If you lived in a democracy where the candidate with the most votes wins, there would be no other republican justice currently serving on the Supreme Court. Clarence thomas would be the only one. The current competition of the Supreme Court stands, in my view and in my view alone, as a stain on americas claim to the world that it is a democracy. No other democracy in the 21st century would seven out of the 50 states decide president ial elections through an electoral contrivance created in a slaveholding country 235 years ago, contrivance they tried to make some serious by calling it a college. Of the Electoral College. The Electoral College gave us this Supreme Court, not the voters. The Supreme Court has given donald trump his immunity, which, in jacks misinterpretation of that immunity decision, still allows donald trump to be charged with all the crimes he committed that were not committed in his official capacity as president of the United States. The indictment stresses donald trump and his coconspirators, were acting in a private capacity. In the new indictment, live trumps coconspirators are people who were not government officials. Rudy giuliani being Co Conspirator number one the other coconspirators were all private lawyers turning Donald Trumps lies about the election and crimes. The other coconspirators are john eastman, sydney powell, kenneth just broke and according to the New York Times, likely boris epshtyn. On page 12 , an advisor is quoted by jack smith describing everything donald trump and his coconspirators were publicly setting at the time as all conspiracy beamed down from the mothership. Leading of our discussion tonight is andrew weissman, former fbi General Counsel and former chief of the Criminal Division in the Eastern District of new york. He is a msnbc legal analyst and coauthor of the the New York Times bestselling book, the Trump Indictment, now in need of an update with a new indictment. Andrew, there is so much to say about this, including how the Supreme Court forced them rewriting of this indictment. What did you see as the way jack smith has tried to thread the needle to get this to trial . So, when piece of interesting news to pick up on your opening, which is for people who are counting, this now makes five grand jurors, grand juries that have decided donald trump is guilty by probable cause of multiple felonies. This is the fifth time he has been charged criminally. Start with why this had to be a new grand jury hearing all of this for the first time. That is a great point. That goes to the question of why now . Why was jack smith doing this . What does he gain from this . One of the things i think heating is taking an argument off the table and trying to say donald trump cant challenge the old indictment by citing the grand jury that charged that didnt know what the law was that it was somehow tainted by evidence the Supreme Court has said it shouldnt here. There may not have been a lot of merit to the argument but this removes that issue about whether there needed to be a new indictment because now there is one. It is a relatively simple process to present a case. They clearly did that. I think it will streamline this arguments that are going to come both at the District Court full and up to and including back to the Supreme Court. This is all an issue if Kamala Harris wins. Otherwise, this is all irrelevant because donald trump could get rid of this in a nanosecond. What does this do to the schedule in the courtroom . We are anticipating a possible hearing or argument about what should be allowed in this case . This, has this rewritten indictment, in effect, has this become jack smith argument about this is what the claim is customer i decided he could have just said we are not going to proceed on the following allegations. This is definitely a cleaner way to do it. Donald trump, as is his want and as a defendant is entitled to raise any and all arguments about he will certainly say there should not be a hearing on this until after the election. We will know on friday whether jack smith says no, we should have argumentative hearings about proceeding on this case before the election. There is no way it will go to trial. You could have a lot of issues decided to. The key thing that happens in terms of what is added and what is subtracted, but is subtracted, as you noted, is all of the obligations about the Department Of Justice in internal white house actions are sort of deleted from this. What is added is lots and lots of language citing mike pence acted as either a candidate or as president of the senate. In other words, not as an official piece of action and that trump was acting in an unofficial way. Donald trump can say i challenge that. I think that is not right. You could have a factual hearing. That is the last thing donald trump once. He does not want a factual hearing, at least before the election. That would lead to people like mike pence being able to take the stand and testify that he in fact was acting as a candidate or he was acting as the president of the senate. That i think, is going to be the battleground it will be interesting to see whether these reports jack smith may not be seeking that kind of hearing before the election, whether that is true or not. It is not totally clear. We havent really heard from the horses mouth. We have really only heard leaks that are coming from the defense side. On friday, we should know whether there will be that type of hearing, which of course, could be really explosive because the position of mike pence and what he has said in the grand jury to jack smith is not public. One basic interpretation of the Supreme Court immunity invention is that the president , when hes ordering people in the Executive Branch who he can boss around, whatever hes doing there, hes immune from crimes. That sort of quick, dirty way of saying it. The trouble with the Vice President is, he is under no obligation at any moment to obey anything the president ever said to him. He is independently elected and he occupies an independent constitutional office. He needs not ever speak to or listen to the president of the United States. So, this dynamic with the Jeffrey Clark and Justice Department officials that may have gotten that scene knocked out of the indictment doesnt seem to have any impact on a very similar scene of donald trump talking to mike pence trying to get him to overturn the election. What donald trump would argue on that point is that is true. What you are saying about the Vice President independent function is true. When donald trump is acting as president in trying to convince his Vice President to do something, as long as he is acting in an official capacity, the Supreme Court has decided that that would, at the very least, be presumptively immune. If it is within his core powers, it is absolutely immune. To be clear, i think that is, to use a technical term, bonkers. That is an outrageous decision. Ketanji Brown Jackson was unbelievably polite in the clip you played in terms of what this means for the country. To be sure, everyone understands the Supreme Court set even though donald trump is alleged in the prior indictment to have Start Schama Criminal Investigations of his opponents, he is absolutely immune to do that. That is the Supreme Court decision. Sham doj investigations, absolutely immune because that is considered by the Supreme Court a core president ial function is seeking sham investigations. Just to say it is to refute it. So, what do you see as a timetable here in this case . I think that judge chutkan has her work cut out for her if she wants to have a factual hearing with evidence before the general election. On the other hand, that is, in large part, one of the things the Supreme Court decisions that she needs to do. On some of these areas, and they said there are factual issues she needs to decide. She could decide shes going to go forward. The issue will be whether she is helped by jack smith position on friday where jack smith says yes, im willing to do that or whether jack smith says no, lets do this after the general election. And so as it goes forward and as judge chutkan decides 31 process or the other what shes allowing to go forward, that trump is going to a motion to dismiss anything in the indictment, she is going to say no and then they are going to appeal it to the Supreme Court. Yes about it will be hard for them to appeal it prior to that factual hearing. Theres no question that they can delay the ultimate trial, again, if Kamala Harris wins. They can be going back to the Supreme Court for an additional ruling. This could take a lot of time. One way i look at this is if donald trump wins, we know this is absolutely going. If Kamala Harris wins, at least there is a chance it will go forward. It may take some time. But, that hearing we are you will hear additional evidence and there will be new material for the public to digest about donald trump and what he was up to so that something for us to go on in terms of what he did, that is something that should happen prior to any potential appeal. Will there be a new edition of the Trump Indictments that will include this one . It would be nice to have something which is a book that is about trump convictions so that we are sort of more at the end of the road. The first step is to see what happened in november. I think of the old law books, which the computerization of all of this has eliminated where they used to stick the supplements inside of the back cover. She could only dream of becoming a doctor, scientist, news reporter, labor leader, factory foreman, College Professor or elected official. She couldnt get a prescription for birth control, have a legal abortion, him out as a lesbian or prosecute her rapist. She could not get a credit card, let alone a mortgage without her husband or father. That is the opening paragraph of Clara Binghams new book the movement, how womens liberation transformed american 19631973. Joining us now is Clara Bingham, author of this brilliant new book , the movement. I want to begin with the question of why this is titled the movement instead of the Womens Movement well, because there are so many different parts of the movement i didnt want to just, i wanted to show it was so big and involved athletes and artists and Health Care Advocates as well as politicians and women to liberation. So, it was such a big movement and that is why i thought the movement was the right title. When you look at all of them antiwar demonstrations, especially in the late 1960s, the phrase there was the movement because in the speaking lineup, there would be the Womens Liberation Movement speakers, there would be Environmental Movement speakers even picketing at that time and of the movement covered everything. Every one of these pushes toward a new enlightenment in this area. This book, you let the liberators speak. It is not you telling us about Shirley Chisholm, it is Shirley Chisholm telling us about Shirley Chisholm. It is an oral has three. They had a lamb, they had a very funny posters and the famous trashcan, where they threw their girdles and bras and aunt did not burn them, by the way. They did stunts all the time. They dressed up as witches. They glued the doors shut at wall street and they let nice out at a wedding pageant. A Wedding Dress ceremony. Just to freak everybody out because they thought weddings were so capitalist. Having written an entire book myself about 1968, i cant tell you how jealous i was when i discovered the miss America Pageant of 1968, which i completely ignored in my study of the president ial campaign of 1968. Theres so much in that one year alone. But also, your frame of 1963 to 1973 in telling this story, why is that time frame . I wanted to pick one decade where you could really see a massive change from beginning to end. 63 was the year of Betty Friedans book the feminine mystique, which was a galvanizing moment, especially for white women. It was also the time when the Civil Rights Movement was on fire in the south. Next year, the Civil Rights Act passed, which had a busy impact on womens liberation later on. But, the and in 73 with roe v. Wade, with the battle of the sexes, when Billie Jean King beat bobby riggs, and with the founding of the National Black feminist organization. It is sort of a happy ending of the book. It is before the backlash begins. Phyllis lashley appears in the last few pages as she zeros in on the e. R. A. , which passed with flying colors in the house and the senate in 1972. So did title ix. It was just the most jampacked 10 year. It is astonishing to see how the equal rights amendment, how popular it was then. Shirley chisholm, at what has come toward the end of the story you tell him year is the first person to enter, First Black Woman to be taken seriously in a president ial nominating convention. She says in the book, when i got to the convention hall, it was lit up by noise. That was a wonderful moment for me to see the way all of that delegates receive for me at the convention because i felt that someday, a black person or a female person should run for the presidency of the United States. Now i was a catalyst of change. Shirley chisholm got 152 delegate votes, you point out at that convention. Amazing. I mean, she really is the for mother for Kamala Harris. Kamala Harris Actually met her when she was running in 1972 and came through oakland and Kamala Harriss mother was an active feminist and was very advanced. Shirley chisholm had to deal with being black and female and she was always very interesting about how important it was to take on both racism and sexism at the same time. She was an early intersectional list. And she was incredibly brave and had to deal with the most horrific racism and sexism when she entered congress in 1969. The white southern men wouldnt sit next to her in the cafeteria. One guy would always spit into his handkerchief every time she passed him. She took on everybody with humor and grace and was very well dressed and feminine, yet incredibly powerful and strong. She was just, you can just feel, the word no doesnt have any meaning to Shirley Chisholm. The book is the movement of the author is Clara Bingham. This is the definitive book about the movement, especially the movement for womens rights in this country, how we got to roe v wade.
