According to Grand Jury testimony, and aid rushed to trump on January 6th to tell him an angry mob was threatening vp Mike Pence, Donald Trumps response, quote, so what . The campaign says the filing is riddled with falsehoods and called it an unconstitutional witchhunt. Tonight, the filed a new motion asking for more time to submit their response. We will have much more on this story coming up. Its the latest headline to a potentially big shakeup in the president ial race. Suffers well, what sticks out in the filing i think is where the fight will be which is over the discussions that Donald Trump had with Vice President Mike Pence and whether those things are allowable as part of the prosecution, given that the Supreme Court has made this distinction basically saying that the official acts of the president are not things that he can be held accountable for by prosecutors, so the question is, which of the conversations between Vice President pence and President Trump when President Trump was trying to get him to overturn the results of the 2020 election, might be admissible, so theres a lot of discussion in this filing, in the filing, of just what Mike Pence told folks in fact, i felt one of the most interesting things that he said, the prosecutor say Donald Trump was told by a lawyer that his plan to have pence basically reject the certification of electors, was illegal. And so, i think we are seeing this sort of outlines of this but the other big thing of course, is Jack Smith basically laying out his entire case against Donald Trump, and you know, with coconspirators, names redacted but people know who they are, and doing that right now before the election, so the question is that you post, about whether this can have an effect, im not sure, stephanie, that it will have an effect. I do think it is a jarring reminder of just what happened during that period of time but i also think most americans had made up their minds about it. Its not something that they particularly want to talk about. In fact Last Night, Jd Vance, had to January 6th brought up to him and i thought it was much more poignant you know, that his commentary on January 6th was the fact that he wouldnt say that Donald Trump lost the 2020 election. The possibility of a recurrence is a lot more on the minds of voters particularly democratic voters but also maybe some Swing Voters than whether Donald Trump is guilty of crimes from four years ago, just because voters tend to look forward, not backward. And some are getting worried about January 6th 2025. But i want to talk more about news of the day. When you look at Hurricane Helene, whats happening in the Middle East and the Dockworkers Strike, what do you think will have the biggest impact on the election. We are getting a lot, with the October Surprise and the month has barely started. The way that you framed this at the start of the show is right, theres so much happening in the country and the world thats bringing the stakes of this election into focus. I do think that you know President Biden and Vice President harris, being in North Carolina and georgia today, that was meaningful for President Biden. He is still in charge and this is what a president does. This is what this president is known for, you have former President Trump in georgia last week surveying the damage, and the thing about these trips, they are a detour from the Campaign Trail but they also do focus Voters Attention on kind of the ongoing efforts to rebuild after this devastating storm in the midst of the election season. And it shows how a president or it would be president would behave. An early voting is about to begin and both of these states in the next couple of weeks and folks are still going about the business of putting their lives back together but with five weeks to go, everything feels political, the Dockworkers Strike puts the issue of Workers Rights back into the conversation, labor is a huge constituency for Trump And Harris and even if you are not in a union, the Supply Chain issue. Experts say it might not affect people immediately but depending on how long this last, this could be something that affects people who are not necessarily a part of, a dockworker who is trying to push for you know, better conditions for themselves, this could be something that is affecting a lot more people across the country. 4 to 5 weeks from now, people are walking the grocery store, if things are really expensive, they are going to look to the administration and say, this isnt working for me despite the fact that the president , there is little he can do on this and at this point he has said, he doesnt want to get in the middle of it. Lets talk about the debate Last Night. This time Last Night there was hot takes everywhere, it has now been 24 hours, cooler heads have prevailed. What is yours thinking . Its interesting because its almost as if the pundits all said right after it happened that vance had won because he was smoother, he was able to get a lot out very quickly. A lot of it not true, but very smooth and very fast, like someone whos had a lot of experience debating. Meanwhile, tim walz was looking a little scared, and pale, perhaps it was a moment for bronzer, no, im just kidding. And there was this kneejerk reaction that perhaps vance, by lying so effectively and being so, you know, so congenial, in a certain way, may have sold trumpism without trump which has been sort of the long dream of the republican party, but i do think since its been 24 hours, we are seeing that actually a lot of voters really liked walz better, and you even saw that on the right, there was the statistic that sort of 25 of the right wing is voters who watched it found that they liked walz. So the midwestern nice, actually think that translated and maybe he didnt get quite all the hits in maybe he was not able to provide the real time fact check in the way that in an ideal world he would have been able to but his personality still transmitted in a way that voters like. And i do think vance, if you want to spend time being worried, you can worry about that vance was able to make trumpism without trump seem a little bit more possible. And i think that might have implications for 2028. Lay it out, because Jd Vance came across smart, quick and capable but as molly just said, the things that he was saying smoothly, and speedily, it was filled with lies, he lied about the nationwide abortion ban, lied about the affordable care act, when confirmed the outcome of the last election. So which matters more to Swing Voters, and i cringe when i say Swing Voters because i dont know if i believe there are any swing or undecideds left, but i leave it to you. Look, both candidates pretty much met expectations if we are evaluating them. Tim walz said he was not the best debater but what we think as journalists and pundits is not necessarily the same thing that voters think. Which one of these candidates was the one that voters found more relatable . Former President Trump is really the only person out of the four people that weve now seen at a Debate Setting that the american people really are very familiar with. The rest of these candidates are still very much trying to introduce themselves to the american people, so i think weve now had a chance to see all four candidates in a Debate Setting and its unclear if we will again but i do think you know having more interviews with fans and walls, would be helpful and i think what they do on the Campaign Trail is going to matter a lot more than what we saw Last Night. You know the rise of Donald Trump in politics, we kept hearing over and over, he doesnt speak like a politician, hes not slick, hes not quick, you know, he just speak like a regular old person and that connects with people. Thats exactly what we said about tim walz Last Night and he was criticized for it. And when democrats are slick and fast and cool and elites from Ivy League schools, they get crushed for it and thats exactly who Jd Vance is. Yeah, i dont know, i guess, i would look at Barack Obama and say he was the guy who was pretty smooth and quick and had an Ivy League education and democrats left him and a lot of independent voters loved him but i would say this, i think there was an implicit rejection of Donald Trump Last Night which is, we saw a normal debate. A civil debate. A debate where both candidates expressed compassion for people who dont share their political affiliation. And that in of itself is really the first time weve seen a debate like that and i dont know about a decade now since trump got on the scene. I also think while its interesting to watch and while there are Permission Structures created, you know, say, on the republican side for people who are already leaning toward trump but dont let everything he says, to look at vance and feel more comfortable about their vote, nobody in this country is voting in the selection based on these Vice President ial candidates. If you dont know how you feel about Donald Trump, love him or hate him, if you dont know how you feel about kamala harris, love her or hate her car you missed the movie. Thats what people will vote on. It wont be like folks being well i really like the cut of that Jd Vance is jib, so forget all of those things i dont like about Donald Trump or man tim walz, hes so friendly, hes like my dad, i like him better and i think he would be a better president than kamala harris. Nobody is saying that themselves, stephanie. But there are people that are saying they like or dislike a candidate enough but they are going to get off the couch and go vote, remember, in 2016, a lot of people didnt really know who Donald Trump was, they were excited about something new and different and now, you might be excited or not about him, but you know every single thing there is to know. Oh back to this point but first i do want to say, your phrase, lowering at its best, you are one of the few people in the world that believes that there is such a thing as that, most people dread the idea. The fact that prosecutors are saying despite the fact that he was president , the scheme, they use the phrase, was fundamentally private. Explain that and what do you make of the argument . So what the Supreme Court said is, they were worried about government officials, particularly the president , being attacked, for doing the job that they are elected to do. And you know, thats true in other parts of the law, with qualified immunity like if a Police Officer you know, makes a Mistake Or Something like that, generally, if its a true Bona Fide mistake, its not something you can have liability for and thats what the Supreme Court was saying was that if the president acts in an official way, fine, no criminal liability. What Jack Smith is saying is, okay, but when trump did all of this stuff like pressuring pence, and all that stuff, that wasnt any president ial power, that was a guy who just wanted to keep his job. And you know, Judge Chutkan, the judge and washington, d. C. who released the filing, shes now got the really difficult job of trying to decide which actions by Donald Trump were president ial and which ones were personal, and the problem is, for Donald Trump, the line between public Service And Self service, is nonexistent. Okay but the document is supposed to help her, the judge, decide which parts of the indictment survive, so how much do you think prosecutors can save here . I think they can save everything. Its a totally compelling document. Trump is going to try and file his brief and its due on October 17th but his lawyers were asking for more time, no surprise there. They are the king of delay, asking for five more weeks, Jack Smith will respond to the filing and Judge Chutkan will decide but i dont think this is actually very difficult, i think the case for the president , having any constitutional powers in this area, is nonexistent, but she will decide, itll go to the court of appeals and it may even go back to the us Supreme Court. All of this is part of Donald Trumps Master Plan to make sure that hes never had to face the music before the 2024 election because if he wins, hes going to pull the plug on Jack Smith on day one. Actually i spent my time today going by and spending time with our Port Workers and i had a call with some of the leadership earlier on from ports around america and we need to get a conclusion to this quickly because weve got to make sure that we are supporting our workers and weve got to make sure the economy is moving again. This is devastating, not just for our families but the larger work Supply Chain, so we need to get to a conclusion to this quickly. What did you learn in the conversations . We are not a party to the agreement, the thing that we know is that we have to get to an agreement and quickly. And i know for the workers, they want to get back to work. They know and they understand the importance of maritime industry. And it really relies on our workers, and relies on our unions. And we also know that for the large corporations and the large industries, theres a lot of money that is being lost every single day. So both sites are incentivized to get a deal done but weve got to make sure we are getting a deal done that is taking care of our workers and the families. Do you think the White House needs to step in . I think the White House has been very involved, and one thing we continue to see even during the Port Of Baltimore, the closing, during the collapse of the key bridge, is you had a White House thats been very focused on making sure the workers are supported. I think the White House has been and will continue to be very involved but we also know of the negotiations that are taking place right now, they are negotiations that are happening between corporations and also our unions and our workers. You knew i was going to ask about Last Night the P Debate because it wasnt long ago you were on the Short List to potentially be Vice President harriss running mate. We all watched the vP Debate. It might be the last debate for this election cycle. What did you think . I thought my friend tim walz did great. You know tim walz, much like me, he doesnt come from a political background. And i think he showed, hes a teacher, hes a former sergeant major, and he someone who speaks directly to people and i think with Jd Vance, you saw someone whos a very skilled debater and Jd Vance did a good job of showing that hes human, but he also could not defend policies that are inhumane. You cant defend policies like things like Mass Terrace which is going to serve as a massive Sales Tax Increase for working families. Think they getting rid of the department of education, policies like saying that we want economic growth to stem from massive Tax Cuts to billionaires that will somehow trickle down to everybody else. So i think tim did a wonderful job of being able to not just defend the future facing vision for the Harris Walz Campaign but also showing how dangerous project 2025 is and why that should never be policy in the united states. I want to ask about something potentially happening in maryland. Youve spoken about it already, a vigil has been planned for gaza and its going to take place on October 7th at the university of maryland. You said this vigil is inappropriate. What do you want us to know . This is a heartbreaking time for our state. And im a Deep Believer in the first amendment. Im a believer in due process, and i also know that the Pain And Suffering that is taking place amongst many innocents, women and children in gaza, its heartbreaking for all of us. I also know that October 7th, the Year Anniversary of when hamas conducted one of the largest and deadliest Terror Attacks in recent history is an unwise time to be able to have a protest. That has to be a time of a larger remembrance of the horrors that hamas inflicted on October 7th of last year. And in the past year alone, weve seen how hate crimes have increased over 120 . And the majority of them have been anti black but the second category has been antisemitic. So you had beautiful communities firing away from the heart like asheville, where everything is a valley, every valley has a river and when your home gets so much water at once, unfortunately, those places of heaven became places of hell. They raised so much that it put so many homes away. But in the worst of humanity, the best of humanity shows up. What i see is these entire communities coming up with creative ways to take care of loved ones, to bring Food And Water and medicine, diapers, to bring anything that has to do with health kits, for women, especially, baby formula, dog food, this is what i see, the work that ive seen here from example from the National Guard, sea, the governor, its been amazing. I have a feeling, it is one of the best responses that ive ever seen because this has been one of the worst scenarios ive ever seen because nobody saw it coming, in away, even they said the storm was coming, you know, its not the same hurricane or tropical storm, this was devastating because people were in away, unprepared. But im amazed, this is only five days from the storm. I see that everyday, things get a little bit better, even if still we see Search And Rescue teams looking for people, trying to still rescue people, i found an entire unit that came from new york, firefighters, amazing heroes, they were still rescuing people from far away communities . You are a central hub. You are going to be cranking meals. Then you have to et go them there. How is that going to happen . And where is your team . Where are you staying . Listen. By the river. They have been totally destroyed. And it is going to be a very big long reconstruction. As a whole, its in good shape. And this is good news. Because from nashville obviously is where much of all the aid is going through. It is fascinating. You have hundreds of National Guard. Helicopters from the National Guard and the army. The helicopters used to reach impossible to reach communities by boat. But once we reach them, the message is clear. We are going to keep coming. And that means at the same time, we have teams that try to reach those communities by road. With Rethe Help of every single fire department. We the help from the people of fema and the National Guard that they are trying to clean the debris this huge storm has created. Hundreds if not thousands of roads. It is hundreds of bridges broken. It is the devastation is so huge. But you are creative. You dont give up. So we keep going. So, we are doing food by air. By road. We are doing water. We have five very big water tracks. That they do over 100,000 gallons a day. Then we have a smaller track. We make sure we reach the communities that need the water. You cannot keep bringing the water by helicopter Little By little with bottles so we need to start thinking bigger. Every time we think the breach has been repaired we make sure k we start bringing by helicopter and start arriving by road. Slowly but surely. It is still the devastation is huge. But Little By little. Like in every event, things get better. By being there next to the people, you give hope to people. The community becomes stronger, hopefully, we look at the future with hope and saying my god. This is what i see. Slowly, surely, people are getting the aid. Today everything looks like a nightmare. But hopefully in the future, it will look like wow, we made it. We the people together. We went through this together. Tomorrow will be a better day.
