one of those heads of state was in charge as recently as 2022. and in these many cases, the failed autocrats were ousted and exiled sometimes on a path to prison for abuses of power. that's a historical comparison that we should keep in mind for a different development today in washington where a failed coup leader returns to the site of his failed coup. a man indicted for plots to obstruct congress is making his first return to congress since january 6th. donald trump returning to the scene of a now-convicted crime. the violent militia leaders who led the storming of the capitol are currently in prifrp. they have been tried, convicted and sentenced for sedition. that's a grave charge tantamount to treason. trump himself is awaiting his own supreme court ruling this month on when or how he'll face a trial for jack smith against him. while it has swiftly ousted leaders of failed coups and the united states judicial branch is trying to hold this failed coup leader accountable, the news tonight is how the legislative grafrn is failing on this front because while democrats and a handful of republicans did pursue accountability, no matter where it led, most republicans are now embracing trump and minimizing or lying about january 6th, undercutting the very capitol police who protect them and who protected the capitol that day. before cynics pop up and say, well, isn't this just politics? or okay, ari, this is what republicans always do? that's not actually true. so we begin with a pack fact check here to bear witness to the history of that day. members in congress were in grave danger. people died that day and the day after. police were brutally attacked. what you see on your screen is how members of congress had to flee in the first hours after control was regained. republicans and democrats alike stood up to trump's insurrection as republican leader mcconnell called it that very word and the thugs and the mobs that trump unleashed, again, mcconnell's words and that trump was responsible for it. here was the republican response then. >> the united states senate will not be intimidated by thugs, mobs or threats. we will not bow to lawlessness or intimidation. this failed insurrection only underscores how crucial the task before us is for our republic. >> i have spoke tonight president. i asked him to talk to the nation to tell them to stop this. this is not who we are. >> there's no question. done, that president trump is practically and morally responsible for provoking the events of the day. >> trump and i, we've had a hell of a journey. i hate it to end this way. all i can say is count me out. enough is enough. >> senator graham out. journey over, enough is enough. the top house and senate republicans condemning what trump unleashed and refusing to bow. in fact, let's play that mcconnell part again. >> we will not bow to lawlessness or intimidation. >> will not bow. here's senator mcconnell today. politically bowing and shaking hands with the leader of what he called an insurrection. that's today. a long ways from the january 2021 statements where mcconnell's team is telegraphing the very next month that trump committed impeachable offenses and that democrats moved to impeach trump would make it easier to purge trump from the party. impeachable offenses are high crimes, mcconnell was saying trump was guilty of high crimes and that would help purge trump once and for all. he said trump was morally responsible for the insurrection. that was mcconnell then and here he is today. so today marks a key moment in history and in an era where images and memes can matter more than the words or what it might feel like receiving history and let alone re-written history which i'll return to and the top republican embracing the convicted candidate and embracing it as if mcconnell's own moral denunciations do not exist. although mcconnell has been at the top and currently is the top officeholder at the senate. he's not running for office anymore. he doesn't need to go out like this if this is how he's going out. joining this parade of republicans who know better which is a public fact because they told us already they know better. >> con artist is about to take over the republican party and the conservative movement and we have to put a stop to it. >> this man is a pathological liar. >> he's a race baiting, zeen phonetic, religious bigot. >> the man cannot tell the truth and he combines it with being a narcissist. >> i think he's a kook. i think he's crazy. i think he's unfit for office. >> the man is amoral. >> his policies are bad for the country. >> his reaction to everything is to throw a fit. >> those warnings came true. trump's approach to lying did go beyond political hyperbole or what politicians do. trump ensnared his lawyers and allies at fox news and some of the most costly defamation punishments ever. lies that formed the propaganda arm for the crime spree that stretches from his '20 campaign on the right and that's all about january 6th and the assorted plot to overthrow the election to the right to other enterprises and campaign, number one all of those convictions. the kind of thing that attorney mike johnson warned about in calling trump unfit for office back in 2015. he's now the speaker of the house and here he was today. >> said very complimentary things about all of us. we had sustained applause. he said i'm doing a very good job. we're grateful for that. >> that's why today's return to the capitol matters. return to a literal crime scene and it's very different from how other countries have recently dealt with these kind of failed coups. at this meeting, trump reportedly trashed the host city of the republican convention, the kind of attack on fellow americans that used to be a big political gaffe repeat his attacks on the doj while speaking inside the very capitol where he unleashed the crimes at the center of this trial at the doj. and the republicans who once criticized trump now bend the knee so completely it's a reflection of kind of total craven knee-bending to power that's so brazen, it's more commonly seen in fiction and film than a real world display like we saw today. >> come to king's landing, bend the knee or suffer the fate of all. >> bend the knee, and i will name you warden of the north. >> you're a rival. >> bend the knee. that's why they're rulers. >> no. >> bend the knee. the u.s. is still a constitutional democracy, however, not a kingdom. our constitution makes congress an equal branch of government and not some subservient arm of the president and let alone a former president, let alone a felon, let alone a coup leader returning to the congress he attacked. trump and his allies in congress tried to lie to people to get them to commit violence that day which happened. now they're trying to control and re-write that recent past, and there is nothing new about these authoritarian tactics. george orwell said it best. you can say it better, he said who controls the past controls the future. who controls the present controls the past. >> he meant that people's understanding of the past will define their politics and what they will do and what they will allow and what they will put up with going into the future. so demagogues ypically try to re-write history and it's parts of the ongoing propaganda campaign. remember, the attack is and was still a very significant, big deal. >> that's why they have to lie about it. if people didn't care, they might have moveded on and it was to recast the convicted felon and to continue over what happened over time. now star witness cassidy hutchinson, his own secret service agents who stopped him trying to protect his own safety that day. you may recall if you followed the news, while trump team was attacking her as a liar to try to discredit her account. her testimony. nowadays, trump has shifted from running from the jan 6th attack and they initially did because they thought it was so bad they had to do something other than admit it to now making a bet that his side has accepted thissor well spin i'm telling you about to completely re-write the past so that the president might forge him a path to power in the future and they've done that so much that now trump does admit trying to join that now did make it in. welcomed by the lawmakers that his fans had targeted with violence and worse, potential assassination. that's a crime spree that includes over 1,400 people indicted for crimes that >> a republican obstruction there against even holding that vote is at odds with how so many republicans were scrambling to claim they were pro-ivf after an alabama court issued a ruling that it was going to ban the practice and that cited skrupt scripture and god. they found that so extreme and they quickly passed a law allowing the procedure and what the court would have done. senate democrats say they would like to pass this tonight, but if republicans keep stalling and obstructing it, then the democrats will take what's coming out of this which are headlines like this. these are brand-new headlines in the last couple of hours the fact that republicans are obstructing the basic protection of ivf and if you want to keep track of how extreme some of the senate is, keep in mind that in the land where we are divided on so many things 50/50, where this presidential race is up for grabs, a whopping 82% of americans ivf, this method of having children which is so helpful for some families, 82% say it's good, fine, quote morally acceptable. kimberly maguire of the reproductive rights move and you're going to be with pro-choice activists. thank you for joining us. >> happy to be here. it's been a busy day. >> your view on the effort to protect ivf on the senate floor today and the republicans are walking that. >> you know, this is deeply personal for me. i'm a current ivf patient. i am also the leader of an organization that is committed to defending the full range of reproductive health life injustice for yung people across this country. it is shocking the way that some politicians have chosen to play politics with our health. there should not be interference with folks using medical science and healthcare to build the families of our choosing. so i think it's been really clear the conservative agenda is anti-ivf and any attempts to say different is a smoke eye screen. >> as for the the vice president hairs responding. >> two-thirds of women in america live in a state with a trump abortion ban. this ruling is not going to change that. this ruling is not going to change the fact that trump's allies have a plan that if all else fails to eliminate medication abortion through executive action. >> the vice president speaking there on the stakes, and we've seen a lot of indications that people and women care about this including in very conservative areas and maybe it scrambled some of those so-called categories. i wanted to get your reaction to the ruling and what does it tell you that there was a headline here, to me, legally it seems like the conservatives who have been very activist on this issue actually realize or found they wanted to sidestep it. you don't need to go this far just to back down on standing. >> yeah. i -- i'm not really celebrating the way that it was framed today. i'm glad people can use safe and effective methods like abortion pills, right? we need these methods to be available and it doesn't change the fact that two dozen states have banned or restricted merely off a possibility of access to abortion care. the justice have a larger plan and that is to make abortion as inaccessible as possible. it doesn't change anything what they did in the past with overturning of roe v. wade and we remain concerned on the court's upcoming decision and how sick pregnant people have to get before they can get emergency care. so they will continue to unfortunately, play politics with our health. >> how big of an issue do you see this being in november because there was a whole host including democrat see, itself where do you see this fitting in? >> i am proud to have led two successful ballot campaigns to protect legal abortion in kansas and ohio, and what we saw in both states which are thought of as red and conservative is a strong majority of people are shocked and outraged by the loss of legal abortion and they have consistently been voting on this shock and outrage. we saw immediately after dobbs with our victory in kansas. we saw it last year with with our victory in ohio and many more voters will be coming to the attack of our reproductive health care. ? my guess is sort of straightforward, but i'm curious what you'll. made ways, and he expects her good choices. we've quoted some women's rights leaders on it, but how do you think that landed with your organization and the people you work with and do you think and i word it this way to ask seriously, do you think he was trying to be rude or provocative or is that a touch? democrats have found new, familiar, this is new, three more secret luxury trips that clarence thomas took from republican mega donor harlan crowe. crowe's own records which on oversight had to be turned over here show what you see on your screen flying on his private jets from washington to georgia and a third newly revealed trip from washington to california, criss-crossing on a billionaire a dime. it first led to a report on all of this and they revealed that for over two decades, thomas has been taking these luxury trip, most, though, secretly hidden. there are problems and then there are clarence thomas. this is a level of grift that as you've heard me say before any member of congress would find themselves and these justices find themselves above the law and the rules. the man hiding secret luxury travel and also likes to lie and claim that what he really prefers is to stay off of airplanes altogether to say nothing of private jets and rv parks. >> the rv parks, i prefer the walmart parking lots to the beaches and things like that. there's something normal to me about it. i come from regular stock, and i prefer that. i prefer being around that. >> no, he doesn't. i can't stress this enough. the way that clarence thomas almost like a politician or some, you know, corporate figure has laundered this and publicly misled about what he prefers is itself a kind of tell. while he was giving these interviews and while he's talking this up he also knew he was hiding these luxury trips. you can criticize justices for all kinds of reasons, most do not go out of their way to buddy up to billionaires and then hide luxury jet travel. it's not what most of them do and this is the first of several supreme court scandals and you had the secret tapes of justice alito facing questions about his judgment and bias. >> i don't know that we can negotiate with the left in the way that needs to happen for the polarization to end. i think that it's a matter of, like, winning. >> i think you're probably right. there are differences on fundamental things that really can't be compromised. >> no compromise for justice alito as we mention. whenever we play that, that was record surreptitiously by an activist. there questions here about alito's violation of the u.s. flag code through his household and as we discussed earlier in the broadcast his claims that he didn't see the flag, didn't know about it and he deferred to his wife. one day here after senate democrats did force that vote to try to get a binding code of ethics for the supreme court and while ethics used to be the kind of thing that many politicians said they'd support in government and conservatives used to say you have strict rules so people don't abuse power, it was conservative republicans who blocked this getting to the floor. >> i think it's just a campaign of harassment against the supreme court in order to try to undermine public confidence, and i think it's -- it's dangerous, frankly. >> it's absurd. and to threaten funding. they're an independent branch of government. i mean, they have -- >> this is an overreach. this would overrule the court's ability to operate and it's been a continued effort by our 14s on the democratic to undermine a court they don't like. >> this is not a drill and the biggest questions are not just for alito and thomas although they are causing the problems. the buck stops with chief justice roberts who controls the court and has to decide if he's going to put a stop to any of this. with all that in mind we turn to one of boring. think about it. boring is the unsung catalyst for bold. what straps bold to a rocket and hurtles it into space? boring does. boring makes vacations happen, early retirements possible, and startups start up. because it's smart, dependable, and steady. all words you want from your bank. for nearly 160 years, pnc bank has been brilliantly boring so you can be happily fulfilled... which is pretty un-boring if you think about it. we report on judges a lot these days. you may have noticed, we talk about what judges are doing and very few senior judges are available to be interviewed. we do have something special in that vein. my next guest is a distinguished jurist. the judge recently retired after 30 years on the d.c. court of appeals and he authored numerous decisions on key issues like voting rights, the environment and environmental government en regulation. he wrote the court shelby opinion and upheld the voting rights agent and he has a new book, vision, a new memoir of blindness and justice. that is a metaphor with reality. he overcame his own blindness to serve in high positions and provide public service. also for making headlines for some of his clear warnings about this current supreme court. we are honored to welcome him to the beat. thanks for being here. >> thank you. it's a pleasure to be here. >> we've had some recent discussions about when and how judges should recuse. you're familiar. supreme court. >> yes. >> does its own thing. when you were looking at a case that involved whether the paper currency should be somehow adjusted for the rights and access of the blind, you said that while you had a personal opinion that quote i believed i could put my view aside and decide the case fairly, i worried what the public might think. whether it would be good for my court and the country and decided to recuse. it's almost as if you're erred on the side of protecting the court's independence rather than your own stated belief that you could have done it and handled it. could you explain that decision to us and do you think that's how alito and thomas are approaching these decisions these days? >> well, i can only speak about my own experience. you described it just right. i felt that although i was completely confident that i could decide that case objectively without regard to my blindness, i worried that the public might be concerned that a court with a blind judge on it that ordered the treasury department to spend billions making the currency accessible. >> why do you think today's supreme court justice is so rarely recuse? >> well, there is a difference between a court of appeals judge and a supreme court justice. when i recuse myself from the case, another judge could step in and handle the case. that's what happens. different for a supreme court justice. because there are nine justices and no substitutes if one recuses himself or herself. so as the supreme court itself has said in ethics guidelines, justices have a higher burden to sit. but i think that that imposes on them an even higher burden to avoid any situations that might require a recusal. >> i wanted to read from something you wrote here about the evolution of this particular court. you wrote it's one thing to follow rulings i believe were wrong when they resulted from a judicial process i respected. that is respect the process, disagree at times with the result. quote, it was quite another to be bound by the decisions of an institution i barely recognized. what did you mean by that regarding the shift in the supreme court? >> my concern about this court, this particular supreme court is that it all too frequently abandons the principles of judicial restraint i think are critical to preserving the separation of powers and checks and balances and a government that in turn protect individual rights in our country. >> when you look at this supreme court and its process, donald trump put three people on the court. one of those was through the holdover fight when the republicans refused to hold any hearing on floor vote to confirm a nominee, garland, people remember that. there seems to be a widening plitization and look of credibility and rather than the court being as you mentioned, restrained, some of the members of the court, specifically kavanaugh, alito, and thomas especially seem to take it as a blank check. to act in ways that i guess prior traditional, custom, other things would have held them back. do you think that that is a problem and is it fixable? >> first of all, i've been very careful in my book to talk about the court and not the individual justices. i have not gone into motive. i don't know motive. my book focuses on the court as an institution and the conclusions i've reached about the dangers that the current court presents come from their written opinions and nothing else. and i do think that the court as it accumulates more power for itself at the expense of the other branches of government is a risk to democratic values. my conclusion in my book is i call on people to resort to the very basic most important right we have, to vote. everybody should vote. and we should vote, people should vote, if a president says he's going to appoint judges or justices to accomplish a particular purpose, don't vote for that person. vote for presidents who will appoint the best judges they can. >> yep. makes sense. i tell viewers we rarely get to hear from federal judges and you draw on your experience and share it candidly, appreciate it so much. the book is vision, a memoir of blindness and justice. get it wherever books are sold. . get it wherever books are sold with bounce pet, you can cuddle and brush that hair off. bounce, it's the sheet. - so this is pickleball?
