A 41-year-old ambulance driver has filed leave for judicial review at the High Court here following his suspension and emoluments cut in breach of the rules of natural justice.
Sanjay Ganth named the Health Director-General, Support Group Disciplinary Board (No.1), Departments and Institutions, Ministry of Health Malaysia, Queen Elizabeth Hospital Director and the Queen Elizabeth Hospital as the first, second, third, fourth and fifth respondents, respectively.
His application for leave would be heard on Jan. 13, 2022 before High Court Judicial Commissioner Amelati Parnel.
The applicant said he was suspended from his employment pursuant to Rules 28 and 44 of the Peraturan-Peraturan Pegawai Awam (Kelakuan dan Tatatertib) 1993.
Furthermore, he said his salaries and allowances were reduced by half. The applicant contends that the action taken by the respondents pursuant to the said letters are ultra vires and in breach of the rules of natural justice and, accordingly, is seeking remedy from the High Court at Kota Kinabalu
