Meanwhile, republican candidate donald trump has once again been indicted for his efforts to obstruct the 2020 election. Special counsel jack smith filed revised charges late today coming two months after the Supreme Courts ruling on president ial immunity and remove some of the charges in an effort to save the case. Donald trump has suggested he might back out of the September 10th Event but today he posted on his Social Media Site that he would debate harris as long as the rules are the same as his matchup with joe biden. A Harris Campaign spokesman said quote, both candidates have made clear their willingness to debate with in muted mics for the duration of the debate fully allow for substantive exchanges. Aaron, i want to start with you because you know atlanta and georgia as well as anybody actually down there covering the state. The Atlanta Journal constitution notes this is a big deal because it is outside the atl, the bus tour. That is definitely not atlanta. Its quite a ways from atlanta and the world away in terms of being a very different georgia. This is going to bring a focus on rural america. Its going to bring a focus on workingclass folks, you know, really the kind of people she is trying to highlight and that the Campaign Says theyre focused on the middle class trying to get to the middle class. She has a Housing Add Up today that really taps into one of the most important issues for voters in this election, which is the issue of affordability. People in South Georgia are struggling to make ends meet whether youre talking about gas prices, whether you are talking about housing, whether you are talking about groceries, so to hear directly from the Vice President in governor walz about what theyre going to do something that could be very meaningful not just for people in South Georgia but people in communities across the country that look like those communities in South Georgia. It really says this is where they are choosing to go coming out of that convention. To Focus On Americans who are struggling even as this campaign, so much of it, has been about momentum and joy. Rural georgia is, in fact, in play. Youve got to close those margins across the state if they want to be competitive. Mckay, i want to play what harris is rentable Deputy Campaign manager said about this. We have to be statewide in that state. Even compete in counties democrats dont traditionally go. That is how you win statewide in georgia. This is her second trip to georgia since taking the spot at the top of the ticket on the bus tour again is going to rural areas. Mccain is a little bit about closing gaps and going all over the state. He was the Campaign Manager to senator warnock. Are these kind of plays that might make the trump team nervous . I would have to think so. It was not that long ago at the Republican National convention in milwaukee when Chris Acevedo was Briefing Reporters and talking about how the Trump Campaign was expanding the math and how they were going to possibly contest states like new mexico and virginia, how they were so ahead of biden in Battleground States that they were going to be able to venture ahead of these states trending blue in the battleground cycles. I dont think we are hearing a lot of that rhetoric from the Trump Campaign anymore. The fact that the Harris Campaign is doing this pretty ambitious blitz in georgia suggests that they see a real opportunity there and from the Trump Campaign perspective, if they have to be defending a state like georgia, talk of expanding the map and contesting states like new mexico is probably off the table at this point and it probably shows how much the race has shifted just in the last two weeks. Mckay, one followup. In selecting senator jd vance, that the Trump Campaign also think jd vance was an expansion of the map running mate . To me it suggests that they were doubling down on the base but they heard all the briefings and were very forceful about the fact that not only mexico, but minnesota was in play. Yeah, i think when they talked about jd vance they would say we are just going to drop them in states like pennsylvania, let him move in there and win the state for us. I dont think they necessarily saw vance as somebody who is going to compete in new blue states although minnesota wouldve been one where he couldve contested but i do think they saw him as somebody who could solidify the gains republicans were making in the socalled blue wall states, those midwestern states will trump expanded into other states. I also have the theory that jd vance is a pick born out of supreme overconfidence by the Trump Campaign. You recall at this point biden was still at the top of the ticket. They were writing that disastrous performance biden had had in the debate and i think trump thought he could pick whoever he wanted because he thought he was on track to win. The race looks very different now than it did when he picked jd vance as running mate. Speaking of what a difference a month makes, the harriswalz campaign has scheduled a sitdown interview on thursday thats going to happen in savanna during this bus tour although it is my understanding the savanna stop was a solo stop for the Vice President only. The Vice President s opponents have been calling for an interview. They say that planes i gavels were not enough. Members of the Media Apparatus of been asking for it. Voters have not been defending an interview so what do you think it says that this is gotten scheduled at this time . What is the white house chatter from the press corps . People have been talking about an interview for the last several weeks in part because every White House Reporter wants to get an interview with Kamala Harris. She is the hottest ticket right now in politics because she is new and also because people want to know about various positions she is taken and partly because the Trump Campaign has not been able to land a punch on her and the strategy theyve been using over the last several weeks, say she has to stay on script. She is not good unscripted. Those are the arguments theyre making and now shes met the challenge of saying i will do an interview. Whether or not she delivers on that and how she performs during the interview will be important to understanding whether she can beat back the latest charge from the trump folks because they first charged her with whether or not she is black, whether or not shes asian, whether or not as a woman she can stand before leaders on the world stage. Shes been able to push back against a lot of those arguments and they tried to label her as a liberal. She said im the president for everyone. Now theyre saying she cant do an interview. She is scheduled this interview and whether or not shes able to rise to the moment will determine whether or not the trump folks go to another tactic and try to lend a punch on her in a different way. I was talking to some strategists and reporters today about this. You are a bureau chief. You have to give the marching orders, if you will, to the reporters. Is there a double standard here in some respects because donald trump has talked a lot to the press but he doesnt Tell The Truth oftentimes. Sometimes he doesnt answer questions at all, he will run over the reporters verbally, if you will, but does that make it okay . If hes answering questions but not telling the truth is there a double standard here . Trump is one of the hardest people to interview because he does not have any allegiance to the truth. Sometimes he strays very far from the truth and trying to fact check him in real time is very difficult so he has made a strategy of using the media to put forth his bluster and bowl over reporters and not stop to focus on the facts and so hes been willing to talk to the press in part because he knows he cant be fact checked in real time while Kamala Harris knows that if she does talk to the press some of the things she says are going to be picked apart. Some people would say thats a double standard. As a reporter we want access in every different circumstance because we want Ask Questions that our readers and viewers are asking. They want to know what the candidate thinks but its a very difficult situation when you have one candidate who is not caring about the truth and you have another candidate is going to be picked apart whether or not she sticks to the truth. Theyre operating in very different lines. As reporters we want them to be everywhere talking to the press, talking to reporters to find out what they believe but its a very different circumstance looking at trump or harris. They have two different approaches. Two different approaches to the truth. Im going to start using that phrase, aaron. Lets talk about Georgia Democrats because we did a story on this last night. Theyre fighting Election Rule changes right now. I want to play with their party chair said just today. We saw republicans changing the law. We played by the rules so they change them. Theyve been trying to set this case so they cannot certify a very valid election this going to be in november. Do you think voters are playing close attention to ms. Like this in the states . Absolutely. Georgia voters are very familiar with attempts to make it more difficult to vote in georgia. This is something thats been going on that predated the 2020 election for sure although i think it came to National Awareness after the 2020 election. We are unfortunately in an era of election that comes down to the strategy of Voter Suppression or voter turnout. Georges election was fair in 2020. Georgia continues to make steps to make it more challenging for certain voters to participate equally in the process so that is something certain georgia voters have to be very vigilant about because the very bottom line is for people to have confidence in the system they have to believe their votes are going to count before and after the cast a ballot and that is not necessarily something all voters in the state have gotten. I want to switch topics. This budget model just today predicts that economic proposals would add between 1. 212 trillion to the deficit whereas we take a look at Donald Trumps they would add between four and 6 trillion to the deficit. Do you think harris could use a traditional republican Talking Point of deficits against trump . Are we just too far past that . Ill put this on the screen to be clear. During his first term, donald trump [ inaudible ] double what biden had. Is the deficit conversation one that is going to speak to the voters . I think there is very little evidence voters in either party especially care about the financial deficit. Maybe they should. [ inaudible ] he cares about the deficit. He cares about the National Debt and said he went around to senators in both parties trying to drum up support for some kind of deficit plan and what he heard time and again, including from republicans was look, nobody cares about this. Its not a popular issue. Its a political loser. Were not going to tackle it. Youre not going to get anywhere on this and that was frustrating to him but i think it has proven true. You know, mitt romney, 2012, he ran on the deficit. It was not a winning issue for him. Since then, one of Donald Trumps frankly political innovations was to realize that he could break with republican orthodoxy on these issues at least in rhetoric. The reality is always more complicated. Republican president s have often expanded the deficit but he didnt even try to pretend like he was going to tackle deficit and i think he realizes the voters are going to let them get away with it. I do think though, to a point about republicans, you know, there is a reason a lot of these republicans from the bush campaign, the romney campaign, the Mccain Campaign came out and endorsed Kamala Harris. They dont see donald trump as somebody who is a fiscally disciplined fiscal conservative like those republicans of the past and so you know, that is one of many reasons they dont feel any special loyalty to donald trump as a republican standardbearer. Aaron made the point at the top of the segment that housing is one of the top issues for folks and talk about the economy so maybe we will hear more from donald trump on housing as the Harris Campaign leans in. The last question i want to get into is the border conversation. Donald trump is spending a lot of money and i think his allies are spending a lot of time attempting to attack the Vice President on the issue of the border, the border and immigration of been an issue that has plagued the Biden Administration since they came into office. He is saying that she changed her mind. Republicans are saying she changed her mind on the order wall which is part of the Immigration Bill former President Trump helped kill earlier this year. I remember when the bill was killed donald trump killed it. Do you think this is a salient topic. Top Talking Point for the Term Campaign . Its the best thing they have going right now. They tried to hammer her on the economy and the things that seemed to stick to biden dont seem to stick to harris because she is not the president , she is the Vice President and shes rolling out different policies but on the border she has taken a tougher stance than that Biden Administration are previously taken. Biden said he would sign the bill. Biden said he would sign the bill but there were questions about whether she would continue to push that message after the bill failed in congress. She said as president she wouldnt reopen the negotiation, she would sign the bill just as it is so she has taken a position of strength and force on the border when in the past, democrats have been on their heels, theyve been on defense and now shes going on offense trying to turn a liability for the party into an asset by attacking trump and saying he is undermining the Border Security of the country. I think its clearly an effort to try to do more Election Interference from jack smith. Okay, this comes as trumps other Criminal Cases remain at a standstill. Just yesterday, special counsel jack smith urged in Appeals Court to reject cannons decision to toss out the classified documents case. His Georgia Election interference case has been delayed until after this years president ial election and donald trump is still awaiting sentencing in his new york Criminal Case. Lets bring in harry litman, former u. S. Attorney and Deputy Assistant attorney general. Harry, i was literally at the mall when this happened and im like, what is going on . Can you break down this new indictment for us and how significant it is . Yes, jack is back. The most important thing, all four charges are the same. Smith is saying i can prove this entire case even with less evidence if the court says i have to. If he gets convictions here the penalty is going to be no less than it was before. A jury will decide the same four charges but they wont have the benefit of one big chunk of evidence, everything having to do with trumps interaction with the Department Of Justice, and a few other ways in which he sort of shaved things away, but as jd vance was just saying, it is a fairly bold move on his part to keep pants in there, but the Supreme Court said look, there is a presumption that its official acts and therefore you cant use it but that presumption can be rebutted and smith is coming to chutkin now and saying we can rebut it. Give us a shot to rebut it. We will see what she says. One thing to remember, though, whatever she says, there can still be another round up to the d. C. Circuit, to the Supreme Court but we no longer have the Clock Ticking as we did before because no chance of anything before november. So, the indictment features heavier emphasis on basically how donald trump danced between what our official duties and private duties, but how did the Department Of Justice decide what was and was not an official . I know the Supreme Court and president ial immunity decision did give examples, and one of those examples was conversations with Justice Department officials which is not in there. Honestly, having worked in the Executive Office of the present i wouldve thought the Justice Department conversations were unofficial. I did not know it was official to ask people to investigate a free and fair election. It sure felt that way, right . If this had been the law, what Richard Nixon did in trying to squelch an indictment he wouldve been immune for but the court you know, the doj did but in this one instance the court did say anytime youre dealing with doj that is part of your official duties so they know their they did not have much of a choice. Other places are much more gray, and i think in general, the Department Overall called the gray area in favor of Going Forward aggressively and again, all four of the charges are still there. Hence is the best example of something the Supreme Court sure can say that when trump and pentz are talking its official action and yet, they are ready to say no its not or at least you can say it did not intrude on the authority of the executive branch, a whole kind of standard that the court put out there that is very hard to interpret. That is the hand they have been dealt. Chutkin has an unenviable task. So does the department but they took their best shot and generally leaned forward, tried to keep the case intact. That is the sort of headline here. Before we go, it happens Supreme Court Justice Katanji Brown Jackson spoke to cbs news about the immunity ruling recently. I want to play this for you. In your dissent you wrote that the court declared for the first time in history that the most powerful official in the United States can under the circumstances yet to be fully determined to become a law unto himself. Sounds like a warning. Well, that was my view of what the court determined. You are concerned about broad immunity. I was concerned about a system that appeared to provide immunity for one individual under one set of circumstances when we have a criminal Justice System that had ordinarily treated everyone the same. What do you make of this statement from Justice Jackson . Her book is coming out next week so she is setting up interviews as part of her book tour. A but she will take some heat. People have the dissent. They read them from the bench. She is doing no more than that and she did field the question but you feel its almost kind of poignant that the three in this important case are completely rolled. I dont think what she did is anything different from reading from the bench on your dissent. Nevertheless, it doesnt happen much and people will say oh, she shouldnt be taking this to the press. That is for the dissent does. You publicize your views but the fact remains that those views, and maybe this is part of what she was saying, were given very short shrift by the six person majority that just really steamrolled over it. Hopefully these people can be nudged to get some of the bigger names off the sidelines, you know. H. R. Mcmasters has been doing the rounds this week but has not weighed in one way or the other. Chris christy, we could go down the list. I think this is a good thing. It is something donald trump doesnt have. Its the first step to getting haley voters but i want more. People outside of trumps orbit, h. R. Mcmaster, he worked in the trump white house, he did not weigh in on if he would vote for him but he did say he wont work for him again and then he has this, in my opinion, kind of weird oped in the atlantic when he talks about what trump got right on foreign policy. What does all this tell you from the h. R. Mcmaster perspective . I think there are still instances where some of these trumpaligned folks are trying to straddle the line and have it both ways where they can retain some sense of dignity by speaking out in a minor sense against donald trump and basically trying to have their cake and eat it, too. I think at some point they have to recognize that this is the party. Its not going back to there is not some Sleeping Faction of reagans Republican Party thats going to suddenly spring up again so its up to them to determine right now whether they want to speak out against the trump maga party, which has enveloped the rest of the Republican Party or if they want to continue feeding into it with these halfhearted steps away and really not take the full leap. I mean that is the point you basically made. You know this like look, you recognize some of the names and we might know some of the names in the letter but the voters might not know these folks really well. You said you want more. Will this make an impact on the voters or do we need to see some of the betterknown generals come out who worked with trump . Again, i think something is better than nothing. They saw people in swing states and gone on networks and its part of the grassroots Harris Campaign to in some effort to work at that level and bring up arizona and michigan republicans so i think thats a good thing but yeah, we need more. You mentioned the mcmasters Op Ed In The Atlantic and it was absurd. He is quoting stoic philosophers and how trump has some characteristics like epictetus did, his like what are you even talking about . Donald trump is a clown. H. R. Mcmaster knows hes a clown, like this is not getting us anywhere and i think having some people who saw donald trump up close to say clearly without weasel words or fancy references that this guy is dangerous, he is a bad person and as a result, Kamala Harris is a better option in not only a better option but somebody who is totally appropriate to be president of the United States and within the bipartisan tradition of people who care about her security and rule of law and constitution. I dont think that is to be given ask. We will be watching for whatever. I think these letters are quite interesting in getting people to sign their name on the list. I think it matters but there are a lot of people who assigned the name on another list. Rfk junior, former democrats, trump has tapped them for his transition team. What did you make of these choices . It is the issue that too many people are calling you and your running mate weird and your responses to tapped the guy that is most wellknown right now for taking the carcass of a bear and putting it in his truck. The 52yearold has father of 11 had been working in security in a kibbutz in southern israel when he was captured on october 7. At least 17 were killed during the Terror Attack in october. His family, overwhelmed with joy and relief. We prayed for him, his brother says. My mother prayed for him more. Her prayer reach the sky. Those still in captivity helping for this kind of liberation. Joining me now is ben rose, former National Security adviser for president obama. This kind of rescue is very rare because not only did they just bump into him, but they were in a fight with hamas. He was alone in the tunnels. Just how remarkable is it that this rescue happened . We just havent had similar instances of hostages being rescued in the circumstances before. Dozens of palestinians were killed because hostages were being held in heavily populated area with hamas operatives taken those hostages, so this is overwhelmingly joyous news, obviously, for the family and everybody that has followed the plight of the hostages. At the same time the only significant release of hostages came through a diplomatic agreement earlier in the conflict many months ago now where you had dozens of hostages released in negotiated exchange. That is why the Hostage Family themselves have been focused on trying to get this larger Cease Fire Deal that could unlock the release of potentially dozens of hostages instead of one. This is a very important point because the Israeli Government said this rescue will put pressure on hamas and the peace talks. To your point, the largest number of hostages that came home were due to negotiations, so the missing family form is clear. Negotiated details are the only way to free the remaining hostages. How much pressure is on netanyahu right now to get that done . There has been a tremendous amount of pressure inside israel from Hostage Families who have been very outspoken in believing netanyahu has not prioritized hostages relative to other objectives including the perpetuation of war. What we have seen is the deal that the administration is really been pushing particularly for the last three months since joe biden went out and announced a proposal for a ceasefire would involve the Larger Exchange of hostages for Palestinian Prisoners being held in israeli prisons but also a formula for a ceasefire in the gap thus far between the leader of hamas and netanyahu has not narrowed when it comes to some of the bigger issues, like hamas insistence that the ceasefire be an end to the war in israels insistence that it be a temporary ceasefire that they can resume their Military Operation and maintain Security Control over the gaza strip so it feels tragically like there continues to be this gap between the two sides. The hostages are caught in the middle of this and obviously so are hundreds of thousands of palestinians who are suffering ongoing bombardment and parts of the gaza strip, and now an outbreak of polio. As long as this conflict drags on, hostages and palestinians in gaza are the most Vulnerable People right now. So then, what closes that gap . Every day we are told that talks are continuing in cairo and negotiations are ongoing. Folks are optimistic but cautious and there is no imminent deal but conversations are still happening. How does the gap get closed because there are still americans who are among the hostages that have yet to be released and not to mention the devastation happening in the gaza strip . Its very difficult. We have seen this kind of movie over and over again the past few weeks where the u. S. Gets increasingly optimistic than the goalposts move on both sides at the end of negotiation. I think it is possible hopefully that you get some more limited exchange and release of hostages but on the bigger questions of the future of gaza on whether the war is actually ending on who is going to administer gaza, how gaza is going to be rebuilt, these things are far apart. The u. S. Is far apart from netanyahu on those questions, as well, so part of the question becomes, at what point do you move beyond this effort to get really diametrically opposed parties to all agree to something that can have some permanence versus the u. S. Pushing for an objective to bring war to an end. Biden has really tried to draft up netanyahu and make sure they are pushing something netanyahu signs up for but thus far netanyahu is not willing to publicly stand up for the Cease Fire Proposal that Biden Administration describes.
