Developments in Donald Trumps ongoing legal battles. In a newly unsealed brief in response to the supreme Courts President ial Immunity Ruling, special Counsel Jack Smith gives us the clearest view yet of his 2020 Election Interference Case against the former president. Smith asserts trump acted as a private candidate and not as president , when he tried to overturn the Election Results and resorted to crimes to stay in office. It also provides new evidence about Trumps Phone Usage and the conversations he had on the 6th Of January, as the riots were unfolding at the capitol. Quote, beginning at about 150. 30 p. M. , the defendant settled in the Dining Room off of the oval office. He spent the afternoon there reviewing twitter on his phone, while the Dining Room television played Fox News contemporaneous coverage of events at the capitol. Citing testimony, the filing says that when trump was informed his Vice President had to be rushed to a secure location after trump attacked pence in his speech for refusing to help him overturn the election, trump allegedly replied with two words, quote, So What. After the filing was unsealed, trump slammed the release as politically motivated. They should have never allowed the information to be to come before the public. But they did that because they want to hurt you with the election. It is pure Election Interference. Joining us now, nbc News Justice and Intelligence Correspondent ken dilanian, danny cevallos, criminal Defense Attorney and msnbc legal Analyst And Temidayo williams, what is new and most significant in this filing which is 165 pages big . Yeah, what is new here, jose, is a granular level of detail that comes from 165 page brief written almost like a novel, filled with quotes from Grand Jury testimony, fbi interviews, and notes that the public has never before seen. For example, smith says trumps private operatives as he put it sought to create chaos as the votes were being counted. In detroit, the document quotes a Trump Campaign Worker as encouraging violence, saying, quote, make them riot. And another Trump Staffer is quoted overhearing trump telling Family Members it doesnt matter if you won or lost the election, you still have to fight like hell. Some of the most fascinating new information involves the interaction between trump and his Vice President , Mike Pence based in part on five pages of pences contemporaneous notes that were not available to the January 6th congressional inquiry. The filing describes how pence tried to gradually talk trump into accepting the results of the election and how trump turned on pence when it was clear he was not going to stop the congressional certification. Trump was sitting in the White House, as you described it, watching the Capitol Riot on tv as aides rushed in to tell him pence was in danger. But trump said, as you said there, So What. The Bottom Line is that anyone who is interested in the subject knows the broad outlines of what happened here. This filing offers some powerful new details. Ken, do we know what is behind to make that decision, to unseal it yesterday and why specifically it was unsealed yesterday . Yes. It is important to point out the special counsel did not make this document public. The judge did. By unsealing it. It was sealed. Filed sealed. Now Donald Trump and allies and independent analysts have said smith could have or should have asked for a delay weeks ago, so that this would not be happening so soon before an election. But current and former doj officials i talked to say they really didnt have a choice here. And that nothing they have done here in any way violated the unofficial policy of not taking new discretionary Action Close to an election. Remember, these guys were ready to go to trial in this case in january and the Supreme Courts Immunity Ruling required a reappraisal and they instructed the judge to figure out what was private and what was official and the judge told the parties to brief on that. Once that process was set in motion, It Led to where we are today. If Jack Smith had asked the court to delay, one, it is not clear she would have agreed and, two, he would have been criticized by the other side as putting a thumb on the scale in that direction. So, what is your reaction to when you when you were able to study these 165 pages . I would say, first, it really follows the contours of our investigation on the January 6th committee. Im not shocked by anything here. And it does confirm the story that we told, which is that the former president knew that these lies he was telling about the election to the american people were all false, and he proceeded nonetheless. What i was a bit taken aback by in a good way was how Jack Smith has been able to use his tools as a federal prosecutor, tools that we didnt have. I previously was a federal prosecutor and the power of the grand Jury Subpoena is something the committee couldnt use. What he can do here is force people to sit with him in a way that we couldnt. One of those people here is former Vice President Mike Pence. And the detailed communications he had between Pence And Trump are going to be really powerful testimony at trial and they do what clearly Jack Smith is focused on, the mens rea, the state of mind, which is critical to proving guilt at trial and hes done that here. He shows again and again that trump knew he was lying and Mike Pence will be a critical witness if this ever goes to trial. And those five pages that ken was talking about, that the Vice President , then Vice President took contemporaneously as this event was unfolding and the Jack Smith mentioning that they were able to determine what the former president what then president was doing on his phone during those hours, Thats Kind of access to information that you all just simply couldnt have. That is correct. And we were both limited by our time pressures, but by our tools, and Jack Smith has done exactly what we expected the doj to do, which is to go further than we could. So, danny, when youre looking at this and especially from a Defense Perspective, those are a lot of tools that are very effective. And im really glad temidayo is here. This goes to what i was thinking as i read this, i didnt see a whole lot of new factual nuggets that blew me away, that were blockbuster. To me, everything that was new was kind of consistent with what we largely have known over the last several years. For example, Finding Out when Donald Trump is told that Mike Pence is in danger and he says something as callous as So What didnt surprise me. I would have expected Donald Trump to say something like that. So as im reading this, i think about the dual mission. The first mission for the government is establish that these are private acts and not official president ial conduct. Secondly, they laid out their entire Case And Cant tell you how rare that is, not just for a criminal Defense Attorney or a defendant, but the public to get a preview of the governments case, especially in a complex case like this. This is not a drugs and guns case. This is a very complicated case and the government, in 100 plus pages, has laid out essentially their entire case with what i would call less redactions than i expected. The people are redacted for the most part. We can divine who they are. For me, it was the legal argument i found compelling. Yes, the quotes and texts and messages, What Bannon says about pences lawyer, it is flashy, but to me, the legal argument, the way the special counsel lays out that the executive Branchs Duty is not to be involved in state and local elections, even citing abraham lincoln, going through history and explaining how this is not the role of the executive, this is the role of other branches, he had no business in this area. And if You Leaf through some of it, you look at the majority of the redactions, really the footnotes, right, where it is kind of to qualify who the individual is or not, but there are appendix citation. There are very little of the actual text. So, lets talk about just asking earlier, about the timing of this. Why do you think that the judge decided to release this now . And there is a difference between what the judge decided to do and what the doj could have suggested or not. Well, the delay here or the timing is all because of the former president. It is because of trump. He has sought and successfully to delay this case again and again and again. This case could have been resolved much, much earlier, but for the obstruction through legal processes of the former president. So i think to look at Judge Chutkan or the doj here is misguided for anyone to do. And we must remember, the public has a right of access to the court system. The public has a right to understand in any case what is happening, and especially in the case of this kind of national importance, so we should actually be happy that this has been unsealed because the public should have this information. The question is, it is when it is unsealed and there is No Doubt a fact that were less than 30 days away from an election. Well, as i think Judge Chutkan said at one of his first court appearances, the former president , he is Defendant Trump in front of her, not President Trump. The fact that in his private capacity he is seeking another office, that is his choice. First and foremost he must answer for the crimes hes being charged with. Danny, how are you seeing this from a Defense Perspective . What do you think are the main arguments to rebut these 165 pages . Sure. Thinking like a Defense Attorney, one of the things youll expect is number one theyll argue that, hey, all these terrible things that people are saying, make them riot, do it, cause trouble at a polling facility, those were other people. And Donald Trump is clever enough that he doesnt create a whole lot of a digital trail in terms of text messages, emails, all the things that traditionally, temidayo can tell you this, these are the things that sink defendants in the modern age and you wont find a whole lot of that other than his twitter activity. So, youre probably going to see a defense at least at trial that these were things other people said and did, they didnt do it at my direction. Thats for trial. At least in the immediate, because now the mission is show the court that these were official acts. So the argument with pence is clear, youre going to say, hey, even if it had to do with the campaign, im a president , talking to my Vice President , therefore the presumption lies. Because the presumption is that communications with pence will be immune. The government just thinks they can overcome those presumptions and they have done a really good job of making that argument. So thats going to be the Defenses Argument essentially here. It may have sounded it was about the campaign, but here is some element of president ial official conduct, were immune. Returning to our top story, the Court Filing from special Counsel Jack Smiths office, the most exhaustive account yet of the former Vice President , Mike Pences interactions with Donald Trump after the 2020 election. Interactions which smith argues were done in a private capacity as Running Mates, not as official president ial conduct. Lets speak with someone who was with the former Vice President on the 6th Of January, his former Chief Of Staff, mark short. Thank you so much for being with us this morning. You were in the room for so many of these incidents, including in this Court Filing. These are some of the photos of you and Vice President pence from January 6th, after you were whisked out of the Senate Chamber. Does your memory align with how Jack Smith says things played out that day . I think that the filing from what i read is consistent with testimony that was offered and consistent with the way the facts played the events played out. I think it is also consistent with the way the Vice President told it in his own memoir in his book. You spoke to the Grand Jury. Were there other key moments during that period that didnt make it into this special counsels filing . Well, you know, i think that there is obviously a lot of focus on the day of january ofth. And this was an effort over several weeks and i think that from my personal perspective, i believe that once the Electoral College had acted on december 14th, much of this would sort of dissipate and i think when it didnt, it became clear that the focus would be on the Vice President s actions on January 6th. His last few weeks were certainly, you know, more intense in deliberations between the president s office and the Vice President s office. But, you know, i think there is some pieces that probably arent told because they were probably considered to be at this point protected because of the supreme Court Ruling of official activities. In other words, i think there is probably a lot of Mark Meadows testimony that has yet to be unearthed from this, i think youre looking at not going to trip over that potential disqualification, so much of what is released in this filing is things that are considered to be campaign activities and, again, i think that the president probably hurt his case when he dismissed his own white House Counsel for many of the conversations because the advice that cipollone and Pat Philbin were giving was not consistent with where he wanted to go. So relying on outside counsel, it is hard to argue it was official activity when you ask that your official counsel not be present for these conversations. And how do you see it . Do you see that these conversations that you were a part of there, by witnessing then Vice President speaking to the president on that day, do you see those, do you remember those conversations as being conversations between the executive Office Branch or is it more conversations of a candidate speaking on a political way to his, you know, Running Mate . Well, jose, im not a constitutional lawyer. I confess that. I think it is a gray area to be honest. Because i think the Vice President s role in presiding over that ceremony is a very official part of his responsibilities. But, again, i think that many of the conversations that unfortunately the president was having and i think being led to some of these Conspiracy Theories was generated by outside counsel. So i think that does not benefit his argument that these were official actions. I was thinking what you feel, not as a constitutional lawyer or not. I get it. Just the conversations. I think it is a gray area. It is a gray area, jose. One revelation was about trumps actions as rioters stormed the capitol on the 6th Of January. According to this filing, quote, upon receiving a Phone Call alerting him that pence had been taken to a secure location, person 15, not saying who that is, i dont know who that is, rushed to the Dining Room to inform the defendant in hopes that the defendant would take action to ensure pences safety. Instead after person 15 delivered the news, the defendant looked at him and said only, So What. What do you make of that . Well, i mean, i dont know how much of this is new to us. As you recall, when the Vice President had been evacuated and Secret Service was sheltering him down in the Loading Dock area, thats when the president tweeted out, i think, in ways that riled up the crowd further. Hearing that extra tidbit, it wouldnt it is not really shocking. So, i mean, it is disappointing, of course, but i cant say that it was inconsistent with what i was already led to believe on the events that were transpiring them. As you and i are speaking, were putting that video of the moments that the Vice President at the time, secret Service Detail and other people including yourself are leaving the Senate Chamber on the 6th Of January as rioters moved closer to the chamber. I think we actually have you highlighted. There you go, right there. What was going through your mind, right here, mark . Well, at that point we felt we had a job to do, and so as we have evacuated, i remember being with the Vice President , the first thing said was i think we should call Kevin Mccarthy and call leader mcconnell, Call Speaker Pelosi and schumer and make sure all the members are safe. As soon as the Vice President was located on the Loading Dock, that was the activity we went to. It was quickly moving into action about what our responsibilities were that day to ensure that, you know, that the voice of the american people was protected and the proceedings continued on. I think the Vice President was very consistent because multiple times Secret Service asked him to be evacuated, and he said this is the hallmark of democracy, im not going to let the world see a 15car Motorcade fleeing the capitol because of this. And so he was determined to stay in the capitol. Which is why we ended up in the Loading Dock. Multiple times Secret Service asked him to get in the car to leave and he refused to do that. He said this is important that we stay here and finish our job. I think later i had an opportunity to talk to our lead secret Service Agent and i think that as far as our security, i always felt like we were surrounded by Secret Service and protected. But he had counsel that because the crowd had gotten so close that they were really, really close to being given order to open fire on the crowd, which would have been bloodshed and a whole other series of events that would have transpired. Mark, i see the building that is behind you. And for so many that building represents the democratic experiment that is the united states of america. And how it has survived, grown, with moments of difficulty for centuries. Im just wondering when you look behind you and you see that building, what are the things that you see there and what are the things that you fear about what happened there on that 6th Of January . Well, i think it was a tragic day. And i think that too often were trying to gloss over that. And i feel that, you know, for our movement, i think that while i always champion the policies of the first term and proud of being part of the trump pence administration, and what was accomplished then, i think sadly the root of conservatism is believing in the Rule Of Law over the rule of man. Once you embrace the rule of man over the Rule Of Law, it leads you to a pathway, if you say it is no big deal, it is easy to say well divert on our commitment to life, well divert on our commitment to our allies, well change our position on trade, or now well be the savers of obamacare. I think it leads to a Slippery Slope when you abandon your protection of Rule Of Law as conservatives you begin to abandon a lot of other positions too. Lebanons army says it returned fire at israeli forces for the first time. Were learning that days before israel killed hassan nasrallah, the leader of hezbollah, he had agreed to a 21day Ceasefire with israel, according to two senior lebanese officials. Right now the world is awaiting to see how israel will respond to irans ballistic Missile Attack on tuesday. President biden was asked about it this morning. What are the plans to allow israel to first of all, we dont allow israel, we advise israel and there is nothing going to happen today. Well talk about that later. Joining us from beirut is nbcs Matt Bradley. Also with us, david ignatius, foreign Affairs Columnist for the Washington Post and msnbc contributor. Matt, israel is bombing beirut, not just in the outskirts, but pretty much throughout the capital . Reporter yeah, i mean, thats what we have been seeing from where im standing. Last night, we heard three loud thumps and that was the strike that killed nine people, according to the lebanese officials, deep in the heart of beirut,capital. Thats the furthest they have gone, into the capital. And even just today, we have been hearing a lot of thuds and seeing smoke rising off the neighborhood of dahieh and its environs, this Shiite Muslim area, just south of beirut, that is a hezbollah stronghold. We dont know what that latest one was, but the israelis have come out and announced shortly after that, that they did strike an Intelligence Headquarters of hezbollah in southern beirut. So, this is all still ongoing and as you mentioned, this indicates the israelis expanded the footprint of their Air Strikes, not just geographically, reaching further into the capital, but also in terms of kind of the politics and the range of targets that theyre hitting. What they struck overnight was actually a medical facility that was connected to hezbollah. It wasnt ostensibly a real military target. And that killed, as i said, nine people. So this just goes to show the israelis are lengthening their menu of targets. And we also heard from Lebanons Ministry of health that the number of people who have been killed in lebanon as we approached the Oneyear Anniversary of those October 7th attacks, the number of people killed in this country is now reaching nearly 2,000 in the past year. So, as we see israel expanding its Target List, were also seeing this incursion in the south of the country expanding. The israelis are Lebanese Army said they had a confrontation with the israelis, two members of lebanons regular military, not hezbollah, were killed in that fire fight. So, again, were seeing the israelis Target List expand and the number of people theyre confronting expanding as well. Jose . Matt bradley in beirut, thank you very much. Appreciate it. David, you write that there were a number of times over this last year where israel decided to strike at hezbollah because israel determined it was like a now or never moment, including killing nasrallah. That also included the Exploding Pagers and the exploding walkietalkies. What was that about . So, jose, i wrote that israel had considered striking nasrallah and killing him on october 11th, immediately after the October 7th attack by hamas, when israel was reeling. And decided against it thinking that israel was too vulnerable at that time. The issue remained on the table, but what actually propelled the final action was a series of kind of tactical accidents, israel came to believe that hezbollah was searching the supply of pagers and might discover these sabotaged pagers that ended up exploding in peoples hands. That was first. So that was a use it or lose it. And then as several weeks passed, they learned that hassan nasrallah, the leader of hezbollah, might be about to move his headquarters from the Area Israel had mapped extensively, had done careful Target Planning for to somewhere else, much, much harder to hit perhaps. So, again, go now or you may lose the opportunity. So, we end up in this position, that as Matt Bradley reported from beirut, israel keeps expanding as a relentless logic of escalation until israel keeps hitting more targets, expanding his footprint in lebanon. What worries me the most because of something i watched in gaza, from the start of that campaign, is the lack of day after planning by israel about how lebanon is going to be put back together. Matt bradley said 2,000 people have been killed now. Someone said A Million lebanese have been displaced since this campaign began. The country that can help put lebanon back together is the united states. We, for 15, 20 years had a program to support the Lebanese Army, preparing for exactly this moment, when hezbollah was collapsing. So the Lebanese Army could stand in and recover sovereignty for the country. And i hope, i believe that the White House is thinking about that now and id execute that. It is going to be needed because lebanon, as matt said, is basically being, you know, turned over as people flee and people are killed. And, david, it is so just outrageous on so many levels, you know. Lebanon has such an extraordinary history. They have been just faced with so much so many problems and im just thinking of syrias influence, hezbollahs influence, the Prime Ministers that can and cannot survive either politically or even physically. How is it that lebanon is always victimized into being a target . So, jose, this is the tragic consequence of having a weak state that cant enforce its authority through a strong army. The plo ruled lebanon for a time. It was lebanese civil wars, other lebanese tried to fight back. That raged for years. And then hezbollah came in and filled the vacuum and has really been a state within a state. I know so many lebanese who have resented hezbollahs dictates, the way that they just took over the institutions of the country. There is now a moment, one bright side of this terrible tragedy were watching, there is a chance for lebanon to regain the sovereignty it lost. And it will require the u. S. And its european allies, france in particular, to step up and do Something And Substitute for the israeli bombs and i hope, as i said earlier, i hope the White House is thinking about that. Marissa parra is in bristol, tennessee. What is this investigation all about . Reporter i want to start by saying that is not too far away from where we are right now, thats in irwin, tennessee. Were in bristol and this is part of the recovery, the Relief Efforts that, of course, so many of our colleagues have been talking about. So this is bristol speedway, where it is an 80,000 square foot warehouse, being used for supplies, donations, but as you mentioned, as people are in the process of cleanup, this is still a dire situation for so many on so many levels. Of course, not just all of the people in need of supplies and in need of rescuing that our colleagues have been talking about, but there is also the families and Loved Ones of those who are still missing who are seeking consolation, who are seeking some sort of understanding of what happened to their Family Member because they dont even have confirmation on exactly that. So, impact plastics, this is where we understand six workers were swept away by floodwaters, clinging to a truck, they lost their holding on it, it is just devastating and awful. But then you also have this investigation separately into why they were still there to begin with. And it has become a he said, she said, because the company, impact plastics is saying they had management monitoring the weather, that they did not require anyone to stay, but then you have employees who are telling our affiliate, who are telling us that is simply not true. And so that is something that were looking into. We know there are investigations from the Tennessee Bureau of investigation as well as tosha looking into the allegations. And we had a chance to speak with the public information officers on the ground, we know that there is a 911 director looking through the 911 calls to see if Spanish Language was a barrier and i can tell you, firsthand, on the ground here, jose, i have seen that barrier with Spanish Language speakers, the surviing Family Members, many of these workers, most of these workers who have not been found yet were spanish speaking. Families are looking for that sort of confirmation, and, of course, looking to see if that Language Barrier was any factor in all of this. Just an awful situation all around, jose. Thank you very much for being with us this morning. What does the area look like . How have you been involved in Recovery Efforts . Our office started on Saturday Morning with a plea from their sheriff to come get his inmates out of his jail, they had no power, no water, no food, that type of thing since about thursday. So we made a trip up early saturday, saturday afternoon, to get their inmates and brought them back. It was a rather hard job getting up and down the mountain there, one of the most nervous times ive been in Law Enforcement in 30 years is getting those inmates safely down. We left a crew of about 12 people up there, i returned the next day with a much larger crew. So what are some of those challenges that you say really were challenges that you havent had to experience in three years 30 years of service . Yes, sir, the devastation ive just never seen it. My parents have lived at the coast of North Carolina. Ive seen hurricanes. But ive never seen the damage to the North Carolina mountains as i have seen. I have Family Members in Avery County, mitchell county, were dealing out of Avery County, North Carolina. We have been a part of numerous Search And Rescue missions. We have atvs, four Kwheele Whe Side by sides going into those areas. The footage is myself and the atvs going in and thats how we have to get Food And Water to some of the places. We cut through Cow Pastures and like were going through Somebodys Yard here, it is just so difficult to get to some of these what the mountain people call hollers, hills and hollers, where there is one road in to about 50 to 100 homes and that road is gone. It is not just a bridge that is gone, it is the whole road that is gone. And it is pretty bad. Sheriff, what do you need right now . How can we help you help those that are right now living in areas where there is just very difficult very difficult to get to them . Thats a big issue. I dont think that even the Avery County sheriff and his staff have done a fantastic job, but these are rural communities. They may only have 30 or 40 officers in their whole community. So, it is a manpower strain. We have been sending a good many people up there. Finally you see some national Guard And Fema coming. But they usually generally deal with the Food Distribution centers or hubs. It is still the small apartments that are going into these areas and reaching other people. We finally got across the river, youre showing a picture of the river that we finally got across a few days ago to look for a missing schoolteacher that was swept off of her roof, her husband was thrown on the bank, she was swept away. We looked for her three day unsuccessfully. It is something ive never seen. I would suggest that you donate to your organizations like your red cross. What we are experiencing is a lot of great people wanting to help and they bring things up to the mountains. And it just causes a lot of traffic. It causes a lot of logistical issues because they get up there, and then they realize, i dont have enough gas to get home, and there is no gasoline up there. So, if youre wanting to donate, donate to the national organizations that we respect like your red cross, and your other groups, americans first, things like that and let them be the coordinator of it. Sheriff, do you have any idea how many people are out there that havent been reached and so desperately need help . How many people . I can speak to about Avery County. Avery county, where we have been working, i would say 70 of Avery County can get to Food And Water and can get to things. But there is probably still about 30 of the Back Country that is not accessible other than helicopter, other than atvs. We Avery County as of yesterday had two fatalities, but there is a lot more, there is several missing people that a dozen or more that we know that we saw were actually swept away that we havent located. I think as the days go on, this number will get drastically worse. Sheriff, thank you very much for being with us and for all the efforts that you are carrying out. You and your people. What Jack Smith is showing us and whats unveiled by Judge Chutkan is the threat remains because he doesnt take accountability for that day. Christina, is this going to maybe have make a difference in undecided voters or people in any way seeing what happened here on January 6 and what this Filing Shows . I feel like if you are undecided at this day and age, we have a larger problem. We know theres a segment of the Republican Party unmoved, unbothered by anything that Donald Trump does. These people who are still on the fence, they want a reason to vote for the Republican Party. This i dont think is going to change things. This has always been part of the election cycle. I dont know if thats a factor that would switch them one way or the other. We have to be real. There are some people who will never pull the lever for a woman at the top of the ticket, a person of color at the top of the ticket and definitely not a woman of color at the top of the ticket. This is one of the variables in the indecision. I dont think it pushes them into the democratic party at all. Another issue that, of course, is of paramount significance for the selection and throughout every day is i want to play a video that Melania Trump posted this morning. Listen to this. Trump has struggled to effectively message largely republicans as well on the issue of womens rights and reproductive rights. He knows he is not winning. He has been flipflopping saying ivf for all, six weeks is too short. I dont know if this is a coordinated effort. I believe she operates in her own silo. As someone who has said that two things can be true at once, you can believe in life but also believe in medical freedom for half the population. Its important that republicans recognize that the fringe of the party thats so strict and only looking at it through religious lenses, is not where the country is. Thats not a winning strategy. I dont know this is going to appeal. To your point, maybe she thinks the Trump Campaign thinks this will bring women into their fold because shes espousing a stance a lot of women who arent outspoken about It Care about and agree with her. That could be the strategy. Its all about framing. So many times republicans frame it as, prolife. Its a choice, antichoice question. Thats how melania framed it. The republican goalpost keeps moving. The diehards, they will say, she operates in her silo. He gave us the three Supreme Court justices. Republicans are saying, she must actually represent what he really thinks. Even though time and time again, Donald Trump has shown us that he will err on the side of antichoice when given the issue. What we have seen every time abortion is on the ballot in states, democrats win.
