet. The project was originally scheduled for hearing on octobeo allow additional outreach and discussion to the neighbors. Since that hearing the applicant reported very constructive conversations with calle 24 to bring the proposed facility into compliance with the guidelines for the district. He has held multiple outreach events with neighbors. The department has received nine letters of opposition to the project and the petition submittal of 107 letters in opposition. Currently no letters of support have been received. The opposition to the project centers on the perception of the area as primarily residential, concern over increase in crime and the concern the establishment doesnt include parking as part of the proposal. The department initially had concern regarding the small size of the proposed establishment, however maintaining small and affordable spaces is a goal of the calle 24 plan and theres other dispensaries in the city approximately the same size. The project does not include any request for onsite consumption and the space is too small to be able to include onsite consumption in compliance with the health codes requirements. Weve been approved before the Cannabis Retail at 2934 chavez Equity Program. The building is owned by my family. Has been for over six years. Im a San Francisco native, born and raised in the bayview, spent a lot of time in the mission. Over the last few weeks ive hosted multiple neighborhood meetings and heard many neighborhood concerns. Im going to try to address some of the few concerns that theyve had. About three meetings ive met with calle 24. And weve addressed almost every single one of the meetings so far, every single one of the concerns. One of the main concerns everyone had was parking. In San Francisco we know how difficult it is as a resident, i know how difficult it is myself. We proposed to them that theres an existing out front that we would be trying to convert that into a green zone so we wont be taking additional parking away and have dedicated parking for our customers. Of course a Security Guard is required so that guard will double as a parking enforcer in a way. And then also while that wasnt enough for some of the neighbors, weve also proposed that our team members will double as watchmen during peak hours to patrol the neighborhood if anyone is double parking or blocking a neighbors driveway. Beyond the parking concern there was also a concern of the overall image and crime and whatnot. Working with the Community Members and calle 24, we have agreed to include murals and other things, murals and local artwork by local artists, including cultural aspects of the mission neighborhood. Other than that, no major exterior work is being performed. The way it is, its meant to be that way, and we are going to keep it that way. So you cant even tell really if theres anything there. And one of the other concerns was smell. And i think a lot of Community Members are not very well aware of the smoking aspect. Weve advised that they are not allowed to smoke inside or outside. And it was just lack of information that people dont have. Weve tried to advise and educate our neighbors as much as we can but we can only do so much. Other than that, weve tried to stay involved as much as we can, hosting multiple meetings. We havent had a super great turnout but for the ones that have turned out, theyve acted as community ambassadors. Theyve reached out to other Community Members and told them what the situation is. We continue to host more informative meetings, stay connected with the local neighborhood as much as we can as well as the local organizations. Ive tried to resolve all the Community Members concerns, all the neighborhood concerns, and i feel ive gone above and beyond trying to meet those needs to be a successful business. We need to keep our family together, our children without being exposed to that environment. We dont need people loitering outside this proposed cannabis store. It is illegal to consume a smaln Public Places but people still do, even driving. How are they going to enforce this when the customers decide to use the driveway . They say they will hire a Security Guard. The use of the Security Guard is to guard the location and check id. They are not going to be monitoring the block. Calling the police is out of the question because they wont show up right away. We need to be able to get in and out at any time from my garage without getting out of my car and trying to find whoever is blocking my driveway. As i recall, at one time the applicant himself blocked my driveway. Im wondering if he will use his own company to tow away his customers cars when they block our driveways. While they might be beyond your 600 feet, theres still a bunch of kids on this street, passing this Cannabis Club to get to their schools and come home. I see families all the time coming to and from across that street. These kids are going to be seeing this stuff. Explain to your kid what is going on there and why drugs are still bad, you just get to sell them now and explain to your child why it really is bad and no, these guys are exempt from that. I can tell you as a licensing requirement, ive been working with equity applicants and these two gentlemen have attended my fireside chats where theyve learned about running a cannabis business, ive seen nothing but compliance with them and wanting to learn how to operate a Cannabis Club. And theyve also held outreach, which ive attended, and ive seen they have been working with the public to try to comply with the concerns. They are definitely looking to operate as it should be. One of the things we should have learned from the recent vape crisis is legalization provides testing and quality products to the community and keeps those away from harmful products away from children and adults who would otherwise purchase them on the black market. The other item i wanted to mention is for seven years ive been the neighbor of a commercial building aft same family, and they are a strong member of the community and very family and helpful neighbors. We need to make sure we have party across all neighborhoods and the west side is doing their fair share because its not fair they are targeting our communities and making a profit off it, especially when folks have been marginalized historically for that. I can second the fact that these are local businesses that are looking to grow and implement the calle 24 which is not bringing something external into the community. I urge you to not be persuaded by calls of child access as someone under 21 cannot come into a december pry and a dispensary has to record 90 ds of footage. If you want to eliminate crime, we need to legalize more of these stores. The black market would be crushed. Previously before we have heard if dispensaries are approved that people will die and people will get killed because people smoke marijuana. So thats not happening. On the west side of San Francisco, the cannabis dispensary opened about a month ago. I looked at the neighborhood for months before the store opened and ive been checking it out ever since they opened. This is a completely thriving business. People walk into the store, they buy their product and they leave and they go home and smoke their weed or eat their weed. Its the least harmful business i can imagine. Theres a Security Guard on the sidewalk. Everyone feels safer. Theres no drama. Theres been not one incident. Theres more activity on this block than there ever has been. If you go from 19th and walk down irving, as the numbers get higher, theres less and less people on the streets except for this block on 22 and 23 and the Business Owners nearby are happy, because they are busier than ever. So i just want to tell you that this is a perfect case study that in sunset in a predominantly chinese residential neighborhood, this business is completely succeeding. Thank you. If you look back to 1922, it did create a black market and the black market is harmful. The legal market is where you want to be because you know what you are getting and its regulated and taxed. The section 303w findings, i guess you talk about them at the bottom of page 5 and the top of page 6, the way they read, its not really sounding like they sounds like an argument for not approving it. So im confused. The department does find the project is compliant with the finding and the general plan. It is true, though, the intent of the finding was to get to a point where we are having a better geographic spread of these uses throughout the city. The finding itself does cover a lot of topic areas. It kind of should be split into multiple findings. The truth is when we look geographically at the city, the eastern neighborhoods, particularly the mission are overconcentrated. So while we do find that theres particular location and where its locating is not exacerbating an overconcentration on a microlevel, we need to address in the finding that at a macrolevel the city does have a concentration in the eastern neighborhoods. So it is a bit of a finding. Is that overconcentration reason to turn it down . Or is that a statistic you would use for additional regulation Going Forward . Its a policy the city is tr. I believe the City Controllers Office is going to be releasing a report soon that will go a little bit deeper into this. The finding itself only says the planning which i guess commission should consider the geographic distribution of the uses in the city. Its not prescriptive on how you should respond to that. The business doing business as redemption. The project includes interior alterations to the ground floor and no work on the second floor which is occupied by a professional service use. The project site is located at the intersection of 19th street and is a twostory industrial building. A request for discretionary review was on july 25, 2019 by kevin of the cultural action network. That discretionary review application which includes his concerns and proposed alternative it is is attached in your staff report packet as well as a response from the discretionary review response from the project sponsor. To date the permit has received eight letters of support for the project as well as a letter of opposition to the project in support of the dr. The departments recommendation is for the approval of the project as the proposed arcade, general entertainment use and restaurant use are principally permitted within the umu Zoning District. Okay. Im a San Francisco native born and raised in the mission district. I filed a discretionary review for 3252 19th street for a multitude of reasons. The first reason is joey the cat has been illegally using the space for over five years. The timeline dates the amount of time that he has actually used his space unpermitted for private event tech parties even after notice of enforcement in 2018. So he was the timeline shows he had a meeting in 2014 to actually have a meeting to change the use and then he withdrew the meeting. After that point in time, he was given a notice of enforcement in 2018, july 26 from the Planning Department to knock it off, stop it, you are not allowed to host private event parties here. At which point in time hes had multiple events stating he is the host of private event parties including an alcohol permit he requested from abc to have a private event party. So that was in march 2019 of this year. So this is not im a small little business owner, he has been breaking code even after he was told no knock it off, multiple times for the last five years. That is not a goodfaith actor. If you look at where the review below, in the multiple, you see he requested one alcohol permit afterwards but the yelp reviews showcase he has been hosting private event parties further along down the way and including having a chance to throw a private event party with children involved. So you talk about this being a familyfriendly space but hes had alcohol around all of that and we dont know how many parties hes had. So i would ask the commission to ask joey how many onrecord, how many parties hes had with alcohol and after the notice of enforcement. That would be my first request. Second being i want to shift the narrative very quickly, no one is going i work with High School Use on a daytoday basis and i think having a Family Friendly arcade place is awesome. If you look at the pictures, that is not what the use is being used for. Its hosted for private event tech parties that are for uber, lyft, airbnb and the average rental is 25 00. If he is able to get approved with a license that would restrict the hours of operation where he would be able to have alcohol. Thats not a familyfriendly space. We dont need another mission bowl where monday through friday you are not allowed to have children in the space. And its great you brought like ive seen the pictures of nuns and having these folks come in and they are going to bring the kids. I want a Family Friendly space. I dont want another bar. We have 389 alcohol permits in the mission district. A special use district is being ignored and within the process of changing and fixing the loophole right now. So i would urge the condition to take that into consideration. And regardless if you approve this i would ask that you limit the hours of operation to make sure this is not a night life destination coming in because of the fact that this comes in i want to see hes turned time and time again that he has been asking for alcohol permits without it. I dont think hes responsible enough as an owner to have an alcohol permit if hes going to be hosting private event parties. What is the impact going to be when it cops to traffic . You need 24 7 access for pg e around those areas as well as the Fire Department across the street. So we dont know about the actual traffic impacts and i think a study should be put in place with that. So, yeah. Also urban mixed use and the current use is actually for production distribution. So hes asking for change in use to entertainment. But pdr is our most valuable space we are losing at a rapid rate and we need to preserve that. Not to mention he had illegal signage for joey the cat and the auto body shop was still on there. He removed the signage when the discretionary review was put in place. This is within 500 feet of an Elementary School and 600 feet within a high school for john on connell high school. We are talking about proximity to schools. We dont need our young people walking by that and seeing these negative images unless that space is going to be solely for a familyfriendly event. So no one is asking to shut down that place. I want to make that clear. But we dont want corporate event parties like the one he hosted in march illegally. And so not to mention i want to bring up the fact that ive heard this is going to clean up the sidewalk and this is going to make everything safer. Someone was shot on this block. Thats something we need to keep in mind. I dont think having an increased Police Presence come on 19th street is going to be good for black and brown communities, especially for the homeless folks that are there time and time again. So i think that shows theres a lot of lack of understanding of the Police Encounters with black and brown communities in this community as a whole. So im really worried about those because of the high increase of calls that are going to be coming in with that. So, yeah, i think that all of that are really strong reasons on why we need to come into play and uphold the dr review but the restaurant is being up held right now currently. We are the ownerrers of the adjacent building, located at 19th street. I would like to provide some information regarding the building in question, located at 3252 19th street. Mr. Joey did not displace blue collar or any workers when he and his family purchased their building. The previous Property Owner attempted to rent his property once he retired from the Automotive Repair industry. Unfortunately, it turned out badly as those renters were also growing cannabis illegally and the upstairs portion of the building caught on fire, threatening the janitorial building. After that, he decided to retire and completely retire completely and sold the vacant building to joey and family. Since then, he has run a business repairing and renting arcade machines and hosting the occasional special event. There have been four generations of native san franciscans which include my family and friends that have enjoyed these games during my childrens birthday parties at joey the cat.
