Well its quite simply i mean i was a federal prosecutor in one of the easiest tools they use to put pressure on individuals its not even a criminal case i mean if you look at some of these cases its like the United States versus 58000. 00 United States versus the way of the United States versus an airplane or whatever and when you make it a civil case what you actually end up doing is lowering the burden of proof you know Everybody Knows to convict someone you have to prove beyond a reasonable doubt that the individual is guilty when youre doing civil Asset Forfeiture on the civil side its just that its a civil case and so winds of happening you only have to prove beyond a preponderance of the evidence which is a much lower standard and it really is designed in order to put pressure on individuals very often to plead guilty or they walk away i mean this happens immigrants all the time when theyre deported they they have assets taken from them and then they have no standing in order to take these cases of to court because theyre no longer in the country you know this is amazing and it absolutely is one of those things which is really gets stuck in my teeth when i hear stuff like this because its just its a subsiding to hear this look Law Enforcement they always claim that civil last of this is absolutely necessary and we need it for the war on drugs. And subsequently then the war on gangs that you know thats always the biggest use is there any truth to this and then secondly i want to ask you what happens most of the time to these assets after they are seized. Well goes into a civil asset for preacher fund that money is actually to congress is designed how that money is going to be split up it very often goes to victims thats a good thing i mean thats one good thing that does happen is it necessary well its really hard or german it is it is it a powerful tool yeah its a very powerful tool it is one of the most powerful tools. That the federal government has because its instant and you know because its instant and you were to put on the the the other side of the government and you have to fight against the government or to get your money back and everything is against you you have to hire attorney and members not a criminal case and attorneys not appointed for you you have to do this yourself it is an incredibly powerful tool and you know its hard to feel bad for the bad guys when that happens and that may go and a lot of assets are taken from crooks criminals and as such i do find it funny that its a loss of corporate or something you dont see a lot of white collar crimes because that would actually be the most of back to use a bit but its pretty rare so is it effectively as effective but its affective against both the guilty and the innocent and i think that is the major problem but thats a great point you brought up about not being used in white collar crimes without blows my mind because you think the you know if youre going after you know groups on wall street who are you know are robbing people blind trust that would be the perfect opportunity to put the squeeze on them interesting. And out there im sure you know this but one of the big things that come up in Police Reform conversations all the time is the trust the issue of trust is the trust gap between Law Enforcement and the public because of civil Asset Forfeiture cases and if so what can be done to stop it. Why i think its yes it is incredibly. Destructive to the Community Relations with police because its unfair listen americans have a long history of being able to deal with harshness and toughness what we do not have a tolerance for is things that are unfair this is unfair its unfair unfair on its face and i think that right there really screams to the problems were seeing on the street when things do not be like the play out it would be. Everybody. Wants to fight back in the should fight back and i think there is the. Perfect. Thing that we could do to change the right and the left both hate this so why not fix it and the simple things we can do one we can ensure that theres a conviction and even if you dont want to go that far and i hear a lot of prosecutors say that takes away their leverage i dont agree with them but ok but at least have a process where if youre not charged within so many days but money is automatic we push that to you there are very simple things we can do and even states that have done the right thing like North Carolina that a band civil as forfeiture they still get around it through something called at the will sharing which means that all they have to do is be on a federal task force and they still are allowed to do this so they have bypassed the democratic process by their legislators saying hey we dont want to do this anymore and they still do it they just do it through did an avenue and i find that to be to simply outrageous i couldnt agree with you more i love your take on this i want to ask you is there legislation you but as you said you bet on both sides of this fight is there legislation or a model policy that youve worked on to help end this process of civil Asset Forfeiture and how its being abused and and how can this system truly be ended. Yeah i mean i had written lots of pieces of legislation a different states and the federal government there is an appetite for it and i think right now there are individuals that are really looking for compromise when it comes to policing and anything related along Law Enforcement from a justice those types of pieces typically try to be an equitable sharing because its seen as an absolute affront to the will of the states and as a conservative mean armisen or right or that is outrageous that were all for states rights and tell that we dont want to be more than we could be really for get that that is because we would have our Guiding Principles lot of the Reform Efforts to simply talk about sharing they also talk about ensuring that there is some type of burden of proof thats beyond compliance of the evidence. If you want to hold someones money and if you dont i mean i believe it should be beyond a reasonable doubt i think it should be connected to the conviction but you dont want to go there for at least make it something higher they wanted to be evidence at least have something built into that theres not a conviction or theres not even a charge think about that a lot of people are never even charged and they never get their money back because what the government says is ok we couldnt prove the case beyond a reasonable doubt but we couldnt buy a part of the evidence to go ahead and buy this spin and the thousands of dollars that its going to take to fight this and you know most people say i cant give up what on the gap is widening for.
