Defense contractors their stocks went up if their stocks are going up you should be concerned because that doesnt end well for the American Public we know what that means there are a hell of a quote there are kind of equating burning to the coronavirus you know thats really what they were doing is this awful person is going to make hes going to change life on wall street which is in effect he was he was going to make it tougher for wall street to commit crime the new report shows that drug cost of risen more than 3 times faster than inflation for the past decade and so far consumers arent getting any relief is not the better it is not going to get a better under biden who we just talked about nothing really changes but these numbers frankly are pretty startling i mean i weve been doing these stories a long time right and weve been talking about inflation area aspect of drugs and but this this is this is gone crazy 159 percent 159 percent when you can when you take the inflation rate compared to Everything Else that comparison is pretty ugly right i mean even if we werent already paying in some instances 20000. 00 times more in a markup now we have to deal with 159 percent increase over that of in like when as a matter of just a 2nd i think people that just heard that number thought that was an exaggeration really ferran 20 thought yes yes the number is 20000 we are senate we actually have documents we do have some drugs that are 200000 percent markup on those 20000 honestly thats a middle of the road number we typically see between 10 and about 30 or 40000 percent markup between cost to make and sale to consumer and so yet just to put that in perspective but this number here its not only that the 160 percent above inflation is horrible because it is but even when you take the low income people who have the rebates they get the coupons they get medicine for next to nothing there. But the truth is its by its bipartisan isnt it we saw we saw a cory booker who was a president ial candidate we saw we saw a chance of all things coming from trump trump said you know why why cant we just import drugs and take advantage of drugs that come out of canada and it looked like it was going to pass and like at the rat last minute cory booker goes around and he put 16 democrats together and they defeated now that ridiculous argument we dont know that the canadian drugs are as good as ours that was really their argument ok so talk about that because people dont get it its is a democrat issue just like its a republican issue thats why they love biden being a contender right now well you know Drug Companies are pretty smart with their money when they buy off politicians they are slightly more republican with it but by one or 2 percent they typically spread money evenly so that way no matter who wins they win and thats what happened with cory booker hes from new jersey a lot of drugs are manufactured in new jersey that those are his people thats who he represents and thats who hes going to take care of and thats why he did this but you know to say that we dont know canada is testing their drugs like we do we dont test anymore no we dont test nor do we hold the Drug Companies responsible when they screw up and create a defective drug that kills people they at least do that in canada a major online retailers like amazon could soon be held legally liable for selling counterfeit goods on their website now ok. This story struck me this way when it comes to money issues the Congress Says oh my god we have counterfeiting going on and we have wall streeters that are losing money because of counterfeiting and so we need to hold these campuses responsible they say that even at the same time that we let them sell pharmaceutical narcotics killing people all of the country without any regulations we Human Trafficking is at a halt all time high on the Internet Congress takes no action there give me your take on this on this was very interesting because obviously the internet is still the wild west with in terms of regulations theres nothing really there policing much of anything and honestly the counterfeiters are huge problem and you have these sellers like amazon who are letting people buy all these counterfeit goods from other countries with the you know very lax regulation that a lot here and so yeah that hurts american businesses but of all the things to go ahead and tackle with the internet you start with the one to say oh my god corporations are losing money lets help them know we have people who are having their data their location stolen from them and sold to the highest bidder. Thats ok right are we doing nothing about any of that as you said nothing about Human Trafficking or opioids or any of the other criminal activity happening on the internet but god forbid corporations are losing a couple of dollars here and there because somebody wants to buy a knockoff watch and raise it and they actually as they go forward with this this legislation its a good its good legit said is and im glad theyre doing it but for them to say this is more important this is a lot more important than what the Tech Companies are doing to us where theyre invading our lives theyre taking everything we own as far as our identity unit and then theyre selling it the sum to somebody else and you know Congress Says well thats ok this is america thats good capitalism but where comes to counterfeiting something like. You know some of the stuff theyre califate ing it is serious i mean theyve got theyve got some some types of vitamins that are counterfeited the formula they be forming is that its thats true they they need to do something about that but they need to handle this in a way that we can look at and say you know theyre kind of doing this with an even hand theyre holding the Tech Companies responsible for all the bad d things that theyre responsible for right now right and what we need honestly at this point we need a new Government Agency we need somebody in a department overlooking the internet these days that thats what needs to happen we need to have broad regulations not just to make sure the internets being fair but to also protect the companies as well weve got to take care of them but there is so much happening so much that congress is over looking for them to prioritize the profits of these companies and its because they give them money for their campaigns it really kind of stings a bit as a consumer because ive had my data stolen you know and nobody nobody is doing anything about that fair and doesnt think you for joining us will continue all of these stories because they get weirder almost every week i do want to come up the u. Supreme court has overturned a kansas ruling involving the prosecution of undocumented immigrants using false Social Security numbers when they apply for work this is going to open the door for states to more aggressively crack down on the immigration were joined now by alan or Vice President of the American Immigration Lawyers Association and all around very soon very smart lawyer has done a lot to help america help immigrants all over this country allan how d are you well thanks for having me. 1st of all could you tell us a little bit about kansas you know what the way i understand this is its a preemption what we would call a fight on a preemption issue which is the the what what is the relationship between a states right versus the federal preemptive right to preemptive orders thats kind of what this is coming down to isnt that right exactly its coming down to federalism and an understanding of who enforces Immigration Laws is it a federal issue or is it a state issue and when there is a written context with and federal statutes with regards to what form information on that form can be used for can states use it for Something Else that is specifically what it sort of narrows down to so kansas look we have the right to criminally prosecute if we have laws that put these to say that this particular person did something wrong yes were familiar with the fact that the feds have some involvement in this arena but we havent lost our right under and what we call Health Safety in welfare protection of our citizens to do what we wanted to do so what theyve done is theyve said immigrants what are they saying immigrants right and so i think its a far stretch and to just talk about the facts of the case specifically in this case these 3 individuals were pulled over for a Traffic Violation so it wasnt an audit procedure at a company to see if the check in the Company Documents what the what the government can do at any level which is sort of relegated to the federal government and then they sort of went and found these documents and then they added on this charge and people being here undocumented is a simple violation right something and in most states when you volleyed an identity it is a felony so it is a work around to give states the ability to sort of force some type of Immigration Law because charging them with that felony would make them automatically deportable. So what we have here is we have d its kind of a bonanza to go after immigrants on issues like you know i use this this id because i needed work i need to use a i do use a Social Security number because i needed a job to support my family and theyre saying well you shouldnt be here to begin with so were going to use this element of violating the law really is a reason to send you back to where you came from of until this ruling how his Work Authorizations d for undocumented immigrants been handled by our court system up until the time that this kansas case has been tested by the Supreme Court right so this case is specifically about the form so generally the local state and force my officers would not use and i nonform to enforce some kind of state rules such as the sort of Identity Fraud rules it would only be the federal government that would come in either through an audit or through some kind of enforcement action to sort of get these documents and sort through them for the company. You know alan as i look at this here in america you know youre dealing with on the law of the time constitutional all the time and we talked about on this program sometimes when a state aggressively goes after the argument to say look we respect the federal government we know you have your rules we have our rules to our constitution our state constitution says above all things where it comes to the states right we have a right to protect Health Safety and welfare now what im saying what im saying is a pattern im saying the Supreme Court this is this is a series of immigration cases that were seeing right now in the Supreme Court is saying yes youre right state you have this right under Health Safety and welfare protection it seems to be expanding doesnt it you know well if you see in these immigration cases as youve already said as a number of them and theyre all 54. 00 which falls along political lines what sort of tells you that immigration has now become a political football but in this specific case what they did was theyve also expanded the scope of an employers liability under the same rules so now the employer that takes that information and knowingly provide that to that state on some other form right knowingly doing so is also now involved in this sort of Identity Fraud you know schema and therefore should also be subject to these federal penalties so i think thats the undergirding from the legal analysis of how it sort of follows that i dont think they sort of thought in this case what they saw in this case was now were going to be able to get these immigrants and be able to deport them quickly and to sort of get them a felony crime because once again i want to state that the underlying document issue here has a deeper penalty than actually coming to the United States without documents one is civil the other is federal. Alan of interview just before and i remember my last interview you said that as we expect to see conservative courts are going to further enable the not only federal government but theyre going to enable the state govern. Its to figure out ways to say you shouldnt be here you came here illegally and now were going to find ways to turn all that around this is one of those things your statement i think last time we talked is we expect to see this expanding more and more at the state level and at the federal level you see that is is whats unfolding here absolutely our problem is immigration is relegated to a federal issue and for whatever reason our congress is broken right the senate has not moved on any bills from the immigration they havent worked on immigration in 20 years either party right so this becomes a football and it goes to the states to sort of now sort of say were going to do what we want to do here which then makes greater disparity because these foreign nationals that are in one state that are enforcing it in other states arent are just going to move to the other state when in fact we both know if someones using someone elses so security line that it is not a hate crime in that sense because basically what theyre doing its paying taxes for someone else to get benefits for in the future. Yeah President Donald Trump has rebranded the north American Free trade agreement aka nafta with a new pact known as the us mexico Canada Agreement the us and ca passed with bipartisan support from Congress Democrats and republicans both cheered the gutting of nafta as controversial investor state dispute settlement clauses which empower multinational corporations to sue governments when laws threaten investor profits like you just said for example if the u. S. Were to implement new regulations expanding Environmental Health or Labor Protections canadian or Mexican Companies could then sue the American Government if those new laws undermined that companys ability to profit now under the same i. S. T. s rules American Companies are also free to do the same so the new trade pact is different because its actually abandoned an investor state dispute settlements for most industries but there is now an exception for american oil and gas firms that have government contracts in mexico so u. S. Energy is really the big winner of this new north American Free trade deal. Well i mean the point is lou when we drill down to what the whole problem is with globalization one of it is were able you have a foreign a foreign country youve got france or wherever mexico asia or wherever they come to the United States and we they say to us you have affected our right to go to to come to america in cut down all of your timber you have affected our right to take our toxins and put them in your streams because youre affecting our business this is the same kind of analysis here but were giving this extra protection to the american oil and gas industry why and why is mexico significant to this particular part of the story. Well mexico significant because International Companies now hold exploration and production rights and offshore and onshore blocks of Mexico Mexico is the number one destination believe it or not for American Gas Oil and refined product exports and before nafta only mexicos state owned Petroleum Company could operate in the countrys upstream segment but recent reforms in the last few years have actually opened the country up to more privatization and the problem is that these new trade agreement this new trade agreement locks those reforms in and makes it really hard for future mexican administrations to change their policies without the risk of being sued by the American Energy industry the whole reason these are problem is because they really impede on the sovereignty of these nations. Well thats the whole idea with this whole globalization though you know which i think about what you just said i mean i hope the viewers caught that if if if mexico passes laws in they say to the all industry what youre doing is hurting our people what youre doing is destroying our waterways its destroying our environment theyre not able theyre not able to push back when the oil Company Comes back in and sues them even though even though theres laws on the mexican books that say you cant do this oil company the old company says those laws in affair with our right to do business no matter how horrendous the business may be my point is they were trying to do that in the United States under globalization in that were seeing it play itself out right here for those who dont know brazil how do investors stay dispute settlement how does that harm taxpayers the most people understand how to fix taxpayers. Sure well these cases are heard outside domestic courts and private arbitration they basically create a shadow legal system for corporate polluters and criminals and their decisions cannot be appealed and when corporations when taxpayers foot the bill to cover losses on a companys estimated future profits ill give you an example american taxpayers once paid canada over 1000000. 00 after the u. Based Pharmaceutical Company eli lilly lost the lawsuit that it had brought against the canadian government for the countrys drug patents system were constantly told that congress is completely divided among party lines but here it is again uniting for corporate interests.
