House republicans struggling to find that leader after assistant Kevin Mccarthy with no clear successor in sight. Then, disgraced crypto case sandbag mans trial is getting underway. What his parents are now saying about the case and new reporting on why theyre looking for their own escape routes, as the 11th hour gets underway on this wednesday night. Good evening, once again, im Stephanie Ruhle live at Msnbc Headquarters here in New York City. Donald trump also in New York City today, back in the courtroom for his third day of the civil fraud trial. He left court midway through the proceedings and was visibly on his way out. We are going to play some of what he said, even if it is filled with slender or lies or absurdity. We are going to play it because this is the front runner for throughout the president ial nomination, and what he says matters. Watch this. Im here, stop here, and i cant i would rather be right now in iowa. On rather be in new hampshire, south carolina, or ohio, or a lot of other places. But im stuck here because i have a corrupt Attorney General who communicates with the doj in washington, to keep them nice and busy, because im leading biden in the polls by a lot. Election interference. They made up a fake case. They are fraudulent people. And the judge already knows what hes going to do. Nope, none of that is true. As far is donald trump being stopped here, not true. He chose to attend court today. And yes today. And let it before. In fact, a reporter asked temperate after, that what he makes the choice to be there, and he said, because he was to point out how corrupt the cases. Lets give you more facts. To be abundantly clear. There is zero evidence of corruption or any kind of election interference. In fact, that is what trump is accused of doing and two different cases. Here is new York Attorney general Letitia James soon after trump left the courthouse. Mr. Trumps comments were offensive. They were baseless. That were devoid of any facts or any evidence. What they were, or what comments that unfortunately fermented violence, and comments i would describe as race baiting. Comments unfortunately that appeal to the bottom of our humanity. This case was brought simply because it was a case or individuals have engaged in a pattern, practice of fraud. And it will not sit idly by and allow anyone to subvert the law. And lastly, i will not be bullied. And so mr. Trump is no longer here. That donald trump show is over. This was nothing more than a political stunt. A fund raising stop. As far awh happened inside the courtroom today, we are testimony from two accountants who at one point worked on trumps finances. One of them singled about trumps son, eric, who was in the courtroom today. The accountant Cameron Parish said eric was part of the executive Leadership Team who, quote, set the tone at the top. Meanwhile, erik sat in the courtroom shaking his head, no, no, no, during that great testimony. With that, lets get smarter with the help of her penultimate. And guess what, its a big news tonight, which means it is ladies night. Carol leonnig is here. Pulitzer prizewinning Investigative Reporter for the washington post. Susan glasser is, backed staff writer for the new yorker. And former u. S. Attorney, joyce alene, who spent 25 years as a federal prosecutor. Susan, of course, none of these comments are going to surprise trumps base. But what about the rest of the country . Are we just getting used to him pushing these lies over and over . Its nonsense well, if there was a role against nonsense coming from donald trump, look. The bottom line is, it is about politics, not the law. Theres no lawyer, i mentioned, it would advise anyone, never mind the former president , to Front Mustard Edgy of attacking the judge in your case. Attacking the judges staff in your case. Taking the prosecutors in personal terms. Thats not generally speaking it recipe for winning your case. So it seems very fair to conclude that what trump is doing here is continuing his campaign to return to office by other means. And his campaign, as his campaign in 2020 and 2016, its not aimed at the rest of us. To your question, its aimed at rallying and angering and roll it up his own electorate and his own base. His base is not enough to win the president ial election, or it wasnt in 2020. Carol, whats interesting is, and the last few weeks although, donald trump has taken his rhetoric to a whole other level in terms of lies and slander. And just overall darkness. What do you think going on . I love the word that susan used about riling up. Because what donald trump learned in his 2016 campaign, is not only could he tap in to the anger, disappointment, and frustration of a segment of the population, but he could crank it up for his own benefit. For his fundraising, and for eventually his election to the white house. So when you ask, what is going on here . He has learned that lesson of 2016 and 2020, which is whenever he tries to appeal to peoples lowest expectations of government, the greatest distrust, there are huge just, most fantastical conspiracy theories, that everyone is against him and potentially everyone is against them, it is a very winning combination. Now whether or not it gets him the number of votes he needs in the next election is still to be seen. But it has been at, winning role for him in many, many situations, and hes going back to that well. I think some of the comments hes made recently about, for example, the possibility that mark milley, the general and former chair of the joint chiefs of staff, would be executed, the idea of calling a prosecutor corrupt in her own courthouse, sending pictures of judges staff member and calling that judge a left wing liberal, these are things that go not so much to winning his case, but winning his campaign. Okay, and all of these things go, joyce, to a question i have about the gag order. There is lots of people sitting at home this week go, and didnt i hear something about a gag order . What does donald trump get to keep running his mouth with no consequences . And now we learned that he doesnt. Just like that, a State Court Judge in manhattan say, it donald trump, in this instance, you are just like everybody else. If you talk about my courtroom personnel, if you do it again, trump had passed a picture and made selection statements about one of the judges courtroom deputies, a lawyer in her own right. And the judge said, thats the line. If you do it again, there will be serious consequences. As with all of these charges, the question is, whether or not there is an enforcement mechanism. Might judge be willing to hold in contempt or a fine or even jail donald trump . To put an end to this sort of behavior . But the reality that every judge trump is in front of, ultimately faces, and we heard james say today, we heard these comments dangerous. Hes targeting people. Someone could easily get hurt and the judges bear the responsibility for preventing that from happening, even if it means taking this unusual step of getting up former president while he is running for reelection. But joyce, hes not stop. And he would harder and more aggressive today than he has yesterday or the day before. Thats right. He has this upcoming hearing and the district of columbia, where is a request for not a gag order butlimited Restraining Order with prosecutors clearly very angry about this attack on his court has staff. He is, i think, and susan for, its pretty propelled up about that. And so we may see him mentioned the temper of trump. Who displayed, by the way, today in the courtroom that demeanor of a toddler. And its still limit to me, people, average americans, if one of their kids behave like this, one of their case is behaving is the china patient, accusing everyone but him of being in the wrong, people see through that. But here we have a former president who wants to win everyone but himself for whats emerging as a clear pattern of fraudulent conduct. The question is, how long people and the judges will tolerate the ongoing lies. I think we are seeing the end of that sort of permissive environment for trump. Carol, hes out there and staying hes stuck in the courtroom, when thats a lie. He could be anywhere he wants. Hes in that courtroom and every chance he gets, hes asking his donors for money. Even a single dollar, while at the same time, hes talking about how super wealthy he is. So explain to me. Is this Fundraising Mechanism actually working . And who is it writing the checks . Theyre nodding, saying, you are right, big guy, you are the richest person in the world, all right you the. Jake i dont get that either. I dont pretend to know exactly how well hes doing on the Campaign Trail in terms of donations and the last few days. But i will say this. Donald trumps poll numbers were really, what were described as milk toast before he was charged with a crime. His expectation has proven true. His Ex Patient Station is when hes up against the ropes, when he is appearing to be victimized, he plays a martyr role. He convinces his supporters that somebodys coming for him, so that they can block him from being president , and that means that the justice department, the federal Law Enforcement, the local Law Enforcement in new york, the county and state Law Enforcement in georgia, and all of them have chosen to come for him so as to come for voters who support him and to claw their wishes. And, you know, these poll numbers were pretty pathetic until he was charged. And then they started to creep rather rapidly upward. Which is really interesting. Voters are seeing him onstage, acting that matter, and they are coming to his defense. Sometimes with donations, sometimes just with fair registration that that really supports the sky and are expected to vote for him again. Susan, lets talk about the trump case. Ivanka has wiggled her way out of this, but one witness today, a former accountant it worked with the Trump Organization tote by eric trump. Said he said on top of the organization and at leadership position. Eric said, no sir, i didnt. And in the video of the deposits we, saw erik and don jr. , i dont get her any of this works. Is that going to fly . This wasnt a giant corporation. Less than 20 people or. There it was a Family Business with a big, giant. Bryant thats right, thats always the striking thing about the Trump Organization, it was a Family Business. And its one of the most extraordinary model in fact to me about the Trump Presidency that the president , when he came into white house, refused to do what all other recent president s have done, which is to follow ethics rules, to divest himself or at least place his holdings and a blind trust while he was president. He said he wasnt going to do that. No mentally speaking, his son eric was placed in charge of the Trump Organization. It is clear trump himself was still a personally engaged with his own business. By the testimony of numerous people who followed trumps career throughout, he cared most of all about the Trump Organization, not only did it have his name on it, but money has always been an animating factor for. Him he was still working on deals, remember, even throughout the 2016 campaign when he was running for president. And so i dont think its going to be very plausible to suggest, as a defense in this case, that the family organization, that the family didnt know with the family was doing. Thats going to be tough thing to prove, i would imagine. Important reminder. The one thing that put shoes and those deals was the fact that donald trump stood to potentially become the president of the united states. Thats what there was no way he was going to loosen the reins on his business. Joyce, lets talk testimony. What stood out to you from these two former accountants . The testimony is slow and perhaps not the six east part of testimony and a case. But what these accountants do is they build the case, you or member of the judge has already ruled as a matter of law there was a fraud involved. Now were looking at some of the remaining charges that the Attorney General has brought that and fulfill statements, primarily, and whether these false Financial Statements report for it and by who. But also the issue that is hanging in the courtroom is the issue of damages and how much money trump will have to pay, in essence, how much profit he has received as a result of the fraud that must now be diss the incumbents are an important part of expanding the lines of control and organization here. Eric its a great example. There was testimony obtained during depositions that he was responsible for the false valuation on one of the properties. And that he sent off on some of the Financial Statements in one year. Today, we are primarily hearing testimony about whether he trump provided actuate in formation to mazars when they are doing the accountant. Weve already learned it was not pretty audited in any sense of the word. It was mostly just a compilation of documents. And this accountant, who i think at some point, had to make a decision to did he want to be defendant or of witness, he clearly chose to be a witness in this case. He is now laying forth this sort of notion that he was not given the documents that he would expect to be given by any other business involved in this sort of accumulation of documents. I need to move on, but i do have to ask, quickly. Lets just get the damages are huge. Whats the timeline that he actually has to write a check . Or will he does get to appeal and appeal . Im thinking, six months ago he was ordered to pay e. Jean carroll 5 million. Has he reckon that check . Does she have the money . Typically, to appeal a judgment like this, you have to put an appeal bond and place. That money for instance and the e. Jean carroll case isnt in e. Jean carrolls hands, it but you have to secure your willingness to pay the appeal bond before iran made it to move forward. That is, i think, a partial step towards justice and these cases. I want to move on to georgia. Because the New York Times points out, even though trump will not be in the first trial this fall, hes going to beat him large. Because thats her Return Kisses work. Can you explain to us, joyce . Sure. This case thats going to trial at the end of the month will only involve two defendants, Kenneth Chesbrough and sidney powell. The government still has to prove the entire conspiracy to engage in rico and the other charges that are made records to these defendants. So we will see, this will really be funny willis to up the same case that shell bring against donald trump. She will have to prove that agreement was made among defendants to achieve that rico outcomes that would engage in this sort of effort to interfere with the election on multiple fronts. We will learn an enormous amount about the evidence that prosecutors in Fulton County have against donald trump in the course of this case against his two codefendants. Carol, also reporting georgia prosecutors are fluent plea deals to some of trumps codefendants. How could these deals change things here . Just to be just as the accountant in new york is deciding hit rather be a witness that a defendant, there will be people in georgia who are charged in a very, very broad conspiracy. They cited themselves, have private conversations with their lawyers, i just did this one little thing in this paragraph and i did it because so and so encouraged me to do it. And they will think about what the penalties are if convicted. What the changes are, if convicted. And what are your choices . That is something that every defendant has to wrestle with. Are they going to be actually convicted . What are the penalties for that . And when those people start to flip, essentially, and start to give their testimony, its some of the most powerful testimony there can be. Because they were essentially a party to this. They were a coconspirator. And now they are turning on, essentially, the head of that rain and saying, you did this i did this but im explaining how we do this together and why this happened. Tim, because of the vacant is in the house, the next speaker actually only needs 278 votes. How do you think this is going to play out . Do scalise and jordan have a shot . He said in a separate interview, hes going to go to fisticuffs with matt gaetz head hate state last night. They have to take a break for the week. They took six weeks off for the summer, they need another break to calm their jets. Heres the problem. To get to 217, you need to have all the mecca crazy people in the caucus, right . Because at least eight of them have already shown theyre willing to throw overboard anyone whos willing to not go along with her crazy. On top of, it another congresswoman and Napoleon Luna sent out a tweet today, maybe yesterday, she would only vote for a speaker who funded jack smith and promised to pull up an Impeachment Vote on biden, which is over nothing. They dont have anything. Its lunacy. Net were up to 11. And you can only lose floor. So that is good news for jim jordan. The question is, would any of the normal republican congresspeople, Quote Unquote, normal member connor can speak to this, since there his former colleagues, would any of them use their muscle to push back on a jordan nomination and say, hey, we need a speaker who at least it isnt a conspiratorial lunatic and will at least find ukraine. Arthur five republicans that will say that . I would hope so. But i kind of doubt it. Thats basically where we stand. Conor, republicans might be in the majority in the house, technically, but given what tim just laid out with the Marjorie Taylor gaetz extreme affection love to shut things down or blow them up, revolutions do not have a california rubble majority, period. They cannot pass anything, they cant get anywhere else. It basically converts itself, the house converts itself to a place to hold performance hearings. Up bunch of lawmakers who cannot make any laws. How do you see it . I think that people like eric graves and moderates and establishment members in the Republican Party have kind of been in denial about this. Ever since january, when they all support Kevin Mccarthy right away and they stuck with him, even when he handed matt gaetz the club to beat him with. And that was bound to come to fruition, sooner or later. And so, this time, they have spent a lot of the last couple of days limit democrats. And that just tells me they are still in the mile and very going to end up back in the exact same place. They need to walk out of this conference, walked out of the party, people into cross the aisle and team up with democrats to let somebody else be speaker. If they are not willing to face facts and go to those lengths, matt gaetz is still coming to control this and her thing. I want to talk to who you think behind medicaid, spin terms of strategy. Because the New York Times was reporting that its steve bannon whos feeling this meltdown and we talked a lot about this long term attention that hes had. I remember, 2017, interview he had, where he said his goal was to burn it all down, just for the state. But this now appears to be happening. Is it bannons handiwork . Im sure hes a part of it. I think gaetz is also inspiring young politicians who want to be the governor of his state, or just wants people to notice him. I always felt like he had a pathetic quality about, him where he needed to be recognized and love in a world where people arent giving him that kind of affection. So this is big moment in the sun. So youre right, its not for anything. He just happens to be from a district where people are okay with very radical measures to slash and burn that federal government. But thats not a Majority Position and america. And that raced of the Republican Party is going to pay the price for this, if theyre not willing to go to extreme measures to kick the sky out, or to go around him by teaming up with the other same people in the caucus. I want to see who could be behind this curtain. Tim, you confronted steve bannon about his lackluster. Lets watch a clip of that. To the house of next year, we need a real basics committee. Oh, come on. No, we are going to adjudicate all of three november you cant really believe all this [bleep] people stormed the capitol over this [bleep] dude. These are that was oh, they are lies. You dont believe this now you dont believe this [bleep] you think bannons bathing in all this mud right now . Hes enjoying it, thats for sure. Its interesting, though, you go back and analyze that clip in a while, he promises the new republican majority will go back over all the Election Fraud conspiracies and so, bannon what is wrong about that prediction. He was right about his prediction, though, that he could find enough fellow anarchists, nihilists, whatever word you want to use, to take out Kevin Mccarthy and the the maga. And Kevin Mccarthy did. He pandered out maga as much as he did, but even still, bannon and their ilk were going to throw him over. Because he was a member of the old guard gop. And i think conor is right that bannon and those guys do not represent a majority of the country. But they do represent a majority of the people that vote in republican primaries. That is where their Power Emanates from. That is why Garrett Graves and Kevin Mccarthy and all of them keep Running Scared from him. And until thats one thing i agree with conor on until that segment of the gop is caught, that establishment, old guard, and told a flex their muscles in the same way that bannon and matt gaetz have, it is going to be groundhog day. Running scared, or empowering them, conor, because my colleague john allen is calling matt gaetz and his allies the bazooka caucus. Hes arguing mccarthy didnt just runs here. He helped to arm them with his weapons. Does that sound right to you . Yes, he was desperate to be the speaker of the house, and he was willing to do whatever it took to sit in that chair. It wasnt worth it in the end. And i think people who know this institution knew back in january that this was gun, the second it was placed on stage, it was bound to go off sooner or later. But being in washington, there is group think. There are people who spend the years and years chasing the ring. Thats what we saw here. Thats why, again, i just returned to these people who allowed kevin to do that. The garret gravess of the world, the second they allowed him to give that away, this was preordained. So, if they dont recognize that, now this is all going to happen, all over again, and on thanksgiving we will have a government that is shut down. We will have troops overseas that are not being paid. And these guys will be responsible for it. And i will be looking for the constituents who said we voted for. His mom and dad are still saying their boy is innocent in a recent interview with the new yorker, his mother barbara was defiant, saying, quote, i dont what is said about me. Joe doesnt care what is said about him thats the dad saving sam is the major project of our lives. And making you two filthy rich was the project of his. The author behind this incredible report joins me now. New yorker staff writer, my dear friend, sheelah kolhatkar. What sheelah kolhatkar, i want to hear all about the parents. But just tell us, what were the biggest takeaways in court today . I was struck by the insane contrast between the two stories being presented. The government made their opening argument. They said, yes, sam was basically a sociopath. He built his entire empire on lies and deception. He still Ten Billion Dollars. That is their version. And sames lawyer, their presentation was, basically, here is a a nerd, he didnt like to party, and he did not mean to hurt anyone, and he got in over his head. So, we have two very, very different stories the jury is going to have to but how can that fly . This is not an honor Board Meeting for a guy who cheated on his physics final, okay . He was the biggest player in the crypto universe. Hes facing 100 years in prison, Ten Billion Dollars in fraud his direct reports in his company, who were his closest friends, have now pled guilty and they are cooperating with the government. His Defense Lawyers really think his short new here cut and the big business as a defense . I dont think that they would suggest that they are going to have an easy road. Obviously, the chances of a conviction here are very high. The evidence and the power of the argument the government is making is enormous. It is hard to imagine anyone being able to prevail in this situation. But i will say, sam seems to really believe, still, that he can talk his way out of this situation. And he has an explanation for everything. And for him, my sense, is its heartfelt. He really believes these explanations. And again, i believe i am going to be named playmate of the year. That is just not remotely possible. I want you to talk to us about the parents. Because you spent time interviewing his parents. And we are reading his mom is saying, my son is absolutely innocent. This woman is not sitting at home knitting with her son hundreds of miles away. Explain to audience, how deeply involved is, mother and father are in his business. And if he is found guilty, they are in trouble too. We are not going to know exactly what kind of legal peril they are facing until after sams trial is over. But yeah, they have been named as potential witnesses in his trial. So, the government could call them to testify, which, i am sure, for them, would be horrifying. What has their involvement . Been you mean in the company itself . Yes. They very involved, especially as that. Joe bank min, who is a renowned scholar of tax law, he has done all kinds of important work exposing tax filing direct to the government, so you dont have to pay a ton of money to turbotax, which basically has a monopoly. So, anyway, he has done all this really good work. But then, one day, his son, who he reveres and who he thinks hes a genius, seems to be achieving all the success with this newfangled crypto stuff, which i really dont think joe or barbara, sams parents had any understanding of, like many people of their generation. And sam needed help. He needed help finding tax lawyers, he needed a counting up. He needs to find Legal Counsel for the firm. And his dad was a wellposition to provide that. And he did. And of course, as the whole thing seemed, in the heat of the crypto Frenzy Bubble that was absurd but was a very strong at the time, the company seemed to be taking off. It reported hundreds of millions of dollars in profit. And sam said to his dad, well, listen. I want to give away all my fortune to philanthropic causes. I would like you to come here and help source charitable projects to give away all of my billions to, and for his dad, that was a dream job. So, the parents went to the bahamas to help him. Indeed. Of course, hes now in this hot mess. What was your take away . From spending time with the two of them, what do you think . One of the most shocking things that happened when i was reporting this piece for the new yorker was, the beginning, at the outset, when i was beginning to know barbara who, was, again, a very well respected legal scholar, an impressive woman but i said to her, listen, was there a moment when these charges were filed when you had to go to sam and just say, did you do any of these things . Look at what the government has accused you of doing. Of, course all of us who have children or who have parents know that kids can shock their parents. So, this is completely normal and . Well, she didnt even ask him. She said she did not need to ask. She knew he was incapable of stealing or lying. That was the level of her faith and confidence in his character. Oh, barbara. Barb. Either the chief was, perhaps, the most incompetent chief that anyone could have ever imagined, or there was some malicious intent behind this. He just today filed a defense against a reporter whose computer is being taken away and a picture that is on the screen right now, he also seized her personal cell phone, and his response was, i just told everybody about this, and they did not tell me it was a bad idea to search this. And then they told me later that they had not even read what i said. And so, what am i supposed to do . So, what do you think . It is deviance . Or incompetence . I dont think its actually both. I think theres a little bit of both going on in this. And theres a lot of different players, all of whom had different objectives in what they were looking for. Our story that we were trying were breaking this day in our papers, some suspicions being raised about a politician locally who seemed to know a little bit too much and talked a little bit too soon to the supposed victim of the Quote UnquoteIdentity Theft that wasnt. And try to implicate us in that, even though there was absolutely no reason to, for him to know that we had received the document that we had received. So, we think there is some leaks going out, that we are trying to see, weve got this newspaper and this politician. Because the vice mayor was also involved in this. Who we can really squash right now if we want to and lets go out and do it. And it was it is obvious for me its overkill that they went to. They think that just sticks in my mind is, seven Police Officers to raid the home of a 98yearold woman . Its just ridiculous. They did not need that many. They used to two when they were waiting home of someone who had raped his five year old granddaughter. I think thats a little more dangerous and serious of a crime then stealing somebodys record that says they are not driving legally. And we did not even do that. That was not a crime. To date, no Law Enforcement officer has ever spoken to me about this case. So, the investigation, as thorough as it was and they accused me of being involved in it they have never even spoken to me, other than to hand me a Search Warrant and take stuff away from me. You mentioned your mom joanne and again, i want to offer my condolences, and remind our audience, it was just 24 hours after that raid that she passed away. She was a longtime publisher of the paper, she was so passionate about her work, about the paper. What do you think she would say now after everything you and your staff have done . Getting the paper out . Reporting on what happened to you . She is looking down from heaven. What is she thinking . First thing she would say is, get some sleep and eat better. But she is a mom, after all. I think she would say that, you know, when you are 98 you dont have a lot of contribution to make to the world anymore. You are going to go out, and you would like to control that. You will go out, but you are going to go out quietly. She didnt go out quietly. It was very unpleasant for her. But i think if he could look down and say, see what happened since then, she would say, gee, this is great, at 98 i still managed to contribute something to this discussion of Freedom Of The Press and democracy and the First Amendment and everything else. I think she would be proud of that. I think she would be proud of what we have done. And she would be mad or then i dont know what at some of the people we have been reporting about.
