So miss mccambey has taken over and shes been there many, many years and mission is in great hand. The antiracist teaching work, the social justice work will continue, will only deepen and get stronger and i couldnt be prouder of that. I also just have to say personally, as a child, my grandmother went to girls high school, which is the First High School for young women in San Francisco. My father, he went to sherman and marina and lowell and he went to schools in the city, as well. I was born in the city and it has been such an honor for me to be there and to be ail to d ablo the antiracist work but i do it on a personal level. Speaking of my family, my daughter was a tiny baby when i moved to mission and she literally took her first steps there and graduated from mission. Shes now studies creative writing and literature and feminist studies and said she couldnt have done it she said, i couldnt have done it without a Mission High School education. So what else can i say . It was time to move on but i love it deeply and i am humbled and incredibly grateful for this honor today, thank you. applause . That brings us to our last commendation by supervisor hainey. Thank you supervisor stephanie for declaring november veterans month or veterans awareness month. Yesterday was a day we were recognising the service of so many people to our country and also looking critically at some of the ways in which our veterans are often failed when they return home. And recommitting to be able to honor them and support them and celebrate them appropriately. With that, i have the privilege today to honor del seymour, one of our cities and one of my districts most wellknown and accomplished Community Leaders and also a veteran. Mr. Seymour served in the United States army, 82n 82nd airborne from june of 1967 to may of 1969. He was ranked as a specialist, five at the time of discharge, having received several soldier of the months awards and served during the washington riots of 1968 and a dustmethod in the com bode ycambodia region. Hes run the gamut from living on the streets, workings a taxi driver and becoming the advocate and leader we know him as today. Over the last decade, he has worked closely with organizations like glide memorial church, st. Anthonys and using his Life Experience to help inform and guide the service providers, many whom service veterans. Dale has served as the cochair of the local homeless coordinating board and has an appointed position with the sanfrancisco tl hip board. Dels deep love for the tenderloin is evidence to all that know him or have heard him speak. I heard him give a sermon at glide. He educated people and to set the record straight on an often ignored part of our city. It highlights the tenderloins rich Cultural Heritage and supports longtime residents and relative newcomers. In 2015, del cofounded tenderloin to perform the outstanding quality he saw in his neighborhood. A startup workforce, trains exprepares and places Community Members into Community Jobs and at the midmarket Tech Companies and businesses. Given the tremendous amount of work that del has done for the tenderloin, its no wonder that many know him as the mayor of tenderloin and this tight has beetitle hasbeen well earned. Its a rare day i walk around the tenderloin and dont see you. Youre always there as someone who is bringing people together and acknowledging and respecting and valuing everyones experience in our community, whos trying to get people to see each other and connect with each other and understand each other better. And youve you, to me, represent the best of San Francisco is and the neighborhood i live and andi know its something from your own experience as a veteran and in service and taking that experience, the good and the bad, the hard parts, the trauma, the suffering and also the commitment that came with that and bringing it in the way that you have to our community. So im really excited and grateful to be able to honour you today and also the many other veterans in our community. Thank you. Thank you. Ive been all around the world, arrived in the tenderloin 35 years ago, got out of my car and i thought they were shooting a movie. Point by 8 00 that night, i was in that movie. I went on to star in that movie for 18 years, life in the tenderloin. As a medic, a combat medic, i wasnt required to fight, didnt fight, my fight started when i got to the tenderloin. 18 years, i fought my addiction, most of the time. I fought my dignity, lost most of the time. I fought for my selfeesteem and lost most of the time and went on and on and on and i was able to get my military development and put my life on the right track. When you talk about del seymour, thats just a force. Hes my crew and thats where del seymour is. Im just the leader, or one of the members of a force that we tried to do. Some of the supervisors have been here for awhile, like supervisor peskin, and youll remember me coming here yelling and screaming years ago about Workforce Development and it didnt work. And i decided to go to work on it, because my idea of the way to manage homelessness is a paycollectpaycheck, not a wellfk but a paycheck, thats quality we havent had in the tenderloin for a long time and i want to thank the board here for that support of a lot of the things that i do in the tenderloin, special thanks to supervisor hainey. Hes like a oneman show that does everything when he was running for supervisor he was a friend i mean, i knew him as a friend before he decided to run. When he decided to run, i was thinking, will this be another politician that will promise a thousand things to do nothing . He promised a thousand things and hes done 999. And so its a pleasure to work with someone like him. And i work with a lot of other members on this board and i will continue to work on this board and i want to say this is an honor. In the last three yearses, i received an accommodation at the state capitol, the u. S. Capitol and at the white house and this is important to me. I have a space on my wall because this is from my folks, my family and my city and they know all about everything. So thank you so much for this opportunity, sir. [cheers and applause] so thank you. Item 23 is the motion to affirm the departments certification of the feir, item 24 is the motion to conditionally reverse the departments certification and item 25 is the motion to direct preparation of the findings. Items 2629 is the hearing of persons interested in the certification of a conditional use authorization for the planned development for the proposed project at 3333 california street. And items 27 is the motion to approve the decision of the Planning Commission to approve the conditional use authorization and item 28, conditionally approves the apartment approval of that conditional use and item 29 is the motion to direct the preparation of findings. Items 3033 compromise the hearings of persons interested in public works approving a tentative map for a 15 lot vertical subdivision and six 75 residential and newused projects at 3333 california street and item 31 is the motion to approve the public works decision, approving the tentative map and and item 32 to conditionally disapprove public works decision and item 33 is the motion to direct the preparation of findings. After the hearing, the board will vote on the planning departments final Environmental Impact reports certification and it takes six votes to either affirm or reverse the Planning Commissions determination. If the environmental determination is rejected, the conditional use authorization becomes moot. No other approval actions can take place and we will table those items. If the environmental determination is upheld, we will then vote on the conditional use authorization and then the tentative map determination. It requires eight votes to overturn the planning departments conditional use authorization or impose additional conditions. For this combined hearing, we will be considering whether to approve the Planning Commissions certification of the final Environmental Impact report for 3333 california street. Then the Planning Commissions conditional use authorization and then lastly, the public works determination of the tentative map. So i want to let everybody know that because of the horrifically violent incident in chinatown, the mayor and i are doing a gathering in chinatown and so ive been and so i have to leave for that. I was completely prepared to come back, but ive been advised if i am not from the for a not a portion of the hearing, i should not be there for voting. So through the president to deputy city givener, in i can come back, but i wont be back for an hour. John giveneringner, if every supervisor who votes at the end of these hearings must be present for the full hearing or have watched the full hearing, that the board votes today and you miss a portion of the hearing, you cannot participate in the vote. If the board completes the hearing today and continues the items and votes next week and you watch the tape of the hearing over the course of the next week, then you could vote on the motions next week. Whatever the boards will is. Thank you. Why. There to site can be redeveloped with 744 Housing Units while preserving the significant features rather than destroying them. But the eir presented an inaccurate and inadequate analysis. Our association was the first to support the increase to 744 Housing Units, but it has opposed the new retail uses as unnecessary because the site is directly adjacent to laurel village. The firesmans front office is designed with a landscape that is integrated with building forums to create a seamless connection between indoor and outdoor spaces, a kind of green surround. Its listed on the california register of historical resources, which identifies the resources that deserve to be protected. And the landscaping was designed by the famous firm of williams with a terrace of the city, trees and beautiful shrubs and brick aligning with the window frames. We make the terrace Public Open Space that could be used for picnics and its the first thing the developer would tear down. And the site was designed with 110 varieties of trees, plants and ground cover to give it a parklike aspect and its believbeloved by the community. Theres 195 trees on site of 48 different species. The lawns and terrace banks along laurel are historically significant with views of the city and Golden Gate Bridge and have been used by the public for years. Although its prior owner had a 2011 survey, stating that it was eligible for listing as a historic resource, they concealed the historic significance from us until the eir scoping process began in september of 2017. By this time, the developer had designed the project without regard to the historic guidelines. When i last met with the developer, i said, you concealed this historic significance from us, but now weve got the site listed and the historic readaptation rules apply. They said forget the rules, do you like it. I said, yes, i thought that the seamless connection between the indoor spaces and landscaping was a brilliant idea. But they stated you wont resign this project. However, this process has run afoul of state sequa law but they admit the proposed project would cause a significant adverse change in the significance of the resource. Under sequa, use of the historic prescribed guidelines is the method of mitigating effects on a resource. Thats what theyre designed for but they were lawfully omitted from the mitigation section of the eri. Ir. These are called the secretary standards including specific guidelines that explain how adverse impacts on the resources can be mitigated. For example, a onestory addition on a multistory is acceptable. The eir is defective because it failed to describe mitigation measures that would reduce or avoid the proposed project exhibit impact on the resource through the use of these guidelines. Both mitigation measures and alternatives are required to be discussed in an eir and theyre both different things. And the eir only considered photographing and documenting the resource that would be destroyed, but this was insufficient to mitigate the effect. The emission of mitigation measures was prejudicial because it deprived the Decision Maker and the public of the full collection of Design Guidelines that could be used to mitigate the impacts by selecting some or all of the measures in the standards and guidelines to attaalter the design. This is evaluated as a fixed site plan and the alternative in the eir all have flaws and they do not present a full collection of the historic Design Guidelines. The city acknowledges that alternatives are more limited and refers to them as a package. Based on these omissions, the findings that were feasible, changes incorporated into the project to reduce significant effects and all significant effects have been substantially lessened are false and not supported by substantial evidence. The eir also inadequate analyzed alternatives to the project. After the Comment Period ended on the draft eir, the project dropped the fiveunit proposal and only included the 744 unit change to that being the project. However, the draft failed to analyze any alternative with approximately 744 units or anything close to that. The eir only presented alternatives witha 558, 629 and fewer residential units. The eir erroneously complained that two Community Alternatives, one of which is a 744unit, which im showing you here, were substantially similar to those discussed in the eir, but theyre not because there was nothing there 744 units, evaluatedded ievalevaluated in. About 5,000 square feet of office space in the Main Building and built New Buildings along california street including familysized fourstory flats. And it would involve less excavation of green space on laurel hill and be built in approximately four years rather than the 7 to 15 years that the developer would take. And giving the developer 15 years to build does not address the citys current housing crisis and will have no effect on reducing the price of housing if new housing is phased in over 15 years. The Community Alternative has much detail as the alternatives presented in the eir and sequa does not require an alternative to contain architectural drawings. They are assuming it would be larger than the Developers Unit sizes and have double corridors, excessive space and other things that they didnt have. So they would fit with two and threeusthreebedroom units andt use bigger units. Much adieu is made about the pathway the developer wants to cut through the middle of the Main Building, which is being used as an inadequate and ambiguous basis for rejecting alternatives. And city staff did not request that the developer cut a 40foot wide hole in the middle and requested a northsouth pathway or portal that could meander through the site and did not need to be a straight axial pathway. The eir doesnt disclose it. The eir doesnt disclose it. Add one level edition to the Main Building asper mighted by the historic Design Guidelines. The city, erroneous claims this would be similar to office alternative of d but d is office and ours is residential. So theyre not similar. And the e. I. R. Lacked a stable project description. The project shifted two months before the Planning Commission hearing to be 744 residential units. And, this changed the entire climate in which alternatives would have been evaluated if we had known this from the beginning. Also, the retail parking was dropped from 138 spaces to 74 and then when the special use district was released in july, 2019, it included flexible retail and social service for philanthropic facilities are not so, this was another new aspect. The e. I. R. Response to comments states the project will comply with the provision to the planning code as to Affordable Housing but thats inaccurate because the Development Agreement would wave those and have no moderate Income Housing and have its own plan. The e. I. R. Failed to analyze the projects potentially Significant Impact on shadows on publicly accessible open space. This is the Developers Site plan and shadows are shown in blue. This shows frequent shadows on the lower walnut walk and the square which the developer proposes to use as Community Benefits and open space. These proposed areas would be shaded mostly by the proposed buildings for much of the day or year. The city procedures provide that shadows must be studied if the use of open space could be adversely effected. And it doesnt matter whether the open use controls. The city failed to conduct a cityrun planning process. And the developer described his proposed project to the community once in a meeting in which members of the public were not allowed to speak. At the end of the powerpoint, he took three written questions and ended the meeting. There was no opportunity for public discussion of the potential zoning changes. The day before, in the office of supervisor ferell, the developer would not disclose the nature of the project and said this is not a negotiation. The developer conducted poster board sessions which exhibits were placed around the room but no opportunity was provided for an open discussion by members of the public and inaccurate zoning. There have not been 90 Public Meetings with the community. The developer may have had 90 private meetings with select people but not 90 Public Meetings. The e. I. R. Failed to analyze the projects inconsistency with provisions of the urban design element that protect major views in the city and maintain open spaces, especially those on hilltops and relate the bulk of buildings to the prevailing scale of development, et cetera. Let me just say here that im only highlighting some things and id like to incorporate all my prior comments because of the time i cant include them all. And do i have five minutes left . All right. So, the project would also have a significant effect on the loss of topsoil and was not considered. Wed like to prohibit deliveries to non residents such azzam a son walker and wed like to change ncs to nc1 and have a closing hour at 11 00 p. M. And eliminate flexible retail. Thank you, very much. Our population has increased and we have not increased our housing stock. As a result, a great many people in this town pay a hugely disproportionate amount of their disposable income in order to obtain shelter. In the case of people in the lower wage scales, it is tragic, it is criminal, what we have done. And the only way that were going to solve the problem is to create more supply. You have that opportunity today. The median surprise of an apartment in the United States of America Today is 965 a month. The median price of a three bedroom two bathhouse is 395,000. Our prices are between three and four times the median and the median means the middle. A lot of places are cheaper than that. We did this to ourselves and we did it to ourselves because see whaceqa isused. I urge you today to approval this project because its a good project and a good sponsor, thank you. The text is taking from the website. I added the highlights. This is not an Affordable Housing project. There is a great deal of flight modern income families from the housing but this is mostly posturing. Yes, affordable Senior Housing a wonderful component supported by all but it does nothing to address the fail your to provide any affordable moderate income Family Housing on this project. So we have 544 market rate units, zero affordable moderate family units. Except for seniors. This is a development geared specifically to the wealthy. Its what they build. 10 minimum should be set aside for affordable Family Housing. Why do i call 33333 an uber luxury development. The numbers speak for themselves. The rental rate or todays rates in the neighborhoods around 3333. Who do you see living at 3333 . Do you see any First Responders . Nurses, middle income wage easterners with families listed on the righthand side . Being able to afford these prices . No, the folks that afford 333 will be 200 of the a. M. I. 200 . Here are the facts. A third through the cycle 4 of the affordable moderate income goals have been met. Market rate, 18 times greater, note that San Francisco meets its 2,022 low income Affordable Housing in 2030 but doesnt meet its moderate family Income Housing at the 245. I support the Community Alternative and i definitely support the appeal. For various reasons. My concern is that we as a community are not looking at trends in San Francisco. I think things are changing. I can see it in my neighborhoods. We have at least seven or eight, what i call zombie businesses right now empty. Theyre not being rented. Theyre houses on my street that used to sell in two or three weeks and theyre sitting empty and theyre not being bought. Zombie businesses, zombie residentses. The tax issue is one. People cant deduct much of their property tax and whatever other taxes they have associated with owning property. The other issue is the broad economy. I have several children but two who live in San Francisco. Both are considering leaving. One is in tech. He has had it. He is doing quite well but he said i cant live here anymore. Its housing of course and also quality of life. We have very dirty streets, drug use, open drug use, all kinds of problems that are not being solved by the city. And thats a trend that is happening not only with that age group but even with my age group. I talked to friends, im in my 60s, ill admit and theyre thinking of leaving. Whats going to happen in 15 years when theres not a population to buy this property or to live in this property . I think the board of supervisors needs to pay close attention to the broad economic and historical issues. I also think they should really look at the historical designation of this property and the lovely green space it provides our citizens. I had the honor of attending the tunnel tops designation last week. And i said, this is the fabulous gift. Were giving our citizens. Supervisor yee thank you. Next speaker, please. What is less clear is whether we have a future if we allow business as usual to determine the quality of our lives but whether we shall survive as a species. They communicate by smell and also by their root structures which are Like Networks and they communicate sharing food and oxygen and carbon dioxide. When we walk by are we a predator. How do they observe us . Americans have yet to fathom how, not only their actions but the thoughts and emotions with the environment. Touch be everyone and every aspect of what is known and not known. In the face of continuous warmth and increasing environmental disasters, humans are being invited to chose a guest and take increased responsibility and to reconsider their actions. In fact, climate disruption is teaching humanity the laws of nature are more powerful than corporations and even nations. Meanwhile, the type, frequency and intensity of largely man made climactic events revealed the fragile tee and interconnectedness of all life. I beg of you to think of our lives. Hell had he, my name is susan and im a 20year resident of San Francisco noticing that development is happening in this city in a way thats making it increasingly unlivable for those of us who have been here for a decade and some generations. I wanted to speak specifically to the issue of trees, which the person before we raised already. On the promotional video for 3333 california on the internet, it makes it look like theyre retaining trees but my understanding is they will remove 200 out of 210. I dont think that theres anything in their e. I. R. That discusses the discussed this this loss for the city. San francisco declared a Climate Emergency and we are falling fag behind in our goal for planting new trees in San Francisco and were way behind in our goals for building Affordable Housing and way a heads of our goals for building market rate housing. So, i strongly urge you to support this appeal and work with the community and their alternatives which will preserve the greenery that we so desperately need in our city. Thank you. Next speaker. That being said, i was walking down the streets and the words of a Supreme Court justice came to mind, the question, do trees have standing . So i did a Little Research and i got the words of the case by Supreme CourtJustice William douglas and the see era club versus morton where he talks about Environmental Issues and pushed fourth that question do trees have rights . Standings like its part of the administrative procedure act. Thats not an issue here but if you havent read the pin its a part of my submission that i put forward for this hearing. Its an environmental issue and i think the reason it came to mind was there were signs on the trees about each tree and theres also sometimes a developer actually post trees telling us what will happen. A notice of a hearing where i can walk around and find it on a tree. Ive seen complaints filed on buildings. Its bizarre. Thats the way we notify people stuff. Go out and look for it and its posted. I would like to draws your attention to the open space at laurel and euclid. This is the highest points on the property. You might ask, well, who cares if you notice in the background there, there is a few of the golden gate. This is a closer shot of it. This is a publicly accessible open space enjoyed by all. We recently had fleet week and had tons of families come and enjoy the space. I know people who, as theyre driving westbound up euclid, they dont expect to see the golden gate and there it is. Ace understand it, and as it shows on the Developers Planning submissions, we are replacing the open space with four luxury townhomes. This could happen in your districts. Is this what were allowing to happen in the city . You know, we have plans 675 units if we made it 671 im sure all of our friends here plus our friends and the carpenters in action could all enjoy this open space together. We want to save our old growth forest, the trees and wildlife at laurel hill for future generations to create real Affordable Housing for families and seniors instead of an expensive mega project at 3333 california that the Developers Plan for flex retail latenight destinations, strip malls and luxury sky townhomes and towers. For wealthy, for the wealthy. They also have an option to have the city buy back the Affordable Housing that theyre not going to probably make. Laurel hill is listed in historic registry and was the inspiration for Golden Gate Park. I dont know if you know that our park, the cemetery most of the cemetery in San Francisco became our park. Laurel hill was an inspiration for Golden Gate Park and were going to destroy that. It took that long to enjoy. Its unbelievable. Keep our trees on both sides. Keep laurel hill. No commercial retail. No towers except neighborhood height limits. Building period for four years no flex retail it will harm our businesses that are struggling. Thank you. Next speaker. Hi, i agree with everything that my previous speaker just said. I just wanted to add a little bit about the government leaders and pioneers and i do think that that would be almost like desecrating their graves to move the trees as well as having their burial sites. I also understand that the building itself is in the california historic at register and is eligibility for National Register and it would be because the current owners of the property opposed it because they wanted to do this development and its not going to get in there. This is a sad thing and historians should really look at this before they tear it down. It just needs a little bit more review and i hope the board of supervisors will credit it an important piece of property in the city. Supervisor yee thank you. Next speaker. Good afternoon, my name is josh clip. A resident cog to the developers Environmental Impact report of the 210 trees on this property this project proposed to take out 200 of them or 96 of all the trees including 19 healthy trees look the public rightofway. According to the developers it will be complete in 10 to 15 years and theyll plan roughly 270 baby trees most of which are species that are completely inappropriate for that microclimate which means they will likely die. Our Department Says we have 10 years before its i am reversible our so world will have reached the point of no return on climate. Our city has declared itself to be in a Climate Emergency and our department of environment has specifically recognized that if we are going to meet our climate goals, we must sequester more carbon and the most effective tool for that are big, mature trees. We have 10 years and in the year 2029, when we look back and say we did all we could to prevent where we were now from happening and the answer right now is no. Because we have not asked these experienced developers why they need to chop down 10 acres worth of big, healthy trees. We havent asked their architects whether the plants coffin corporated rather than kill these trees and until we ask these questions and take bold action to preserve the Natural Resources we are failing to do everything for our city and our future. We dont think we have to make a choice between housing and open space in the trees. We feel very strongly will maintaining this size of the existing green space and the trees, with the population of San Francisco and there are a lot of studies and it shown that green space does actually effect the health and wellbeing of the population to improved air quality and enhanced physical activity and helping people manage stress just getting out and walking in nature and improved social cohesion and equitable to grown space. My trip from Laurel Heights ironically or not, the only green space i saw was laurel hill. And i think it would reel be a shame and more than that harmful to lose that open space. I am here as a neighbor of the 3333 california project. Im in favor of over turning the Planning Commissions approval of the Developers Plan as currently submitted. I speak in support of building 700 plus units on the site but with the strategy that is less didisruptive. Theres been a pattern of impropriety with the proposal before you. The site would have caused modifications in the design. In addition, flexible retail was never discussed nor was it mentioned in the Environmental Impact report so neighbors had no ability to consider it and respond. The e. I. R. , which was filed, did not analyze alternatives to the proposed project. Several issues exist beyond by allowed time limit but id like to address just one. Trees. Mature, historical trees and green space simply cannot be replaced with new plantings and cement landscaping. Eye recognize that the deliberations on this project have gone on for a long time.
