It is a category d building for our preservation standards. Included in the report is a ceqa exemption which is signed by our Historic Preservation staff. This went through a number of iterations. There is no vistas . Saying that it is not blocking significant views from any public vistas that we see. I would be happy to show you the different iterations we have gone through to get to this design. Thats okay. What about the letter of approval . It is included in the staff report. I didnt see that. It is after you get through the plans, the photo simulations and the categorical exemption. After you get through those graphics you will see the statement from the engineering firm. After you get through their statement toward the end of the staff report is the letter of approval signed by arthur duke. Ashley. Thank you. What about my last comment in terms of good faith efforts . The project sponsor can speak more to this. They did submit an updated letter that we requested. The original letter only said no lease interest. We asked for a little bit more detail on that. Which they provided to me. The mobility site analysis is here the updated one. Which they have detailed the days, the ways in which they actually contact. Sfgovtv. The project sponsor can go into more detail about this. When we saw that report we did ask for additional information. This was provided to us in which at t listed the ways that they contacted, why they contacted and the about why the Property Owners of those other sites were not interested or were unable to accommodate. With staff have thought that the parking garage might have been a better location. We receive the sites that we got. These were also submitted to the department of Public Health for my understanding. While we can bond with the project sponsor, we simply saw the application that was in front of us at the time. I would raise the same question to the project sponsor. You have copies of that providing greater details on the good faith efforts . We sent letters of interest via fedex to all of the Property Owners or emailed them. The parking structure is owned by Sutter Health. We talk to them directly and they are not interested in cell sites. The Center Health is right across the parcels across the street i think theres one whole block, but the parking structures owned by them. The hospital was a preferred location, but they said no. We searched for properties nearby and the current project is across the street from the hospital and has shown the least interest and meets all of our cell site design requirements. Thank you. The one thing that has struck me, you know, there is all of these numbers im not an electrical engineer physicist, but what resonated with me is this 51 feet, great bodily danger. Somebody said that if your hundred feet away there is no danger. For every foot you go away, for every foot you go away from 51 feet, how much does the risk go down from no bodily danger, or less bodily danger . In terms of radiofrequency emissions on things like that. The conditions of approval also state that all radiofrequency emissions must comply with fcc regulations. Looking through dph approval as well as the other documents that were provided to us i did not see the phrase great bodily danger. Workers should not be, i think within 51 feet in front of the site while it is operating. That was in the application submitted to the department of Public Health which is the agency designed to review such matters. I forgot to let you know how a representative who can address those questions. Good evening, commissioners. We are an independent Consulting Firm that prepares the rf exposure for the site. Our report does specify that 51 feet is the calculated distance for occupational workers directly in front of the antenna. The report does not say great bodily danger. The with the occupational limits that is not the threshold of great bodily danger. I dont think the guidelines ever used of the terms a great im not sure where that came from. It is not in our report are based on any independent or engineering organization. If you are standing near 51 feet, what happens . What happens nothing happens. 40 feet what happens . Likely, nothing will happen. Hold on. Sir, you are out of order. Im trying to understand for how long before something happens. The fcc limits are not the threshold of harm. If you exceed the limits nothing happens to your body. Science tells us that anything starts to happen with the human body. Its not even harm. Its just any noticeable effect. These limits are set 50 times lower. Even if you start to peek over these limits when you ask what happens if i stand in front of the antenna, nothing happens. Even if im exceeding the limits on 50 tons below the level where anything that happens on the human body. Not capable of emitting enough powder power. Why would we have an osha requirement . Because there is a notification requirement even if there is not an imminent danger. The workers need to be notified. These are areas that are calculated to exceed the fccs limits. When you hear about europeans they are debating on not allowing it. Im not sure as to whether or not its equipment or health related. The only thing i know is even if you are quoting differences of these criteria as human beings we are all quite different. What affects you might completely affect me in a different way a son age size, et cetera, et cetera. The generalization on health data i think is a concern that still i think resonates with me when i hear people expressing concerns. We have not talked much about 5g. We have not talked much about new technology and how it is different or more harmful than what we have all been doing, including using these things all the time. The thing that resonates with me is a concern about the visual impact of this equipment on more and more of our roof scapes. I have talked about that in other circumstances. We have a Historic Building at the corner of goss and franklin where we ultimately come as a commission, decided that the visual impact was undesirable and we made at t in our particular case, find from a general landuse perspective, i assume all commissioners will lead without the outcome of the garage would be a better place to have visually less impacting for reasons of building the size of the building something which one could hold away from residential and impact to quite another distance. My question to you is, to at t, why isnt there another attempt being made of finding a better location particularly because i, myself, when i look at the visual stimulations of this rather enormous facility i am quite uncomfortable of what it does collectively to our roof scapes and throughout the city. If you look at it each time, an individual the same way you dont see it when you walk around though, all of these roofs are bulging out which doesnt have to do with the real residential building on roofs. Im saying i want to put a stop to this. I want to basically not be impacted by these strange intrusions any longer. I want to complete keep a clean, orderly roof scapes particularly when it comes to residential roof scapes on buildings where the distinctness of buildings is definitely affected by the way we are altering the visual appearance. Those will be my comments. I am kind of wondering to whether or not we instruct at t to resume another conversation with the garage and see whether or not that would be a better option. Really cant speak to finding new locations. I can address the concerns about 5g that you had. I know some of the protesters brought up 5g, especially michael chang, 300 gigahertz service. This station doesnt operate at frequencies the new frequencies that some 5g service proposed operate at. All of the frequencies proposed that the site supports the same frequencies that has been used for decades between 700 and 2300 megahertz. It is really well established that have been used for telecommunications for decades and decades going back to radio broadcast television. As technology that is regulated by the fcc. While 5g sounds scary sometimes because people dont quite understand what it is. It is a scheme to put data onto radio waves. The radio waves are a fundamental part of physics. Vibrating electromagnetic waves. The frequency of what is important in terms of health and safety. The frequency and power at the site is on par with any other station in San Francisco. The same frequencies and power that have been used at other sites for other 4g sites in the past. Anything else . That is good. Thank you. Commissioner moore . I would like to ask the commission to consider encouraging at t to investigate alternative sites and have us revisit the discussion once to that effort has been made. I am uncomfortable, for a number of reasons to support the application the way it stands. Can i have a question for the project sponsor . Im going to go ahead and an extensive alternative site analysis is done as required by the Planning Department. For every application that we do. I personally have worked on the site to work with Sutter Health for over ten years to try to get a site on their building. We have that, we also had st. Lukes which they would not allow us on st. Lukes either. If the commission has any i guess, specific addresses that they would like us to look at. We think we did a pretty good campus for the area. An ordinance to amend the planning code to extend the date by which a must have received a permit to operate from the department of Public Health to be deemed contemporary cannabis sale used from december 31 to december 31, 2020. Amend the planning code to extend the duration of the temporary Cannabis Retail sales up to three years to expire on january 1, 2021. Good evening, commissioners. As aaron mentioned the ordinance before you will amend the planning code to extend the date by which grandfathered medical cannabis dispensary must receive a permit to operate from the department of Public Health from december 31, 2019 to december 31, 2020. It will also extend the duration of a temporary Cannabis Retail sales use from a 13 years. This will give grandfathered medical cannabis dispensaries until december 31, 2022 obtain the permits to operate and it will allow temporary cannabis resale uses to be permitted to operate for three years. If additional time will allow existing medical cannabis businesses to continue to sell adult use cannabis while the office of cannabis processes the permanent licenses. Additionally, the soreness will allow cannabis because when the citys program to continue to access waivers through 2020. We appreciate planning staff and are happy to accept staff recommendations. The temporary adult use cannabis permits it be extended up to four years instead of three. I want to thank aaron starr for his work on this report. This is the first time that the temporary sales provision has been extended. The extension for both is due to the amount of time that the office of cannabis is doing the review. The departments recommendation is for approval the department supposes supports the proposed ordinance. Providing Economic Opportunities for those previously impacted for the war on drugs. The initial ordinance creating section 190 and 191 was intended to allow existing and cds to sell adult use cannabis until the city can process the equity applicants. They have not been able to apply for their permitted licenses in the planning apparent has not been able to process the conversion permits. The department is concerned that the proposed three year extension will not be enough. We are recommending an additional year extension for a total of four. That concludes my report. Thank you. It is timeconsuming and has basically gotten quite a few wellknown operations behind the eight balls. Since i have spent many years to help them get established knowing what scrutiny they have gone through with this, i think it is a necessary step that requires our support for them. I also appreciate mr. Starrs extension of modification to move the timeframe up to four years given the reality of how many of these things are. [please stand by] [please stand by] im going to provide a background of the project, its master approvals. Ill bring you up to date as to whats happening with Candlestick Point. Well talk about the proposal. And well talk a little bit about the design for Development Document their refinements, and thats the actual action before you. Also just to let you know, david tom who is the master urban design for candlestick will provide you a presentation, well dig deeper into how the documents meet those and talk about the actual proposal before us. As a quick reminder this is a project Candlestick Point was approved in 2010 along with the shipyard. As an active redevelopment project area, our sister agency, oc ii the Successor Agency to the Redevelopment Agency is the lead, however in the master approvals we have documents where we have elements that are within Planning Department and Planning Commission jurisdiction. In those master approvals we created a subarea plan, part of the general plan for this area, we created a special use district which refers to the d for d and we approved amendments to the Bayview Hunters Point Development Plan for which candlestick is a part. And part of our jurisdiction is to look at actual amendments when they are proposed for the design for Development Document. Orchestrates c oc ii seconddegree lead on that the master document talks about how this gets built over time is the disposition and development agreement. And within that, there are subplans that address things like Affordable Housing, Community Developments and then a document called the deardap the procedural document that describes how actual construction, when its ready to go, both horizontal and vertical gets approved in subsequent approvals. And in fact the master developer has been working with oc ii over the last years to get this stuff ready for construction. The candlestick is divided into three major phases. The first major phase is consists of what we refer to as candlestick center. That is the location of the previous stadium. And its considered sort of the the hub of the project. Major phase one also includes clocks across the street from the proposed streets and also includes about twothirds of a hope sf project. And under that major phase, they have gotten their first subphase approved and completed at Alice Griffith and three other of the five subphases have also been approved including initial approval for Candlestick Point excuse me candlestick center. Invariably because this is such a large and complex project, the master developer has come to us with some modifications to those master approvals. In 2016, you may remember we were here with an initial set of d for d amendments. They were i think fairly minor in character. That was a time when they were looking for a development for candlestick center. Last year we also saw some amendments for the shipyard portion of that project. That also had some ramifications for candlestick. That was one of the neighborhoods we took out and put under our jurisdiction jamestown, and there was transfer of land use that was enabled transferring some units back to candlestick from the shipyard and allowing some Square Footage of Office Development to float to candlestick. So now five point is looking to reimagine candlestick center as again as you may recall this had been a regional mall given the changing nature of retail, they are now looking to develop it rather as a mixed office and Residential Development, still retaining some of the office, i mean some of the retail and entertainment aspects to that plan. Most note pliably you will see that most notably youll see a significant Office Development, they are looking to develop 750,000 square foot as part of this proposal. Very important to note, prop o from a couple years ago exempted development at candlestick and the shipyard from prop m. That means this Office Development can move forward without having to compete with our Office Allocation and affecting other Office Projects we are looking at. This project enables the earlier delivery of about 400 units, the number of units across the two area plans would remain the same, however this means those that Residential Development could happen sooner. And then again some other components are being tweaked slightly. Theres still an entertainment component with the Film Art Center and a hotel as well. So that brings us to the development that is before you. This is a site plan of on the left is what the previous proposal was. And on the right, 2019, is the current proposal. Im going to let david dig into the details of the proposal physically a little bit. But i just wanted to just from some highlevel observations previously it had been a single floor mall, single use on the western side of candlestick center is now mixed use, i think a much more potentially dynamic urban forum. So the substance of the changes in the design for development are focused on section 5. 3 section 5 talks to the neighborhoods individually so section 5. 3 has been completely rewritten. We still have emphasis on the public realm. It talks about the streets running through candlestick. Theyll be privately owned and publicly accessible. And it enables flexibility in its ultimate configuration. We require an additional clause now of roughly onehalf acre. Because of the Office Development this Office Development is going to be a fairly largescale at 120 feet so we address some additional design requirements, modulation and the like. And then of course like the public realm, it really pays attention to how the buildings interact with the public realm in terms of setback lines relative to the different types of streets requiring activation. I might note that before, again, as a regional Retail Center, we had a requirements for retail throughout where we really kind of want to focus the requirement on a more centered portion so its on the two blocks closest to the shared intersection. The d for d now has more parking design requirements. The new proposal does anticipate some abovegrade Parking Facilities attached to buildings. So we look to address active uses at the base of the buildings and then also wrapping and then streaming as well. And there are some other things we are interested in the terminations into the site. And we do allow a sky bridge on one of the sites. We have design controls for them as well. Perhaps most significantly as the design for development now does permit some additional height, we are looking to bump up the heights along harney. More significantly the Office Development going up to 120 feet. We worked with ocis staff and with five point to make sure there are design controls within the d for d that make sure the development in its entirety is well broken down, that it relates well to the street. We believe we have come to a design for development that does meet the original vision for the project that is consistent with the general plan, specifically with the Candlestick Point subarea plan, with the planning code, and we are recommending approval. I am happy to answer any questions, oc ii staff and five point staff is also here to answer any questions and with that, ill turn it over to david tom. Thank you. Good evening commissioners. Im david tom the urban designer for the candlestick project. Going to have to help me with the technology here. Ill cover three topics. Introduction, which is why are we here, which math has covered quite adequately. Well talk about the Guiding Principles that have been in place since the initial d4d was conceived and then an illustration of what could be done with the changes that are being proposed. Excuse me, david, sf gov tv, can we have the compute computer please. Matt said the 2008 approvals made provision for transfer of office, and thats now happening in this new design. The main thing is the Market Conditions have changed in retail, and this gives five point the agility to respond to markets and move from predominantly retail into a mixed use more vibrant community and also enables housing to be developed sooner because there is housing that is coming into this section of the site. Ill talk about a few of the Guiding Principles and go through these quickly but a lot of it was driven initially by the use of significant vistas to Hunters Point and down to the end of Candlestick Park and that gave rise to a new form of urban park now referred to as the wedge parks sort of an addition to the history of San Francisco which has this extraordinarily beautiful urban spaces, and this is a new one which is a wedge shape in addition to that type of urbanity which characterizes San Francisco. Theres a series of sort of important landmarks. Theres a hierarchy of them significant gateways through to natural points that are landmarks new landmarks signature tower, like a tower in italian hilltown and then a series of focal points which are sort of heat maps of urban intensity and urban activity. One of the most extraordinary parts of this site that makes it really unique is the state park. A lot of San Franciscos Community Interface with the bay but this has its own special characteristic having the foreground of the state park and the relationship between the state park, back into the community is an important underlying design element of this project since its inception. Theres a basic block pattern of the San Francisco block pattern but as weve done with the parks introducing a new typology with the wedge shape, we are introducing a pedestrian break and that serves to break down the scale of larger urban development that and avoids really meg Block Development and continues to give it a very walkable scale. Theres an overlay of transit which provides a good walking coverage the brt that goes through the site and provides five minutes walking accessibility from any point in sight. I talked about the hierarchy of streets, midblock connections. And theres streets that are more intense urban active high streets down to more quiet pedestrian streets. This is a slide that matt adequately covered, which is the 2016 plan which i wont go into. This shows the summarizes some of the changes the change on the 85 from 80 to 85 feet contrasting with the 80 feet across the street. Thats merely a reflection of the change in the California Building code that happened in 2016 that allowed that typology of buildings to add the extra five feet to it. Signature building remains the same and the Office Buildings at 120 feet, which you can see are backed up against bayview hill. This is the colored pieces are everything that is either approved in the case of Alice Griffith built that are approved or under consideration but it gives the context for the site we are looking at today. The main changes as matt pointed out is the change from a Retail Center to a more urban and more granular mixeduse development. And much more sort of i guess connected to the pieces of the site which are now neighbors which ultimately will be its neighbors across the street. These are plans that are in either approved or in the process of being approved. So they are effectively the neighbors. So as the design is developed for the site we are looking at today, this is really the context. And theres a context to relate to and neighbors to take into consideration. And now the plan we have today, its a framework. It allows for a different type of vision for this site and there are a few slides that speak to that in a moment. Basically it creates a new heart and center to candlestick. One of the interesting things about this site is the conversion of two urban grids and for an urban designer, that was really exciting because theres kind of a collision of two different types of urban form and that collision creates a lot of sort of creative opportunity to respond to the change in the urban plan. And these are places in cities that because of that, those types of intersections become the most memorable places you see in many cities around the world. I wont go into this in detail but theres a lot of analysis on shade, so the buildings are responding to that. And of course wind is a very important consideration, so extensive analysis was done on that as well. There was a brt the previous plan took into consideration how parking could be accessed to the site without conflicting with that brt and that same principle is maintained in this plan, approach to parking going from one big structure to a series of three parking structures is the change but the principle of not hindering it in any way cons continues to apply. So what do we end up with the new heart to candlestick is intended to be eclectic off beat, idiosyncratic has to do with its very different uses as well as the physical form the geometry, the intersection of those streets as they come together and converge in candlestick center. And its where the Community Comes together. The plan that you have on the screen ill show a few pieces of it. Your time is up. I will just show you a few images. And this really kind of cool public space that has this great elevation great places for ampitheaters, very active, a view from harney looking back. And thats the plan. Candlestick point was central. Everything that you will have in terms of open space parks housing, we are building more housing in San Francisco. Community benefit. In fact, ours is a model for all of you to take. If you can hold every development in San Francisco up to this standard, that we have put together for five points, you will not be going through your previous meetings, believe me. And the Planning Commission, we are really urging you now to help us to uphold that plan because it was put in place by you your staff and former commissioners. So we are so excited to be out here. We know weve got the votes. But you all are going to have your legacy to help us out. So thank you all for your patience for working with us. And again many are called, few are chosen. The Development Finally got this project approval and he and his team, i was in mayor newsoms office, at that time, he was the mayor when all these documents was signed. And to see where we are now and hopefully we will leave here today knowing that this commission, you always do good things and i see one gentleman there dr. Coalmans building that we got landmarked that came and spoke. And i would like to leave with the same type of excitement from you gentlemen go ahead and complete the approval. I served with Bayview Hunters Shipyard and currently now as a commissioner. And i stand here on a bittersweet day. Bitter for the loss of our u. S. House representative Elijah Cummings, who stood and fought for justice with rolling oceans as well as fairness a river of fairness. He stood for equality for all so i stand here today as he stood in a spirit of unity with purpose. The purpose is for our children and the generations that are to come the purpose is to see equality in a much needed Community District 10, that was considered blighted and underserved and now is moving up the ladder and moving up levels of being a served community. But we are looking for the fullness of that. And it is my appeal to you to ask that you would approve of the amendment its my appeal that you would agree to pass this on as Elijah Cummings said our children, the generations to come are the messages of the future. And we look for the hope for hopelessness, help for helplessness and a voice for the voiceless so that our children can stand, revering a muchserved community and being a part of the workforce and Affordable Homes as well as recreation and all the other amenities. Im standing in for randy who is the executive director of urban ed academy a Community Based organization in bayview Hunters Point and this is what he wanted to share with you. Since 2010 weve served our neighborhoods Elementary Students of color with a focus on young boys of color with stembased saturday School Programming and inschool support. We stand in support of the approval of the days proposal for this project. Over the past 18 months our organization has been building an initiative titled man the bay an intersectional effort to address Education Support Workforce Development and teacher housing issues in the bayview. Weve had the honor of being a Community Partner with five point in our quest to recruit develop and house 100 africanamerican male teacher candidates over the next few years. With the support weve received as a Community Benefit partner weve been able to secure three teacher housing in the city and will be welcoming our third cohort of young men from historically black colleges and universities in summer 2020. While we hope our work will create the level of impact this neighborhood deserves, we know that the approval of this project will help sustain more efforts like ours in the bayview and beyond. I would like to thank you for being here today and thank you for our new center on fairfax. As a Service Provided to this community, we have provided childcare to families in and around Alice Griffith since 2000. We look for every opportunity to meet the needs of our families. In doing so we have worked with ucsf Practical Nursing Program and dr. Barnes breast mobile addressing the needs of breath mobile, addressing the needs of children with asthma. We see and hear the playground that is located in Alice Griffith. We are asking that Childcare Services provided near this site. My question to you is how we can ensure it has the space needed to be a 21st century childcare center. We work hard to have safe space for children to learn and families to get help to have a partner to be a partner as they raise their children in the midst of poverty. What do we need to ensure the same sustainability . Im excited about the development thats happening at Candlestick Point and im in support of the development. But with the new families about to come and the growing need for childcare is extremely important that we keep on the minds of everybody families and children and childcare. Thank you very much. How are you the rest of the wonderful commissioners. Im speaking on behalf of the cac. This is a new vision for this land. When i was out there doing the trn spot, it was nothing but dirt, imagine what that could look like. Just have that vision in your mind. Its a beautiful and exciting vision. It includes residents from the area and welcomes new residents. The members have approved this new vision and design. People who had issues with the program are now on board because they realize what is at stake and what is going to be developed. We know your concern with urban design and street grid and connectivity issues and all the wonderful stuff you do but i wanted you to get a feel for this what means for the community, what it means for folks in the community. This project has Affordable Housing over 7,000 homes 35 percent affordability. These houses are for the homeless. For seniors for working class families. At 60 percent ami and lower. This housing gives families and working class people opportunities that doesnt exist elsewhere. This project gives Small Business people an edge by providing places built out to warm shell status which is helpful to Small Business people who usually get cold shell arrangements. It provides job training Opportunities Office space african marketplace film and art center, Community Use facility hotel park, open space and childcare. You and you alone determine what happens to this project. Im a student of history. Today is the day that an africanamerican man lies in state in the capitol a good man a man of conviction and passion, son of sharecroppers, graduated cappa from his college. He left a legacy. It is your turn now to leave a legacy for this city, not only for the folks in bayview but for the folks in San Francisco. Thank you for allowing me to speak. Youre welcome. Thank you. Next speaker. And i talked to you at that time about is it possible flexibility that may change, because the handwriting for the demise of retail of that kind was already on the wall. And you said kind of, im glad the pencil was still in your hand, because i think your transformational effort is amazing and i think the use you are suggesting here of promising a much much larger level of success and growing of community than the previous retail component.
