Before the news last night, his parents said they had not received any updates on his sons whereabouts since they released that video. In a Statement President biden said he was devastated and outraged by his Death And Today the Prime Minister double down solely blaming hamas for the loss of the hostages even as Israels Opposition Government and Hundreds Of Thousands of protesters asked him to set aside his ego and make a deal. The United States has a stake in all of this beyond its quote special relationship with israel. There are several hostages who havent returned home after being captured by hamas. Earlier today i spoke with jonathan, and israeliamerican, whose son is still held in gaza by hamas. Thank you for joining us. I know its been a long and difficult day for you and so many others. I did want to start by asking you if you had heard any updates on the Whereabouts Or Condition of your son either from the american or israeli government over the last few months . No. Unfortunately, i have not. The last solid information we had came in late november or early december and from some of the women in teenagers who were released during the first round of the negotiations, which freed about 100 hostages overall and of those, 40 were from a small Farming Community on the border of gaza so some of the women and children were able to tell us they encountered him and some of the people from our area and at the time he was alive and wounded but that was several lifetimes ago and that is the way it feels. I know there are protests taking place all across the Country Escalating in israel as we speak. We expect more tomorrow. A lot of the anger of these protesters is targeted at the Government Or Cabinet of the Prime Minister for his failure to bring the hostages back and failure to secure a Ceasefire Deal. At this point, do you agree with the focus being squarely on the Prime Minister . Do you believe he is a once the release of the hostages and it being achieved . I have been highly critical of the Prime Minister and his wartime policies particularly around this Hostage Crisis and for many months now. There is clearly a part of the israeli government is or is not playing to complete the negotiation process. That said, we are in this place because of what hamas perpetrated on october seven. By massacring somewhere in the neighborhood of 1400 israelis and taking Hostage 240 and perpetrating mass destruction, hamas set off this horrific chain of events that could have ended at any time starting on october eight simply by releasing the hostages. Hamas could release the remaining 101 hostages in one hour and this would end. Sadly, we dont have an adversary like that who is in the realm of humane so we have to deal with the adversary we have which, again, that of the Negotiating Partner we have and this has been pretty steadfast with negotiating in good faith and certainly getting yes on our part and then to force hamas to say yes or no at the end of the day. Why do you believe, if i may, the israeli Government Isnt Negotiating in good faith as you say . I think in any case it is difficult to negotiate with a fundamentalist terror organization. This isnt even a rogue state. This is a ban of criminals for all intents and purposes and governments dont really know how to do that. We have mediators and that is true. They have done amazing work. At the other end of this, we still have is a terrorist organization that clearly has no regard for the lives of israelis or palestinians for that matter. And from the outset, this was always going to be a difficult thing to accomplish. But i think there is No Doubt at this point, or almost No Doubt, the israeli government and their Prime Minister are driven at least as much by their own personal, political interests and political survival as they are by interests in ending this war. Instead, pursuing the most radical visions of this tiny pocket of far right nationalist politicians that hold our government, the israeli government, in a kind of stranglehold because of Coalition Politics that is our political system. What would you say to the critics of those that say if you get a Ceasefire Deal now and hamas continues to exist after a deal and the release of hostages, you will find yourselves in another october seven situation down the road . Hamas has said they would do october seven over again and right now there are those who say if you take your foot off the pedal and not destroy them completely, even if it is at the detriment of hostages inside gaza, you will live to have more attacks and more terrorism from the Gaza Strip . Look. We are dealing with a very specific country here, israel. We do need to understand as israelis and most of us do that the country was created in 1948 for the express purpose of not killing our neighbors as the first order of business and as a matter of selfdefense of course but the first order of business is to protect our own citizens. Our citizens in the south of the country were abandoned by our government and sadly by our army on october seven and it is inconceivable for any reason to allow them to be abandoned a second or third time and be allowed to die in captivity, which is the pattern over the course of the last few weeks with 12 bodies, 12, is really hostages, whom we know for a fact were live for months and hamas a committee captivity. And their bodies were returned by the israeli army. This isnt an infinite question. We must act now to bring them home now. And Israeli Society itself, aside from what may be a legitimate security discussion, Israeli Society itself is coming apart at the seams of how this government has been handling the Hostage Crisis. The same government that began some of this social dissolution in israel starting in january of 23. And then on october six before the attack in the massacre by hamas, Israeli Society was holding on by a thread in terms of its Coherence And Solidarity because of the wedges that this same government had been driving into our society. Now, with the betrayal that so many israelis feel around the hostage issue, our society will never recover if we cant get as many of them home as possible of the 101 and bring the remains home to be reunited with their families for those already murdered. In my opinion, there isnt a reason for a delay in the sentencing and the sentence can always be shortened or lengthened after the fact. It should go ahead and there isnt a reason why these things that took place during his presidency which related to his personal Conduct And Liability should impact the outcome so the immunity Decision Shouldnt be a key issue. You say he could evade sentencing for ever and i would have to challenge that by saying he could delay it. But eventually he will get sentenced. Even if this means there has to be a retrial because the court somehow said that some evidence came in at the Supreme Court in the Immunity Decision said couldnt come in even as to personal, private, political conduct that is not in any Way Part of his official duties. If he does impose a Prison Sentence, it is tricky because on one hand it tarnishes his image and hold them accountable but on the other hand it makes him political speaking a martyr to a space which we know he is exploited in the past. This could go both ways. What are your thoughts on this . If trump wins in november, he will use whatever power he has to make as many of his legal woes go away. I think you are absolutely right. If he does win in november, not only will project 2025 go into effect, we will see the former president or then new president again basically try to wipe away all of his legal issues. On top of that i think his Delay Tactics will have been effective because he will be in office again. With that said, its one of the primary reasons he runs and not so much he wants to be leader of the free world as much is that is he knows he has legal woes at his back. I do agree what was said a few seconds ago. This is something the former president has used time and again to bolster his base. He has a habit of turning himself into a Martyr Up to and including showcasing means on true social as him like jesus being attacked and his base eats it up and he will use it as a weaponization of the Justice Department and now he wants to say biden is setting him up as much as Kamala Harriss but he runs the risk of doing something now, further isolating women, moderate voters who have not only seen this but also watching what will be the prosecutor. I think it sets up that narrative a little bit more as well. This week there was a Superseding Indictment submitted making changes to fall in line with the Supreme Courts Immunity Ruling and they have opposing timelines moving forward. What would be a realistic timeline for the judge to set. I think the one set by smith is a reasonable amount and this is a case like the facts are obvious and the Superseding Indictment eliminates all the references to any conduct by Trumps President and makes clear the indictment allegations relate to trump as candidate. There is no immunity for the Candidate Trump and even the Vice President is identified as the president of the senate, not as the Vice President. It means that conversations with the president of the senate are not part of the official duties. I think it was a Genius Move on the part of smith to clear it up and make it easy for the judge to now look at the evidence, to have a hearing, see what would be presented to the american people to see that evidence that there is a hearing, and to be able to see what they wont get to see at a trial before we get to the election. I do want to go back to the other question. It is being portrayed as a Win Win whether Donald Trump is sentenced before the election. I think it is a win for the people if it is. It would show Accountability And Justice being done. It is a win for him in terms of his followers. He will either be, as you said a martyr for that will enrage his followers or he wont get sentenced or do something really minor. He will be able to say to his followers who believe it was a big nothing burger. I think we need to see the sentencing happen. A Law Professor took 2x to x and said Jack Smith had the Trump Jump through hoops and do you share that conclusion . Certainly, the courts Immunity Ruling really opened up a new chapter in american history. We have been talking about the imperial presidency for a few decades now and this takes it to a whole new level. I think there will be some true constitutional conservatives there that i think will end up regretting his decision because they have expanded the president s powers in a way that i think our founding fathers would absolutely find shocking. I do think the legal system processes that ruling and the more they do, the more the dangers will be exposed. Lets talk about the sentencing in the hush Money Case. Last Month Trump asked the judge to delay sentencing after Election Day and this week he tried to get it moved to a federal court. Giving all these motions do you think we will see this as scheduled on September 18 . Unfortunately, no. I think that Delay Tactic will work and i dont think right now we will see anything happen before September 18 and that is like 2 1 2 weeks away. I dont think that is possible if anybodys calendar. He was looking forward to it not being and he wants to be in the Campaign Trail and he doesnt want to have the next debate but he definitely wants to be on the Campaign Trail doing anything than having the News Carry conversations about his cases. That hurts him even though he could bolster his base he knows he needs more than that to win. At this rate he is doing whatever he can to push the things and thus far successful. Do we expect to see anything, any sentencing, in the next few weeks were before the election . It is scheduled for September 18. I was just making the argument that for the people, for justice, for accountability, it should proceed on September 18. I cant predict that, especially with that i wont take a position on this sentencing. Its probably something that the judge may take advantage of and postpone the sentencing. Thank you so much. Ayman, i think the point the Vice President made in that clip of the interview you showed is probably the most powerful argument she has, the most powerful instrument she can brandish ahead of the selection. It isnt just in the republican party. We think back about 10 years and all of American Politics has in some way revolved around Donald Trump. What did he say today and who did he insult . How is he undermining the biden administration . How is he undermining people in his own party . That argument she made about turning the page, i think a lot of americans, particularly swing voters and we know that both parties have their basin Donald Trump has a very strong base and so does Vice President harris. But the people who will decide this election in those key swing states, those still undecided voters, with them this idea of turning this page this ugly difficult page in american political history were we have had so much turmoil, so much negativity, so many insults of those being hurled all across the spectrum, but really with Donald Trump being the Focal Point of all of that, this argument is very powerful about turning the page. I think that is why, even though she is an incumbent Vice President. She has passed herself off as a change candidate. The chance of them not going back were very powerful. It is hard to deny that even though trump has been out of office for four years were still living with the impact of his presidency. Also his refusal to concede the election and mishandling of the Covid Pandemic that brought about inflation and caused the deaths of thousands of americans, how can he run away from that record and by painting the selection is a chance to move forward and not go back, do we finally close this chapter on the presence of trump in American Politics over the last 10 years . He could run away from it if people dont ask the questions you did. For the most part, if he can frame his own narrative because he loves to talk in front of the press and he loves to tell his own story which is running a complete front to actual facts but people allow him to get away with it. As long as they asked the questions, i think it will get to the point where it starts and you have to get there quickly because we have a few months with early voting and it is very important to acknowledge that trump set the wheels in motion for a disastrous economic recovery and thankfully Joe Biden in the Biden Ministration have worked fervently to decrease inflation and make sure these jobs are available and turn it into infrastructure. We do know that Donald Trump in his level best to undo democracy at every turn and we know he had a plan to do it after and took shape in states across the country and is working to nullify the vote in georgia right now even though the Election Hasnt even taken place and he appointed the Supreme Court justices and who would overturn Roe V wade and meanwhile he said he wants to support ivf omit the government pay for it. There is a Donald Trump we need to put on blast for the record he created in the deaths or as result of the record with the truth behind the man who continues to lie and that is the job of journalists and those consuming and meanwhile we watch. It will be a very hard thing because Donald Trump is known to lie and lie again but i do think it is very important that we continue to push forward and acknowledge what could happen with a new Trump Administration that will have more people in place to get the job done and in addition he wants those things back to the states on purpose because he created a State Government in many places that is amplified because of the policies and many things that will totally make them become their own kingdom and i think its important we talk about that as well because these people are working to nullify elections and people who have worked diligently to stop medicaid or people have worked a fight against the things done by the current administration to make sure people have good schools and Healthcare And Economy and Donald Trump has to be held accountable to those things. Lets talk about this Arlington Stunt that got worse and the u. S. One of the questions you set out to answer with this investigation was why nobody has been punished for these crimes and walk us through what you learned. What if you found out in your reporting and why has there been no accountability since that massacre . I should say we spent four years doing an exhaustive dive into the story and we reviewed Tens Of Thousands of documents and talk to people and we found that this was really a case handled is all u. S. War crimes are, inhouse. Ultimately the us military substance that despite evidence opted to dismissed charges against three of them and resulted in the final charge with the Squad Leader of the squad accepting a Plea Deal that carries no Prison Sentence and the leader and his lawyer said it was the equivalent of a traffic ticket. Talk to us about the process of having these photographs released and the hoops you had to jump through. I know your team filed a freedom of Information Act Request with the navy years ago and i believe it was four years ago. But what finally gave way for them to be released . What you think of The Ultimate Public Good of releasing them . Like you said, we filed this first one in 2020 and it wasnt getting anywhere so we ended up working with a Law Firm out of chicago, an amazing team there who sued the military to try to get this information for not only the photographs but the whole record of this in the File And Prosecution records and all of it. And we did anticipate a problem. We knew in the past the military had claimed as a reason to keep these photos secret that releasing them may traumatize the Family Members of the people depicted in the photos. We were anticipating that concern with the military and what we ended up doing is talking to Family Members of the dead in iraq and say what you think about having these photographs made public and how do you feel about it . You know, i did talk personally to two men who had lost Family Members that day. They both said they wanted the reporters on our team to have these photos to examine them. Those two men did something remarkable and went house to house and brought a form that would release this to us to the other surviving Family Members and explain the reporting and explain why we wanted the photos and collected of a 17 signature total. We did work with iraq He Researchers and reporters so it is a Team Effort but ultimately led by the survivors here saying clearly they wanted the world to see these and us to see them and decide so we did File It in court and the military relented and in march we received the photographs and we had a decision to make. We wanted to either publish these are not. But we decided to do was to consult with the surviving Family Members. As you said, the photos you see were all published with the permission of the Family Members and the surviving members of the people depicted in these photos. One of the stories of what happened is of course the brutal killings that took place and another story is how in the years that followed the surviving Family Members felt that they were left out of this process and the prosecution and the story. The last thing we wanted in our handling of this classified material was to do that again to these people who had already been through so much. As you said, the families were overlooked, neglected or their stories were never widely shared. You have brought life to that and we havent seen the photographs of that and it wont bring their Family Members back. Does it bring them any kind of accountability to have the spotlight on this story once again years after the incident, or is that less likely now . In terms of what can happen now, the actions are quite limited. The military can only have assertion over those in the military so all of the people involved in this are out of the military. The Icc Isnt really an option as you know because they dont really try people in absentia in the us Government Hasnt been able to extradite its citizens to the hague and there is a limited possibility in some cases for the federal government to intervene in situations but thats caseby case and a difficult road and would require a lot of attention to legal details in the case and it seems relatively on Mike The but survivors have said they want their story to be told and they want the truth to be out there, the public to know that their Family Members were killed that day and they werent insurgents but they were people like you and me living their lives only to have them erupted and ended by this. This is such an important piece of Journalism And One that shed light over a dark chapter in our Countrys History and what happened and thank you to you and every Buddy Else who worked on this incredible reporting and being so persistent over the years to get these photos published.
