Tonight on all in i said we ought to go to court and we ought to bring a lawsuit because they are going to lose hundreds of thousands of ballots, maybe purposely. Donald trump is doing it again. Those people who cheated will be prosecuted to the fullest extent of the law. Tonight, the republican nominee's plan to undermine a free and fair election. The american people deserve new evidence of a postdebate polling pump for democrats and michigan governor whitmer on the fight for her swing state. And why did the selfproclaimed leader on fertilization allow his party to block federal protections for ivf? they know that and everybody else knows it. I have been a leader on fertilization. When all in starts right now. Good evening from new york. I am chris hayes. Seven weeks to go. Everyone is obsessing over swing state polling on phones and various outlets. Odds for who will win. The reason for that obsession with seven or eight states, oh, new poll in arizona, is of course that we don't elect our presidents by a popular vote in this country. We have a frankly undemocratic system, the electoral college. It is the reality of how american elections for president have worked for 230 years and our citizens and parties and candidates, everyone operating the election works within these constraints. That is how it works. That is one of the ground troops of this election. The other ground truth that defines the selection and the campaign right now is that one of the two candidates has shown us and told us he will not commit to a peaceful transfer of power. The harriswalz campaign is, i think it is fair to say, running uphill, in other words. The thing is, the only option for kamala harris and democrats and the prodemocracy coalition, popular front, the only thing they can do is organize, mobilize and persuade voters. Use democratic means to save democracy and if they win they should strongly defend the victory in court and if they lose, which is a real possibility, they must then peacefully transfer power. That is the way it works. Those are the only options on the table. However, we also should not ignore how nuts all of this truly is. First of all, the electoral college is a genuinely perverse system. A compromise at the founding convention that we commemorate today on constitution day between slave states and small states, everyone else, and it results in a world in which we often end up with what is essentially minority rule. Particularly in this era. Look at the results of the past 30 years. Since the fall of the berlin wall we had eight presidential elections. The democratic candidate won the popular vote every time except one. When george w. Bush was reelected in 2004. Of course republicans have had the presidency more than once as you might recall, thanks to the electoral college. They got three terms in office. 2000, 2004 and 2016, not to mention a super majority on the supreme court. To put it another way, in 30 years the republican party was only able to build a true national majority wants, but they held the highest office in the land for 12 years. It is a pretty sweet deal. And let's look at the last two elections. In 2016, nearly 3 million more americans, more of our fellow citizens voted for hillary clinton then donald trump. Again thanks to the electoral college he became president and in 2020 joe biden one with a popular margin of over 7 million votes. Now the nature of the two coalitions right now and the way it interacts with the electoral college. The electoral college is kind of like a few points handicap for the republicans. Right? an incredible weight on one side. Depending on how this shakes out this year, we will see, kamala harris will probably have to win four or 5 million more votes then donald trump to actually win the election and secure victory and be sworn in as president and then even if she is able to mobilize that big of a majority, which again in a polarized country is tough, and when the swing states to secure 270 electoral votes, what we all know is kamala harris will then have to deal with what will undoubtedly be a fullscale maga republican effort to overthrow the election. The second time in two cycles. Donald trump will rerun his playbook from 2020. He will attempt to use the courts and manipulate state lawmakers and maybe county boards and election officials and manipulate members of congress around certification of january 6. He will target election officials. He will rile up supporters and let's be honest, if past is prologue, likely urged them in his own coded, not so coded way, to violence. He is basically doing this right now. Every day. It is not news anymore, but every day he is doing it. Listen to how he tells his supporters not to trust the outcome of the election in an interview with a rightwing conspiracy theorist yesterday. What we don't have confidence in is how do we stop a rigged election? how do we stop overseas ballots the democrats are talking about, these overseas ballots that will stick in battleground states? the u. S. Postal service endorsing kamala. How do we trust the system and how do we stop voter fraud? i don't trust the system at all. They are horrible, horrible cheaters. They were in the last election and probably in 2016, but they did not cheat enough. To be clear, the postal service did not endorse kamala harris and also lots of americans live overseas, including tens of thousands of active duty service members. They should probably be allowed to vote. Trump followed that up with the social media post avowing, quote, when i when those people who cheated will be prosecuted to the fullest extent of the law, which will include long term prison sentences. He specifically targeted lawyers, political operatives, donors, corrupt election officials. This is a must copy and paste at this point from him doing it all the time, promising those involved will be sought out, caught and prosecuted at levels unfortunately never seen before in our country. That comes the day after election officials in several states received threatening letters containing suspicious substances. Nbc news reports that secretaries of state, attorney general offices and state election offices in nebraska, iowa, kansas, tennessee, wyoming and oklahoma were targeted with packages that contained a white powder. The return address identified the sender as the u. S. Traitor elimination army. Thankfully there are no reports of injuries. Substances appear to be non harmful after testing, but the envelopes caused offices to evacuate. The fbi is investigating and working with the postal inspection service to intercept additional letters and we learned the office of the secretary of state of colorado who i will speak to in a moment received a similar package containing white powder today. That is under investigation by the fbi, postal inspection service and colorado state patrol. 49 days left to the election. Donald trump day in and day out. Not news anymore, but it is happening every day. That is why we are leading with it. Spreading minnis and fieri and undermining foundation structures of elections, making sure his supporters believe the only way the election will be free and fair as if he wins. Looking at faxon other countries you would think that is a country where democracy was under very acute and dire threat. It is not okay. But the only way to preserve democracy is through democratic means. By joining with our fellow citizens to build a majority big enough to win this campaign and preserve what should be our democratic birthright. Colorado secretary of state jena griswold is the chair of the democratic association of secretaries of state. As i mentioned, the secretary's office received one of those packages containing a suspicious substance and she joins me now. First of all i am sorry that happened to you. If you can give us any updates on what happened and how you learned of it. Well, first off, chris, thank you for having me on and thank you for showcasing the continued threat on democracy. So we are the seventh public state to have received the mailing that contained a white powder. Initial investigation shows the powder was harmless, but to contextualize this, this is not the first time these mailings were sent. They were actually sent to multiple states last november and contained a powder laced with fentanyl. So we do take mailings like this as a threat. We discovered this letter for our state today and acted quickly, so it never actually got to our office. It was intercepted prior. But i would say, chris, you rightly mentioned that donald trump decided to once again threaten election officials today, but he also did the last week or so and these threats, the mailing threats, come on the heels of once again donald trump threatening election officials who are just republicans, democrats and doing their civic duty to uphold elections in this nation. It is striking, that list of states, in terms of, you know, the way that the math works in a state like wyoming. In terms of what that states political leaning is, as a kind of aggregate sample. I doubt it is a bunch of, you know, hardcore occupiers of every office in the state of wyoming, to your point. You tweeted that donald trump is a liar. We have great elections. Trump is a threat to our democracy. I think you understandably pinned the blame for these threats on him. We should say we don't know who sent the powder. It is possible it is not who it would appear to be and they weren't inspired by what they appear to be inspired by, but i want to ask, how much cause and effect you see between what is coming specifically from trump and what shows up in terms of what happens to election officials in your state and the secretaries of states that you talk to around the country? donald trump knows exactly what he is doing. When he posts information about election officials, specific secretaries of state, judges, juries, he knows exactly what he is doing and to your point he does not need to say go attack and threaten these people. It is clear enough that that is exactly what his intention is and frankly if he did not know what he was doing initially, he does by now because this is a pattern and i will tell you, chris, his threats have a real effect. Since 2020, colorado has seen a huge turnover in county elected officials, election officials who have stepped down because of the threat environment and we are seeing that across the nation. On top of that i think at the end of the day, donald trump walks the line of skirting accountability. Election officials or anybody standing up for democracy that comes in his crosshairs, i think need to speak out and to pursue prosecution. So i hope the fbi and law enforcement does investigate these letters and any threats that are coming to election officials need to be taken very seriously and i would urge prosecution, because at the end of the day we need elections to be safe and secure and if election officials are afraid to do our jobs, that is a major problem for our democracy and more than that, no one should be threatened for simply doing their job. There is reporting in the associated press today about these threats and preparation to deal with them as we get closer to the election. Across the country local election directors are beefing up security events to get workers and polling places safe while ensuring that ballots and voting procedures won't be tampered with. How much effort, thought and planning is going into this, given the environment that has been created by donald trump across your state and other states? a tremendous amount of effort and the planning to safeguard and fortify elections from the new and emerging threats did not just start this month. It has been ongoing since 2020 and take colorado for example. We are the nation's gold standard for elections and in part it is because we are continuing to innovate. I lead a new law making it a felony to bfa collector. New laws on a. I. And deep fakes. Outlawed guns at polling locations. Made it a felony to try to compromise voting equipment. So we are seeing these new threats and we are acting very quickly and colorado and at the end of the day states need to do everything they can to tighten their procedures ahead of november and to hold bad actors accountable. But to your point at the very beginning, democracy will be saved through democratic institutions and americans at the end of the day have all the power in their hands to safeguard the future of this nation, fundamental freedoms and our democracy at the ballot box in november. (♪♪) we are a week out from the debate, the only debate of the cycle between the two candidates. It happened one week ago today and i am happy to report, you aren't insane. The debate was what you thought it was. Kamala harris sounded like a sharp, prepared, supremely confident individual and donald trump's performance was disastrous. But who knows? the biggest lingering question was with that performance resonate with voters? now we have enough data to say provisionally, yeah, it did. A new poll taken after the debate shows vice president kamala harris up by six points nationally. If you look at the polling aggregate it shows her lead up to about four points nationwide. A suffolk poll shows harris leading by three in pennsylvania, which is within the margin of error, but is a better result for her than she had been getting before the debate. With just under 50 days to election day, seven days from today, a lot can change between now and then. I still think it will be a very close race, but i would say based on the data we have now, a week out, the polls confirm that the laws of political gravity still exist. Margie o'mara is a democratic pollster and strategist. The author of the upcoming book, flip the tables, the everyday disruptors guide to finding courage and making change. As someone who works in polling, if that is your read and again this stuff can be difficult to parse in terms of pollsters, but in the aggregate, that there has been a polling bump and the debate was a win for harris. Surely the debate was a win for harris. Polls taken at the time, afterwards, the coverage people are absorbing and continue to absorb all point to a harris win. That doesn't mean that these small differences in polling averages mean something massive that is substantial that will last to election day. I just wanted folks to caution that. A one or two point advantage on election day is a big win. That is not big in polling. That is a very small adjustment that means there may be some shift and there may not be. Let me ask you because kamala harris i think, you know, had huge expectations and exceeded in the debate. Today she was before the national association of black journalists and did a long interview with a variety of journalists on stage. It seems to me that in those settings she has performed incredibly well and i wonder if you think the campaign should be thinking about her doing more of that? listen, i think she had a robust conversation with the national association of black journalists and i think the campaign should, probably more than likely is thinking about ways she can speak to journalists and have this robust conversation, as well as the american people, because she was able to hold her own. Because as she said at the debate and also said today that she wants to earn people's vote. She is not taking anything for granted, so in the context of us talking about this polling, the mindset of vice president harris as well as the campaign is that we hear these calls, but we will not pay attention to them. We will go out and continue to earn these votes because that is strategically important and they will continue to have these conversations in front of journalists and the american people. One of the things that makes this race difficult to read in terms of where we're at, there are two things. One is the swing states are insanely close. In the aggregate they are all insanely close. There is i think a reliable, national polling lead for the harriswalz ticket, but it is only two or three points which i said in 2016 was not enough. Then there is the question of polling error and obviously in 2020 there was a big error that masked higher levels of republican support on election day than what the polls indicated. In 2022 it went the other direction. Writing about this he says, if the polls error as they do in 2020, trump would sweep the battlegrounds. Conversely, harris would win big if they were as wrong as they were in 2022. It is also possible that they cancel out. All this to say, like, we just don't know. But the fact that we have had a polling error go into different directions in backtoback elections makes it even more confounding. Overtime we have collectively spent a lot of time talking and discussing polling in terms of coverage. Back when i got into this business there was no such thing as the end of journalism. There weren't these polls people were breathlessly covering. There weren't outlets that talk about this on a regular basis. It was a completely different thing in terms of following polling and someone once said and i think still rings true, that polling is something that is designed to measure pounds, but we look at it to measure ounces. That we wanted to show and say this is what is going to happen, but really people are saying what they think they will do. They don't know if they will vote at all, let alone who they will vote for. There are different types of voting across the state. Different motor files and ways to reach people. All of these things, plus the increased use of text and cell phones and online, so there are a lot of complications and every election cycle gets more and more complicated to reach people all of the different ways that people can or don't want to be reached. So i think that is why it is important to think about this as a tight race where undecided voters and decided voters who are watching the debate or any other event are viewing it through the lens of their own partisanship. This is really about making sure people who are less motivated to vote i reminded to go vote and also making sure people feel heard and included in the political process more broadly. To that first point, we moved to the part now where we are just about, i think the north carolina ballots will go out on the 25th. They were delayed, but we are moving there is still a lot of persuasion, but we are moving to the get people to vote, phase of this with early voting. Yes, today is national voter registration day and people are making sure people are vote ready and part is being ready to know which candidates to vote for. The harris campaign has 70 grounds to cover from talking to voters as well as talking to voters through media. The point about polling, the polling got wrong the 2022 midterms around abortion being a top issue. The reality is one in three women of reproductive age live in a state with an abortion ban and that is a key issue not only for democratic women, independent and republican women as well. Black men, vice president harris talked about the polling shift and how she will engage them. You know, the campaign is getting folks vote ready as they are going to the ballot box, while the polls are showing indications that we should watch out for election day. Basically a hosted rally where he only took heavily curated questions. The person in charge of keeping him on message was his former press secretary, sarah huckabee sanders, governor of arkansas. Despite michigan going for trump by over 10,000 votes in 2016, the state has been arguably one of the most successful areas of democratic resurgent, governed now by a democratic trifecta. At the presidential level it is neck and neck with recent polls showing what is essentially a dead even race between donald trump and kamala harris. Michigan's governor gretchen whitmer has been a big part of the resurgent democratic party and is also the author of what i learned about life, leadership and everything in between. Governor, great to have you on the program. Thanks, chris. Good to be with you. I guess i will start with the general vibe check. You have obviously the presidential election, but there is a crucial open senate seat. The democratic nominee there. How do you think things are going? i am optimistic, but i am sober and as i have said, the whole time i've been on the political scene in michigan, elections are always close here. We cannot make any assumptions. We take no vote or vote her for granted and that is why i am proud to be a cochair of the harris campaign because i know she has lived a life like most michiganders. She wasn't handed a huge inheritance. She worked her way through school. She's done the hard work. She dedicated her life to public service and i think that is why we are seeing energy and enthusiasm, but it will be a close race. I saw a question today that was asked about manufacturing. Obviously a very proud manufacturing history. Autoworkers and world war ii and things like that. The question was to former president trump about what the biggest threat to manufacturing was. He answered nuclear weapons and went on a tangent. I didn't get it. I guess the idea is nuclear weapons are a threat to everything, so sure. My question is about manufacturing in your state right now. If you look at the data there is more growth in manufacturing, investment and construction then we have seen in literally a generation. Is that tangible? is it palpable in the state? it is tangible. You can see it. You can see what has happened because of the bidenharris administration work. We are seeing on shoring of supply chains that were so critical to our manufacturing base. We are doing a lot of it in michigan. We do it better than anyone else and we are out competing the world when it comes to chips and, you know, clean energy, batteries, et cetera. This is all thanks to, by the way, the bidenharris administration which got it done. Donald trump, i don't know why he is talking about nuclear weapons when it comes to manufacturing. Maybe he's talking about defense sector. I can't figure it out. But at the end of the day we know how to get things done, we are the heart of manufacturing and there is a resurgence because of the bidenharris administration. Those are good paying jobs. There has been real growth in union jobs in your state. I want to ask about something i talked about at the beginning of the show with secretary of state jena griswold in colorado. Obviously your state has dealt with attempts to subvert the election, either through bullying election officials. There was a plot specifically against you and your life. There are attempts to get fake electors, to intimidate county vote tabulation. What does it mean for your state that the expresident is threatening prosecution and reprisals against political enemies and how confident are you about the integrity of the system you have in michigan? it is the same old line from the same old guy. He runs on grievance. He offers nothing to make michiganders lives better or americans lives better. Contrast that with kamala harris who is focusing on putting money back in americans pockets, making sure every american has a path to prosperity. When you listen to the words that donald trump says, number one they don't make a lot of sense and number two they are never focused on the american people. Are never focused on making your life better. Kamala harris on the other hand has dedicated her life to public service. Wants to put more money in your pocket, bring down the cost of insulin, ensure we have good paying jobs and more people can get into them because we have the skills they need without a lifetime of debt that can come with it. I feel good about that but i feel that the rhetoric is dangerous. I've been calling for people to lower the temperature on rhetoric for years. He has stoked it. It has been a dangerous situation. It is not okay to only call it out when it turns on you. We have all got to stand against this ugliness that has become a regular part of political campaigns where people threaten political opponents and can threaten their lives at the same time. It is unacceptable. You became governor, you were elected in 2018. You took over in 2019. You had to, as a new governor, deal with covid. Both the public health aspects of that, the politics of it. The economic aspects of it and the aftermath of it. What have you learned about the trajectory and are you optimistic that we as a country have learned something as we have gone through these last, say, five years? i am optimistic. I wrote the book true gretch because people ask me that question. How do you stay optimistic? why do you want to keep doing this with 28 recall attempts and historic flooding and a pandemic and attempt to kidnap to kill you. Why do you keep doing this work? there are good things i learned in my life that keep me focused and centered. I am sober, though. We have a lot of work to do. There is no question this will be a close election with high stakes. Whether it is the individual ability to make decisions about our bodies or the ability to make sure our kids have a climate that will sustain their lives and livelihoods for generations to come. After sunday's arrest president joe biden and kamala harris both came out with loud and clear statements against the violence and they were partly alone. The vast majority of americans understand that political violence is wrong on its own and also toxic to democracy and selfgovernance. It is stuff of failed and failing states. There had been, i thought, a broad consensus. It seems clear that political violence is becoming more commonplace in the u. S. , at least recently. Before the attempts against trump, the january 6 insurrection was the most explicit and unnerving example. There have also been racially motivated mass shootings as well as threats against teachers, librarians, election workers. As we told you earlier the fbi said it is investigating threatening packages sent to powder sent with powder in at least seven states. The address identified the sender as the u. S. Traitor illumination army. In ohio government buildings every seemed bomb threats. Elementary schools are locked down. Immigrants are fearful after trump and his running mate j. D. When you have these positions, when you have a microphone in front of you, you really ought to understand at a very deep level how much your words have meaning and we've got to say that you cannot be entrusted with standing behind the seal of the president of the united states of america, engaging in that hateful rhetoric that, as usual, is designed to divide us as a country. The republican party had an opportunity to actually put action behind their words. And you and i both know, the leaders lead. And the way in which president trump rallied republican voters with just republican senators with just a tweet to tank the border security legislation. He didn't say a word. He didn't even tweet or utilize you know truth social to communicate his views or direction that he would give to republicans, senators, and we ended up in the exact same place that the american people were before with their rights and freedoms to make decisions about their own bodies. To expand their families. Exactly where we were prior to today's vote. And it's shameful. And the american people shouldn't believe a world he says. You know, i think one of the things that's a little gaslightty about this whole thing is republicans keep saying that we love ivf. What are you talking about. There's nothing here, and voting to block it. I think the reality underneath that and i am curious if this is how you see it from senators, that there is a large faction of the republican party and the conservative movement that believes a fertilized egg is a person with the full rights under the constitution of your eye. And that invitro fertilization is the same as killing a person. And that the whole process is wrong and made illegal. Those people exist and they do have real power in the republican party which seems to me that this is the reason you're getting the no votes unless i'm misreading the information. You read it exactly right. Senators are having to protect the state law because their state had that same interpretation. Because they said a fertilized embryo was consistent with murder. Here is where we find ourselves. They painted a picture and gone down the road defying the right of people to make their own decisions on their bodies for millions. There's no turning back, they've tried to hide and bend and shape shift every position at every opportunity and today, in the united states senate they had the opportunity to make it clear to the american people that they stand with them and their right to make their decisions and to advance their families and we now know exactly what they believe. You have known senator vice president kamala harris for a long time. You've known her when she was a senator, you've known her from california for a long time. You know her very well both as a politician and as a person. I'm just curious as someone who has known her for a long time. What are you making of all of this? like watching someone you know as well as you know the vice president put in a position to perform in the level that she has to perform at. And so far doing that, what do you think? look, if this were an olympic game she would be sticking the landing. She is doing outstanding. And i am not surprised. I have seen her leadership up close and personal in good times and in bad. Making decisions every single day on behalf of the american people. It is and i'm not surprised chris because it is exactly who she is. And she has been that way a fearless fighter for the people her entire career. And it really is, does my heart proud. But most importantly, i think, you know, for the american people to get the opportunity to get to know her in the way that many of us who have known her for a long time really is speaks to the kind of leadership that our country needs in this moment and for all of those kamala curious voters out there, she's doing a great job extending an invitation to build a new way forward for this country and unite us as a people.
