Quote, when the defendant lost the 2020 president ial election, he resorted to crimes to try to stay in office. At its core, the Defendants Scheme was a private criminal effort. Private is the keyword there. After the Supreme Courts controversial decision granting broad president ial immunity, smith must now show that trumps alleged actions laid out here cannot qualify as official acts. Lets bring in nbc News Correspondent vaughn hillyard, Nbc NewsJustice And Intelligence correspondent, ken dilanian, and a pair of msnbc legal analysts, former federal prosecutor in the southern district of new york, kristy greenberg, along with civil Rights Attorney and former prosecutor, charles coleman. We have had the house January 6th committee hearings, the initial Special Counsel election indictment, and now this updated factual proffer, whats new in here . This is a 165 Page Document with new evidence that reads almost like a novel. Theres a lot of interesting new tidbits including in the immediate after math of the election, even as the votes were being counted, theres testimony that Trump Staffers were talking about concocting protests after the socalled brooks Brothers Riot that happened in 2000. One is quoted as saying, make them riot. And then you have a Trump Staffer testifying that Donald Trump himself was overheard telling Family Members whether you win or lose, you have to fight like hell, suggesting that even if he knew he lost, he would still try to fight to stay in power, which is exactly what the Special Counsel says he did and broke the law doing so. The most interesting revelations come around his interactions with Vice PresidentMike Pence, and based on five pages of contemporaneous notes that the January 6th committee as far as we know did not have access to and we have never seen before its fascinating. It portrays Mike Pence trying to gently and gradually trying to convince Donald Trump that he lost and it would be okay to leave the White House and that they could consider it an intermission, he could run again. Then it shows trump turning against pence when it became clear that pence was not going to stop the certification on January 6th, and then it takes us up to the moment that the rioters were pouring into the capitol, and Donald Trump was told that Mike Pence was in danger, and told at one point that he had been evacuated to a secure location and the aides were hoping that the president would order some kind of action to protect his Vice President , and this document quotes Donald Trump as saying, so what. So thats a lot alone, and its just scratching the surface of what is in here. Vaughn, what are we hearing from trump and his campaign . Have they disputed any of the facts of this filing . No, not at this point. For the trump campaign, you turn attention to Donald Trumps Social Media. Literally minutes after this filing was publicly released, Donald Trump began posting on his Social Media account saying in part that its a falsehood, unconstitutional j6 brief. Its worth noting that Donald Trump, though, is not refuting any of the actual substance of what is inside of this document. He is not refuting that he put pressure on Vice President pence or other republican lawmakers like Georgia Governor Brian kemp, and Arizona Governor Doug ducey, which is outlined inside of this filing, and it does not include any refuting of his conversations that he had with the likes of ronna mcdaniel, rnc chairwoman, and or close ally, Steve Bannon or other advisers to his campaign. At the same time, we expect, based off a request from trumps lawyers, they have sought from Judge Chutkan to have an additional five weeks added on for them to be able to respond with their own filing to the Jack Smith filing, so of course this all comes down to we dont expect much movement here before Election Day on this. But at this point in time, its up to Donald Trump and his campaign to respond in kind, and instead of actually refuting specifics as part of his 160page filing, Donald Trump is just outright dismissing it in its entirety, the basis that the indictment was brought against him. The Special Counsel must prove this case involves private conduct. That it has nothing to do with President Trumps official acts. That was because of the Supreme Courts ruling. Based on this new filing, what youre reading here, does it look like Jack Smiths case is harder to prove . No, i think based on what he has set forth here, hes set forth a lot of different categories of conduct that seem to be plainly private. He talks, for example, about Donald Trumps interactions with various state officials, and he paints a really dismal picture where Donald Trump is right in the center of it. He is out there not only trying to pedal all kinds of knowingly bogus Election Fraud claims, but when the various officials of the states say, no, thats not true, were not going to overturn our elections, were going to follow our process, you know, Donald Trump then starts to, you know, publicly attack them, and retaliate against them, and its numerous people. Its governors, its house speakers, state legislatures, i mean, its really striking to see, and its, you know, how in the world could the supreme Court Look at that as bullying, and telling people not to do their jobs and say that is somehow within his president ial authority. The president has no authority to engage in what states do and how they certify, you know, their votes, so, again, you know, thats just one example. There are many many examples throughout this, where Jack Smith really gets into the details and really paints a very clear picture as to why this is unofficial conduct. Speaking of details, theres a lot of new detail in here about Donald Trumps Pressure Campaign, his then vp Mike Pence, and the Supreme Court made it very hard for trumps Pressure Campaign involving Mike Pence for that to be a part of this case. Right . Private conversations between a president and a Vice President. But smith argues because the Executive Branch has no role in the proceeding, the president was precluded by design, prosecuting poses no danger to the executive Branchs Authority or functioning. Is getting the pence interactions into the trial the highest bar for the Special Counsel to clear here and how important is that to this case . I think its a very very high bar, ana, and i think one of the things that Jack Smith understands is he can not put all of his eggs in that basket. If hes able to get those notes and conversations in as part of his case in chief, that gives him a huge leg up as far as establishing the fact that these people were not acting in any official capacity, they were Running Mates, talking about a campaign, a victory Donald Trump knew he lost. What this brief lays out very very clearly is that if you take that stuff away, i have enough, as far as the prosecution is concerned, to put on the table in front of a jury or in front of a judge to establish that Donald Trump knew that he had lost, and he was engaged on his own in another campaign that involved no official acts connected to what his responsibilities as a president are. And i think that thats important to understand. If you have the stuff with Mike Pence, i can move forward and it helps a lot. But if i dont, i still have more than enough to make up my Case And ConvictDonald Trump for what he has done on January 6th. This filing also zooms in on Trumps Use of twitter, and im quoting here, the Phones Activity Log show that the defendant was using his phone on January 6th, and in particular, using the Twitter Application consistently throughout the day after he returned from the ellipse speech. The Special Counsel wants to introduce this at trial using an fbi forensic expert, what do you think the prosecutors are trying to show with this . Theyre trying to show on January 6th, Donald Trump has actively involved himself, not having some aide do it, he is himself tweeting, and the tweets are, you know, spreading Election Fraud, even on that day, leading up to it, and on that day, he is trying to retaliate and pressure Mike Pence to not certify those votes. He is rallying his base. Hes inflaming his base. Theres one tweet in particular at 2 24 on that day at January 6th where he says Mike Pence lacks courage. Thats when he already knew that the capital had been breached and then he finds out that that could potentially harm him. Jack smith refers to that tweet as a powder keg, knowing that could be putting Mike Pence in danger. Sure enough, he says so what when hes provided with information that he had to be moved to a secure location. These tweets are very important evidence, and, again, you know, if youre spreading Election Fraud, if youre trying to pressure Mike Pence, if youre trying to retaliate against your opponents and rally your base, none of that is president ial duties. All of that is what hes doing as a candidate to try to overturn the Election Results. Charles, ken mentioned this incident in detroit where votes were being counted the day after the election, and there was this pro Trump Group that was there on site, and looking to cause some chaos. Quote, when the colleague, and this is a colleague of trumps hes saying, when a colleague suggested that there was about to be unrest, reminiscent of the brooks Brothers Riot, an unnamed Campaign Aide responded, make them riot and do it. Prosecutor says this is one example of trumps private operatives trying to create chaos, intending to have some kind of a riot, but do they have to prove that trump was behind that specifically if this is an indictment against trump himself . Well, there has to be a connection at some level between Donald Trump and these actions, not necessarily that he specifically directed them to do this specific act. However, with respect to the ultimate goal that Donald Trump sought to accomplish, which was deserting or preventing the certification or disrupting the elective process in 2020, if that is found to be in the scheme of what Donald Trump was advancing, that will be sufficient for Jack Smith to move forward. The specific acts in terms of how its accomplished is not necessarily something Jack Smith has to establish beyond sort of presenting a case that basically ties in, we all were acting in this common goal, and we were all clear about the common goal that was set forth in advance by the former president . Ken, trump has been complaining about the timing of the brief being made public. Did Jack Smith have any control over the timing of the release . In the immediate term, he did not. This was a decision by the judge to unseal a sealed filing. The Special Counsels office didnt know this was going to be happening yesterday. Theres a larger issue here where you can question whether Jack Smith could have done something to avoid this happening until after the election, could have asked the judge for more time, but the justice Departments Position is this does not violate guidelines. They have a case to litigate. The Supreme Court has asked that this procedure happen to sort out whats private and whats official, and that they need to move forward. And Judge Tanya Chutkan made clear she believes the election has no bearing on how the case should be handled. Vaughn, trump calls the timing Election Interference, arent his legal moves the reason this all was delayed to this point right before the election . Right. Lets be clear, when we were talking about him disputing underlying facts of the case, Donald Trump has maintained that each of the actions he took were well within his right, not only as president but as somebody who continues to make the case that the 2020 election was falsely stolen from him, and we are already seeing, a month before the 2024 election, the current republican nominee lay claim to more than a dozen Election Interference claims hes making about this election, in which domestic actors, he has made the case, google to the Secret Service to the biden administration, to Jack Smith, to Judge Chutkan, they are the ones actively interfering in this election in order to manipulate and make the outcome unfair. A couple of data points. When israel announced the offensive on monday saying these were limited and targeted raids, they said there was one division of israeli forces involved. Now, thursday, there are two divisions, and as we drive across northern israel, every road, almost, is full with military vehicles. We are seeing tanks at staging areas all across the north of this country. Which strongly suggests israel is preparing to send more forces in, and we are also getting signs that israel is expanding the area of operations where it plans to attack inside of lebanon. Today the Israeli Military ordered lebanese civilians to evacuate from several villages and towns which are not directly on the border, but some of them are north of the latani river, The End of the Buffer Zone to separate hezbollah and israel. That indicates that israel is planning to push further. It is taking casualties, at least eight soldiers killed yesterday, and as you said, nine people killed in this israeli strike in the center of beirut. When it comes to iran, do we have any idea what type of Retaliation Israel is considering . Are the israelis supposed to send 181 ballistic missiles towards iran, towards cities in violation of international law, in violation of the laws of war. What they need to do is give the iranians a clear message that this is the time to end the escalations from iran. If they want to hit some of the nuclear sites, whether its the entry ways, access to them. Some of the research facilities, thankfully, i think Joe Biden doesnt know what hes talking about when he suggests they shouldnt do it. The Jewish New Year has just begun. Could that have impact on the timing of retaliation from iran or new strikes from hezbollah. They could wait until rosh hashanah has concluded. I dont think they feel necessarily bound by that religious restriction, though, when it comes to a military operation, and i would say, you know, i would add to what danielle said, i dont think the u. S. Government should necessarily chime in on exactly what israel should be doing or shouldnt be doing. We can have that conversation with the israeli government behind the scenes. But i wouldnt counsel our government to tie israels handles publicly in the way that it appears the president is trying to do. So, danielle, the biden administration has said it is fully supportive of israel, but President Biden says he would not support an israeli strike on irans nuclear facilities, something that some in israel are calling for. Reporter if shes elected in november, she would be a president not just for democrats but for all americans, and we have seen the Harris Campaign in recent months make end roads with independents, with republicans, but specifically with these never trump republicans, these republicans that have been disillusioned by former President Trump, and the campaigns thinking now with just over a month until Election Day is what better time than now to really double down on these efforts, and so thats thing behind this Event Today that were going to see Vice President harris appear for the first time with former congresswoman Liz Cheney since her endorsement last month, and youll remember a few days after her endorsement, we saw her father, former Vice PresidentDick Cheney follow in her foot steps. Theyre going to, as you mentioned, whats widely considered to be the birthplace of the Republican Party, with several meetings in the mid1800s, that led to the creation of the gop. You can remember what cheney brings to this event, brings to the campaign. She was at one point the number three house republican. She served as Vice Chair of the January 6th committee. Played a huge role in the Impeachment Effort of former President Trump. Remember, she eventually lost her seat in wyoming to a trumpbacked rival, and she has said ever since that she would do everything in her power to make sure that former President Trump didnt return to the White House. So thats the thinking behind this Event Today, and a senior Campaign Official tells us that a little bit of what we could expect from harris, expect her to really praise cheney for her courage in choosing her country over party, and saying even though she may disagree with republicans on several issues, her Vision And Goal for the country is the same as Liz Cheneys. Ali vitali, thank you. What do you see as Cheneys Role and potential impact in this campaign . Well, i think this is real important, not only because its historic in this moment but also as it harkens back to a time when there was a bunch of people as part of the Wig Party who felt they had nowhere to go, and ultimately formed the Republican Party in the 1850s, as we talked about on the issue of slavery, which obviously turned the country into a Civil War over the matter. What this does, Liz Cheney and others, its a signal to independent voters tired of the partisan politics that dont like either political party, dont like democrats per se, and dont like republicans per se, feel like theyre sitting in the middle of nowhere, dont feel like anybody responds to them. This bipartisanship message, and symbolism sends a signal to them that, like, you can be comfortable here. Thats one thing. The other part, which we dont often talk about soft republicans who cant see themselves voting for Vice President harris, but because of Liz Cheney, what they could get is a single, do you really want to get up that morning and turn out and be enthusiastic and vote for Donald Trump because many of them dont like Donald Trump but cant see themselves voting for a democrat. I think this thing is twofold, a great signal to independents but also a signal to republicans, i dont think it will cause them to vote for the Vice President , but it could cause them easily to basically say im not going to vote for the top of the ticket. Jonathan, the timing of cheneys campaign appearance, a day after the Bomb Shell Court filing from Jack Smith, the election lies, the January 6th attack that pushed cheney away from trump and his Republican Party. Will the new details in this new brief by the Special Counsel about trumps actions breakthrough with voters . One can only hope. I hope it breaks through with voters the way the January 6th hearings, i believe, with voters. The hearings would have no impact, that everyone knows everything, everyones dug in but after ten hearings, dramatic hearings where we saw what we saw with our own eyes, live on January 6th, but then hearing live testimony, learning new things, i think it was almost impossible for the american public and for the electorate to not hear those things, internalize them, and then have that inform their vote when they went into the Voting Booth in the 2022 election. The debate between Governor Walz and Senator Vance and his nonanswer, to January 6th, finally being release bid Judge Chutkan, to the campaigning were about to see, Liz Cheney with Vice President harris, it all will serve to, well, one, were talking about January 6th again, which gives us in television a reason to show the images from that horrible day here In The City. And i agree with Matthew 100 , what Liz Cheney does and her father and the hundreds of republicans who have come out and endorsed the Vice President , its giving those republicans who cant see themselves voting for Donald Trump but are unsure about Vice President harris, it gives them the permission, the Permission Structure to vote for her, if not for her, then for the constitution because what the Liz Cheney endorsement demonstrates the stakes of this election. Jonathan, on the other hand, trump has been posting a lot about this special Counsel Brief since it came out, calling it a witch hunt, calling it Election Interference. Weve seen him get momentum in the past when his legal troubles are front and center. Could this potentially help him politically . I mean, you know, sure, it might. I mean, thats what we have seen over these last few months, but as many people have pointed out, the former president has a ceiling on his support. And so whats he going to do, just rile up the people who are already riled up and who are with him . We will see, finally, in about, how many days do we have . 32, 33 days . Thats when well know for sure. Just 33 days until the election. Matthew, jonathan mentioned that nonanswer from j. D. Vance at the debate when he was asked about whether trump lost the 2020 election. Well, he was asked about that yesterday at an event in michigan. Watch. Heres the simple reason. The media is obsessed with talking about the election of four years ago, im focused on the election of 33 days from now because i want to throw Kamala Harris out of office and get back to Common Sense economic policies. Matthew, trump brings up 2020 all the time, but how is it that the Republican Party is still struggling to deal with his obsession nearly four years later . Well, because they have never been able to admit reality, which is Joe Biden won. They refuse to admit reality, and its like a 12step program. Until you admit you have a problem and then Go On, you can move to the next step. They have never admitted they have a problem. And the problem is their lead candidate refuses to accept Election Results in a country where democracy is base on the loser fading away and accepting the results of this. And i think its so hypocritical of j. D. Vance to say that democrats or the media wants to talk about this. When the person who talks about this the most day in and day out and complains and whines and refuses to go along with what the voters wanted is Donald Trump, and thats fundamentally the problem. And i want to add something to a previous answer jonathan said when i agree with completely, Donald Trump, we say he gathers momentum when hes under legal problems. He never gathers momentum with Swing Voters. He gathers momentum his base. It helped him with his base against Ron Desantis when he was running in the primary.
