This unusual day in the House Of Representatives. We will figure out a way to talk about this too, with congressman james clyburn, who had every right in the world to think he had seen it all until today. Nobody has seen it all, apparently, with this House Republican conference. Unusual is one word for it, my friend. One word for it. Thank you, alex. Have a great show. Matt gaetz, the 42yearold republican congressman who overthrew the speaker of the house today, had not been born yet when republican Ronald Reagan began running against government. Ronald reagan was the first republican president to be rhetorically and only rhetorically Anti Government. The last republican president , elected before reagan, richard knutson, was a very conservative republican. But he believed in the governments capacity to solve problems. Nixon willingly signed the legislation creating the Environmental Protection agency. Richard nixon pushed a Health Care Bill in congress that was structurally similar to the bill president nixon would try to an act, and president obama the republican president before Richard Nixon knew that government was a force for good, in this world, when he served as the european commander of the United States forces in world war ii. When general Dwight Eisenhower became president eisenhower, he supported all of the relatively new social service programs, including social security, that were advanced by a democratic president Franklin Delano roosevelt, and legislated by democratic congresses. President eisenhower created the interstate highway system, the single biggest federal Infrastructure Program the country had ever seen. So Ronald Reagans Anti Government rhetoric was actually out of sync with his republican predecessors in the presidency. But president reagan never followed through on his rhetoric, because he never meant it. He campaigned on cuts to Government Spending that he then never enacted. He campaigned against taxes, even though in his service as the governor of california and president of the United States, he raised taxes as well as cut taxes. Ronald reagan told his lies about a Government Back in the day when no one in washington thought they were lies. They called that stuff spin, but the young republicans listening to Ronald Reagan in those days were too young to know that reagan didnt mean what he was saying. And now, many of those republicans or in the House Of Representatives and even younger republicans, who never heard Ronald Reagan speak, are among the most energetic traffickers in rhetoric. It expresses uncontrollable hatred of government. The american government. Including parts of the government that were one of reagans favorites, like the fbi. Republicans and only republicans in Congress Want to abolish the fbi. They say they want to destroy everything in government. They say the only reason to preserve the Justice Department in any form is to use it to prosecute republicans political opponents, and no one else. And when they say that, they are echoing the leading republican president ial candidate who is openly campaigning for the presidency, simply so he can use the presidency for his own personal purposes. That is the kind of madness Kevin Mccarthy was trying to preside over in the House Of Representatives. Until today. When just one member of the Republican Party filed a motion for a vote on removing Kevin Mccarthy from the speakership. The motion is called a motion to vacate the chair. 210 republicans voted to keep Kevin Mccarthy in his job. Eight republicans voted to remove him. And in republican world, eight republicans beats 210. Which is, in its way, Poetic Justice for a party that believes in minority control of government. And so for the first time in history, a speaker was removed by a motion to vacate. And then, Kevin Mccarthy said this. Unfortunately, 4 of our conference can join all the democrats and dictate who can be the republican speaker in this house. I dont think that rule is good for the institution, but apparently im the only one. I believe i can continue to fight, maybe in a different way. I will not run for speaker again, ill have the Conference Pick somebody else. The house is now closed for business, for a week. Republicans are expected to try to elect a speaker on wednesday of next week. Here is a sample of the last words america heard from republicans in congress, before they shut down the House Of Representatives for at least a week. Theres a second group. A small group, honestly theyre willing to plunge this body into chaos and this country into uncertainty for reasons that only they really understand. This republican majority has exceeded all expectations. It is astonishing to hear any colleague give Speaker Mccarthy credit. Voting is at the least a disruptive overreaction. In reality, its selfish. Bad for a conservative policies. The Incentive Structure in this town is completely broken. We no longer value loyalty, integrity, competence or collaboration. Oh, look at that. Oh, look. Give me money, i filed a motion to vacate. Using official actions, official actions, to raise money. Its disgusting. Disgusting. Leading off our discussion tonight is democratic representative james clyburn, of south carolina, he served as the Majority Whip under House Speaker nancy pelosi. Hes now the assistant democratic leader in the house. Thank you very much for joining us on this historic night, congressman clyburn. As i said to alex wagner, you had a right to believe that you had seen everything in the House Of Representatives, until today. Well, thank you very much for having me, lawrence. Youre right. I thought i had seen it all. And i thought that id read about stuff way back yonder that we never see again. I was wrong. History does have a way of repeating itself, and ever since i think it was Joseph Cannon was subjected to this kind of a vote. But even then, the vote did not prevail. Today it did. It looks as if we are now confronted with a conference that is trying to run the entire House Of Representatives, that is divided against itself. And that, as we know from history, it will not prevail. So, we will come back in another week and hopefully they will get their act together. Because they country is looking to us for leadership. The country needs stability around the world. And within our borders. And we ought to be providing it in a bipartisan way. The democrats demonstrated last saturday, when we had the vote, that was mccarthys bill that he put on the floor. It was not our bill. Because ukraine in it in the we voted for, in a bipartisan way, more democrats than republicans, yet rather than accept that as a good gesture on the part of democrats, as having done something in a bipartisan way, he went on the sunday shows the next morning and started calling democrats out for trying to force a shutdown of the government. You go figure. How could you do that . And then stop this morning. He doubled down and says, i will not deal with the democrats. Im going to go to the floor, take my chances, with only republicans. And he saw for one hour A House Divided against itself, the republican conference, the entire debate was between their factions. And we democrats, like the rest of the country, looked in on it, disappointed by it. Now forced to live with it. Congressman, a week ago, the question was, would republicans shut down the government . It turns out, what they were going to shut down was the House Of Representatives, which is now shut down for at least a week and, in effect, for as long as it takes to get to the next speaker, however many votes that might be. Thats correct. I would hope that they would come forward with someone who can work in a bipartisan way to get things done for the American People. Next in line, of course, is steve scalise. He has a very good reputation in the house. He is someone that i worked with at the coronavirus select subcommittee. And i have known him for a long time. He seems to have the demeanor that is necessary to bring people together. The chair of the Rules Committee from oklahoma did a great job today. So, there are people on the side of the aisle that, i think, the public will be comfortable with. And i think democrats could be comfortable with. But we will see what they will do. They seem to be more interested in making headlines than making headway. In the past, i used to think someone like tom cole, he just mentioned, chairman of the Rules Committee, could be a fairly effective republican speaker. But that was before donald trump, where Congressman Cole has been a complete supporter of donald trump. Isnt it the case now that if a republican speaker works with the democrats in any way, there are eight republicans on the house floor who will immediately vote to remove that republican speaker . That may be the case. I have a Good Alternative for that. The name happens to be Hakeem Jeffries. He is someone who has demonstrated in the last several weeks, in fact, ever since january, when we put his name up. The American People have been looking at him and the way he has run the democratic caucus, and a bipartisan speaker, let those eight join with us on the democratic side. And lets give Hakeem Jeffries the 218 votes he will need to be speaker of the house. I am saying that. I know full well that is just as far fetched as almost anything i could think of. But if those eight people cannot work with their own, maybe they will work with us. Or there could be eight others somewhere over there on the republican side who no longer want to try to do this in this never before seen version of governing. You cant even call a governing, what these republicans are trying to do. You have worked with speakers before and you have seen them, congressional leaders, up close for many decades now. How would you describe how Hakeem Jeffries handled guiding the democrats in the house through this crisis, this, today. Masterfully. He did it in a very masterful way. Hakeem jeffries listens. And when you listen, you can develop a good response. And i watched him in our leadership meetings. He goes around the table and listens to everybody and tries to find a common narrative coming out of their comments and the questions they raise, and then set forth a process that everyone has been buying into. And that is why you have seen our caucus functioning the way it has. Because Hakeem Jeffries has demonstrated that he will put the people of this country above the politics of the party. Nobody is more diverse in political thought than the democratic caucus. My goodness. We have various thoughts that must be reconciled. And Hakeem Jeffries has demonstrated that he knows how to reconcile differences and how to find common ground, how to keep the country moving forward. Because we all know we are not a perfect country. We are in search of perfection. And that is what he is masterful at. And i think he is going to make an outstanding speaker, if not within the next several weeks and certainly within the next several months. The bipartisan action net was taken this weekend in the house. It extends Government Funding for 45 days starting saturday. Those 45 days are going to pass very quickly with this Leadership Crisis in front of us. That challenge will be the next speakers very first challenge, with that deadline for another possible Government Shutdown deadline looming. Yes, it will be. And i would hope that we would take this week and then go back into our districts and everybody will talk to their constituents. Because i can tell them what they are going to find. They are going to find people who want to see the democrats and republicans working together. I would say that if we can put together not just the appropriations bills, but take a hard look at the issue that is really a problem for us. And that is immigration. Look at the other issue. Voting. Voting rights, i think, are at the basic of what it takes to build a strong democracy. And we know that that has been imperiled here of late. So, if we can do voting, immigration, and the appropriation bills, i do believe a speaker that can get us to that point will capture the imagination of the American People and well make a country that will move together move forward together. In what could be the first of many judicial orders in several different cases, a new york judge sharply reacted to a lie donald trump posted about the judges clerk, a woman who donald trump said was in charge of the case brought by new York Attorney general against donald trump. No judges clerk is in charge of any case, because donald trump wakes up every day of his life sick and perverted and poisonously hateful, he said the woman is Chuck Schumers girlfriend. Because she was seen in a public photograph with the senator, as have many thousands of people throughout senator schumers 42 years in congress. Judge Arthur Engoron said, personal attacks on members of my core saf are unacceptable, inappropriate, and i will not tolerate them under any circumstances, and consider this a gag order. The judge said trump is now under a gag order banning all comments about court staff. Donald trump being a weekend cowardly man, who many of his followers stupidly mistake as tough and strong, immediately took down the offending posts. Judge Arthur Engoron has now demonstrated to the other judges handling trump cases how to handle Donald Trumps lies. Today judge angolan clarified how the statute of limitations will apply to the case saying, quote, the statutes of limitations claims not evidence. Join us now is adam klasfeld, senior Legal Correspondent for the messenger, who is in the courtroom for also with us tim obrien, executive editor for bloomberg opinion, editor of trump nation and bloomberg podcast crash course. Andrew weissmann, hes with us former chief of the Criminal Division of the Eastern District of new york and a professor of Nyu Law School and cohost of the Podcast Prosecuting donald trump. Tim and Andrew Weissmann are both msnbc analysts. Adam, we begin with you again tonight because you are in the courtroom. The most important place you can be to talk about this. Tell us, first of all, about that gag order moment. One of the most interesting things about that was the bustle that proceeded that moment. Because, what happened was trump posted this attack on the judges clerk right before the lunch recess. And we saw trump, his son eric, his lawyers, and the new York Attorney generals lawyers going in and out of the court for these private conferences over the lunch recess. And the start of the Afternoon Session was delayed because of it. Then, when the new start time happens, everyone goes back into the courtroom, wondering how the judge is going to react to this startling post. And the judge has a sharp change of demeanor, off the bat. This judge is usually very mild mannered. Usually cracks jokes in the courtroom, quite jovial. Very stern. Very angry. And he basically calls out the elephant in the room, talks about what happened and attack on the member of his staff, and he called disparaging, untrue, inappropriate and he shared that quote you just displayed, lawrence. And he explicitly just described the gag order. Its the first gag order ever issued on trump. And this has been, by many accounts, a long time coming. Theres a possible gag order in the works in washington d. C. During the first proceedings in his arraignment in the hush money case in new york. Your viewers might remember that trump posted a picture with Manhattan District Attorney alvin bragg where he, trump, was posing holding a baseball bat. Back then the judge presiding over that case, ron merch im, said we are far away from the gag order. And so, this was, by many accounts, a break in the dam. Andrew weissmann, what is the lesson for other judges handling from cases . Donald trump, as adams said, has really been goading the judges to take action for a whole variety of reasons. And its like a greek tragedy in that i think the judges have no option here but to do what the judge did today, because you have to be extremely concerned about the safety of not yourself, of your staff, of jurors, of witnesses, of family members. And donald trump has made it clear by his increasingly erratic behavior and his statements that he is sort of fully expecting that this is what will happen. I do think that your instincts, lawrence, are right that, when called out and when you sort of call out a bully, you have the court saying this is what is acceptable and this is what is not, that he will back down, because the judges here all have enormous power over him. Just so everyone understands, he does not enjoy the same rights as Everyone Else. Because every defendant in a criminal case is out on baylors in jail. But they are subject to restrictions that Everyone Else is not subject to. And so judges have a full panoply of options that they can impose. So, the next thing they will be waiting for is october 16th, when judge chutkan has a hearing on what the restrictions should be Going Forward in her case. And tim obrien, its no surprise to you that donald trump is a cowardly goofball whenever he has pushed back against, as you did. He sued you over the book or you wrote about his businesses, when you exposed he is not with the money he said he was worth. And of course, you beat him in that lawsuit. So, you have seen what happens when there is pushback to donald trump. He is a classic bully, lawrence. I think that he attacks people at a distance, social media was invented for someone like him, because it allows him to maintain both a digital and geographic distance from some of the people he attacks. He has never, is directly, wanted to faceoff with people face to face. He will yell at his subordinates. He will yell at people who work for him, because they are powerless to do anything about it. But generally, in public forums, he tends to back down. And i think as both andrew and adam have said, i do think this is a watershed moment, because, for his as cartoonish and absurd as donald trump is, as the wweization normal court proceedings, and to what we expect from people who, as adam pointed out, are subject to the long and strong arm of the court. And i think judge chutkan in the january 6th case, the federal case, has already warned him a number of times not to make the kind of statements he was making on social media, and the press, because it could intimidate witnesses or taint the jury pool. And continue doing it. I think, beyond the gag order is, i think the next step is, does he get thrown in jail . Thats going to be a very interesting moment, if he continues to ignore the judges admonishments. Theres been this argument, well, you cant put a former president in jail. But i think its because precisely he attacked the court this way because its a demonstration that no one in the United States, including former president s, or above the law. And i think one of the realities of the trump era is that he undermines every institution that bounces off of him. And because of the office he inhabited, people make excuses for him or bent the rules or say it threatens public disorder to apply the law to him in the same way that every other u. S. Citizen has to deal with. And i think its important in todays case that he was shut down. And of course, once again today, donald trump went to the courthouse so that he could dominate the cameras and the microphone stirring court recesses. Were showing you none of that video tonight because it was all lies or relevant, and had nothing to add to this case. Adam, in the courtroom, the judge did apparently clarify his thinking on how the statute of limitations applies in this case. What did we learn about that today . Well, the most unsurprising detail is that the judges opinions of the statute of limitations having changed since he wrote that very blistering ruling, rejecting the same theories about the statute of limitations. Basically, the judge did not mention trumps remarks outside the courtroom on day one, when trump claimed that he had basically succeeded in throwing out 80 of the case because the judge in his words overruled himself, without exactly telling nonsense to those words, the judge basically said that his earlier ruling on that has not changed. That the statute of limitations basically, in his ruling and in his findings, every time trump submitted a statement of facts that he found false, that is going to trigger that clock. And those submissions, those s f c sfcs statements of Financial Condition which is why he found in his words of the ruling the defense series of the statute of limitations bizarre. So its a total repudiation of Everything Trump said outside of court on monday afternoon. Andrew, i was struck by the judges point about the statute of limitations does not apply to evidence. Well, absolutely. The statute of limitations is a doctrine for precluding a claim altogether because it wasnt brought in a timely fashion. And the judge was saying here that you have to count the time as adam said, from each of the last statements that were found to be false. So he found statement a to be false, and you count five years from that. If you keep doing the trim, crime, that the statute essentially keeps getting refreshed. But its not an argument for keeping evidence out altogether. As a matter of fact, a lot of weekly evidence thats clearly outside of the statute of limitations. Thats used for sort of background and to show motive, show modus operandi. If you want to show that somebody is basically lying about theirs statements, the fact that you have that going on for 15 years, that is going to be interesting and relevant proof. So the judges are extremely strong footing here with respect to his ruling on the statute of limitations and how it legally operates. Kevin mccarthys impromptu History Lesson in his Press Conference was quite long and, essentially, accurate about emperors rise to power and his use of aggression that started world war ii. But one of the big differences in this country fighting against hitler and fighting now in its support of against Vladimir Putin is that during world war ii with the House Of Representatives never collapsed and never shut down, never gave up, as it did today. There is a fundamental irony in the former speakers History Lesson, which, by the way, is generally very well taken. His point was that czechoslovakia was the last democracy in that part of the world. Ukraine is the most important democracy in the same part of the world. We have done a little bit better this time. But fundamentally the problem, as you say, is not the ukrainians, unlike the checks czechs and slow facts slovaks which was passed took place on the anniversary of that Novel Chamberlain speech which is maybe why the former speaker was thinking about it on the anniversary of the Munich Agreement we managed to keep our government going at the price of enough funding ukraine. Going forward, we are faced with another funding deadline less than 45 days from now that could end up in a government shut down. We have seen in the world has seen what happened in the House Of Representatives today. They dont even have a speaker now. What can President Biden do at this point when hes trying to convince allies that the United States will continue to support. I think it would be wise for the president to begin at home with a clear language. And here, again, i think the former speaker had a point, to begin with former it has to be made clear to the americans that the goal of this war is for ukraine to win and we have to be thinking about the only way to and this were being to win this war and then the thing forward from there about what ukrainians would need from us and others to win this war. I think that would be very clarify. I think it would be helpful if the president that homework to make it clear to americans that this war is winnable, that the ukrainians are doing very well, that, for example, theyve just opened a Passage In The Black Sea which no one expected them to be able to do, keeping the russian navy out of the way, so they can export grain to africa and asia. They are doing remarkable things we are not paying attention to. I think the president should take the opportunity to define this war as something that can and must be one, to frame it and we frame the politics of it before we get into the model you are talking about. It is there an answer to the question, what has the United States gotten so far in return for its aid to ukraine . Aid to ukraines one penny on the american budget dollar. And for that penny, what we have gotten is a country that has fulfilled the entire nato mission of the last 75 years, that is absorbing, and absorbing and rebuffing and pushing back a russian attack, all on its own, a nonnato member, with one penny on the dollar of the defense budget, is doing that. No americans are fighting in order to preserve the security of europe. What we are also getting from ukraines much less likelihood a conflict in the pacific, in so far as the ukrainians resist, do well and when, its much less likely that china will move on taiwan, and much less likely america will have to fight a war there. Finally, in resisting ukraine, its preserving a legal order in which voters matter, in which the rules matter, in which we have a chance at the 24 century which is orderly. This is even if you are a completely selfish american, a National Security bonanza, the likes of which we have not ever seen before. The house is going to be hard to put back together. We need the House Of Representatives to work. Its an essential part of our government. Its gonna be tougher than i think people really understand, because this dynamic where matt gaetz may say, hey, i dont like what you are doing, im going to pull the plug, is going to be with us, potentially, for the next 14 or 15 months. Its going to make it very difficult for us to do simple and basic things in this country while they are still in power. If we win and we take away the its going to be an enormous boost to us as we head into 2024. It certainly feels like that is the likely scenario now. The democrats following Hakeem Jeffries lead today approach the situation in the house with complete discipline, simply allowing the republicans to take the floor and yell at each other. Yeah, what is underneath all this, and we will have to unpack this over the next few days is the was no possible deal. The idea there could have been power sharing.
