Im ali vitali, in for jhonattan lemere. Former President Donald Trump is blasting an indictment against him as a shocking and direct assault on democracy, in his words. Trump fired off that response on social media late yesterday just hours after he was indicted once again over his efforts to overturn his 2020 president ial election. That, of course, being the election he lost. The effort culminated in the january 6th, 2021 attack on it u. S. Capitol. Yesterday Special Counsel jack smith filed a super seed nothing indictment, which was voted on in return by a new federal grand jury. It included the same four charges, though, that trump faced in the original indictment last august. They include conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and an attempt to obstruct an official proceeding, and conspiracy against rights. This revised indictment is intended to deal with the Supreme Courts decision from july that trump had broad immunity from charges relating to official acts as president. And while the charges are the same, some of the evidence has essentially been whittled down in light of that ruling. Specifically, the indictment removes all references to trumps attempts to use the Justice Department to advance his claim of election fraud. And its now written in such a way to highlight that trump was a candidate for office, something that courts have recognized in the past to be private, essentially, nonofficial, conduct. Even if that candidate is the current incumbent president. A source familiar with the Trump Defense team tells nbc news this revised indictment was, quote, not a surprise, again, contradicting what the president wrote on social media, but the legal team did not expect it to be filed yesterday. And as we mentioned donald trump reacted to yesterdays Superseding Indictment with anger. On a series of posts on truth social, trump railed against the revised filing, incorrectly arguing that the Supreme Court had granted him full immunity. He then called it an attempt to interfere with the election, a direct assault on democracy, unprecedented abuse, and the single greatest sabotage of our democracy in history. He also wrote, quote, it is doj policy that the department of justice should not take any action that will influence an election within 60 days of that election. But we got to point out trump is the one who has continuously sought to delay this trial until after the election. Speaking from the campaign trail, trumps running mate, ohio senator j. D. Vance, also weighed in. I dont think that it changes anything legally. I think its clearly an effort to try to do more Election Interference from jack smith. He should be ashamed of himself, but its one of it reasons why we have to win because he should not be anywhere near power. Mean wile, in an interview that aired last night on cbs news, Justice KetanjiBrown Jackson was asked about the Supreme Courts immunity ruling. In your dissent you wrote that the court declared for the first time in history that the most powerful official in the United States can under circumstances yet to be fully determined become a law unto himself. It sounds like a warning. Well, i mean, that was my view of what the court determined. You were concerned about broad immunity. I was concerned about a system that appeared to provide immunity for one individual under one set of circumstances. When we have a criminal Justice System that had ordinarily treated everyone the same. Joining us now is former u. S. Attorney and msnbc contributor barbara mcquade. Barbara, we both eboth know very rare to here from a sitting Supreme Court justice like that. First, i want to get your reaction on this Superseding Indictment against donald trump. We pointed out one of the key differences regarding taking out some of the department of justice stuff that was in the initial indictment, but what else stood out to you here . Well, i think one of the things that is important to note here in complete contradiction to what were hearing from donald trump and from j. D. Vance, the reason that this new indictment was presented to a grand jury and then returned by a grand jury was to make sure that the indictment was untainted by any evidence that has been deemed to be immune. And so the prior grand jury had returned an indictment, but they had heard all of this testimony about abuse of the Justice Department. And so one could argue theoretically that that grand jury heard some things they werent supposed to hear when they indicted that first case. And so to present brand new to a brand new grand jury only evidence that has been scrubbed of any official conduct that could be labeled immune did this grand jury once again return an indictment against donald trump. So i think this is an effort by the Justice Department to act out of an abundance of fairness. Ill also note that to the extent the Justice Department considers the 60day coolingoff period to be in effect with even a Superseding Indictment, were still beyond 60 days. And so theres nothing wrong with filing an indictment at this stage. Yeah, certainly, thats right. And i think that was something that struck me as well, this idea that trump cant go after a jury that has been prebiased to something that is now new in front of them. I think the other thing that struck me as i was reading through this is the ways in which they tried to reallyism up the idea that in this interactions with his Vice President , it wasnt official, the Special Counsel is trying to argue, because it was in pences role as president of the senate and in his capacity as someone who is certifying the election results. All of this leads to the question that judge chutkan is going to have to adjudicate, which is did he rework this enough . Yeah, i think thats right. And i think intrump team will attack this and say all this conduct is official and immune from criminal prosecution. But as you point out one of the things they do here at any many junctures in this indictment point out, for example, trumps speech at the rally was a Campaign Speech that was privately funded, so making it clear this was not official conduct. That conversation with mike pence in his capacity as president of the senate discussing blocking the certification. Even the very first paragraph of the indictment now refers to donald trump not as the 45th president of the United States but as a candidate for president in 2020. And so i think that will be argued, but i think they have paired away all the official conduct now such this should be in good shape to go forward. Well see if the courts agree. Changes big and small. I think now the next big question is what happens next, and on what kind of a time line . Obviously trump is already complaining about it, we pointed out why were here in the first place. What do you think the best Case Scenario is for hearing this as soon as possible . Well, judge chutkan, youll recall, wanted to hear this earlier in august, and it was jack smith who asked for a little extra time. We now know why because he was seeking the Superseding Indictment and needed to get the evidence before the grand jury. Hell be back in court on friday to sort of lay out what the time frame is going to be, and i suspect that judge chutkan, you know, she should be acting without regard to the election. She should be trying to fulfill the publics right to a speedy trial. No doubt this case will not go to trial, but The Next Step to the ball moving is to have that hearing, to go through paragraph by paragraph and decide whether this is free of official conduct that immune, both sides will argue. It may be necessary to actually scour the evidence in the case, but i dont expect what some are calling a mini trial, where they actually put up witnesses to testify. I dont think the prosecution would find that valuable to their case, and i dont think theyre thinking about trying to influence the election. In fact, theyre trying to do anything but. I think on their papers they can submit what they anticipate their evidence to be, the judge will rule, and im sure well see this case appealed all the way up to the Supreme Court before the case is ready to go to trial. But i think at least some of these allegations are going to survive, and so long as donald trump is not president and cant dismiss the case, i think this case will get to trial some time in 2025. You make such a good point here that the courts might not be and that sort of throws the entire system into a different time line and turmoil. Former u. S. Israels Defense Forces released this video yesterday of him traveling back to israel via helicopter after 326 days held hostage. A senior Israeli Military official tells nbc news to carry out the rescue Israeli Forces navigated a Complex Underground System believed to be Holding Hostages along with terrorists and explosives. He was discovered alope in this tunnel by Israeli Forces and was successfully rescue. He spoke to both israels president and Prime Minister yesterday with this video released of his discussion with benjamin netanyahu. His phone call said they worked around the clock to free remaining hostages, adding that, quote, people are really suffering, you cant imagine. Weve seen the continued hostage negotiations, of course key officials are still in the region trying to hammer out these time details. But even as we were talking in the break, its difficult i think for people to discern where these negotiations are even at because theyve had such a start, stop cadence to them. Whats your read on them as someone whos been previous to discussions in a Previous Administration . This is one of the hardest negotiations we have ever seen. This has stymied republican and democratic administrations alike for more than two years. There are two things deeply desired. Netanyahu deeply wants hamas not to have any role in a future government or any role in the governing of gaza Going Forward, and of course hamas wants a recognition and liberation of the palestinian state. Unfortunately, those two things are in opposition at the moment. What israeli want, they have 105 hostages back. Still 105 people held in captivity. Israeli sentiment right now is that netanyahu has not prioritized that in his continued raids and invasion of gaza, that getting hostages back and antiterrorism was the target and real mission, then it would not be a ground war. Thats traditionally not what you do meet those objectives. The challenge is the United States obviously as an ally of israel is being held to account globally and domestically for netanyahus actions. So the United States really wants a ceasefire deal. But they seem to want it more than hamas and netanyahu do. They seem to have a great story being against each other and that allows them to stay in power. Its the way in which politics has always been loom over the policy and negotiations on this. You make reference to not just the policy overseas but the politics very much in play over here as the u. S. Tries to keep people at the negotiating table. I think the fear this region is a tipder box and as we saw once again escalations over the weekend between forces in israel and in other neighboring countries. The fear was that could have exploded into something more. Thankfully, it did not, but when youre looking at that, what else are you looking at in the region drawing your attention right now . Part of it is how the is United States going to have to back up its ally . And we have carrying forces in the region right now, plenty of assets on the saudi side as well as the israeli side of the equation. But you also have israel potentially on a war on two fronts. Thats where the attacks into lebanon become a challenge. Idf and the Israeli Community cant handle the stretch of fighting a war in gaza as well as in lebanon. So the tradition is youll see a tit for tat, you know, a response, a reaction. The goal is always to not have an escalation, something that just seems so out of the ordinary that it will lead to a broader regional conflict. So iran certainly on the hook. Were going to be anticipating that they will retaliate in some way, but the longer and longer that takes, the more diplomats and diplomacy involved, the less that idea will spark that tinderbox. At the same time we receive News Netanyahu and the idf conducted raids in the west bank. Nine people were killed. Theyre climating terrorism and wanting to stamp out terrorism as part of that. While this is all happening domestically, while were seeing the focus on gaza, the idea of a twostate solution relies on actually have some territory in the west bank stay intact for palestinians, and that is further and further away from the case now. Thats all positive news for the trading day ahead, and it really shows that investors are perhaps showing more signs of stabilization, more signs of calmness here after what was a really brutal start for the month for stocks. Of course, we have also seen fed chair Jay Powell Signaling that the time has come to cut Interest Rates state side. And investors see that as a positive fall signal as well we could perhaps see more market gains to come. So the focus on wall street right now is when were going to see that first rate cut and by how much it will be. But at the same time as well, investors also zeroing in and focusing on earnings to essentially justify some of the rich valuations that we see among those megacap tech stocks in the United States as well. Well, you mention earnings there because Earnings Season is in fullswi, and one report today could actually have a major impact on the markets. What is it, and why is that . Okay, so keep watch on nvidia today. It is one of the most important stocks on wall street, at least according to analysts that weve been speaking to. No pressure, right . Expectations are running really high when nvidia reports results after the bell. And remember this is a stock thats already up more than 10 in the month of august. Its actually up around 160 ytd as well, so its very expensive. We need to see those numbers to justify that type of valuation. And when you look at what to expect here, the focus is really going to be on the guidance. Nvidia has been able to impress investors up until now, but theres a saying on wall street. As goes nvidia, so goes the market. And theres a real concern that if we saw nvidia disappointing today, then perhaps it may not be a green light for further market gains. So all eyes are on nvidia. The Crypto Currency Market is experiencing a downturn. Whats causing that to tumble . Yeah, ali, i thought you might be interested in this as well because, of course, a lot of people now exposed to the crypto space. Seeing bitcoin fall below 60,000 usd. Panelists say this move lower was driven by a drop in inthereium. August is, of course, typically a pretty quiet month for risk assets, for equities, and for crypto. But this is interesting because we have seen crypto and bitcoin being volatile all year, but still mostly in a range, trading between 55,000 and 70,000 usd this year, and still up around 40 of ytd. Also holding onto around a 7 gain, so we have seen some money coming out of this market. Again, i think it ultimately all comes back to what we see from nvidia and whether or not were going to see wall street continue to climb higher that will determine whether or not investors feel confident to put money in such a high risk, such a volatile space. The black women in America National poll shows black women across the country overwhelmingly believe this election is more consequential than previous years. The poll found 71 of black women voters agree that this is the most important election of their lifetime. The nonpartisan poll also found 86 of black women say they will definitely vote this election. Thats an 8point increase from last year. Joining us now is race and politics reporter for the hill. Im interested in this data but specifically 71 of black women say this is the most important election for them, the most important election theyll vote in. Feels like every election is the most important, but why this one . Whats different . Whats interesting is the polls showed how so many black women feel democracy is literally on the ballot this year. And so we have seen them point toward things like the overturning of roe v. Wade and concerns around abortion. Theres concerns around education, the economy, of course. Thats the one thing we definitely keep hearing across the board the economy, the cost of goods, lowering inflation, being able to afford groceries. But also part of that, they want safer communities. So were seeing so many constant issues popping up especially with black women of where their top concerns are this year. Its notable when you talk about things like the economy, because i think broadly women are the ones in their household that are usually in charge of the purse strings. It makes a lot of sense, of course, when you then pair that with polling. I think the flip side of this coin is plaque voters are such a central part of the coalition. Its interesting they definitely say they would like to make in roads with all black voters. Were not seeing that often translate, however. We do sometimes hear the messaging might be off, and we often hear them pointing towards the top of ticket and concerns around the rhetoric we hear coming from the former president and that influencing whether or not they feel comfortable volting for the Republican PartyGoing Forward this november. Its such a notable thing you talk about. I remember when i was writing my book, it was very important to point out the gender gap is driven by men becoming more conservative, not women necessarily changing the way that they vote. And so much of the women vote is made up of black women consistently coming back as loyal voters to the democratic party. When you see numbers like this that say more women are plan on voting, they think this is the most important election in their lifetime, what does that tay to you about turn out . Its how much of that coalition they make up. So what i think is going to be really interesting this year is looking to see how much black women are able to encourage other members in their community to show up and cast their ballot. We know this year especially black men are considered a vulnerable population for both parties. Weve heard former President Trump trying to make in roads with them at the same time weve seen Vice PresidentKamala Harris seems to be doing really well with black male voters. So i think the role of black women this election isnt going to be just showing up at the ballot box but how much they can convince other voters to show up this year. How much of that is about Kamala Harris, a black woman herself being on the ticket . That is so amazing, right . We keep hearing how so many women are so excited to cast their ballot for the first black female nominee. Of course a lot of folks are drawing comparisons to when former president barack obama ran in 2008 and the sense of excitement and hope. I think it shouldnt go unnoticed that for black women this is an incredible moment, and i think we saw that at the dnc and the diversity in the audience and how many women were there and how many black women were speaking. Definitely excitement this year. Thats something ive heard from black voters and factor wi. Its going to be Tref Ingterest see how it cuts across lines. Some democrats argue the move shows trumps team is nervous about the sunshine state. The initiative will target young voters on 150 campuses across 11 states including several battlegrounds. I wonder your view on this new push to motivate young voters and what other steps you would advise the harris team to take at this point. Look, i think the harris team is going all in on Younger Voters and i think that matters. It is, though, important to distinguish between College Students which would be genz voters and folks millennials like you and myself, ali. The play for College Students is genz voters. But there needs to be a concerted effort which, frankly, the policy speaks to, and the Economic Policy harris has started to roll out. The chief concerns if you look at it are accountability, if you drill down, its affordability. That is housing, yes, grocery prices, that is the, you know, ability to get a goodpaying job. If you look back to midterm elections in 2022, and you take a peer into wisconsin specifically, and they had a race and a liberalleaning state Supreme Court justice now, because of the efforts to organize across the state of wisconsin but specifically on college campuses. They ran up the numbers there. Yeah. There were polling places there and it made a difference. It will make a difference. Yeah, this divide youre talking about generationally is almost the difference between brat and those of hughes had to look up what brat actually was. Look, the other piece, too, as were watching them build coalitions is the hard politics that tends to dominate here in d. C. One of those narratives is when Kamala Harris will do her first interview. So much has happened in such a short period of time. At the same time, i want to argue with more openness with the press. We now know shes going to do that interview. What do you think the best scenario . And the strategy in waiting to to do this until the first place . In 2020 after Vice President harris, then senator harris name to the biden harris ticket, they did their first interview together ten days after named and that was in a pandemic and what we call a regular election season. Last week, Vice President harris accepted the nomination herself at the top of that ticket. So, i think the timing is spoton, honestly. And when youre putting together Something Like this, you always want something to drive. When i worked for the Vice President , when i work for any other campaign, and i was setting up the media interviews, if youre going to do a big sitdown interview, you want to have something youre bringing to the interview. The thing that harris walz team now, for democrats, thats something to drive the message, maybe were going to see them unveil a new Policy Platform from the harris walz team. But having something to bring to the interview in addition to questions is always going to be key. Im looking forward to seeing how the Vice President bridges that quoteunquote gap if you will between what she said in the last president ial campaign. And the experience in the white house absolutely makes a difference and i would expect she speaks to that for sure. Yeah, bridging that gap which is a lot of us reporters who covered the 2020 race are looking to see the way she judges the bridge in that juncture. We did a segment about black women and the power she hold in the democratic electorate. Of course, the other side of that race coin is the push for white women who do tend to vote more republicans. Can you talk about the ways that the harris walz might appeal to that group of voters knowing full well that black women yeah, the apparatus, their votes are not guaranteed. Weve seen dropoff over the last three president ial elections in terms of the numbers in which black women come out and support. So i am, frankly, looking to see how the Campaign Works to drive up that number. About 90 of black women, give or take voted for joe biden and Kamala Harris in 2020, theyre going to need to maintain or up those numbers of black voters specifically. But white women are going to have to come out and vote, moderate to white women as well. This push for the economy is very important. Economics atop the list for women across the board. But also, youve seen that conservative outreach to moderate women, they need a Permission Structure as michael my friend said. Michael and i are both friends talking about the permission standard.
