According to Ugaz, said judicial resolution could prevent Vizcarra from being sworn-in as Congress member this July.
The legal protection appeal had been filed when the accusatory petition was still in progress.
In her resolution, the magistrate indicated that what corresponds is to analyze the former president’s request in light of Parliament's final decision.
In this sense, she considers that the arguments "should be analyzed as a whole when the final decision is issued by the parliamentary body so as not to hinder the investigation within the framework of the constitutional accusation."
Likewise, she affirmed that Vizcarra "has relied on the minimum guarantees of a sanctioning due process, has exercised his right to defense, and has even admitted the alleged deeds."
