but a person or process that is not corrupt or rigged enough to give them the results that he seeks. the guilty verdict was handed down by a jury following weeks of evidence and arguments from both sides. that is not a rigged result. that is the justice system at work. but you know what sounds like reading to me? mike johnson urging the supreme court to overturn trump's conviction. >> i do believe the supreme court should step in. this is unprecedented and dangerous to our system. the justices on the court, i think they're deeply concerned about that. i think they will set this straight. >> and trump got in on the action calling on the supreme court to intervene. the court, one third is made up of trump appointees is currently considering his claim of absolute immunity. which she with each day that passes, he wants to delay the trial further. there's also the classified documents case, which has been indefinitely postponed. this gamesmanship from trump appointed judges bears farmer resemblance to a corrupt a rigged process dan a trial by a jury of your peers. as it turns out, a jury is the only institution that has provided itself or proved itself resistant to the ex-president corrupting influence. if trump and his appointees are successful in delaying other quests for accountability until after the election, it will be the american people who decide his you again. i will start with you. despite trump ranting about a ridge trial, the truth of the matter is, he was treated better than most defendants. you had judge merchan practically bending over backwards to overlook his antics and social media harassment. his commentary against the judge and witnesses. what you make of his ever persistent victim complex. >> it's good to be back. you are right. he was treated better, not worse. none of us would've gotten away with 10 violations of the gag order it's absurd to say he was treated worse. when he says rigged, he's a loser. he does not like being a loser, which is what he fundamentally is. and when he loses he says it's rigged. when he lost the popular vote to hillary clinton he said it was rigged. when he lost the electoral college vote to joe biden he said it was rigged, and now he loses unanimously to a jury. and he says it is rigged again. 12 new yorkers found him guilty in rapid time. one of them gets their news from truth social and they found him guilty. this is the american justice system at play and the world's biggest loser and a manchild unable to deal with defeat at the ballot box and a jury. i would say to those on the left , some of my friends who are complacent about the return of donald trump next year, the idea that he will accept defeat in november is absurd. there is nothing in his nature. and, if he wins, there's nothing that says he will go quietly. he does not accept anything that makes him a loser.>> that is an important point about the history of using that word. and tonight there's a new piece in the washington post who looks into the use of the word. he says everything was rigged all the time with the frequency that would make a parent feel embarrassed at how often it was repeating itself. and we come we become used to this. but the frequency doesn't make it any less harmful to our democracy. we fallen into this trap of saying, he's just saying he's going to accept the results, but people like tim scott also say they are not going to accept the results of the election in november. >> i mean, the reality is that repetitive nature is strategic. when you say things multiple times, whether you're watching it on a cable news program, if you say it over and over again it gets into people's psyche. you want to plant a seed of reasonable doubt in the courtroom about whether or not everything is rigged against donald trump. he was given $1 million to start a business. so the fact is you use this word and it is parroted by the entirety of the republican party, which then places down people's minds and the minds of independent voters and some of the people who think to themselves, i never thought i would vote for a felon. so i think it's important for democrats to be able to say that you have a choice in the selection. do you want someone that is been found guilty on 34 felony counts you want someone that shows up for patriotism. do you want a man that was found guilty of sexual assault. they have shown that they are a cult and they show up in the same outfits and they parrot the talking points. >> tom cotton referred to the trial in new york as rigged. the interesting thing is you heard mike johnson calling on the supreme court openly to intervene. not even looking for and appeals process. he has tried to clean those comments up since. >> i've not had conversations with the justices. i just know their personality and they are deeply concerned about maintaining our system of justice. they are concerned about maintaining the idea. it's a necessary ingredient. i think they are concerned about using courtrooms for politics. >> apparently he now has a new job as the spokesperson for the supreme court justices. he saying he knows that they are concerned about this. is that your perception that they are deeply concerned with maintaining the system of justice? >> i guess i agree with half of what he said. i think there are many justices , at least two who are very concerned that the leader of their political party was found guilty of a felony and are very interested in lifting the stigma from the leader of their political party. we've had three weeks of conversation about the flags and i don't think the flags would be such a big deal if it wasn't for the fact that i've covered him on the court for 12 years, and he always votes with the republican party. there is no nuance. we've seen clarence thomas and his billionaires. i want to be clear. i don't know if there are five votes on the supreme court to say, well, we don't want donald trump being a convicted felon because that means our party won't win the election. but there are zero votes on the supreme court that think that. the courts have become way too politicized. >> speaker johnson said he's concerned about using courtrooms for politics. this guy literally went -- had a press conference in front of his trial dressed in a bright red tie to project maga to the world. >> given what you've pointed out that cultists turned out in matching clothes, i should point out that we did not coordinate our jackets and shirts today. as much as i love you, i'm not part of the cold. on the issue of projection, the republican party is the master. projection does not do it justice. this is a political movement that came to power on the basis of current law corrupt. and i'm sorry that i have such a long memory. he posted a picture on twitter of a bunch of democrats and his own deputy attorney general behind bars. hillary and obama and eric holder are all behind bars. this is the sitting president. can you imagine if biden posted a picture like that? this party is based to where they want to lock up anthony fauci. they will lock up everyone. and blame them because they think everyone else is like them. ironically, joe biden has gone out of his way to not be involved in this. there democrats urging joe biden to speak more about his criminal conviction. he should be what does this expose? >> about a year ago they released this ethics code as the first time they'd ever released an ethics code. and we know that it is weaker than their obligation under a federal statute. he cited a provision of the ethics code that says there is a presumption against recusal. that is not with the federal statute says. and the other thing we know about is it's just unenforceable. they get to decide whether or not they will follow the code. the problem i have with justice alito, his own description of why these flags went up is so embarrassing that i'm inclined to believe him because who would admit to that? the problem is his record on the court. he's the most pro-prosecution justice, except when the defendant is donald trump or a defendant from january 6. his record is so partisan that you look at the whole thing in the whole thing has impropriety. but he said he had nothing to do with this and not to sound like a broken record. but the irony of saying it was his wife and she can choose whatever she does, what you make of his argument for not recusing himself and putting the blame solely on his wife as what happens in the household is not an indicator for why he should be recusing himself. >> you have to love family values. throw your wife under the bus. they blame their wives. but i would say that he's a longtime liar. he's lied for many years. he went to ted kennedy and said i will never vote to overturn roe v wade. he lied at the time and kennedy did not vote for him. he lied about every aspect of this flag story. he said it was the neighbor fighting with his wife about trump. that altercation came in february of 2001. he said it was put up because people were putting yard signs near school bus pickup where kids could see it. schools were closed because of the pandemic. and he said it's about his neighbors. then we found the christian nationalist flag. who does he blame that one on? it seems he has an affinity for these flags that suggest he supports insurrection and trump. the idea that he will rule in the trump immunity case is an insult to our intelligence and it is an undermining of our justice system and have reckless democrats are. dick durbin was asked if he will hold hearings he said i don't think there's much to be gained from hearings. are you kidding? holding a justice to account. how about holding the entire supreme court? it is absurd that even when the democrats are in charge they cannot hold this pro insurrection supreme court to account. >> i was going to say that the democrats are not doing enough. maybe not even doing anything besides a letter. that there's no follow-up. there's no fresher. is no comment from the president to use his position to bring about some responsibility to the supreme court in violation of what most legal experts would agree is unethical behavior. spec the fact is is this is what democrats do. the reason why they act the way they do is because they know that democrats won't do anything about it because they are more afraid of appearance than they are prosecuting the case and that republicans sitting on this supreme court are either drifting out right or their flying flags. if, for instance, but if one of the liberal justices were to be flying a black lives matter flag at their home or and lgbtq pride flag in front of their home, what you think fox news and maga would be doing? i think the democrats would get on the bandwagon and say they need to recuse themselves or step down because even in this day and age when we know that trump, vis-@-vis this court case lied to the american people and lied about his character and paid off a star and was able to point three justices, we are still not using this as an opportunity, which is what a hearing is. it's to tell a narrative to the american people. and at this point they want to send a letter? give me a break. >> i have to get ian's thoughts on this. i want to know what you think about this. after the new york times published a report, the washington post said they learned about the flag controversy more than three years ago and then decided not to report on it because it seemed to be the work of his wife. they called it cautious and deferential. what you make that decision and do you agree with the assessment of the editorial approach as deferential to the justices? >> i think that reporters are responding to the public attitude and how it has shifted. a lot of the scandals that were reported about clarence thomas, i reported on in 2011. and i borrowed from a lot of reporting done in 2004. so a lot of these scandals have been known for a long time. what has changed is after the shenanigans that republicans engaged in to make sure they had a majority, after the dobbs decision and the court has showed itself as a partisan figure, there is an appetite not just for, okay, what decision did they hand down today, there is an appetite for political scandal journalism. there is an appetite for covering them as if they are members of congress. i think it is a good thing, but it's also new. i reported a lot of this 12 years ago and it went away. it's not going away now. >> is great to see all three of you. next time maybe the pocket square. >> next time we will both just wear red ties. time and time again israel excuses the deaths of civilians as a mistake. but how long will the u.s. let that fly? (inaudible sounds) (elevator doors opening) wait, there's an elevator? only pay for what you need. ♪ liberty, liberty, liberty, ♪ ♪ liberty. ♪ aryeh neier was born in germany and made a refugee at a young age after fleeing persecution before world war ii. he became a titan in the world of human rights and cofounded human rights watch. he's an author and has just written a piece in the new york review called is israel committing genocide? he joins me now to talk about this. it is great to have you here. i want to start with this recent piece that you wrote and reflect on how you got to the conclusion that you did when south africa presented their case the accusation was it was committing a genocide. you did not see it as such. you are seeing it now as i understand. walk me through how you got to this conclusion. >> initially my view was israel had a right to retaliate for what hamas did on october 7th. i thought that israel also had a right to try to destroy hamas to make sure that they could not do anything like that again. i was unhappy with the way israel was going about it, particularly the use of very large bombs in crowded urban areas. 500 pound and 2000 pound bombs were being used. those are highly inappropriate for a densely populated urban area. those are what you use to destroy and industrial plant producing munitions or a bridge or a railroad. it's not something you target a particular individual in a crowded urban area. nevertheless, i thought israel was pursuing a campaign against hamas. but i was also concerned that israel was restricting the flow of humanitarian assistance to palestinians in gaza and israel has over the period of eight months continued to obstruct the delivery of humanitarian assistance to palestinians in gaza and those who are suffering most are those who are the least responsible for what hamas did. young children are being malnourished and who will starve to death or grow up severely handicapped because of malnourishment. >> do you think israel is using starvation as a weapon of war?>> yes. there are so many different things that they did to restrict the flow of humanitarian assistance. they have restrictions on the number of entry points, they have onerous checks on trucks bringing in aid, which allowed a small number of trucks to come in. they attacked humanitarian workers, about -- more than 200 workers from the un agency distributing communitarian assistance have been killed and there been attacks on the french organization, doctors without borders, the international rescue committee and on the world central kitchen killing seven international humanitarian aid workers. most recently we have the settlers in the west bank attacking trucks bringing humanitarian assistance in any idf in the police standing by when those attacks take place. the combination of all those activities has seemed to me that they are using starvation as a weapon in gaza and that amounts to genocide. >> when you lay out what you just did in addition to comments made by israeli officials since the beginning plus the type of ammunitions being used, what do you, based on your expertise, conclude their aim to be? >> i think israel sees the palestinian population of gaza as complicit in the crimes that hamas committed on october 7th. and they have engaged in reprisals against the civilian population, and that includes very young children who were barely born at the point that hamas engaged in the attacks of october 7th. >> some of these children were born after. based on your experience as one of the leading human rights activists in the world, when you see the u.s. congress invite someone like benjamin netanyahu to speak to a joint session of congress, do you think it's a good move by the united states? >> it is a terrible move. i think the united states is associated with the crimes that israel has committed in the last eight months. is associated with those crimes by supplying a lot of the weapons that israel is using and to add to that, in fighting netanyahu, who epitomizes the way in which israel has gone about this war adds to that and degrades the united states.>> thank you for your time and i greatly appreciate your insight spain, ireland, and norway recognize a palestinian state. but doesn't move the needle toward peace? >> we believe in a two state solution and we have to do everything to protect it. recognition falls into that perspective. we know that the hope of the palestinian people to have their own state is completely interlinked with legitimate security guarantees. so only by promoting two state solution will we get piece for both the israelis and the palestinians and the whole middle east. and it is time we stopped talking about a two state solution and start to put it in place. that's why we have to have the recognition. and they cannot be condemned to be refugee people forever. and human dignity where we see 1200 palestinian killed in a day. 35,000 and we don't know how many more tomorrow. it is high time that we unite forces. >> when you say to critics who say this is about words if it doesn't have any consequence for israel defying the spanish government's recognition or the international community recognition?
