Case. What her plea means for her and the 18 codefendants. And were following the latest developments in the israelhamas war. Israel intensifying air strikes in gaza. Wounded palestinians being rushed to some of the few remaining hospitals. Also happening, President Biden back in the u. S. With a primetime address to the nation tonight after his brief but historic trip to israel where he announced limited humanitarian aid will be getting into gaza from egypt. The big question is when will that aid get in. And this hour, the House Republican conference expected to meet ahead of a potential third round of voting to decide who will be the next House Speaker. But can congressman jim jordan suppress a republican rebellion against him . And we start with a Breaking News out of georgia, where Sidney Powell, one of former president Donald Trumps 18 codefendants in the Election Interference Case there has pleaded guilty to reduced charges. How do you plead to the six counts of conspiracy to commit intentional interference with performance of election dutys . Guilty. Do you understand that you may have limited right to appeal, which ive gone over with you . Yes. This plea Dell Com Deal come before powell was set to stand trial. Shes the second person to plead guilty in connection with this case. Bail bondsman scott hall, you see there, also pleaded guilty last month. Lets talk more about this now with nbc news correspondent Blayne Alexander in atlanta. Youve been covering this case from the beginning. What do we know in this case . What exactly did Sidney Powell plead guilty to . Reporter well, remember, Sidney Powell was charged in connection to the breach of data Voting Machines, the data breach of Voting Machines in Coffee County here in georgia. She hired to go in and get that information. So, this is where the guilty plea is associated with. Now, lets talk about just how this came about. This is something that for many people, many of those of us who have been covering this, it came as a surprise. Were talking about less than 24 hours from now Jury Selection was set to begin for the trial for Sidney Powell and ken chesebro. 450 potential jurors going to march into Fulton County courthouse and begin this process. Remember, she and through her attorneys had requested a speedy trial in all of this. So, when you think about the timing, certainly it came as a very big surprise. So, heres what the prosecution has recommended when it comes to penalty for her, six years probation, 6,000 fine, 2700 of restitution, a letter of apology and then this is the one that certainly stands out to me, guys, she has to testify truthfully at all future proceedings. Thats the same conditions we saw for scott hall when he pleaded guilty. You talk about somebody of Sidney Powells magnitude, certainly that has a new meaning, a different weight, especilyn you consider the fact that Ken Chesebro Trial just about to get under way. We reached out to one of the counsels for ken chesebro, he said he has no comment right now, hes still working right now to try and process this news, process this development. So, that indicates he also was Caught Off Guard by this guilty plea today, guys . Blayne alexander, thank you for being with us. And on the phone, katie phang, msnbc legal contributor and host of the Katie Phang Show and former federal prosecutor barbara mcquaid, also an msnbc legal analyst. And barbara, i want to know, what could this now potentially mean for the other codefendants in this case . I think this is a really significant development. You know, prosecutors often talk about it as the dominos falling. Sometimes one pleading defendant can cause others to reevaluate theirtion so we had the defendant earlier, scott hall, who entered a guilty plea, lower level offender, buto doubt had some influence on Sidney Powells decision to guilty today. Right up until the last minute. But i think that Kenneth Chesebro has to think about it and everyone else involved in this case now knows that in addition to all of the evidence, that fani willis had against them, which was sufficient to find probable cause, now theyre going to have Sidney Powell, an insider, a really crucial insider, serving as a narrator for all of this stuff. Certainly they have to corroborate everything she has to say. But this can be a really powerful event that can cause more of those dominos to fall. Katie phang, im wonder bhag what your reaction to this is. A surprise for many. How significant is this . Well, guys, if you think about it, scott hall, who took a plea a few weeks ago, he actually took a plea concerning his activiies with the breach of the Election Equipment in Coffee County which directly implicated Sidney Powell. So it islet like a Domino Effect if you will. Scott hall pleads guilty, implicates Sidney Powell, Sidney Powell pleads guilty and it is pretty surprising that only because these things happen a lot of times at the 11th hour, as barb knows, as a prosecutor, what is fascinating is that less than 48 hours ago, her lawyer is fighting in court Tooth And Nail to make sure that, you know, her case gets dismissed, et cetera. The thing about Sidney Powell that people need to remember is this. Six years of probation sounds pretty lax considering your attempt to overturn an election, right . But she was the lawyer for donald trump. She was the lawyer for the trump campaign. Donald trump notoriously does not use text or emails, doesnt use thi writing. So it is the communications between her and donald trump that are really kind of working your way up proverbial food chain when it comes to flipping lower level defendants and tryi get to the king at the top, which everybody would concede is donald trump. So Sidney Powell, we skipped a few rungs on that ladder. We skipped some significant rungs to get a guilty plea from her and that special condition of her probation is testifying truthfully when The State Of Georgia needs you, and if you violate that term, even though she got the probation, she could be looking at a probation violation. Do you think, katie this throws off the schedule for Kenneth Chesebro at all since they were supposed to be tried together . Thats a great question. I reached out to scott grubman, the lawyer for Kenneth Chesebro who Blayne Alexander accurately said was taken aback and Caught Off Guard by what happened with this guilty plea. The question that i have not received an answer to yet is will this change your strategy when it comes to mr. Chesebro for monday . Will you withdraw that speedy demand and decide whether or not you want to reevaluate it . Sidney powell may have incriminating information about ke chebro who we know has beenled the architect of the plans to overturn the election and so now you Haveenth Chesebro who was a law f trump and the trump mpaign, himself, but Sidney Powell will ke be called by The State Of Georgia in that trial if he decides to go on monday. Barbara, do you think what is happening here in this georgia case could have some significance to special counsel jack smiths investigation . I do. To the extent that they now might have access to Sidney Powell as a potential witness, it could be very valuable. In the federal case, jack smith was very narrow in his focus and charged only donald trump in that case. He does, though, talk about other coconspirators and one of them is most certainly Sidney Powell because of the description where even donald trump referred to her as having some crazy theories and that matches up with information we have about Sidney Powell. And so if she testifies in this case, then she could also be compelled perhaps to testify in the other case. If she wants to wave any immunity she may have there, and i think testimony in this case will likely open up those floodgates. So she could see that happen because she still faces some criminal exposure in the federal case. Just because she hasnt been charged there doesnt mean she wont be charged there. So i think it could open the doors to more testimony against donald trump in that federal case as well. And what im noticing here in this plea deal, again, no jail time, thats what she was able to work out. Just six years of probation, 6,000 fine, 2700 in restitution to The State Of Georgia, and also an apology letter, katie, to the citizens of georgia. What stands out most to you . Those terms are consistent with what scott hall got for his plea, except scott hall got a little bit less probation time. That letter of apology makes sense if you think about it. There are victims to the crimes that have been alleged in this indictment against the 19 codefendants that fani willis is prosecuting. Those victims more specifically the residents, the citizens of this state of georgia, cnghe fact that they werepting to take away the lawful votes that they placed f now President Joe Biden in the 2020 election. So that letter of apology makes sense. But also, ana, there is a record of proffer that is a special condition that is already provided to the state. I want you to think for a second about the timing of all this. You got her lawyer, Sidney Powells lawyers in court on monday fighting Tooth And Nail to get the charges dismissed. Between monday and today, Sidney Powell provided a recorded proffer and a letter apology and hammered out the details of a probationary plea, guilty to six counts. So there has been a lot of things going on behind the scenes. Do underestimate prosecutors and what theyre able to do while they also prep for trial. And what is the tru camp i think thi is very alarming news for the trump camp. You know, united they stand, divided they fall. But so often i have seen this, jose, there just is no honor among thieves when you conspire with people who are willing to lie and cheat, they are not going to be loyal to you in the end. And so i think that it is alarming for donald trump because Sidney Powell, among all of the things shes accused of doing, i think most crucially was present for the December 18th Meeting in 2020 where they were in the oval office and a number of people were there, talking about appointing her to be special counsel, talking about using the military to seize Voting Machines, that information can be incredibly valuable and so donald trump has to be very concerned. And then, again, because of that Domino Effect, if Sidney Powell has gone and provided t prover, now there is additional evidence against a of the other defendants and which dominos are going to fall next. I think donald trump has to b alarmed, not only about Sidney Powell, but what this portends for other potential cooperators. I also wonder as we were showing the images inside that courtroom, because everything in georgia is going to be on camera, you know, the d. A. Had argued that they wanted to try everybody together in this case, in part because they didnt want to really show their hand to other defendants, right . If they were going to have to go through this trial, coming up with Sidney Powell and ken chesebro, they still might, because ken chesebro is still scheduled to start his trial, but this must help as a prosecutor to be able to keep your cards closer to your vest at this stage, no . Well, i think with regard to Kenneth Chesebro he is still out there and still has exercised his right to a speedy trial and may want to have this trial next week. Although as katie pointed out, it may be that he really needs to reevaluate his defense and needs more time to get his ducks in a row now that we have this new development that has to be very shocking to him. But, yeah, i can imagine, if youre a prosecutor, you want one shot at this. You want one trial. Because if you have to try the case multiple times, the other side gets to see the case, every witness has to testify again, and whenever witness testifies more than once, they are bound to have some inconsistencies in minor and irrelevant details, all of us do. It was a cloudy day, it was a sunny day, whatever it is. Even though theyre not relevant details, they are still details. And a skilled Defense Attorney can use Cross Examination to try to expose those inconsistencies and undermine the credibility of a witness. For that reason, prosecutors prefer one shot and not multiple efforts at either an acquittal or hung jury. Katie phang, the thought on her exposure, her legal exposure going forward, and if she has agreed to testify in the other cases, does that necessarily mean that she is bound to testify or work with a federal case . No, it is not. But i mean, it inures her benefit to do so. There is a statute of limitations that hasnt run for particular charges. We know jack smith has a grand jury that has been looking at some of the Election Finance issues that occurred as a result of the 2020 election and so because of that, if im Sidney Powell and i had this come to jesus moment where i said i do not want to go to jail in georgia, for donald trump basically, if youre given the opportunity, where you may have exposure federally then if im Sidney Powell im going to sit down and cooperate with them as well. So that Domino Effect you keep on hearing this phrase, it significant meaning because it doesn just mean it is limited to just a courtroom in georgia. Katie phang and barbara mcquaid, thank you very much. Well stay on top of this. Absolutely. Up next, breaking developments from capitol hill. Youre watching special coverage of Msnbc Reports. Tol hill youre watching special coverage of Msnbc ReportsBehind Closed Doors, what may come next in the fight for a new speaker. After congressman jim jordan failed to get enough votes for that second vote on wednesday, and not only was he unable to get a majority, he actually lost more votes. Indeed. Moments ago, jordan was met in the hall outside his office by a crush of reporters. Joining us now nbc news senior capitol hill correspondent garrett haake. Garrett, good morning. Jordan made some quick remarks this morning. What did he have to say . Reporter jordan said really only that hes going to talk to his conference about a path forward. And the reality here is hes got three options. He can either put another vote on the floor and risk losing even more support among republicans. He could drop out of the race altogether and give someone else a try, perhaps empowering Patrick Mchenry the speaker pro tem to try to take up more authority here. Or he could try to split the difference. The bulk of the reporting is leading us in that being the direction he may try to choose here. Basically there are enough republicans who want to try to move the house forward, suggest that mchenry, who has been doing the job on a temporary basis, but with very limited authority to do anything other than call and dismiss votes for another speakers race may get expanded power for a month or 60 days or perhaps even to the end of this year. And jordan could continue to run for speaker. Now, you could make an argument for him politically that could work pretty well. He would have time without the pressure that hes under right now to secure votes. And on things like government funding, perhaps this big supplemental spending bill for ukraine and israel which may not be overwhelmingly popular with republicans, if mchenry has to shepherd those through, jordan gets to keep his hands clean. I can tell you from other republicans i talked to, there is a lot of consternation about this. Theyre not sure if it is constitutional to give mchenry this power. What is being discussed even now, the floor itself will be open at noon, we could have votes today, jose, but on what, and when is a hugely open question right now. There is so many unknowns right now. And what ifs. But as you have described, it sounds like mchenry very well could be given some additional powers, but exactly what that means is still very vague. Would that mean that he would be able to pass certain pieces of legislation and very limited type or would it really give him all the powers of speaker, but for a shorter period of time . What do you know . Reporter it is a great question. Historically we have had speakers pro tem who have been empowered to do the job, whether a speaker was sick or out of the country or, you know, for some other reason unable to do the job. And that person basically exercised every power of the speaker except that they werent in the line of succession. Perhaps thats the case with mchenry. Some of this would have to be worked out. And the unusual thing here is in those instances there was an actual elected speaker who for whatever reason wasnt willing or able to do the job at that time. Here one of the questions that has to get hashed out is if you give mchenry these expanded powers to move legislation to the floor, to basically run all of the other duties of the house, who is in charge of the Republican Party in the house at that moment . Is it mchenry, the guy who makes sure the trains run on time . Is it jordan who still at that point is the conferences nominee to be speaker . Is it steve scalise, the only person who is in a high ranking elected position within House Leadership . All of these are Unanswered Questions too and never have been tested before. So, again, a lot of work has to be done in this closed door family meeting. But i can tell you they brought in one of the largest stacks of boxed lunches i have ever seen in my career up here. So theyll be well provisioned if this goes a while. They are fueled up. All right, garrett haake, we appreciate it as always. Please come back to us if you get some new details. New developments this morning from the israelhamas war. New israeli strikes this morning as President Bidens scheduled to deliver a primetime address tonight where he plans to discuss his administrations response to hamas attacks and the ongoing war in ukraine. Joining us now are Nbcs Jay Gray who is in tel aviv, and Gabe Gutierrez from the white house. Jay what do we know about whats happening today, this new wave of strikes carried out by israel . Reporter yeah, very intense, hundreds of strikes in the last 24 hours. That from the idf themselves saying they are running continuous attacks right now across the region. We do know that there have been some strikes to the south and including at least one drop near a hospital, about three or four blocks from a hospital, and near residential areas there. What the idf is telling us and these are their figures and details, they hit Missile Launch sites, tunnel sites, intelligence and operational structures. Theyre also saying at this point that they have, and, again, their words here, eliminated ten leaders of hamas. They continue to press forward there. And theyre continuing to be skirmishes, elevated skirmishes along the border with lebanon. We know that antitank missiles were fired into a kibbutz in that area today. And that the idf Returned Artillery Fire there. We know that they are Building Resources and troops in that region as well, and there continues to be a very serious concern about a second front in this war developing there. And, meanwhile, gabe, the president just returned from his trip to israel. What are you learning about what he is expected to say tonight . Reporter hi, jose, good morning. It is always significant when a president delivers an address from the oval office. And this will be President Bidens second Oval Office Address since he took office. And hes expected to appeal directly to the American People to keep supporting, not just israel, but ukraine, and hes expected to Push Congress to approve what he calls an unprecedented aid package. Now, several sources tell nbc news that the administration is expected to ask congress for 100 billion. Not just to support israel and ukraine, but also taiwan and u. S. Border security. But the timing of all this is still very much up in the air, jose, and ana, because as you know, the u. S. House does not have a speaker. Now, this all comes as the president returned late yesterday from that trip to israel, just over seven hours on the ground, a senior white house official telling nbc news that the trip went very well, that it went as well as it could given the events that were unfolding overseas. Of course, that deadly blast at that Gaza Hospital overshadowed some of the trip. But the president was able to announce 100 million in humanitarian aid for gaza and the west bank. And he was also able to broker that agreement with israel to allow humanitarian aid to head from egypt into gaza. Now, the white house says that aid is expected to start flowing potentially as early as tomorrow. Jose and ana . Gabe gutierrez and jay gray, thank you so much. With us to talk more about all of this is msnbc military analyst retired general Barry Mccaffrey and richard haass, former president of the council on foreign relations. Lucky to have both of you to discuss all of this. General mccaffrey, the situation has become much more volatile in the region. And really around the world, since the hospital blast. According to two senior u. S. Officials it was caused by an errant rocket fired by the Palestinian Islamic jihad, another militant group in gaza. It was not the result of an israeli air strike on the facility, according to these u. S. Officials. And their assessment was based analysis of overhead imagery, ints, pen source information. What do you make of it . Well, first of all, there is no question that 2 million Palestinian Civilians are caught up in a massive ongoing war that affects a population that is largely unmatched purposefully with hamas fighters. Having said that, im not surprised u. S. Intelligence came out so forcefully as did the president , as did Secretary Blinken and Secretary Austin and said this was clearly not an idf aircraft munition. Look, i have had hundreds of incidents, i was either the target of or employing artillery mortars, rockets, attack helicopters, aviation bombs, and within 15 minutes, Infantry Company commander knows what happened. And in this case, it obviously was not an Israeli Air Force precision strike. If they had gone after that hospital, they would have employed a jdam 500 pound bomb and knocked the whole structure down. The other claim was 700 killed. It looked highly improbable that there would be many casualties from a square that was set on fire. So, it was a rush to judgment, hamas propaganda as background to a massive murder of hundreds of israeli civilians. Thats what this war is all about. Just how it spread, as quickly as it spread was quite frankly surprising to many. And richard, that narrative that israel was behind the explosion that there were 500 to 700 dead, it spread around the world within seconds. Lester holt asked jordans Foreign Minister about the position, here is some of what he had to say. Listen to this. Sir, nobody is buying that narrative in this part of the world. The reality israeli army is not very credible in this part of the world as well. The only way that people would entertain a different narrative is if there is an independent International Inquiry into the tragedy that has happened with impeccable evidence that it was not israel. What do you make of this . It is going to be very difficult for some people to be convinced of that. Well, a lot of people will never be convinced of it, but theyre not interested in the truth. Thats simply a sad fact of life. What is disappointing is the reaction of the Jordanian Foreign minister, he knows better. What is disappointing is the decision of the jordanian king and the egyptian president and the leader of the Palestinian Authority to not meet with President Biden. They lost they forfeited the chance to express their concerns directly to him. They could have worked out various arrangements of how to hopefully calm this crisis. Bottom line is they were afraid to be pictured with him and thats just a sad statement on the state of our politics. And these are some of our associates in the middle east. Thats discouraging. I dont think the truth will ever catch up with the lie. We heard from that official, maybe an independent inquiry would make a difference. What do you think, general . Well, there wont be one. I think the idf would welcome one if there was a European Union or United Nations group, experts that flew in there, even this far after the fact, just looking, watching the video of the strike saying it seems patently obvious that that isnt what happened. It was not an Israeli Air Force bomb. But, look, the central truth of this whole thing is israel was savagely, massively attacked, they were surprised, they were incompetent in their reaction, they now have to protect israeli people. And the real question in war is how does it end, not how it began. And if it ends with hamas military fighters, 30,000 of them, still threatening israels existence, and with 100,000 hezbollah fighters to the north with a massive amount of armament, then israel will never have a days peace. So, were going to see an idf attempt to eliminate the hamas government and fighters in the gaza strip. Thats going to be a painful, bloody proposition. And, richard, with the reality being what it is in the middle east, and throughout the world, but in the middle east specifically, where is or is there a player that could come in and be beneficial to the future and im thinking you were just talking about really the lack of leadership and even availability of egypt, of jordan, and of the Palestinian Authority, so is there, like, a saudi arabia or another group at could have an impact . Saudi arabia could have an impact if they revived its effort to normalize relations with israel. Insisted on certain conditions to h the paleinns. Particularly in the west nk but i disagree with my friend Barry Mccaffrey. There is no way to eliminate hamas. It is as much a movement as it is an institution or an organization. We are going to have to live with it. Israel lived with hamas for decades. And hamas hasnt changed. What changed was israel reduced its intelligence capability and its Military Readiness on its border with gaza. That can never happen again. Israel has to restore defense. It has to restore deterrence. But the idea that were going to somehow eliminate hamas and find the arab world or the u. N. Or the Palestinian Authority is going to take its place or Something Better is going to emerge after Israeli Occupation that is just a pipe dream. It is not going to happen. I think it is a time for sober realism in the middle east. General, final thought . Well, actually, i agree with what richard said. I think all of the israelis can do now is to buy two to five years of relative lesser danger. There may be a political option that emerges after a savage israeli response to try and reduce the hamas threat. But i agree, i dont think hamas is going away or hezbollah or the iranian influence or the inability of egypt to help with a refugee problem. So, here we are, a bloody future coming up. It is going to get a lot worse before it gets better. We will be covering every twist and turn. General Barry Mccaffrey and richard haass, appreciate you offering your expertise and insight. Thank you. We have Breaking News on capitol hill, concerning the House Speaker race. Lets bring in nbcs ali vitali and msnbc political analyst brandon buck, former senior adviser, to both boehner and ryan. Ali, whats the latest . Reporter still no consensus on what vote or if well see a vote today, jose. But our understanding from what just happened Behind Closed Doors in yet another House Republican conference huddle, the current speaker designee, jim jordan, when i spoke to him this morning, said he wanted to talk to his conference first, thats what he did. Right now heres the plan. Jordan is not dropping out of the speakers race, thats according to what several sources have told me and my colleague julie tsirkin. Instead, he went into the room today, told his colleagues that he would back empowering the speaker pro tem Patrick Mchenry until january. Some time in early january. During that interim time, the house would be able to proceed on normal business because the pro tem speaker would be empowered, but jordan himself would remain the speaker designate and would continue to try to whip votes and get in line for an actual speakers bid sometime in january. This sort of solves the problem of trying to let the steam out of the pot on the frustration front and letting the house function. But it doesnt necessarily help jim jordans Numbers Problems. Theyre hoping that more time and more cajoling and conversations with colleagues could get them to a more positive place in terms of achieving the 217 number they have been going for three or four days now. Unclear that thats a strategy that will work. But it seems like thats their Operating Strategy right now. In terms of what were actually going to see around noon, when we expect the floor to open later today, it is not clear that were going to see them vote on another balloting round for speaker, were not clear on if theyre going to vote on the resolution to empower the speaker pro tem, that may have Numbers Problems as well, but our understanding right now, and this has always been the case, is that democrats are now sort of entering the chat and starting to figure out how many numbers they can supply on their side to empower the speaker pro tem. Again, All In The Name Of just trying to get this place working again, even on a temporary basis. So, brandon buck is here with us. January. An Interim Speaker until january. What does that tell you about the Republican Party right now . Ready for another speaker election . This is the only option they have. Jim jordan made a decision, he wasnt going to win. I think what hes trying to do is demonstrate Good Behavior over the next few months until these people who been holding out, i can be a team player, i can work with Patrick Mchenry. The fact hes not dropping out is important for a couple of reasons. One, of course, it empowers Patrick Mchenry, but it also means hes still the leader of the republican conference. Jim jordan . Jim jordan is effectively the leader of the republican conference, elected by his colleagues to be the number one spot. You have mchenry jordan Power Sharing within the conference. Not clear to me who will be making decisions. Who is deciding what we bring up . The fact that scalise got more votes the last time and decided not to run, would that give him any power there . I think scalise is dropping himself out of it. They had another election and jordan has now taken that over, over austin scott. So you have Patrick Mchenry, in charge of the house, you have jim jordan, in charge of the House Republican conference. And then you have to add in democrats. As ali pointed out, there is probably a lot of republicans not comfortable with this but they probably need democratic votes. Now you have democrats, Patrick Mchenry and jim jordan need to figure out how to get on the same page to govern the house. Never seen anything like it. We still have a long way to go before we can nail down the votes on it. It will be a very interesting dynamic and a lot of tension between the two of them. He thinks there is an opportunity to get there in january. Jim jordan for a second, what makes you think he can unite his conference . Hes somebody who has, you know, been, i guess in some cases more of the extreme in the party, right . He didnt vote to certify the election. He was an election denier. And we heard from some of his colleagues, but that actually is one of the biggest reasons they want somebody else. Yeah. He may not be able to get there. Youll hear a lot of people saying this doesnt work for me. You can empower jordan all you want, empower mchenry, but im never going to be there. He may have to drop out. We may be right back here again in january. But hes got a chance in the next few months to say biggest thing we have going on is funding the government. Thats the big tough thing to do. If he can demonstrate im a team player, ill work with most of the people who are not backing him are the appropriators. If he can say im with you, i can get this job, i can be responsible in appropriating, maybe you can come along. I dont know if thats enough. I think he has a very steep hill to ever be speaker, but he bought himself two or three months to say look at me, i can work with you, give me another chance. Well see. Brendan was talking about this, the role of democrats. What is their role . Reporter look, their role here is to figure out what has to happen for them to get on board and effectively give republicans the extra numbers that they need to empower a speaker in the meantime. I spoke for a while with democrats across the caucus yesterday, and Hakeem Jeffries, the top democrat, in the last few days, has been really sounding notes of openness to the idea that they know theyre not going to get a democratic speaker, but they could get someone to work with who is not jim jordan. Yesterday, Hakeem Jeffries outlined two priorities to me. First, making sure jim jordan would not become speaker. I think theyre feeling good about that. But then who in the republican conference could they work . The word jeffries used was someone who could work in genuine fashion with democrats. They would like to see this place just simply move forward. The Government Shutdown is not getting any further away. That November 17th Deadline continues to creep closer and closer the more that this thing stalls out here in congress. I think the other piece of this too, politically speaking, you think about moderate republicans, and brendan was right last hour when we were talking about the fact that moderate republicans seem to realize that they have as much power here as the more far right members of the conference have always known that they do. Were watching them start to have some moments here in the sun. I think the important thing is too when they go back to their districts, any moderate republican who is already voted for jim jordan now has that political baggage in their reelect, whether he becomes speaker or not. Ali vitali and brendan buck, to be continued, no doubt. Thank you, both. Thank you. And this is where former trump attorney Sidney Powell just pleaded guilty this morning to six Misdemeanor Counts in the Georgia Election interference case as part of a deal with prosecutors. And joining us now as we reach the 46 past the hour, nbcs senior Legal CorrespondentLaura Jarrett and nbc justice and intelligence correspondent ken dilanian. Laura, what is your assessment of the terms that powell agreed to in this . The most significant term in this entire deal is the fact that she now has to testify truthfully against other codefendants, including the former president , and rudy giuliani, who are all part of this alleged scheme to try to overturn the last ection and to try to keep the former president in power. Thats something that the judge reaffirmed today in court, something she said she understood. And if she goes back on that, that means the prosecutors can go back on this deal or she could be facing prison time. Remember, this is what has allowed her to avoid time in prison and get probation, which is significantly lighter than what she had been facing there. And so, ken, of course, bigger picture, there are two Election Interference Cases. What could this mean for the federal case against donald trump . Thats a great question, ana. Anything that Sidney Powell says in this state case could be used against her in the federal case where shes one of six unindicted coconspirators. So, the jack smith and his indictment of donald trump and that federal election conspiracy case made a series of allegations against Sidney Powell, she was unnamed, but clear it was her. It raises real questions about what is her posture in this federal ca, will she cut another Cooperation Deal with jack smith before shes even charged . If she doesnt, shes at great risk of incriminating herself if she testifies truthfully about her bogus claims of Election Fraud in the georgia case. Smith could say, hey, listen, come on and ill give you any kind of legal exposure to the side, right . More likely shes hoping she can go in and make that her attorney would go to the federal prosecutors and say, look, my client has reassessed her options. She now understands where she sort of lands in this, visavis her culpability, were willing to make a proffer, which is her coming clean with everything she knows. And would you be willing to sit down with us so she can essentially tell her story . And then they could assess if after they hear what she has to decide whether they want to charge her with something or not charge her at all. Donald trump is the only one facing charges in that case, likely because they wanted to make sure the case could get up to speed and go fast because we see how far along this georgia case is taking. He isnt anywhere close to a trial. Chesebro and powell were going to go right away. 19 defendants say different ball game. But for the defendants, they were focused on donald trump first. If she can get away with trying to get the prosecutors to give her a deal before shes charged, shes in a much better position without that Uncertainty Hanging over her head. And any thoughts on the timing of this deal . It is hard to know because right now, again, trump is the only one facing any charges and they seem so focused on making sure that one goes to trial first. They dont seem to be in any rush or any urgency with any of the other unindicted coconspirators and may never bring those cases at all. And so, back to the issue of this trial, so specifically focused on trump, but there is a whole slew of people in there, including rudy giuliani, where he had a lot of communications and exposure with her. And she has to now come clean about not only trump but all of those people as well. Shes in all of the meetings before and after the election. The Wild December Meetings we heard about as it relates to the january 6 investigation, some of that testimony came out. Shes there in all of those meetings. She can speak to what trump and giuliani said. Remember, she has a codefendant who i guess former codefendant, ken chesebro, who will go to trial on monday. She may testify at his trial as well. Do you think this changes trumps defense . It makes it more complicated. We will see how they shift their strategy as a result of this. Is not welcome news for them.
