Your show. I was. Have a good night. Thank you. We're just 24 hours out from the vice presidential campaign. And already the harriswalz campaign has picked the most important part of that debate. It's really rich for democratic leaders to say donald trump is a unique part of democracy when he overturned peaceful power. Who won the election? i would rather focus on the future. You have a real clear choice of who's going to honor democracy and who's going to honor donald trump. That was an absurd statement that donald trump peacefully turned over power. If you watched the debate you would have seen j. D. Vance trying to put a normalcy. It is hard to defend donald trump's action. There's a lot of bad data points there. Tonight today it sort of feels like the news gods watched last night's debate and saw j. D. Vance appalling answer and decided to highlight the whole issue. Because today a federal judge in washington, d. C. Unsealed a partially redacted a statement from jack smith in which smith lays out why he thinks the case is very much prosecutable following the supreme court's immunity ruling. Smith lays out another new narrative of the case. And that all 165 pages of that, is what reporters and legal analysts have been pouring over all day today. Things like conversations with trump. And vice president mike pence before an angry mob called for mike pence to be hanged. At a private lunch, pence encouraged trump not to see the i election as a loss but as a pause. And trump asked pence what should we do. Trump should take a bow. Trying to get trump to think of his loss as an intermission. Suggests that pence wanted trump to run again and joining him in the future. But it was trump to conclude that mike pence lacked courage. Later in the filing, smith describe's trump's reaction when the capital mob threatened pence' life on january 6th. Upon receiving a phone call alerting him that pence had been taken to a secure location. A staffer rushed to the dining room to inform trump so that trump would take action to ensure pence's safety. Trump looked at him and said only, so what. The vice president's life is in danger and the president's reaction is so what. This new filing further sheds light on just how clencious trump was. Then we learned the degree to which the trump campaign explicitly encouraged violent disruption. Not just at the capital on january 6th. But in states where the vote was still being counted. You might remember this footage of angry trump supporters in detroit demanding access to the secure location where votes were being counted. This shows how trump campaign staffers appeared to active live encourage those people to commit violence. A coconspirator tried to sew confusion when the result looked unfavorable for trump. There when a colleague told that campaign staffer, we take a bunch of votes in trump's favor, right. He said look for a reason to it. When the colleague suggested there was about to be unrest reminiscent of the brooks brother's riot an effort to stop the vote count in florida after the 2000 presidential election. The staffer responded, make them riot. Do it. Joining me now is democratic congresswoman zell lauflin. I'm eager to get your initial reaction to this staunch of new material that the judge has unsealed today. A lot of it quite damming. Well it has detailed that we were not able to get. But i don't think the conclusion is really much different than we reached. This was a plot by trump to keep power in, even though he lost the election. He knew we lost the election. In fact, we found statements going back to april of 2020 where he said, you know, he was going to stay in power. He would not respect the vote. So this was, he never intended to seize power. We were not able to get testimony from the vice president. So there were some things in here that we didn't know. Certainly the who cares statement is shocking but not surprising keeping with his attitude. He called, he assembled that mob in washington. He knew they were armed and he sent them down to the hospital anyhow and he wanted to go with them. He tried to go with them. Congresswoman, the most ex ex explosive. A lot of it is explosive. A lot of people that aren't privy too is the so what statement. Because it is heartless to say nothing of the morals and ethics and being completely unconcerned that your running mate might lose his life in around insurrection you started. And there were 71 instances that trump threatens pence. To the point where they feel like they have to alert the secret service. The threatening of a vice president's life by its very nature can't be part of the role of the vice president, can it? well, it boggles the mind if it is. Clearly as, the prosecutor has laid out, these efforts were in his capacity as a candidate for president. And someone who is trying to keep office and not act as the president. So i think you know it's a compelling case. I think we'll see because if trump is elected president, he's going to order the department of justice to dismiss this case. And the supreme court made clear that any communication between the president and the doj is going to be in that immune bubble. But if he is not elected president, this case is going to go forward i think. And i think a solid case has been made that there's evidence sufficient to proceed and probably to convict. As a congressperson, i wonder how you're processing the details like trump campaign staffers encouraging election workers to make them riot. As we now sit a month before another election when donald trump is once again at the top of the ticket and once again questioning whether the election will be free or fair. Now has an army of poll watchers who are going to do his bidding. What's your concern there and how prepared is congress in the coming months and years ahead if trump is reelected. Well, we did of course make changes in the electoral counter act liz cheney and i were the lead on that to make it harder to overturn the election. Trump has been pretty overt, pretty open that violence is something he appreciates. All the way from urging his followers at rallies to rough up people they didn't like. And encouraging an armed mob to attack the capitol. He uses violence for his own purposes. And he is, threatening i believe to do that again. He sometimes uses code words. But his followers certainly understand what he's saying. They sure do. Congresswoman, thank you for making the time tonight. I appreciate it. I'm joined by chrissy greenburg. Thank you for joining us and helping us understand what was just gifted us by the news gods. It feels like there's three buckets. There's probably more but in all honesty it's probably 360 pages. Three really buckets where the special council is saying these are not official acts therefor, there should be an indictment. We should move forward. This is all stuff he can be held to account on at trial. The first are all the interactions with mike pence. It seems the supreme court has left open the door that some of the conversations and our actions between the vice president and president may just be prosecutable. In the filing, the special council goes out of his way to characterize the conversations as those friends would have. That they are conversations where trump is being encouraged by pence to acknowledge that it's over. Kind of like you would console a grieving friend. That the context and contest of the conversation reflect candid statements. I found it very convincing, reading through their exchanges it doesn't seem like it was a president and vice president talking. It seemed like a schoolyard bully and you know a victim. Like that's how it seemed. You have mike pence calling him on christmas to wish him merry christmas and saying, so you're going to go and certify that election. It was constant to the point that he was saying everybody is going to hate you. He does sound like a bully. Everybody is going to hate you. And you're too honest. The part that just hit me because going back to the intro, where is your part in the 360 page that they knew trump had lost and they knew these election fraud claims were bogus. That right there is one example. You are too honest. Again, it's hard to see how the supreme court can look at those statements and say, that was well within his official acts as president. When pence is talking to trump to try to get him off the ledge. It's not a vice president serving his president. It's a running mate saying, hey bro, we lost. We can try again in 2024. The fragility of this man's ego. It's just reading it. It was just very lame and pathetic but again not seeming very official whatsoever. The next part of it is the ellipse rally. They go out of their way to say this was not an official white house function. This was paid for, i believe by a grocery chain heiress. The special council is trying to establish that everything that happened there had nothing to do with official function. Anything that trump said there would not be deemed official acts, right. Right. And so, i think what jack smith sets up so beautifully when he gets to this point on january 6th. He takes you through days and days of the pressure campaign on state officials. The fake electors scheme. And now everything is failed and this is his last shot. This is it. He's got to get this crowd to stop the certification. Because mike pence isn't playing ball. And so, you know, seeing how donald trump, the words in that context with that fuller context everything that had come up before it, it just seemed so clearly designed to incite this riot. He's not charged with inciting riots but that's clearly where that statement is. How is that presidential. Vance does the same thing. Suggesting this is in no way official. This is completely unofficial. It's fair game for. Judge smith unveiled this. The public is digesting it. It's heavily redacted or partially redacted. Where can trump go from here. They get the chance to re examine the witnesses and confront them. And presumably for a number of these witnesses the way that they are characterized in the filing is not going to be the way that trump is going to characterize them. For example, eric kershman who is not identified by man but you can read between the lines and figure out who he is. He's described as a conduit from the campaign to the white house. Am at some point in 2020 he's actually working in the white house. They're going say, no no, this is official. He's a white house guy. None of this was just within the campaign and the candidacy. And with mike pence, i think it'll be a similar calculus of how much of this was official versus nonofficial. I think with those kind of varied facts and determinations he's probably going to want to hear from the witnesses. Those two witnesses are particularly important because those are the two that jack smith says, donald trump knew he lost because these two people told him and he knew it as of november 13, 2020. You have a lot of statements from donald trump back to them seeming to acknowledge it when hershman says this is not going to hold up in court. And trump says well details don't matter. Things like that. Those are really important facts for the judge. And i think he's going to want to hear it from the horse's mouth. Whatever she decides is going to get appealed and going back to the supreme court. That's a whole other question. Christie greenburg, thank you for your time and expertize. Thank you. Why didn't you answer the question last night during the debate about who won the 2020 president election. Here's the simple reason. The media is obsessed of talking about the election of four years ago. I'm focused on the election of 31 days from now. J. D. Vance might be ready to move on. But a judge is keeping the insurrection. And trump wrote on truth social, democrats are weaponizing the justice department against me because they know i am winning. And they are desperate. Joining me know is miller and sykes. Gentlemen. Here you have it. This is the weaponization of the justice department. This is all joe biden's master plan. Your thoughts. It's amazing how weaponization works. When they're going after the bidens. The most interesting thing that we learned in the filing is just how much jack smith has about donald trump's behavior on january 6th. I think the january 6th committee did such a great job. I didn't know how much more material would be out there. Just kind of scanning what we've seen so far. You know, the knowing what trump was, what he was watching on his phone. Like as the riot was occurring. What the context was when he sent out the mike pence doesn't have courage tweet. The fact that people told him about the threats to mike pence and that he didn't care. There is, even additional information here added on top of the already damming stuff that we learned from the january 6th economy. And so, hopefully you know between that and what we saw from j. D. Vance last night kind of continuing to keep this story in the news as it should be. You know about refusing to say that donald trump lost the election. You know it can, be something that is injected into the public debate in a way that like, a certain demographic of people, probably not viewer of this show but certainly good people haven't been top of mind. Charlie, there's the reality of how damming this is for any former president. But the fact that this person is running again, that election day is in 33 days. I've lost count. And he's out there, saying this, let's play the sound of his you know, his level of confidence about the coming election. Do we have the sound? can we play it? trust the process this time around? i'll let you know in about, 33 days. Charlie, i will let you know in about 33 days. S that is not what you want to hear from a guy who is the subject of a 165 page filing showing his desperate measure of defying the process. You're going to be hearing a lot of this. This filing of jack smith is a reminder of what trump did on violence. But it's also a warning. Because donald trump intends to do it again. And i think that is one of the reasons why this is, you know on really on fire. But also, and you were mentioning just the juxtaposition that the news gods gave us today with what j. D. Vance said last night. Jack smith's filing explains why j. D. Vance was on that platform last night and not mike pence. And it is precisely because j. D. Vance is willing to do what mike pence refused to do. And the really the dramatic take away i have from reading this 165 page document, is the incredible pressure that was put on mike pence. All of the threats. All of the lies that were told to and about mike pence. Then that decision that mike fence pence made for the first time he was not going to do trump's bidding. He's gone now. He's been decommunicated by trump world. And now j. D. Vance is in his place. And j. D. Vance with his nonanswer really confirmed look at the narrative how trump tried to overturn that election. The role that mike pence played and the reason that mike pence is not on the ticket but j. D. Vance is on that ticket. So one of the things that i think that jack smith has done is he has taken the whole january 6th story out of the memory hole that it has been in for the last few weeks. And he's placed it right in front of the voter. Whether or not they're going to consider this we don't know. But the details in this report are dazzling. The narrative is clear, it is compelling. And it is written in such a way that i think nonlawyers can go through it and ask themselves how is it even conceivably possible that donald trump could be president of the united states again? it is a remarkable story and it is a remarkable reminder of the stake's of this election. When we talk about the relevance of the 2020, the capital riots tim it's often seen as i think charlie so rightly points out something that happened in the rear view. But there's a new level of urgency when you see just how much of a suplicant j. D. Vance is to donald trump. And walz saying where is the fire wall. Oh yeah, that guy tried to steal the election and the only guy that tried to stand in his way is now gone. I think the calculation how much this matters. Changes a little bit maybe even if it's just on the margins given the last 24 hours. I was right there. The jim comey letter that was old news too. And it changed things on the margins. Won't know whether that was the decisive thing that happened in 2016 not to trigger anybody. But you know there are late breaking deciders. We've seen this in both of the 2016 and 2020 election. People who don't like either candidate decide really late. It's a small group of people but can be a decisive group of people. The thing that didn't get mentioned last night in the exchange with j. D. Vance. It isn't just a backward looking thing because j. D. Vance's boss wants to pardon the perpetrators of the 2020 riot. It's part of their agenda. It's a key part of their forward looking agenda. Donald trump talks about it all the time. And this is an ongoing effort, looking to the 2024 election. I talked to joe mecina he's doing a super pack called democracy defenders. You would be astonished at how much effort is going in right now to gum up the works. And all of the key swing states by republican officials who are trying to learn lessons from what happened in 2020. This is absolutely a forward looking issue not a backward looking one. For the handful of voters who are maybe former nikki haley supporters or republicans who need to be reminded once more why they should not be voting for donald trump do you think it would be effective for vice president harris to talk about this in whatever way legally she's allowed to on the campaign trail? yes, absolutely. And i think she will. In fact, tomorrow here in wisconsin she's going to be at an event with liz cheney and i think this issue will come up and it will be aimed at republicans. Who have to look at this and say, do we want to go through this again. Do we really want to have another replay of all of this. You know, and especially when you have to confront the evidence that donald trump actually was leading a conspiracy that would have resulted in vaporizing tens of millions of votes including the votes of millions of wisconsinites. That had pence gavel in trump as the winner. When you factor that in, you may have an electoral that says we may not like all of harris' policies, but this is beyond the pale. Harris spent the day in georgia while biden toured both north carolina and south carolina meeting with local officials and thanking aid workers. Super charged by climate change, hurricane helene traveled 500 miles from florida to the southern appalachian mountains destroying hundreds of homes leaving more than a million households still without power and killing 183 people across six states. Today biden and harris announced a series of immediate measures to help people impacted by the storm. Biden ordered the pentagon to deploy up to 1,000 active duty troops to help distribute aid and he announced one time payments of $750 from fema to assist impacted residents in florida, georgia, north carolina, south carolina and virginia. The message of these visits was clear. The federal government is here to help and it is here to stay. My final point to the residents of this community and the region is that, we are here for the long haul. There is the work that we have done together that was the immediate response, preparation for and then the immediate response after. But there's a lot of work that's going to need to happen over the coming days, weeks and months. Days, weeks and months. Now in addition to all the other challenges this recovery effort begins the timing of this storm means that in the middle of all of this, local officials are going to have to make sure people can vote. You might remember a similar situation from back in 2012 when hurricane sandy hit the northeast just weeks before the presidential election. It did not go smoothly. Election day got off to a chaotic start in communities outside of new york city that still do phot have power. When voters arrived at polling places that were not ready. It's a disgrace. I've been here three times. They finally got machines in, now the machines are jammed up. Reporter: and in new jersey, officials could vote by mail. Even before that move, critics were warning of voter fraud and efforts say all of this might end the state of new jersey in court. In any election. Trying to make sure people can vote in an area that's still actively recovering from a natural disaster is, well it's a challenge. But this is not just any election. This is an election where one of the candidates is actively looking for reasons to claim fraud. To claim that any chaos at all is the sign that the election has been stolen. Hurricane helene wreaked havoc on six states across the southeast. Two of which are potentially critical swing states tpwaá georgia and north carolina. Today new polling shows that trump and harris are statistically tied in georgia and literally tied in north carolina. Either state could end up deciding the entire 2024 election so every vote in those states will really count. In north carolina, in person early voting is supposed to start in 15 days and in georgia, mail in ballots are supposed to start going out next monday. I say supposed to, because the north carolina the state is unsure which voting sites will still be usable. And in georgia, the postal service has suspended operations at scores of their facilities across the state. So with 34 days before election day, how are these local officials going to pull this off? especially, with this guy on the ballot. The scope of devastation caused by hurricane helene is still being assessed. The storm's price tag could reach $34 billion. And some of that damage was to the state's election infrastructure including reports of flooding at multiple poling sites. In addition to that, damaged roads could make it extremely difficult for mail in ballots to be collected or sent in. Almost 1 million voters live in the area of north carolina most impacted by helene. A state that trump won by 20,000 votes. First, if you could just tell us what the recovery process is like in your state and how it's going down there. Anyone in north carolina, that needs help or assistance can go to ready nc. Gov and be able to see all of the resources that are available to folks that have dealt with flooding devastation or just the collapsing of homes and communities across the western part of the state. We know folks are still out there in need of those resours. We're really appreciative of governor cooper and president biden and the resources that have given to north carolina already. All of our hearts are out there and the devastation is just stagger. I do wonder because we're thinking about north carolina proceeding hurricane helene as such a critical state in the 2024 election. How optimistic are you that local elections officials can get things up and running in time for voters to start voting in a matter of weeks. We have every confidence in the election process for our state board, you know our board of elections director crimsonbell has called the state of elections board together to give relief to the 25 plus counties that have been impacted by the hurricane and also given discretion to those counties to be able to depict what they need to ask for from the state board in order to be able to get elections proceeding in the right direction. But again, number one effort right now is going to finding and rescuing people in western north carolina. There's still remote parts of western north carolina that haven't had access and have been able to been reached yet because of how hard it is to get to the hollers. And entire roadways have been washed away. Climate change has really derailed the geographical presence that's out there in these communities. And what people in those communities once knew and once traveled. Folks that are familiar with the terrain are actually having trouble being able to find folks out there right now. We trust that the nonpartisan board of elections in our state is going to do everything possible to make sure folks are voting securely. But our first priority is making sure we're finding everybody in north carolina because we know every person matters now. This is about human survival. This isn't about party affiliation. Former president trump is one to cry fraud when there isn't even any. When there was a pandemic that caused thousands of deaths, he was free to use qualm. And using those measures to cry foul and to say the election was rigged. Are you at all concerned that the dispensations that will have to happen. The special procedures whatever needs to happen to give these people the opportunity to exercise their constitutional right to vote. Are you worry about that being seen as an opportunity by the republican on the ticket to cry foul. Look, we've already seen donald trump say that voter fraud exists in north carolina. But what we know right now is we have a board of elections that's made up of nonpartisan and good people from across the state that they're interested in just making sure that every single person has access to the poll and it's our job to make sure that we have got a voter protection effort in the state of north carolina. That anyone can have access to in the state to make sure that you know that your vote is the most important thing to us this election cycle. Anybody right now that's impacted in western north carolina can go to ncsbe. Gov/helene for help and find out where the best resources for you are going to be with voting in this election cycle this year. But again the number one priority is making sure that we're finding everybody in the state. Anyone that's missing somebody in north carolina right now can call 211 in the state and file a missing person's or also being able to do a wellness check on folks right now too. We know there's still huge parts of our state that don't have internet access. We don't know what the extent of these damages will be for polling locations. We're still in assessment change in north carolina. I have trust that our election officials are going to do everything possible to protect that vote this year. Does biden have any leverage left to pull to ensure what he wants, which is a proportional response from israel? the honest answer is no. All politics is local. For biden, the bidenharris administration is four or five weeks away from an election and cutting off israel in any way right now would simply hand a giant cudgel for donald trump and republicans to attack biden and say you are not supporting israel enough. And then for netanyahu, he wants to win this war. He has a tremendous victory with hezbollah and he wants to punish iran now. Do you think, bill cohen from the clinton information administration told our colleague today that the biden administration is handicapped and netanyahu is going to exploit that. How cognizant or how much calculation is being done inside israel visavis the american presidential election? obviously these are domestic politics for netanyahu, but it does deal greatly with whoever will be in charge next year in washington. The cynical view would be that netanyahu wants donald trump to win. Is that cynical or realistic? there is a big divide in israel. In many ways netanyahu is barely hanging on, but there are thousands of israelis who want to move to the northern part of the country and push hezbollah back. Maybe he strikes back more aggressively than in april, but does not overplay his hand. There is no questioning that they have a lot of success. This could be gas refineries they could hit in israel. Nuclear sites. Intelligence headquarters, that is what we saw was targeted in tel aviv and tehran. The differences that are on hit tel aviv. They did not do that in april. It is a dicey time and maybe biden should've acted sooner and pushing for a ceasefire in gaza six months ago but at this point he has little leverage. You paint the picture of how politically untenable it would be to deny israel military aid, but there is also the reality of the war escalating and growing and what david sanger was saying, the door is here, it is at the doorstep. That is also politically somewhat untenable for biden, is it not? i think gas prices, oil prices went up 2% after yesterday's attack on israel, so that is the challenge. One final card that biden can play and it is too late. After the election there is some expectation that he can be very bold. Put a lot of pressure on israel and some grand peace deal that people have talked about when he has less to lose and is talking about his legacy. You think that holds true even if kamala harris wins? do you think biden will make the bold moves of his former running mate will be taking the reins? i do. Shocking. Joe biden i think, i think there is a good chance he will push very hard. His pride has always been foreign policy. He is a big supporter of some kind of two state solution and he will have a chance to do that for several months. Obviously netanyahu could again wait him out, but i think there is a possibility.
