Hearing to consider the premise to premise transfer of her tight 48 on sale general Public Liquor license doing businesses a night market to serve the public convenience and necessitate the city and county of San Francisco. They have applied for a type 40 a license and this would allow them to sell on sale beer, wine, and spirits. They are considered a high crime area. It is also a high saturation area. Central station and the Police Department has no up has no operation. And we approve with the following recommended conditions the sale and service of alcohol and beverages should be permitted only between 3 00 p. M. And 2 00 a. M. Each day of the week. The sale of alcoholic beverages for consumption off the premises is prohibited. No noise should be audible at any nearby residents and petitioners should monitor the area under their patrol and in an effort to prevent loitering of persons own any property adjacent as depicted on the abc 253 and it should be noted that the conditions were agreed to and signed by the applicant on september 17th. Anthony bourdain once said, anyone who doesnt have a great time in San Francisco is pretty much dead to me. It is a two fisted drinking town it is dirty and nasty and wonderful. I think mr. Bourdain articulated what we all know. San francisco is an incredible city. Is full of contradictions. Its beauty is undeniable and so is his legacy as a great all timebarred town. Several iconic cocktails were created or achieved fame here including the martini, the punch , hows cappuccino, the list goes on and on. Today, San Francisco is as quirky as ever, but our industry , the hospitality industry, and that is so much of the citys identity that is shaped by is undoubtedly in trouble. I have attended a number of the meetings, the supervisory supervisor here and you had a few weeks ago and i think a lot of these issues came up and we feel them acutely. Just in the recent weeks, over by the bulk hard ballpark, a few blocks over, we decided they decided to close their doors. They are under threat of closure , as well. We are under seizures for a lot of different issues that the city of the city feels acutely. Housing shortage, homelessness, Public Safety, and his you all know, the city bureaucracy and different agencies that you have to consult with to get a business open. Despite all of this bad news, we love the city. We want to be part of the solution, and as members of the community, we think we still have something left to give to maintain and increase our reputation as the best city for eating, drinking, and hospitality in the world. What is our goal . Our goal is to create a place for our team to thrive and for customers to have a great time. For residents and visitors alike to say, hey, this is quintessentially San Francisco and couldnt exist anywhere else our team is really incredibly topnotch. Kevin d. These are awards that dont come without a tremendous amount of hard work, respect for his peers and respect for customers. It is fantastic it he has been recognized in fantastic our other locations have been recognized as one of the best drinking locations in the world. We dont do it for the awards. I got into this business because we enjoy making people happy. When you come to one of our establishments, the reason why we do what we do is because we understand that each and every individual customer that comes in its is spending their hardearned dollars and this might be the happiest time of the entire day. For us to provide that experience, that connection, the fellowship is the reason why we do what we do and the reason why we do what we love. This is a Public Safety and Neighborhood Commission meeting and we wanted to address why we think we would be a great neighborhood. We have been in the neighborhood for over 11 years. The press club started on the lane when that wasnt the best destination to open up a business. Since that time, we made it 11 years, what you know is an attorney tea in our business. We have been a great supporter of the alliance, all of the events, the hotel and the community that have been highlighted. To that extent, our letters of support include the four seasons residents, the saint regis residents, their work ritzcarlton residents and we have done outreach to the alliance and community arts, someone and so forth. I think our letter of support totals 45 as of this date. Additionally, i think most of the letters of protest are saying theres too high they consult concentration of Liquor Licenses in the area. We pulled from the website all of the 48th in the area and in the zip code of 94103, theres only four within a halfmile of us and two of them will be leading in the next year. It will have to close because of the impending nomad hotel and then mezzanine, as we discussed before, maybe closing if they cannot bird new review their lease situation. Additionally, between third, fourth, market and howard, there are no additional 48. This is because of this center for the arts and the convention center, speaking but speaking specifically to our actual location, there arent a tremendous amount near us. Finally, reducing vacancy i think is helpful. As we all know, homelessness is a huge issue. It is not one issue that can be solved by any individual plan, but we do believe that the less vacant storefronts we have, the more we can activate, the more we can provide really safe quality jobs with health insurance. The more you chip away at the problem. Despite the bad news that everybody hears, we firmly believe that presenting the best face forward in the Hospitality Business is not only good for residents, but for visitors alike. Finally, this is a c. B. D. Planning does a lot of hard work and these hearings exist so we can have a good discussion about what matters and i think the c. B. D. Is a place that is appropriate to be opening up these types of establishments. As we look from all the places where we should be opening up another place, a c. B. D. Seemed logical. Finally, i understand that the supervisors have a difficult job , and you have many competing interests you must consider. That said, if we all believe that hospitality is something worth supporting, having businesses like ours, hotels, able to open up in areas, which makes sense, i think is the first step in helping our city regain its reputation or maintain its reputation as a hospitality capital of the world i will let my partner, kevin, who is a more interesting one of us say a few words. Just something we want to be excited about and we want our community to be excited about in the city to be excited about is night market. It is supposed to be a cocktail bar, inspired by night markets across the world. Emphasizing our culture, diversity, also helping out the thriving Cultural Centre of the center for filipinos in soma. The inspiration of the bar would be to be able to go inside and still feel like you are inside outside. Very street, very urban, some graffiti, some playbills being torn up. Opening this bar will drive more tourism of people that come to this town just to go to bars like his and like mine, and like other bars owned by a lot of people that are here to support. The more people that come to visit his bar from other places, the more they will come to mind and the more successful we can be, and frankly it is quite a difficult time to be in this business in this city. Has operational and hospitality standards are the industry standards here in San Francisco. I moved to the city about three years ago to be surrounded by the best and work with the best, and with kevin and his bar, sets the bar for hospitality and a standard that i personally hold in my social life, as well as professional life. I since have retired from there. I am an investor in a handful of restaurants in San Francisco. One of them is schroeders. And one of the most important people to come in as a citizen as a customer. I have been a fan of andy and jan jen and kevin, as well, for years. I have seen them do great work. They are super positive around the community, the neighborhoods that they inhabit. It is world staff, and i am coming concerned with this idea of how do we keep businesses and the city afloat and magical, and i think that is one of the reasons Something Like night market needs to be where it is. I speak from firsthand experience as an owner of a district six bar and restaurant that additional foot traffic is critical to our continued survival and that i strongly support this petition because i know that thats the only way we can all survive by improving our conditions. I have had the great pleasure of knowing kevin for over ten years i have watched him grow in that time as a responsible bartender into a very responsible manager, and an extraordinarily responsible owner who maintains outstanding standards. Not at all in the industry, but i have known kevin for about three or four years, and im so far removed from the industry i am an attorney, and one of the things that kevin really provided for me in some difficult times working at a big law firm, was the environment of community and safety and love, and he does a great job with that with all the customers that come in there and i think it would be a shame to not allow him to expand that reach. I am in full support of night market for a couple of reasons. It fills an empty unit that has been vacant for almost five years on one of the most busiest tourist and foot traffic areas in our city. It will bring positive foot traffic and in a high tourist area for residents, locals, and visitors, and kevin and his Business Partners are successful , proven operators in this city and are internationally acclaimed and highly sought after which brings tourism to the city because of that. I think bringing night market to that area will do nothing but positive change and continuously building employment in an industry that quite honestly, San Francisco depends on. Thank you. Thank you. I run a bar in the Mission District and i am supporting night markets application because not only the new jobs with full Health Benefits that has been mentioned that it will create, but the business will have an incredibly positive impact on the neighborhood in a community that really needs it, and the importance of filling up bacons vacant space on a street where there is not a whole lot going on. I truly believe that having a fully operational establishment in this vacant spot will positively impact district sixs neighborhood and community. This opening doesnt only support stable jobs for local San Francisco residents, but will also bring additional foot traffic to the surrounding businesses. I have known kevin for over ten years personally, working together, and i have seen many different types of owners and operational and operational bar owners and i truly attest that this team has always shown to be one of the most responsible and reputable, and extremely responsive to any Community Issues that come up. From the Healthy Lifestyle that he lives, to the incredible artist that he is, what he preaches in hospitality, what he offers out of his bar echoes outside of his four walls. I think that we all try to improve our businesses and be more like kevin every day. In regards to safety and guests, i believe that he brings the right type of guest to San Francisco. What i mean by that is if you are a restaurant tour and you are a food enthusiast and you are in San Francisco, his bars are very much the top of your list. Im also a Brand Ambassador for a spirits company. I stand in support of night market because i previously worked for the coowners. Pacific cocktail haven is an awardwinning bar run by literally one of the world his best bar professionals. It has served of thousands of innovative cocktails that have inspired guests and many others local and global bar communities it has done so and continues to do so in a lawful, respectful, and responsible manner. During my time there, i watch this business become ingrained in the community in many ways. Everything from regular people, all the way to hosting bartenders from across the globe these owners are without a doubt a benefit to the community. These owners are also known for working with and supporting other small businesses. In a city that is home to so many big companies, it is important to support those who champion small businesses. They often raise funds for charity, one example is an annual fundraiser for the senior dog rescue which aids in the adoption of senior dogs. Kevin as a leader in this community, who this past year, organized a group of industry professionals to seek wellness through a boxing program he helped help set up. This is something that is sorely needed in the community that often puts their needs behind those of the guests they serve. This is one of the many examples these owners are benefiting the community. With me being born and raised here in San Francisco, there are a lot of changes and a lot of things have been deteriorating our industry overall. I feel like if it is not on paper, and in at risk location where the problems are, it is not one person. It is an overall issue. If you have more positive people like kevin, specifically, he focuses on quality product, quality first customers, places where people we can employ and make better citizens overall, and then grow from where he starts from. Overall, it creates more of a positive atmosphere for our industry. I can attest to their professionalism and the deep care they show both their employees in the communities in which they operate. I work and i am a native of San Francisco. Im very proud of our city and its local community and our ability to Share Community talents with the rest of the world. I have witnessed for the past 15 years the principles of this business having successfully successfully provided communities with a nice place to go for entertainment, for business, friends, and family. I was very impressed and proud that not only have they provided something new and exciting for San Francisco, they have also provided and revived local drinks that put San Francisco on the map. Im very excited to see night market open. The reason why San Francisco is so special because locals and tourists want to support local business. I see this every day through conversations with clients that i have as a banker. I strongly support and will be very proud of the residents of night market to open. Thank you. Next speaker, please. Good morning. My name is erica johnson. Im speaking today as a representative of a business on new montgomery street which holds a type 47 license. As a Business Owner and operator in the area, i say that i welcome wholeheartedly any new business that wants to come in that is essentially an investment in the neighborhood and the fabric of the social growth of the city. The challenge of being in that area is underscored by the disparity between the businesses that are large, often techbased , not populated during the weekends, and that contributes to a scarcity of people in the neighborhood itself after 5 00 p. M. In particular, on a friday or saturday. I think the benefit of things Like Convention traffic and a new Hotel Arrival are definitely seen as positives and definitely are hallmarks of success on a citywide scale, but quite honestly, the benefits of having foot traffic are very, very small if the people attached to those feet have nowhere to go and they walk out the front door im excited to have a colleague and also someone likeminded, essentially a block and a half away to help develop the cultural strength of the neighborhood, and i look forward to his success. First, i want to point out that my name is Michael Nolte and i am a citizen planner, it means i dont get paid. First, there were none of the protests in the packet. There was mentioning of 18 letters of protest. I think that is it is only wise that the decisionmakers understand why the people have protested. Also, for those that maybe dont know in the audience and maybe maybe everywhere else, there are currently lawmakers are planning to change the d. U. I. Limit from 0. 0820. 05 and that would be on a statelevel. State level. That would mean that people who like to you like this establishment would probably have to give out less alcohol to its patrons because they would probably be leaving their establishment drunk. These are considerations because for the committee to understand that theres possible changes that will be occurring that will affect new licenses going forward. The other item i wanted to bring out is on the agenda, they mentioned that the chair will entertain this motion and refer to the full board. It makes it sort of sound like it has already been decided, and it kind of goes against what the sunshine ordinance says, this is the yellow part. I am neutral on this thing. I think that the community the decisionmakers will decide and i appreciate your time. Thank you. Agenda item number two is a hearing to consider the transfer of a type 21 off sale general beer, wine, and distilled spirits Liquor License to Garfield Beach doing businesses c. V. S. Pharmacy located at 399 gary street. It will serve the public convenience or necessity. Great. Welcome back. Here we go again. Before you get the report for c. V. S. , they have applied for a type 21 license. This would allow them to sell off sale beer, wine or distilled spirits. There are currently two letters of protest. I did not receive any letters of support at the time that i sent this town but i believe some more letters of support have trickled in that some people might be here to speak on. Theyre located in plot 166 which is considered a high crime area. They are incenses track 123. 01 which is considered a high saturation area. Central station and the Police Department have no opposition. The alcohol liaison unit approves of the following conditions, sales of service and alcoholic beverages shall be permitted only between the hours of 8 00 a. M. And 11 00 p. M. Each day of the week. No distilled spirits shall be sold in bottles or containers of less than 750 millilitres. No one should be sold with an alcohol content of greater than 15 by volume and the following alcoholic beverages shall not be sold in quantities of fewer than three individual containers per sale, first one is beer, including multiple averages and malt liquor products and containers of 40 ounces of luck or less, number two, premix wine products commonly known as coolers, and number three, premix distilled spiritbased cocktails. And lastly, petitioners shall actively monitor the area under their control in an effort to prevent loitering of persons on any property adjacent to the licensed premises as depicted on the map. Is now requesting public convenience and necessity findings to add beer, wine, and liquor sales. C. V. S. Is a responsible retailer it has a nationwide system of the best safety and security standards, and moving we are moving the license one block away from 225 powell street so we will not be increasing the number of licenses in the area. We are actually replacing a liquor store, so number of licensed locations is going down the Police Department has placed conditions that you just heard. C. V. S. Has voluntarily agreed to provide additional conditions beyond that for its operation. C. V. S. Conducted early outreach in the neighborhood for this site mac. They reached out to Union Square Business Improvement District which submitted a letter of support. There were two protest files, we reached out to them early and we have not heard back from them and have not been able to have a conversation with them, however, the concerns were that the license needed to be properly conditioned, so i think we have very robustly and thoroughly conditioned the license and are open to other conditions should the supervisors feel is appropriate. And then we are not aware of any other opposition at this time. I would like to have the district leader from c. V. S. Say a couple of words, as well. In morning, supervisors. Thank you for hearing me. Once again, i am the district leader for c. V. S. In San Francisco. My responsibility is to oversee the stores primarily in the city , but also in the bay, including at 399 gary. It opened on may 15th, in the store isnt a good location for the newly constructed 24,000 squarefoot retail center. The store features fullservice pharmacy, a complete line of basic need items and expanded dairy and prepackaged to go food selections. The new store activates a long vacant sight mac with a well lit storefront, providing an obstructed floortoceiling windows around the perimeter of the building, and illuminated c. V. S. Signage crating a welcoming and safe retail spot for the neighborhood, visitors, and passersby. Security cameras throughout the exterior of the store are synced with the union square bids Video Surveillance system. Additionally, interior security cameras are managed by staff during hours of operation. With regards to alcohol, we have approximately 3200 hotel rooms within one and a half blocks of 399 gary, and the store is designed to serve thousands of tourists that walk in to the busiest pedestrian corridors. Although the sales of alcohol is an incidental purchase, and is intended as a convenience for customers will purchasing other merchandise, it is also one of the most requested items from tourists that are used to purchasing alcohol at c. V. S. Locations across the country. With over 40 years of experience , c. V. S. Has developed stringent operational standards and Training Programs to teach techniques for the lawful selling of alcoholic beverages. C. V. S. Pharmacy would require all employees is selling alcoholic beverages to complete his Training Program and executed semiannually. We are pleased to have the support of the union square b. I. D. However, the attorney that spoke about these conditions that they want proposed i wish for continuance until all these conditions are put onto the Liquor License, also the reason why we want this on the Liquor License is because c. V. S. Tried to open two other stores on kearney and another one anyways, a couple of them in district three, and peskin refused them open. This is this would be unfair if these conditions were not put on it because these are the same conditions that are also put under the flagship for walgreens so we want these conditions on because they are downtown, and these are similar issues for the neighborhood, and walgreens also has these conditions. So i would appreciate that the committee consider these additional conditions because the attorney said they were willing to put these in and have to be signed with abc before they can be approved by abc. If there any members of the public want to speak, please line up on the right of the room first is overhead, first is i think it is a misnomer for people to say that theres only one license. There was actually three businesses at this building before the construction. We lost the lorries, and then a restaurant, as well as an offsite liquor store on the corner here, and during the construction of the actual posting for the license, it was way over here in the corner, even though the entrance will be in the front here. So people could walk by and not really understand what license was going in there. I think this will happen a lot of times. People are applying for a license and they dont necessarily try to let the community understand what is going on. Having the union square bid right a letter that is basically having a Business Association a business entity. That is not really a letter of support, it is just basically doing whatever it does. As far as having doing the additional conditions, im not sure who the proper entity is to add that to the license. What were talking about is a Grocery Store that has had overwhelming support from the community. Last december we received our c. U. A. From the Planning Commission and began this in our favour. We have spoken several times with supervisor haney and his staff and have their support for this project. We also have the support of the Police Department, and as the officer has indicated, we have 179 letters of support because we have done Robust Community outreach and we have groups, we have residents, we have anyone we could find that were supportive of us. I dont think there can be any doubt to the corner of eighth and market in this area needs a Grocery Store, and that we are here to serve the public convenience to do so. As part of that, it is a small amount of alcohol that will be sold in addition to everything that everyone knows that whole foods does. Healthy food, the great teamwork and the employment there, and finally, there were some concerns raised throughout the abc process. Thats why there was conditions imposed that we agree to immediately. These conditions were, after discussions with the Police Department and the abc, they addressed noise and loitering for possible concerns. It should be alleviated completely, and whole foods has been an operator in this city for over 25 years and has a wonderful reputation, we think, on her looking forward to opening up another store.
