Today hur repeated his reports findings, that the evidence did not support any charges for biden. We did not, however, identify evidence that rose to the level of proof beyond a reasonable doubt. Because the evidence fell short of that standard, i declined to recommend criminal charges against mr. Biden. Republicans had hoped that the hearing would amplify hurs claims about bidens age and memory, but that was before bidens fiery State Of The Union address. So in the end the Key Takeaways today were about why trump was facing criminal charges. At one point hur, whos a Gop Appointee was asked to read aloud parts of his report detailing trumps behavior during the maralago probe. Unlike the evidence involving mr. Biden, the allegations set forth in the indictment of mr. Trump if proven would present serious aggravating facts. Keep going. Congresswoman, im happy to have you read the words of my report. Trump hasnt helped his defense with his public statements. Im allowed today have these documents. Im allowed to take these documents classified or not classified. Im allowed to do what i want to do. Im allowed to have documents. And frankly, when i have them, they become unclassified. People think you have to go through a ritual, you dont. But once you get a subpoena, you have to turn them over. I know this. I dont even know that because i have the right to have those documents, so i dont really know that. And theres also new compelling evidence from a former trump aide at maralago who said he personally helped move boxes and that some classified documents may have ended up at trumps home in bedminster. We got to the airport, i ended up loading all the luggage i had, and he had boxes. You noticed he had boxes . Oh, yeah. They were the boxes that were in the indictment, the white bankers boxes. Thats what i remember loading. Did you have any time, any idea at the time there was potentially u. S. National security secrets in those boxes . No clue. I had no clue. We were just taking them out of the escalade, piling them up. I remember they were all stacked on top of each other and we were lifting them up to the pilot. That former aid also talking about the possible attempt to obstruct justice by allegedly conspiring to delete security footage. I remember him saying, oh, by the way walts coming tomorrow. Oh, cool, thats great. I was like okay. It wasnt until the following day when were out walking hes like, hey, by the way, its a secret. Dont tell anyone walts coming. And why . Well, he needs me to find something out before he gets here. Oh, whats that . He needs me to you know, how long the Camera Footage is saved at maralago. Im like thats odd, why do you need the Camera Footage, why do you need to know how long its saved. And his response was i think theyre looking for somebody that was there. A key hearing in jack smiths classified documents case against trump is set for this thursday. Meanwhile, theres also news today on trumps first criminal trial, the Hush Money Case in new york. A trump filing today saying he may blame his lawyers for the criminal chemo, but hell try to do that without losing the attorneyclient privilege. Joining me now is joyce vance, former u. S. Attorney and msnbc analyst and cohost of the Hashtag Sisters In Law podcast and cohost of the strict scrutiny podcast. Two of The Very Best getting us started this evening. Joyce, id like to begin with you. For today in the hur hearing, no new evidence was heard. No perry mason moments happened. Did anything occur in this hearing to change the fact theres been only one president , former president trump, that is facing criminal charges for mishandling classified documents . You know, katie, this hearing underlined the distinction between donald trump and joe biden for anyone whos listening. Its very clear when you read hurs report and when you hear hur repeat his report out loud at the request of one of the Congress Women that the distinction is donald trump engaged in an extensive effort to hide the amount of Classified Information that he had retained. And those efforts by trump really served to show his State Of Mind in this regard. So hur when he talks about joe biden who voluntarily turns over material after he finds it, sits, by the way, for an interview with prosecutors, something donald trump has never done. All of this goes to show the distinction between the two cases, and now frankly its out in the open even more than it was after hur published the written report. The republicans in the house trying to equate biden and trumps conduct raising their arms and flailing about and complaining how trumps was and bidens wasnt. But its important to point out how specific those are when it comes to criminal the intent. On one hand you have someone asked to turn over information, allegedly ordered people to destroy it and hide it, and thats part of why hes being charged with obstruction of justice. And on the other hand you have someone apologetic, willingly turned it over. Again, underscoring differences in Donald Trumps world, hes very concerned what hell do for donald trump. When confronted with possibly having information he should not have, joe biden cooperate would the federal government and investigators to return the information to them. Again, underscoring just some of the many differences between the two candidates. Joyce, democrats also pressing hur on what he said in his report about bidens age and memory. Take a quick listen. Congressman, politics played no part whatsoever in my investigative steps. You understood nevertheless mr. Hur, you cannot tell me youre so naive as to think your words would not have created a political firestorm . You understood that, didnt you, when you wrote those words . I mean, joyce, the question that lingers, right, hur is not stupid. Hes got a pretty untarnished record going into this special counsel assignment. He kind of danced on the head of the pin when it came to his inclusion in the report about things dealing with bidens memory and his age. Were those comments he made in the report he made today he doubled down on during the hearing consistent with doj special counsel rules . So i think any prosecutor you talk to will tell you that these sorts of comments are unfortunate, that theyre inappropriate. Maybe they dont violate protocols, so to speak, but prosecutors know better than to comment on cases when theyre not going to indict a defendant. Here the situation is a little bit different. Hur is a special counsel. He knows that this report is going to release publicly because Merrick Garland has repeatedly said he will make it public. So everything he puts into the report, he knows its going to be fair game. And i think katie i think scott emphasized this morning when hur was being questioned by congressman matt gaetz. And gaetz acknowledged i think the right thing, you know, the right decision here was not to indict joe biden and the right decision would have been not to indict donald trump, was what gaetz said in this regard. And then he went onto make the political comments, right . And the law aside, he says but of course joe biden was either old or was being deceptive. And so i think thats the point here, that hur permitted himself to be used for a political narrative. Thats not a prosecutors job. Weve got to turn now because ive got to talk about the filing trump just did in the Hush Money Case, in the manhattan d. A. s office in new york. Trump filing a notice concerning his the intent to rely on a defense of counsel case. He said hes not going to be relying on defense and he cites to a Sam Bankmanfried opinion by judge lewis kaplan, footnote whos the judge for the e. Jean carroll case. Its all woven together, isnt it . Make sense of this. How can you assert the defense and not actually comply with what the rules require you to do . You cant, actually. And this is the problem consistently with donald trump and the process. This is a defense he has floated not just in the new york case but also potentially, right, invoke in the January 6th Case where he was possibly suggesting he was relying on the advice of lawyers in order to call out his attempts throughout potentially passed in the 2020 election. In order to assert this as a defense you actually need to allow the court to probe whether your lawyer is actings as your lawyer or acting illegal. Thats not something donald trump can say i get a free pass because of some legal defense, im just going to assert. Joyce, when a criminal defendant asserts this assertion of counsel defense he or she takes the stand and talks about the State Of Mind. The waiver of privilege happens, talks about et cetera conveyed between that defendant and their counsel. But it sounds in this instance, joyce, trump is trying to avoid taking the stand. He puts in this notice that witnesses like Michael Cohen of all people and people from ami that were a part of the transactions when trump made those Hush Money Payments will be testifying on behalf of the government. And as such trump wouldnt actually have to be exposed to maybe crossexamination because those lawyers and people were there and they somehow sanctioned or blessed his criminal conduct. Again, it makes sense. Exactly as liah said, this is trump trying to have his cake and eat it, too. He wants the benefit of advice of counsel defense, but doesnt want to have pay the fright, which is testifying disclosing communications. And that when you think about it has to happen for this to work, because the defense says i didnt have a guilty State Of Mind because my lawyers told me it would be okay to do what i did. Well, hows the jury supposed to evaluate . Unless they can hear about what the defendant was thinking and what his lawyers told him, so trump only wants to offer one part of that equation without getting the full picture in front of the jury. The judge shouldnt let him get away with doing this. Its good to see you guys. Thank you. It comes just days after trumps allies including his daughterinlaw took command of the rnc. Headlines calling it a, quote, bloodbath and a, quote, moblike takeover with more than 60 officials including senior Staff Members laid off or asked to resign and then reapply. Its reportedly part of a strategy to ensure that only staffers committed to trump and the Maga Movement are left at the rnc. In other words, it looks like a purge of members deemed insufficiently loyal to maga. Politically, that could be dangerous, tow, for republicans. The rise of maga has led to a multiyear gop losing streak in national elections, a streak trumps main gop primary rival, nikki haley, blamed on him. Donald trump lost in 2018. He lost it for us in 2020. He lost it for us in 2022. Everything he touches, we lose. But the purge of the rnc could also give trump more control over the organizations finances. Remember weeks before becoming the Cochair Laura Trump indicated the rnc might pay trumps legal bills. You think paying for president trumps legal bills is something of interest to Republican Voters . Absolutely. After those comments, Trumps Campaign insisted the rnc wouldnt be paying his legal bills. But some rnc members were concerned enough to want to put it in writing, drafting a resolution to prohibit the rnc from paying trumps bills. And yet that resolution was never adopted. Some rnc members are speaking out criticizing the move. Rnc member and vermont gop chair saying, quote, its something between a purge and a takeover, and thats a concern for me. Donald trump is not going to think not going to change what i think. Hes not going to change the platform of the Republican Party, the views of the Republican Party. I think were much more likely to change him because if he is president , hes going to have to deal with the right of center world, which is where most of us are. Joining me now is pall dame, chair of the Republican Party, and molly jongfast, msnbc political analyst and Special Correspondent for the vanity fair. Paul, id love to start with you. Before the break we talked about your reaction, which you say it was something between a cross between a purge and to takeover. Tell us whats going on and why you feel so concerned about the rnc. Yeah, the time i had that conversation it was a lot of speculation. That was before broke monday indicating almost 60 staffers had been cut. So it was really interesting for me. I had some concerns. Friday we were in houston, we voted for the new chair and cochair. And i left thinking, all right, im going to give these folks the benefit of the doubt. And the First Business day after that were seeing major changes at the rnc, and its really affecting people closest to the ground, a lot of the regional political directors and State Directors by this. And thats to people and creates uncertainty about whats going to be happening at the rnc moving forward and how does state republican parties interact with the national organization. Paul, i just want to go back to something you said. On friday you actually voted to vote in laura trump and michael waly who were the chair or cochair or cochair and chair respectively, and you said you wanted to give them the benefit of the doubt, but did you really think, though, putting someone like laura trump in a position like that, being the daughterinlaw of donald trump, did you think that was going to be the best idea considering plans we heard of trump to use the rnc as the personal piggy bank . I had direct conversations with laura trump during that meeting before the vote, and i got assurances from both her and chairman wattly that using rnc donor funds for legal purposes was out the window. Ive also heard other staff say that. So i was willing to take them at their word. And so we see that change, well just have to watch what the actions are. Paul, my followup question then is what recourse do you and others that have a concern about this purge that is happening at the rnc, whats the recourse for you if you dont think these are the right moves that need to be done at the rnc . Well, you know, the Republican Party is still built from the bottom up. At our next meeting, members have a lot of options. Itll be the meeting right before the convention so things about rules, passing resolutions. And ultimately next january therell be a new vote to elect leadership. The term ended here when Ronna Mcdaniel stepped down and Michael Wattly is filling in for now until next january. Republicans from all 50 states and territories will have an opportunity to weigh in after we see the november Election Results on what happens. And i think my concern has been it looks like trump is kind of moving the rnc in the same direction youve seen the dnc for years being very top down. A lot of people saw how super delegate situation in the dnc really robbed Bernie Sanders of an opportunity. And up to this Point The Rnc has been very much bottom up, but maybe thats changing under trump leadership. Paul, molly and i are going to disagree with you on that. Molly, go ahmed. I mean its a very nice Talking Point to say that about super delegates stealing from bernie, but in fact its from 2016, its been debunked. And also i might add bernie has been quick to endorse joe biden and has again. I understand republicans are upset what happened to the rnc, but i do not think this is the moment i mean you have a problem with your party and whats going to happen to State Parties, but i dont know how much this has to do with the dnc. Well, and molly well, its a comparison. Dnc has been very top down and rnc hasnt. But this is changing that. Id love to see some reporting that would followup on that. And i would say, paul paul, im not quite sure you can say its not topheavy at the Republican Party if donald trump is the person controlling the Purse Strings as well as the people. Molly, lut me follow up with you quickly on something. Nikki haley the one that outlasted the head of lettuce, kind of, warned that trump is going to be a loser for the gop, his policies, his stances have been losers for the gop as your friend and our friend, rick wilson has said. Everything that trump touches dies. Is there a concern then if trump is basically taking over and purging the rnc, molly, that the rnc will no longer survive . Well, i mean eventually the rnc will rebuild itself, but certainly it is a question as to why the rnc is handing the keys over like this. And laura trump has said publicly she thought the rnc should pay trumps legal bills, so it sounds like maybe shes walked that back. But, look, trump has a lot of legal bills and i think there are a lot of State Parties that could use the money from the rnc. And really the job is that on the ground organizing, which it sounds like the rnc may not have this cycle, and i think they could probably use it. Paul, id like to ask you. The Committee Man solomoniae in oerg told cnbc he believes, quote, more than a majority of members are in favor of helping trump pay his legal bills. Can you share with us what youre hearing about the support for trumps legal bills being footed by the rnc . Yeah, it was a discussion i had had with a few other states to see, you know, if there was any interest in moving that resolution forward. We did get a number of states interested in rolling forward with that but rnc rules require two members from ten states, and because the meeting was called on relatively short notice, we werent able to reach that threshold in the time it was acquired to get that on the agenda for last weeks meeting. I dont know if ive got a good read on what percentage are in support. I didnt know there were a number of people who are concerned. This was also a concern before the primary started, we had been paying some of the legal bills previously. And there was talk at the rnc and we wanted to make sure we werent putting the thumb on the scale for one particular candidate. Molly, donald trump also saying this week hes going to release convicted january 6th defendants convicted, i want to emphasize that adjective, january 6th defendants, as one of his first act as president if he manages to make it back to the oval office. Your thoughts on his plan. You know, look, theyre in jail for a reason, right . And trump wants you know, trump has often spoken about Political Violence and people who commit Political Violence as allies of him. But they ended up in jail because they committed violence, right . And these were violent offenders who went to jail for doing crimes. You know, this is not hard. This is a very simple thing. So i do think, ultimately, you know, what hes signaling, right, if you break the law in his name, thats okay. Thats the sign hes saying, and i think thats a very scary signal. His false claims of Election Fraud, which are at the heart of his coup case, going before the United States Supreme Court next month. Theyre a key part of jack smiths indictment where he alleges that trump kept repeating the falsehoods even though, quote, the defendant knew that they were false. In a new book details just how much trump knew written by a data expert who were actually hired by the Trump Campaign. And now hes blowing the whistle on the, quote, failed hunt for 2020 fraud. The republican expert, ken block, saying he reviewed more than a dozen Election Fraud claims brought to him that he actually told the Trump Campaign were false. But none of this has stopped trump from repeating debunked and disproven claims of fraud even after block delivered his research to the campaign. Joining me now is ken block, the data specialist that was hired by trumps 2020 campaign to review allegations of Election Fraud. Hes also author of the new book, disproven, My Unbiased Search for voter fraud for the crump campaign. The data that shows how he lost and how we can improve our elections. That book is out today. Ken, thank you so much for joining us. I was fascinated by your book. I have to ask straight out of the gate how angry was the Trump Campaign when he went back to them after investigating more than a dozen allegations of Election Fraud, and you told them that those fraud claims were bogus . Its interesting they werent angry because the lawyer i was appointed to, alex canon, who signed my contract, wanted me to do an assessment look into voter fraud. It was only a few days into my contract where he started delivering to me claims that other people had made, and he was doing his Due Diligence. There were lawyers attached to the Trump Campaign who were interested in doing the right thing, who were doing their professional Due Diligence as opposed to other lawyers involve would the campaign who didnt. And then, ken, considering the fath you were paid for your expertise, your knowledge, and your intelligence, you provided that information to the Trump Campaign. What were you thinking when you then saw donald trump on tv and other outlets afterwards repeating over and over again election lies . Yeah. My job was to deliver to the Campaign Evidence of voter fraud that could survive legal scrutiny. My work was supposed to inform lawsuits challenging the course of the election. And we just utterly failed to find sufficient evidence of fraud. We found some fraud but not enough to change the outcome of any of the swing state elections, and that was very clearly communicated up the chain that i reported to and i know that the lawyer, alex canon, who was my main interface to the campaign, took that news directly to mark meadows who accepted my findings as true. And the Washington Post reports that mark meadows took those findings and delivered them to the white house. And so, ken, based upon what you just said and what i have read, have you had any contact with special counsel jack smith, d. A. Fani willis, and others investigating the likely false Election Fraud claims that were made by people like donald trump . Yeah, ive become a professional subpoena receiver. I got subpoenaed by jack smith, got subpoenaed by fani willis in Fulton County and even subpoenaed so ive received subpoenas in all those legal actions, responded by delivering my communications to the Trump Campaign as was requested from me, and thats the extent of my involvement so far. Ken, in your book you also write the following, quote, at first the requests were worded, please try to verify this claim. But by the end the requests were phrased tell me why this claim is wrong. I mean, in your opinion and based upon the communications that you received from the campaign concerning these claims of alleged voter fraud, did it seem they were ever interested in the truth about these allegations . For Sure Alex Canon and his legal team were very interested in receiving from me the truth because they were doing their professional Due Diligence. As far as what happened when my findings went up the chain, i dont have visibility to it, and i was swamped just trying to fulfill the requests that were coming in. We looked as hard as you could possibly look given the intense time frames in which we had to do all the work and completely failed to find what the campaign needed to properly and successfully contest the outcome in a court of law. In fact, at one point, ken, you actually told the campaign, quote, do not allow this analysis to go out, and that was concerning a potential lawsuit that they wanted to file alleging voter fraud. Do you think that this information should have gone public before january 6th . Thats a political question for political people. You know, from my perspective, that lawsuit in particular that you just brought up and the excerpt you showed from the book, that lawsuit was successfully turned away by the Trump Campaign lawyers because the underlying claim was false. Look, theres really an intersection of two Different Things here. Theres the intersection of factual, data driven evidence which is what my gig is, and then theres all the Political Considerations about Everything Else that comes along with pushing other types of claims of fraud. I cant speak to that piece of it. For me, i think its pretty clear that up and down looking at it holisticically, there just wasnt evidence of fraud that would ever stand up in court. The outcome of 60plus court cases and all the work i had done, its very clear there wasnt evidence that mattered that could change the course of the election. So i have to ask you then, ken, for somebody like you whose your currency is facts, your currency is evidence, right, you claim to have answers grounded in reality and facts, how incredibly frustrating should it was it basically for you and does it continue to be for you with the fact there was this push by trump and others there was this Election Fraud never proven based upon your own research . Yeah, probably, the quickest story i can tell you about that is directly after the election in 2020 there were Friends Of Mine who were running for congressional offices in rhode island who picked up the mantle of voter fraud and when they had lost their election, which is hugely anticipated because rhode island is a very blue state, one person in particular had run as a republican and lost by the expected margin that republicans lose by in rhode island. And he claimed voter fraud, and it was ridiculous, and it was harmful. And it was utterly wrong, and i found that incredibly frustrating because we had left the realm of realism in terms of his claims, and he was just mimicking what he was hearing at the national level, and to me that was completely wrong and i called him out for it in the book. And these are only the crimes that were actually reported to the fbi. Support for samesex marriage declined last year for the first time in a decade. That decline was even sharper among young people, whose support fell from a high of 79 in 2018 to 71 last year. And republicans across the country are just getting more brazen. Blocking protections for ivf, testing the waters for limitations on contraception, and even hinting at restrictions on nofault divorce. Increasingly, theyre not even bothering to hide their disdain for anyone outside of their base. Instead, theyre just saying the quiet part out loud. I absolutely want to go back to the america where women couldnt vote. So we need these ladies to get married. And its time to fall in love and settle down, guys. Go put a ring on it. I mean, you know, theyre mad because women dont women arent voting for republicans in the numbers they want, which is not surprising considering these very misogynistic legislations. Look, what happened with katie britt is they picked her because alabama was having a lot of problems with the ivf stuff. The Alabama Ivf Clinics had to close because of this idea of embryonic personhood. The idea that a fivecelled embryo was the same as a person. And that was why they closed those, they werent able to do ivf. Then, eventually, the governor did sign into Law Legislation which made it so that ivf can continue. But i want to add, she never said that a fivecelled embryo wasnt a person. She just indemnified the ivf clinics from being prosecuted if they were to destroy an embryo. So theyre still down this rabbit hole, right, which is a really difficult sort of unwinnable situation for them, but this legislation, these antichoice activists are not satisfied. And ivf is a big nightmare for republicans. Most americans believe that ivf is one of the greatest scientific advances of our lifetime. And then you have these republicans who are against it, and even though electorally its going to be bad for them and you have these antichoice activists who are mad at republicans like katie britt for defending ivf. And by the way, she didnt really defend it. She just sorts of defended it during her speech. She whispered about it. But molly, you recently wrote a piece about how republican women have found themselves in this quandary. How do republican women reconcile their party taking aim at their own rights and Simon Tailiously talking out of the other side of their mouths and saying they are women with families in a Kitchen Doing Everything that working moms do. I mean, everything that theyre standing for is under attack by the gop. Yeah, i mean, this is the katie britt problem. Heres katie britt, shes a senator, shes the youngest woman republican senator ever. Shes very accomplished. She was a staffer, shes a lawyer. And yet, you know, when asked about her, her cosenator tommy tuberville, the other senator from the state of alabama, said she was picked because she was a housewife. So you have this kind of very misogynistic strain in the Republican Party. And as we have seen since the overturning of roe, we have seen women have not been happy with having a right taken away. They did not, you know, a lot of republican pundits wrote that women wouldnt vote on it and women wouldnt care. In fact, what we have seen in every election since the overturning of roe is that women have really cared. And they have gone to the ballot box in states like ohio, red states, and said no, we are not going to put up with this. Again, you know, the polling is one thing. But the actual votes that we have seen women have come out and voted for their own rights. And thats why we cant focus on the polls.
