No evidence for any of the claims but they match the Dark Conspiratorial Tone that Donald Trump struck himself attempting was part of some broader political conspiracy. There was a performance by lee greenwood, Abbi Maria was sent by an Opera Singer and a tone of gratitude for the first responders, that the people who helped him and helped others who were injured. The latter half of his speech did return to his standard campaign rhetoric. He blasted the Biden And Harris administration and this is western pennsylvania, this is critical for the former president. The fact the Assassination Attempt happened in this battleground state, is something i might have a significant impact. The campaign certainly hopes this visit would offer a boost to former president trump, as the polls show that this race is tight and especially in pennsylvania, its pretty much tied at this moment. This is the area around butler, around Western Pa where he really needs to galvanize his base and that is what the campaign hopes this rally might support. Thank you for that. This all comes with the backdrop of the new filing from special Counsel Jack Smith revealing new details about the links that trump went to to try to overturn the over overcome the outcome of the election and his response to the January Sit direction. I am interested in the fact that the conclusions that Jack Smith came to in his filing, about what is personal versus official, dont feel like a responsibility he should have to have but the Supreme Court said theyre going to have to parse this stuff. What is your sense of how hes done so and how hes made it much more clear a determination that theres no possibility these things Donald Trump did couldve been an official capacity. The Supreme Court absurd decision, finding that the president is immune from criminal prosecution for any criminal acts undertaken, under the office, actually is an enormously clarifying thing. When you read Jack Smiths filing, you can see so clearly, all of the cases which was most of his conduct, where Donald Trump was acting not under the rubric of office at all but simply as a political candidate, a frustrated and angry local candidates. Who stepped outside of the Rule Of Law and decided he was going to overthrow it. And it is not part of the job of the president to get involved with staging Electoral College slates. That belongs to the states. It is not part of the president s job to enforce the president ial election in any way. If you read the constitution, the president has no job and obviously so, in conducting elections. Yet he got involved, not as an official, not is somebody trying to take care of the laws and be faithfully executed. Rather as a political candidate trying to frustrate the entire process and overturn the president ial election which Joe Biden had won by more than 7 Million votes, 306 to 232 in the Electoral College. One of the interesting things about this is that if Donald Trump wins the election theres not much chance of the casing the light of day but if he doesnt, and it moves forward it will probably at some point get back to the Supreme Court. Does away Jack Smith has laid it out put pressure on the Supreme Court to say, you have met our weird bar here, and theres no reason to prevent this case from proceeding. I think that is so and i think Jack Smith filled in a bunch of new details that the January 6th select committe did not have access to and the house Impeachment Team did not have access to when we went over to the senate. We have the striking moment of Donald Trump saying so whats, when he is told that Mike Pence is fleeing for his life. And exiting the building. On the contrary, right after 2 00 p. M. , Donald Trump sent out a tweet saying Donald Trump saying Mike Pence did not have the courage to do what needed to be done. In other words, egging them on further, exhorting them to continue their attempts to get the Vice President , who of course the walls were ringing with Chands HangMike Pence, hang Mike Pence and his response was so wet. Theres a striking moment that caught my eye in this filing, where trump says to Mike Pence, that Hundreds Of Thousands of people will hate your guts if he doesnt cooperate with trumps plan to set aside the president ial election and claim office. That, to me, is a very striking moment because you can beat it either as Donald Trump threatening him politically, which obviously it was, but you can also read it clearly as Donald Trump threatening him physically, Hundreds Of Thousands of people, the kinds of people who trump had incited to come and storm the capitol, will hate your guts. In other words putting him in direct fear of his life. And that has been the Tenor And Tone of everything Donald Trump has said about the 2020 president ial election. And they continue to organize politically around a Big Lie. A remarkable thing. There was this woman just sentenced to jail for eight or nine years in colorado. A clerk of court who continued to propound the Big Lie and the judge statements at the sentencing are remarkable, saying you are a charlatan, you have been pushing these Big Lies. Theres nothing behind them and you are going to jail. Donald trump doesnt care. I hope at least that case will be a Demonstration Project for people around the country who may be tempted to go with trump and trying to overthrow Kamala Harris victory. New Supreme Court term begins tomorrow. The court added 13 new arguments to its calendar this week, which brings the total docket to 20 cases so far, more are likely to be added. A new term follows a Blockbuster Season that saw several highly controversial decisions splitting the justices along ideological lines. Those included rulings on the abortion medication, the administrative state, and president ial immunity. This new term runs until june of 2025. It already includes cases on transgender rights, Ghost Gun regulations, and a lawsuit from mexico against u. N. Gunmen u. S. Gun manufacturers. Experts say a close election could prompt the court to intervene in election related challenges. Portably, several cases could be influenced by the Election Outcome since the federal Governments Position may shift under a new administration. The Supreme Court kicks off its new term amid a barrage of Ethics Controversies and going growing calls for reform with Public Trust continuing to plummet. A new poll released on wednesday shows more than half of americans, 56 disapprove of the nations highest court. That is according to the annenberg public policy center. We do a lot of set up to talk about stuff the Supreme Court is going to talk about but melissa, i have to ask you, the polling that indicated 56 of americans are dissatisfied with the Supreme Court, can you help me distinguish, you might be quite dissatisfied with a rolling, decision the Supreme Court makes, but that is not what we are really talking about. This is not simply about decisions, it is about the ethics, about the perceived politicization of the determinations. Tell me what the differences. We dont mind people disagreeing with the Supreme Court but we worry when people lose faith in the Supreme Court. That is absolutely right. The Supreme Court is unlike any of the other branches of government because they dont have any real way to enforce their decisions other than the fact that we believe their decisions are legitimate. If you have a court, where a third of the justices have emotional support billionaires and are receiving largess from corporate entities, it seems like some of these decisions arent based in law and maybe there influenced by other things. When you have conservative Groups Angling to get face time with justices by buying buildings across from the Supreme Court pay maybe it looks like the decisions are not about the law but other things. The loss of legitimacy among the public as part of that whole demimonde at this point. Everyone is talking about the fact that the court, with a six three Super Majority is issuing conservative decisions changing the law, overruling president while being in the pocket, it seems, of these different interests and that is what is contributing to the loss of legitimacy. The emotional support billionaires is the kind of thing we werent thinking about in the past. Tell me how a court that is supposed to not sway with the wind of political opinion, in the immediate moment, how it is supposed to navigate the idea that we may be making decisions you dont like but are legitimate but if the court can do that, what else can be done fairly immediately to restore faith in the court . I guess i disagree with the premise of the question. I dont think faith should be restored in the Supreme Court. The Supreme Court already has too much power. We should not like them. People think you need to get 270 electoral votes to win the presidency but in fact, you need to get 270 electoral votes and five Supreme Court justices. Because if they have more control over the election, then voters in california or New York, it is that kind of power that they have, that they have accrued to themselves, that needs to be taken away. And as long as we cape acting like the Supreme Court is supposed to be above the law, apolitical, all these other things, then we dont get down to the dirt about what they actually do for a living. The same institution that once ruled a black person like me, has no rights, that the white man is bound to respect, has now ruled that a pregnant woman has no rights, that Donald Trump is bound to respect. That is a problem, we should be angry at their decisions. We shouldnt trust their judgment and we should be doing everything we can to have the elected branches of government, congress and the president , the people that we vote for, control our most important decisions as opposed to nine unelected, unaccountable judges who operate above the law. I want to come back to this conversation about the Supreme Court itself but in the meantime, i want to get to some of the things on the docket right now because for the moment this is a Supreme Court that weve got and they are going to look at these issues. Melissa, the case about gender affirming care has resident residence beyond Health Care. States like alabama limit the ability of transgenders to change their Drivers License for instance. Give us a sense of the impact on rights broadly of gender affirming care. Lets say at the outset, it this is like the casey mentioned evolving gender affirming care for minors on the docket and we have just gotten started. This time last year, the Court Hadnt taken the challenge to the abortion across state lines, he hadnt taken the Trump Disqualification Case or immunity case on the docket. So all of this can turn on a dime and this can be even more consequential a term then we are anticipating. But this case, the united dates versus out of tennessee, is hugely important because the court granted equal Protection Issue involving sexbased disc termination. The argument is that these laws prohibit gender affirming care to minors discriminate on the basis of sex. This is the Super Majority first case that would allow it to take on the equal Protection Clause in the cost next context of sexbased disc donation. Next week the court is going to hear a Death Penalty Case that involved a constitutional violation after prosecutors withheld key evidence. Effect the Oklahoma Attorney General has actually acknowledged. The Supreme Court has generally, historically avoided intervening and state, not federal execution cases. Tell me a little bit about this one. This Supreme Court like to kill people. This Supreme Court has been on a heater, where it is trying to get as many people put to death as quickly as possible and when they rule to put people to death, the six conservatives seem annoyed, literally annoyed that people dare to ask them to save their lives. Particular case that is at issue this term involves a man named richard. The Supreme Court literally has tried to kill this man before. He came up to the Supreme Court earlier, almost a decade ago on arguing his Death Penalty Conviction violated the cruel and unusual Punishment Clause of the Constitution And Samuel alito was on the court at that time Emma John roberts and Clarence Thomas who are on the court at that time said no, go off and die. Will oklahoma actually pause the executions and that gave him an opportunity to gather new evidence. He has evidence that likely exculpate them from his alleged crime. Is accused of murder, the person who actually the victim, of that testimony has been called into question and now hes coming back to the court, asking to throw away his confections. Not Tech Eakly ADeath Penalty Case, it is trying to get a new trial, based on new evidence this man, the fact is alive is a miracle. Has been able to bring forth and the Supreme Court might just try to kill him again. That is what these conservative justices do. A man who is broadly thought to be innocent of his crimes was put to death. Melissa, the case involving mexico suing Gun Manufacturers in the united states is interesting. Because the Gun Industry generally enjoys broad legal protection in the united states but mexico claims about 70 of trafficked weapons come from the united states. The Gun Industry is accusing mexico up trying to bully them into adopting gun control. What should we be thinking about with this case . The court granted this case On Friday so again, things can change on a dime but i am not really optimistic for mexicos chances, basically this is a complexity area. Mexico is arguing that smith and wesson, is complicit in the Drug Cartel Violence because they allowed the Drug Cartels to smuggle firearms into the country unlawfully without subscribing to the rules that mexico has set out. This is a court that takes a pretty broad view of sovereign immunity. Again, also a very broad view of corporate liability and immunity and not really optimistic about mexicos chances, also because this court is one that takes a broad view of the Second Amendment. But this is certainly a case to watch and when that Gun Manufacturers are going to be watching with great interest because so much can depend on this case. Elie, the other issue of Ghost Guns, to me, this doesnt seem complicated. If you can buy something that can become a gun, with very little effort and a few minutes, probably should be treated the way you treated gun but there are folks including the Fifth Circuit to disagree with that. First, before i get to Ghost Guns, i have an upcoming book that deals specifically with the law at issue in the mexico case. It is a law that shields u. S. Gun manufacturers from any legal liability and no other industry in the country has it. That is the law they are trying to peers and that is as she says, the Second Amendment conservatives will not let the lot be pierced. Putting that to the side. The Ghost Gun case to me is very simple. If you buy a gun, that is already assembled, it comes with a Serial Number because we can track the gun if it gets stolen if it is used in a crime, it is a basic regulation on guns. If you buy a gun that is disassembled and you put it together yourself, that doesnt include a Serial Number and it is a way to evade almost every law that we have on the books. And so people need to understand how these thanks work. Look, if you go to online, to the dark web, to some places you can find everything you need to make a bomb online. You can go to the Home Depot or lowes and you can buy most of the stuff that you need to make an incendiary device. F Home Depot had a section build a bomb, build better bombs here, that would be a legal problem. Inflows send you all the Bomb Making Components to your house with the instructions, that would be a problem. I think most people would have. That is what Ghost Gun any fractures do. They send you all the parts you need to make the gun, the instructions to it, all you need to do is put it together and yet it has a Serial Number, has no tracking, no way to a way for people to really who shouldnt have a weapon to circumvent what few Gun Laws we have and again, the Supreme Court is likely to say it is okay over the objection of liberals. I want to is there something, i know that Trent Elie said it may be irredeemable. But we have 20 cases on the docket in the next year. What do we do . I think we vote. I was in the audience when Justice Soda Mayor made that startling statement back in may. None of this changes unless you get a new administration and to be clear, simply getting a new President And Senate doesnt change the composition of the court. You have to wait for one of the justices in the conservative bloc to leave the court and be replaced with someone who is nominated by the democratic president for the ideological balance to shift. But make no mistake about it, if a republican wins the presidency and senate, remains in these fractured position it is now or the republicans take control of that chamber, then you will have Sam Alito and justice thomas who are septuagenarians stepping down and they will be replaced by Movement Conservatives who are likely to be teenagers or slightly older and they will remain on the court for the next 50 years. So if youre concerned about this court, if you would like to see more wideranging efforts to bring the court back into line, to strip it of some of the power that it is arrogating to itself over the last couple of years through decisions, then you have to think seriously about who you are voting for all the way down the ballot and you have to make your voice heard. And you have to stay in it. This is not going to be an instantaneous change. This is a 50 Year Campaign to capture the court and get the conservative Super Majority in place. It is going to take a lot of time to undo that and american voters have to be prepared for a marathon. Thank you both of you, great conversation.
