To get her Food And Water after hurricane helene. Good evening. Once again, i am Stephanie Ruhle and we are not just 34 days away from the election. To make a special Counsel Jack Smith. He says his Selection Interference Case against Donald Trump should go ahead despite the supreme Court Ruling on president ial immunity. In a newly unsealed find filing, smith says trump resorted to crimes to stay in office and was fundamentally acting as a citizen, not president. The finally also gives more detail about What Smith found in his investigation. According to a Grand Jury testimony, and aid rushed to trump on January 6 to tell him that an angry mob was threatening vp Mike Pence. Donald trumps response quote, So What. Trumps campaign says the filing is riddled with falsehoods and called it an unconstitutional witchhunt. Tonight the Trump Team filed a motion asking for more time to submit their response. More on this story coming up. It is just the latest headline to a potentially big shakeup in the president ial race. The southeast is still recovering from hurricane helene. Tensions in the Middle East are escalating in a strike is now shut down ports across the East And Gulf coast. Here is Gabe Gutierrez with more. We met tonight, a Triple Threat is looming over the president ial campaign, the rising tensions in the Middle East, a Deadlock Port Strike threatening to raise prices. We are hearing from the folks originally. Reporter and, the devastating aftermath of hurricane helene. Theres a lot of work thats going to need to happen over the coming days, weeks, months. Reporter today, Vice President harris visiting the Storm Zone around georgia, two days after former President Trump went there. With that lets get smarter with the help of our Leadoff Panel tonight. John allen is here. Aaron haynes, editor at large for the 19th and molly john fast, special correspondent for Vanity Fair and msnbc contributor. John, since moments before the show i saw you feverishly moving around candlesticks in the core behind you. Im just so grateful your Table Skipping for the show so you get to go first. Jack smith. Somebody may have forgotten about jack but he didnt forget about us. What sticks out to you . I was just going to say my wife, stephanie, also named stephanie, would kill me if she thought i forgot the pumpkin and skull. And i love them both. Halloween is my favorite holiday so thank you to stephanie. Lets talk about Jack Smith. What stuck out to you in the filing and you think its can have any effect on the 2024 raise . What sticks out in the filing i think is where the fight will be, which is over the discussions Donald Trump had with Vice President Mike Pence and whether those things are allowable as part of the prosecution given that the Supreme Court has made this distinction basically saying that the official asked acts of a president or not something he can be held accountable for so the question is which of the conversations between Vice President pence and President Trump when President Trump was trying to get him to overturn the results of the 2020 election might be admissible and so there is a lot of discussion in this filing of just what Mike Pence told folks. In fact, i thought one of the most interesting things is that he had five pages of contemporaneous notes about one meeting in which the prosecutors say Donald Trump was told by a lawyer that his plan to help parents basically reject the certification of electors was illegal, and so i think we are seeing the outlines of that fight. The other big thing here of course is Jack Smith basically laying out his entire case against Donald Trump with co conspirators, names redacted, but people know who they are and you know, doing that right now before the election, so the question is, that you post about whether this is going to have an effect im not sure that it will. I do think it is a jarring reminder of just what happened during that period of time but i also think most americans have made up their minds about it. It is not something they particularly want to talk about. Last night Jd Vance not only had January 6 brought up to him and i thought it was much more poignant that his commentary on January 6th was the fact that he would not say that Donald Trump lost the 2020 election. That, the possibility of recurrence, i think is a lot more on the minds of voters, particularly democratic voters but also maybe some Swing Voters, then whether Donald Trump is guilty of crimes from four years ago not because of the time distance is so much for just because voters tend to look forward, not backward. Yeah, and some are getting worried about January 6, 2025. Aaron, when you look at hurricane helene, what is happening in the Middle East and the Dock Workers strike what you think could have the biggest impact on the election. We always talk about the october surprise. We are getting a lot in the month has barely started. I think the way that you framed this at the start of the show is exactly right. Theres so much happening in the country, so much happening in the world that is bringing the stakes of this election into stark relief for many of the american people. You know, i do think that President Biden and Vice President harris being in North Carolina and georgia today, that is meaningful. This is what the president does after a disaster. Hes going to florida and georgia tomorrow to see more of the storms impact in this region and this is what particularly this president is known for, given his empathy. You had former President Trump in georgia last week though, surveying the damage. These trips are detour from the Campaign Trail but they do focus Voters Attention onto ongoing efforts to rebuild after this devastating storm in the midst of the Election Season and it shows how a Working President can behave and respond to this moment. I think it does matter. By the way, early voting is about to begin in both of these states is folks are still going about the business of putting their lives back together but with five weeks to go until election day, everything feels political. The Dock Strike you mention, labor is a huge constituency for both Trump And Harrison even if youre not in the union, that is a supplychain issue. Experts say it might not affect people immediately but depending on how long this lasts, it could be something that affects people who are not necessarily part of a dockworker who is trying to push for better conditions for themselves. This could be something affecting a lot more people across the country. Absolutely. Four or five weeks from now they can walk into a Grocery Store in the Produce Section is empty, they could say this is not working for me despite the fact there is little the president can do on this and at this point he said he doesnt want to get in the middle of it. Molly, this time Last Night there were heartaches everywhere. It has now been 24 hours. Cooler heads have prevailed. What is yours thinking . Its interesting because it is almost as if the pundits all said right after it happened that vance had won because he was smoother. He was able to get a lot help her quickly, a lot of it not true, but very smooth and very fast, like someone who has had a lot of experience debating. Meanwhile, walls sort of looked a little bit scared and pale. Perhaps it was a moment for bronzer. No, im just kidding. You know, and there was this sort of kneejerk reaction that perhaps a vance, by lying so effectively and being so sort of congenial in a certain way, may have sold Trumpism Without Trump, which has been sort of the long dream of the Republican Party but i do think that since it has been 24 hours, we are seeing that actually a lot of voters really like walz better, and you even saw that on the right there is a statistic that sort of 25 of the right wingish voters who watched it found they liked walz. So, that midwestern nice, i actually do think translated, and maybe he did not get quite all the hits in, and he was maybe not able to provide the realtime Fact Check in the way that in an ideal world, he wouldve been able to but his personality still transmitted in a way that voters like to make you think vance, if you want to spend time being worried, you can worry about that vance was able to make Trumpism Without Trump seem a little bit more possible and i think that might have implications for 2028. Laid out then, aaron, because Jd Vance came across smart, quick incapable but as molly just said, the things he was saying smoothly, fast and speedily and capably, they were filled with lies. He lied about the nationwide abortion ban. He lied about the affordable care act. He would not confirm the outcome of the last election, so which matters more to Swing Voters . And i cringe when i say Swing Voters because i dont know if i believe there are any swings or undecideds left, but i leave it to you. Yeah, i mean look, i think both candidates pretty much met expectations. I think we know that debating was Jd Vances strong suit. Tim walz said that he was not the best debate about what we think as journalists, as pundits, is not necessarily the same thing that voters think. Which one of these candidates was the one voters found more relatable, right . Former President Trump was really the only person out of the four people we have not seen in a Debate Setting that the american people really are very familiar with. The rest of these candidates are still very much trying to introduce themselves to the american people so i think weve now had a chance to see all four candidates in the Debate Setting and it is unclear whether we will again but i do think having more interviews with Vance And Walz would be helpful but i think what they also do on the Campaign Trail over the next five weeks is probably going to matter a lot more than what we saw Last Night. John, isnt that funny . The rise of Donald Trump in politics we kept hearing over and over, he doesnt speak like a politician. Hes not slick, hes not quick you know, he just speaks like a regular old person and that connects with people. That is exactly what we said about Tim Walz Last Night and he was criticized for them when democrats are slick and fast and cool and elites from Ivy League schools they get crushed for it and that is exactly who Jd Vance is. I dont know. I guess i would look at Barack Obama and say here was a guy who is pretty smooth and quick and adroit on his feet and had education and democrats loved him and a lot of independence loved him. I would say this though, stephanie. I think there was an implicit rejection of Donald Trump Last Night, which is, we saw a normal debate, a simple debate. The debate were both candidates expressed compassion for people who dont share their political affiliation or who dont agree with him on policy and that in and of itself is really the first time weve seen a debate like that in about a decade now since trump got on the scene. I also think that while it is interesting to watch and while there are Permission Structures created, say for on the republican side for people who are already leaning toward Trumpet Trump but dont believe everything he says, nobody is voting in the selection based on these Vice President ial candidates. If you dont know how you feel about Donald Trump, love him or hate us him, if you dont know how you feel about kamala harris, love her or hate her, you missed the movie. That is what you vote on. It will be people going well you know, i really like the cut of Jd Vance is so forget all the things i dont like about Donald Trump or man, Tim Walz, hes so friendly. I like him better and think it would be a better present that then kamala harris. There is nobody saying that. No, but there are a lot of people out there saying that they like or dislike a candidate enough that theyre going to get off the couch and go vote. In 2016 a lot of people did not really know who Donald Trump was. They were excited about something new and different and now we might be excited or not about him but you know every single thing there is to know. Molly, aaron, john. Thank you all so much. John, again, love the skull. Last night Jd Vance told you to think back to the years of the Trump Administration so before we go to break i actually want to do just that because today is October 2nd and i want to give you a reminder of what was going on every October 2nd during trumps presidency, what Jd Vance thinks was the greatest time ever in this country. The country was reeling one day after the deadliest Mass Shooting in u. S. History at a Music Festival in las vegas. The focus was on how to stop gun violence, a member of White House Talking Point said this. Quote, new laws wont stop the madman. In 2018 the Washington Post Journalist was murdered in turkey. Eventually, the cia concluded the leader of Saudi Arabia ordered the assassination but then, trump backed Saudi Arabias rulers and took absolutely no action for the killing. In 2019 trump was fighting the inquiry that would eventually lead to his impeachment. In between, because the investigation bs. In 2020 after months of downplaying the seriousness of the covid19 pandemic, Donald Trump announced that he tested positive for covid and he was then taken to walter reed. That is what the Trump Administration was really like so if youre wondering what Jd Vance was talking about, the trump years, there you have it. When we return, the new evidence on special Counsel Jack Smiths explosive court filing. We are going to get into it. Later, no sign of progress as a Port Strike is underway across the eastern gulf coast. I will talk to Governor Westmore of maryland about the impact it is having across his state. We are still following special Counsel Jack Smiths explosive new filing in the Interference Case against Donald Trump. The 165 page brief includes new allegations about the former president s quote, increasingly desperate efforts to overturn the election. Ken delaney and has the details. Reporter tonight, special Counsel Jack Smith fighting to keep the January 6 case against Donald Trump alive. In a new filing with new evidence, smith tailoring his criminal case to survive the Supreme Courts ruling that president s cant be prosecuted for carrying out official acts, writing that all the trump was president during the frog conspiracies, his scheme was a fundamentally private one, smith also lain out new details about trumps conduct in conversations in the days and hours before his supporters storm the capital on January 6, 2021. After trump began claiming fraud even as votes were still being counted, trump approached an aide saying quote, make them right. The bulk of the findings involve trumps interactions with Vice Spence based on five pages of notes with the Vice President , the Special Counsel same pants gradually and gently tried to convince trump to accept the lawful results of the election including a private lunch in december where parents encouraged him not to look at the election as a loss, just in their mission. Smith arguing trump and pants were political Running Mates discussing private acts, not officeholders contemplating official once. After parents decided not to stop the Certification And Trump denounced a minute tweet, pence recalls a. I. D. S. Telling him he was in danger. As trump said in a private Dining Room watching the capitol riots on tv, and they told him pants had been rushed to a private location. Trump looked at the eight and suddenly, So What. In a statement, trumps campaign called the filing another obvious attempt by the Harris Binary Gene to undermine american democracy and interfere in this election adding that the case should be dismissed. Youre in luck. We brought in the best, Neal Katyal is here. Hes argued 52 cases. It will be 52 next month. Almost 52 cases before the u. S. Supreme court. For a lot of people out there, Jack Smith sadly is a blast from the past. People started to think we would never hear from him again so help us out. This is the most detailed breakdown of his findings yet. What did we learn, and why now . First, ive just got to say you are the best. Thank you for that retrospective you just did about October 2nd because there is so much amnesia about Donald Trump and every day was just nuts, not just covid but the shootings, the deficits, the unemployment, trump trying to sue to get rid of obama care. He certainly did not save it, all that and i think americans really need to remember what happened in the Filing Today by Jack Smith is part of that whole remembrance. It is an exquisitelywritten document. It is really lawyering at its best and it tries to tell the story of what Donald Trump did on January 6 and in the days before it. Now, why do we have this filing . Why is it here . Because the Supreme Court in july said that president s have immunity for their official acts. Okay, so Jack Smith says thats fine. What trump did on January 6 and before January 6, smith argues, is not official. It was him in his capacity as a president ial candidate. The most telling part for smith is to say the constitution is really clear on this. The one thing the president doesnt have power over he has lots of powers, but the one thing he does not have power over selection of the next president for the most obvious of reasons because he is the most selfinterested person in the world. Go back to this point but first i do want to say your phrase, lawyering at its best, you are one of the few people in the world that believes there such a thing as lawyering at its best. Most People Dread the idea. The fact that prosecutors are saying despite the fact that he was president , his scheme, they use the phrase, was fundamentally private. Explain that and what do you make of the argument . What the Supreme Court said is they were worried about government officials, particularly the president , being attacked for doing the job they are elected to do and you know, that is true in other parts of the law, like qualified immunity so like if a Police Officer makes a Mistake Or Something like that generally if it is a true, Bona Fide mistake, it is not something you can have liability for, criminal or civil and that is what the Supreme Court was saying is that the President Act in an official way, fine, no criminal liability. Now what Jack Smith is saying here is okay, but when trump did all this stuff like Pressuring Pence like Ken Delaney and just reported from the smith filing tonight, all that stuff was not part of any president ial power in article two of the constitution. That was a guy who just wanted to keep his job and you know, judge duncan, the judge in washington, d. C. Who released the filing tonight, she now has the really difficult job of trying to decide which actions by Donald Trump or president ial which were personal and the problem is for Donald Trump, the line between public Service And Selfservice is nonexistent. Okay, but the document is supposed to help her, the judge, decide which parts of the indictment survives, so how much do you think prosecutors can save here . I think they can save everything. I mean, it is a totally compelling document. Trump is going to try and file his brief. Its due on October 17th but his Lawyers Today are asking for more time. No surprise there. They are the kings of delay. Theyre asking for five more weeks. Jack smith will then respond to that filing and then Judge Chutkin will decide. I dont think this is actually a very difficult thing for her to decide. I think the case for the president having any constitutional powers in this area is nonexistent, but she will decide and it will go to the court of appeals. It may even go back to the u. S. Supreme court. All of this is part of Donald Trumps Master Plan to make sure he has never had to face the music before the 2024 election because if he wins hes going to pull the plug on Jack Smith on day one. Well, delay is his winning play so we shouldnt be surprised when he runs it. Great to see you. Thank you for joining. When we come back, concerns about the pork strike. Concerns about the economy are growing. Governor westmore will be here to talk about the impact on the 11th Hour continues. Clinic 11th Hour continues. Clinic autumn is here, and leaves are falling. As we mentioned earlier, the White House is keeping a close eye on the situation, monitoring talks between dockworkers and management, saying local officials are also watching to see what happens next with the strike which has closed major East Coast ports, including baltimore, one of the busiest. Lets bring in marylands governor, westmore. Theres a lot i was wanting to talk to you about and i was not expecting the strike this week but here we are. You were a major factor in baltimores port fully reopening in june after the key Bridge Collapse. Now theyre facing the strike. What does it mean for the economy and its great to see you. Is great to see you and you know, this has been a really hard year for Port Workers where you know, The Port Of Baltimore which really is Americas Port i mean, we serve two thirds of this country. It was shut down for 11 weeks because of the key Bridge Collapse and while we are incredibly proud of the speed and historic speed we were able to reopen The Port Of Baltimore and get our work is back on now just months later we now have a strike. I actually spent time today going by and spending time with our core workers. I actually had a call with some of the leadership early on from Ports America and we need to get a conclusion to this quickly because we have to make sure we are both supporting our workers and weve got to make sure the american economy is moving again. This is devastating not just for our families but also for the larger Work Supply Chain and so we need to get to a conclusion to this quickly. What did you learn in those conversations . Do you have any sense of where the two sides are in terms of an agreement . No. And we were not party to the agreement. The thing that we know is we have to get to an agreement and quickly and i know for the workers, they want to get back to work. They know. They understand the importance of maritime industry, it really relies on our workers. It relies on our unions and we also know that for the large corporations, large industries, theres a lot of money thats being lost every day so both sites are incentivized to get a deal done but weve got to make sure we are getting a deal done that is taking care of our workers and our families. Do you think the White House needs to step in . I think the White House has been very involved in one thing we continue to see, even during The Port Of Baltimore, the closing during the collapse of the key bridge, is that you had a White House that has been very focused on making sure our workers are supported, so i think the White House has been and will continue to be very involved but we also know the negotiations that are taking place right now are negotiations that are happening between corporations and also our unions and our workers. All right, no topic. You knew i was going to ask you about last Nights Vp Debate because it was not long ago you were on the Short List to potentially be Vice President , harris running mate. We all watch the vp debate. It might be the last debate for this election cycle. What did you think . I thought my friend Tim Walz did great. You know, Tim Walz, much like me, he doesnt come from a political background, and i think he showed. Hes a teacher. Hes a former sergeant major, and he is someone who speaks directly to people and i think with Jd Vance, you saw someone who was a very skilled debater and Jd Vance did a very good job of actually showing that he is human but he also could not defend policies that are inhumane. You cant defend policies like things like mass terrorism which is going to service essentially amass Sales Tax Increase for families. You cannot defend inhumane policies like getting rid of the Department Of Education are like saying we want economic growth to stem from massive Tax Cuts to billionaires that will somehow trickle down to everybody else so i think tim did a wonderful job of being able to not just defend the Futurefacing Vision for the Harriswalz Campaign but also showing how dangerous project 2025 is and why that should never be policy in the united states. I want to ask you about something potentially happening in maryland. You have spoken about it already. The vigil has been planned for gaza, and it is going to take place on October 7th at the university of maryland. You have said publicly that this vigil is inappropriate. What do you want us to know . Yes, this is a heartbreaking time for our city, and you know, i am a deep believer in the first amendment. I am a believer in due process, and i also know that the Pain And Suffering that has taken place amongst the many innocent women and children in gaza is heartbreaking for all of us. I also know that October 7th, the Year Anniversary of when hamas conducted one of the largest and deadliest terrorist attacks in recent history, is an unwise time to be able to having a protest, that it has to be a time of a larger remembrance of the horrors that hamas inflicted on October 7th of last year. You know, just the past year in my state alone we have seen how hate crimes have increased over 120 , and the majority of them have actually been antiblack, but the second category has been antisemitic. We know we have a larger problem with antisemitic and antimuslim hate that is taking place in our state and my Number One Objective And Priority is to make sure the people of my state are safe, that the students on our campuses feel safe in the places that theyre educated and workers feel safe in their place of work and while i completely understand and respect the first amendment and now there has been significant heartbreak amongst the muslim community i believe that October 7th is an unwise time to be able to have a protest of that type. All right, governor moore, thank you for your time tonight. We appreciate it. Oh, and congratulations. Governor westmore has just been named time magazines 100 next. Im proud of marilyn. Jose, every time i see you i am so grateful for everything you do. Here you are tonight in nashville. Tell us what it is like there. What do people need . Well, its not me, its hundreds and hundreds if not thousands of people that decide you know, in the worst moments of humanity, the best of humanity shows up. Let me give you a very quick few names. [ inaudible ] hot springs, minnesota, fairview, freeport. Pensacola and North Carolina. Those are some of the communities ive been landing in the last few days and what you see is that this is a devastating event for a lot of people. North carolina is one of the most beautiful places on earth. The communities are unbelievable. The mountains, and unfortunately this event has created a perfect storm for destruction, so you have beautiful communities far away from the heart like asheville, where everything is a valley. Every valley has a river, and when you all have so much water at once, unfortunately, those places of heaven became places of hell. Those rivers raised so much that put homes away and unfortunately many lives away but the good thing is that in the worst moments of humanity, the best of humanity shows up, as i said, So What i see as the entire community coming up with ways to take care of loved ones, to bring food, to bring water, to bring medicines, to bring diapers, to bring anything that has to do with helping kids, for women especially, baby formula, dog food. The work is seen here for example from the National Guard, fema, the governor has been amazing. I have a feeling its one of the best responses ive ever seen because this has been one of the worst scenarios ive ever seen because nobody saw it coming, in a way. Even they said the storm was coming, you know, its not the same hurricane is a tropical storm. This is devastating because people were in a way unprepared but this is only five days from the storm and i see that everyday things are little bit better even if we still see Search And Rescue teams looking for people, trying to still risky people. Today i found an entire unit that came from new york, firefighters, Amazing Heroes that are still rescuing people from far away. Difficult to reach communities. This is what i see here, that the best of America In This Moment shows up. That is beautiful. How are you going to get your meals to these cut off communities, right . You are a central hub. Youre going to be cranking out meals but then you have to get them there. How is that going to happen and where is your Team Staying . Listen, luckily when unfortunately, some parts of asheville by the river, theyve been totally destroyed, and is going to be a very big, long reconstruction. As a whole, its in good shape, and this is good news because from asheville obviously is where much of all the aid is going through. In the Asheville Airport its fascinating. You have hundreds of National Guard. You have helicopters from the National Guard in the army. The helicopters are used to reach the impossible to reach communities by road. But once we reach them, the message is clear. We are going to keep coming until you dont need us anymore. That means that at the same time we have teams that try to reach those communities by boat, with the help of every single fire department, with the help of people of fema and the National Guard that they are trying to clean the debris that this huge storm has created. Hundreds if not thousands of roads, its hundreds of bridges broken. The devastation is so huge, but you are creating [ inaudible ] so we keep going so we are doing food by air, by road. We are doing water. We have five very big water tracks that they do over 100,000 gallons a day, then we have smaller tracks. We make sure we reach those communities that need the water in quantities because you cannot keep bringing the water by helicopter Little By little with bottles so we need to start thinking bigger so every time we learn that a road has opened, that a bridge has been repaired, we make sure that we start bringing by helicopter and restart arriving by road. Slowly but surely, still the devastation is huge, but Little By little, like in every event, things get better. By being there next to the people, you give hope to people. The community become stronger. Hopefully we look at the future with hope versus looking at the future and things like that, this is a disaster and this is what i see, that the communities are getting better, that there slowly, surely, people are getting the aid. Today everything looks like a nightmare but hopefully in the future, we look like wow, we made it together. We, the people together, we went through this together. Tomorrow it will be a better day. Well, for people at home were watching this who are grateful for you, and who see the devastation down there, how could they help . What could they do . Listen, many organizations that are helping, we are one of them, with the Food And Water mainly but i know there are other organizations. They should do whatever they do to support. I know the governor. I was with him yesterday. It happens he was landing in the airport when i was there between one of my missions.
