Gingered, and all in with chris hayes starts now. Starts now tonight on all in. How do you plead the five counts of conspiracy to commit intentional interference with the performance of the election . Guilty. Donald trumps first codefendant makes a plea deal. Theyre also be the condition that you are to testify truthfully in this case and for the proceedings. Tonight, the first domino falls in Fulton County. What does it mean for the trial that is starting in three weeks, and for the ex president himself . Then, the absolute absurdity of a trump Maga Shutdown just hours away. People here in washington need to understand how it feels to get shut down. The congress in California Say Goodbye to an Iconic American senator. America, america is a better place because of senator Diane Feinstein. When all in starts, right now. Good evening from new york, im chris hayes. Weve got Breaking News tonight in the criminal prosecution of donald trump in the state of georgia. The first guilty plea from a codefendant of the ex president. This is scott hall. He is an atlanta area Bail Bondsman and one of the 19 people charged in that Fulton County repo r. I. C. O. Case for interfering with the 2020 Election Results in georgia. Last month haltered South Uniontown Fulton County jail and pleaded not guilty along with donald trump and the rest of his codefendants. This afternoon that all changed after hall reached a deal with Fulton County prosecutors. How do you plead to the five count of conspiracy to commit intentional interference with the performance of election . Guilty. Do you understand that the sentence for each of those counts will be 12 months yes maam. A total of five years. Yes, maam. So five years of probation. Hall will also have to pay 5000 dollar fine, served 200 Hours Community service, and he already recorded the statement for prosecutors and will write a public apology to georgia voters. Crucially, as part of that plea deal, scott hall also agreed to cooperate in the prosecution of his codefendants. Do you understand the conditions of your probation are that you testify truthfully and any further Court Proceedings to make any listed on the initial indictment with which you arrived . Yes, maam. You understand that you are continue to cooperate with inched tierneys office and provide any documents needed for the prosecution . Yes, maam. Scott hall played a key role in the conspiracy to overturn the election in georgia as prosecutors laid out in the indictment. On january 7th, after the sixth, still going afr the six, keep in mind, the day after the insurrection, along with trump lawyer sydney powell, Coffee County Republican Party chair cathy latham and county elections supervisor misty hampton, quote, committed the Felony Offensive Interference with primaries and elections by willfully and unlawfully tampering with electronic Ballot Markers and tabulating machines in Coffee County, georgia. Surveillance footage shows hall, with several of the people, entering the county Election Office that day. They were welcomed in by party chair cathy latham. Hall was also captured on video inside the office, where he helped the group as they copied data from the voting machines. Why were they doing this . This was part of the big lie Conspiracy Theory heavily pushed by sydney powell that Voting Systems made by a Company Named dominion, which these were, were part of a plot to steal the election from donald trump. So scott all served as a sort of go between for powell and highranking officials to this group Of Trump Activists on the ground in georgia. Halls plea deal comes on the same day the prosecutor signaled they may also offer deals to more defendants. During a pretrial conference this morning for trumps lawyers, sydney powell and Kenneth Chesebro, prosecutor told judge scott matt mcafee, we believe we can make plea offers in the near future. Pella and chesebros trial, the first in the georgia case, is set to begin with Jury Selection in just three weeks, and considering what scott hodges were to in court, it is certainly possible he will be cooperating or testifying against them. We have known since Fulton County District Attorney fani willis brought the case, that all 19 defendants would not likely go to trial. Of course we did not know who might opt to take a plea deal or when. Now we have the first cooperator, most likely, i would be willing to bet, he will not be the last. Harry litman service writ Deputy Catherine christian is a former assistant manhattan District Attorney. Both join me now. Christian, let me ask you now. What jumped out at me, was no jail. Time five years probation, a fine, apology, community service. 200 hours. Ever thinking about playing, it seems to me there is a real big difference between no jail time and going to trial or being convicted when you will face jail time. What do you think . Exactly. Thats why he pled guilty. Its no coincidence that he pled guilty less than a month from when sydney powell and Kenneth Chesebro are going to trial, because he is particularly against miss Powell A Major witness and i will predict that many more of the defendants will be pleading guilty. This is what happens in a conspiracy case. We have multiple defendants. The ones with the lowering, the ones who are not the leaders, they will get a deal that will either be no jail time or something very minimal, and its a great incentive for them to plea. Right now theyre lawyers for several defendants are engaging in conversations with the d. A. s office. Todays plea was a surprise, or theyre keeping a very confidential. Its not shocking. Its typically what happens when a conspiracy case has all these defendants. Theres a reason why fani willis was saying im going to trial with these 19 defendants. She has the experience, prosecutors have experience with these cases, but you dont go to trial with 19 because many will end up pleading guilty. If you read the indictment, harry, the defendant that has the most proximate connection to one up, the other folks who are in that Coffee County offices sydney powell. Inside, she gets sent the data. She then shares it with other people, that they have purloined pretty clearly, i think, in violation of the law, at least from these election machines. The first person that this would seem to have good implications is powell, who is facing trial in three weeks. What do you think . 100 and. Powell actually pays the firm that goes in and purloins all the data. There is no doubt that they had the authority to do it. We is known as fani willis for r. I. C. O. Cases. The previous one with educators started with 35 defendants. 12 went to trial. 11 were convicted. It still took eight months, but only 12 went to trial. So you saw a cascade of please. What prosecutors will be seeing now is first in, best deal. So haul is seeing, now, all, it is true, has direct, this sort of Coffee County story is discreet and involves those four. But he is kind of a general inter meddler, which is a Job Description in trump world in December Of 2020 and also applies to jeff clark and chesebro. We know among other things that he has an hour plus phone call with clark in early january. So he is kibitzing generally. What he can provide in addition to the three Coffee County defendants, who must be very seriously contemplating getting a plea deal today, remains to be seen. But it could be kind of rich and extend beyond Coffee County. I want to talk about something you just said. Someone else i saw, i online, i dont remember this from t indictment, but you just mentioned it, on or about the second day of january, 2021, before the break it in Coffee County, scott graham hall, the y who just pled guilty today, placed a phone call to Jeffrey Bassler Clark to discuss the november 3rd election in georgia. The phone call was 63 minutes and duration. Hes got an hourlong phone call with another codefendant, jeffrey clark. We dont know if it relates to Coffee County. Wed have no idea. But clark is named in the indictment. Clark just had his motion to move to federal Court Dismissed yesterday. He lost that. Yesterday. So hes gonna be facing trial. And now it does seem like hall might be someone he has to worry about. Definitely. Thats over to act number 110. What was he speaking when over an hour to a man the donald trump was going to make the acting Attorney General until the top deputies in the doj said they would quit . So he will be a valuable witness against mr. Clark. Of course mr. Clark is pointing the fingers at trump. His lawyer, and trying the case removed, said everything he did was at the direction of donald trump. So there will be more people pleading guilty, but mr. Hall is one, the first one, probably, a number of other defendants who will be cooperating, who will be testifying for the prosecution against the higher level people in this case. Which brings us to powell and chesebro. Theyre facing trial, they both want to invoke the speedy trial rights, they are facing what is now a very speedy trial. And harry, the question is, my understanding is that williss office, i dont know if they said this specifically or if it was implied, that they would offer a plea to these two individuals as well. Do you think a plea is forthcoming . Do you think todays plea changes the odds calculation for either of these . What do you think is happening in their corner on defense right now . So the second question, let me take, because the answer is definitely. Thats how these things work. Theres a complicated game theory thing going on. As i said so now that someone has come in, and especially powell has to think very hard. Chesebro will see, he sees himself as isolated. Remember he initially wanted to be on his own and Sidney Powells speedy trial motion wasnt unwelcome addition to his strategy. But we want to think about clark, roughly speaking, chris, there are at least three groups here. The false electors and the people who facilitated them, Coffee County and the higher ups. And what is so intriguing about halls, he clearly gets the Coffee County folks but potentially with ellis and with clark the penetrates the higher circle of federal officials. So we will just have to see. Without a doubt, though, everyone in georgias tie into their attorneys, thinking holy cow. Especially because so many of them, we dont, dont have the funds to defend this, and this is the easy way out, especially if they dont have to do a day in Fulton County jail, which is not a pretty place to spend any time at all. In fact, jenna alice has complained about not having any money. And harry just named another category of codefendant, catherine, that i can imagine we might see, those state electors. Relatively low on the wrong. They are implementing as opposed to masterminding. Again, as far as we know, and as far as being named in the indictment, you can imagine they would probably be the sort of folks that might have a better shot of the most favorable terms earlier in terms of a plea. Yes. And they are also gonna be denied that theyre trying to get their cases in federal court. Why . Because they say they did what they did because of donald trump in the campaign told them to do that. So they are easy. I also think that what i call the log squad, kanye west, former publicist, the from chicago and the voices for black people for trump. So people have a criminal record, those are the easy picking because they will say, we did what we did because trump told us to. So there are a lot of conversations going on, just like we didnt know about whole, theyll be hearing more. Im Sure Sydney Powell and the lawyer todays are saying oh shoot, when they found out about this. Harry litman and catherine christian, edifying is always. I appreciate it. Thank you both. Speaker the house kevin comcast business, powering possibilities. Mccarthy the Republican Congress has brought us to the brink of another government set down, little over more than 24 hours from now. Democrat Senate Advancing broadly Bipartisan Legislation to keep the government funded and therefore open. The house could very easily do the same thing based on a Budget Framework they already agreed to. Remember, remember this . Remember the deal they struck over the summer to raise the debt ceiling . Kevin mccarthy met with joe biden, they worked it, out they struck a deal . But now they dont like that. They wont sign on to it. Right now it looks like its not going to happen. You see, theres a small group in the house that want to shut down and wants mccarthy to lose his job as speaker, partly because they want to enact severe drastic brutally cruel unprecedented austerity cuts to a bunch of different social programs like stuff for women and infant children, or to poorer schools, and partly because donald trump told them to. Today Speaker Mccarthy tried to appease his conference with a wildly extreme government fuinbill that did a lot of those cool cats, but even that failed 1 21 mostly maga republicans sunk the deal. The thing that so important to understand about this shutdown is that probably i would say 98 of members of the republicans cross both i would say its utterly stupid. They think the people pushing to shut are dangerous fools. Just listen to Republican Congressman mike lawler of new york. Theres only one person to blame for any potential government shut down, and thats matt gaetz. Hes not a conservative republican. Hes a charlatan. As far as im concerned, when youre working with democrats to try to vacate the speaker, you are a joke. Okay, now, while you may be correct that he may be a charlotte, and buddies in corrected as one person to blame here. But hes missing is that math gaetz is perfectly in line with taking his orders directly from another republican, a guy you have probably heard, of the quadruple indicted disgraced president donald trump. Gaetz openly boasted about this last week when you talk to trumps Social Media Platform to share this article about the shutdown. Quote. President trump says the present trump should reject the speakers plan. There you have it. Trump says we should reject a deal, and we rejecting the deal. The open public disdain House Republicans hold for someone like matt gaetz and his confederates in the extreme wing of the party, should be how they view donald trump, the guy calling the shots. Indeed, if donald trump, that guy, the guy you see on your screen, if he werent just some raab random member of the freedom congress, republicans would roll their eyes at him and complain about into the press. Like, tough guy lawler does about matt gaetz but does he say that about trump . No he does not. Because donald trump is not just some random congressional backbencher. Thats easy for mike lawler to do. Trump is the most powerful figure in the figure in the Republican Party. The other republicans including Kevin Mccarthy are learning the same lesson that the rest of us learned, that is that it is impossible to negotiate with trump, because their demands are impossible to give into. If you look at what trump said about the shutdown, and you ask what he wants, he wants his criminal cases close, he wants to in the american rule of law. He wants to install himself as the authoritarian leader in this country. When he gets the nomination of the Republican Party, mike lawler is probably going to endorse him. Those are Donald Trumps roman demands. And by extension the demands of many have his Margaret Obstructionists in congress. Mccarthy knows he cant give in, but he is such a weak leader its not clear he has an alternative. This is the White House Communications director and he joins me now. Ben, what is the white houses current understanding of what happens now . Its my job to follow this, and i will admit that i am confused. Look, its very possible we go into a shutdown tomorrow night, at midnight. As you laid out right there, this is totally the fault of House Republicans in the maga wing in the party. This is another manufactured crisis by them. They threaten to crash the economy earlier this year over the debt ceiling crisis, which they also manufactured. But out of that they agreed to a bipartisan Budget Agreement with the president , with the house, with the senate, that laid out a plan to fund the government moving forward. Well, now theyre walking away from that. Speaker gingrich who used to shut down the government at the drop of a hat, said he didnt even know what this was about or why they wanted to shut down the government this time around. As you pointed out, they take their orders from donald trump, the maga wing of party seems to be in control here. And unless their extreme list of ideological demand is met, they are going to shut things down tomorrow night. How do you understand the endgame . Thats the thing. Because of what Speaker Gingrich said in what others have said, there are a few different ones. You could have Kevin Mccarthy bring something to the house floor that he knows will lose some republicans but will pass with large bipartisan majorities. For instance the senate, see our. Some kind of Discharge Position in which eight or nine republicans came up with democrats to bring something to the floor, or what . How do you understand . The endgame that would make sense for the American People and the president supports, is most of the leaders in congress and the president have agreed on a plan to fund the government. Leader mcconnell has agreed on that plan. Schumer has agreed on that plan. Jeffries is agreed. The president says the senate should pass the legislation, in the house should pass it, and we will have active duty tubes going without pay, we would have women and children who need Food Assistance having access to food this week. We wouldnt have travel disruptions at the faa and all the other things that happened if the government shuts down. But whats clear is that Speaker Mccarthy may not have control over his conference. This is something he needs to work out with the maga wing of the party if the government is going to stay open. He needs to take control here. Marjorie Taylor Greene said i think today or yesterday that it shutdown would be salutary. She didnt use that word, but she said it would be good, bracing for the American People, for washington, to understand what it was like to shut down during covid, i think was the argument. Do you think there was any upside to shut down . Look, this is the same sort of ideology over outcomes that weve heard from the maga wing of the party, where they would rather prove a point that helped serve the daily lives of hardworking people across the country. Theyre Playing With Fire here. So many people will be impacted. So many people will be forced to go to work but without pay, thats gonna have an impact on morale, on attendance. The basic operations of the government a lot of people in the country rely on every day. If you have a problem with your Social Security check, for example, who can you call if Government Workers are furloughed . Why would we put active duty troops on the line and refused to pay them one 2 million of them are defending our country . This is just about police saying theyre ideological factions, getting cable hits, making extreme headlines. Its hardworking americans the pay the price. Not just cable hits, also some podcast hits. Just want to be fair after the meeting today a much of them, andy biggs, i think, they all did a Group Emergency pod. So they did get some good podcast content. Youve gotta respect that. It is what the president had to say in a sitdown interview earlier today with john harwood from propublica for his view on why this is happening. The speakers made a terrible bargain. In order to keep the speakership hes willing to do thing things that i think he knows are inconsistent with constitutional processes. Number one. Number two, i think it says that there is a group of maga republicans who genuinely want to have a fundamental change in the way the governmental system works. Thats what worries me the most. That fundamental change, how should we understand what he means by that . Well, i think he addressed it in phoenix yesterday when he was honoring john mccain, talking about the need to preserve Democratic Institutions in this country after a series of comments made by the maga wing of the party over the past several weeks. They have attacked the free press, they have attacked the chairman of the joint chiefs of staff of the military, accused him of treason, said in a different time, he would have been executed. They said a bunch of things that could incite Political Violence and certainly dont speak to preserving Democratic Institutions in this country. They dont believe in the separation of powers. That is not politics as usual. Thats an extreme threat to our democracy. Paul gosar, republican member from arizona, said that another time, the sodomy loving quiz laying would be hung. Thats what he had to say about joint milley. Thank you very much. Was president of the San Francisco board of supervisors, which is their city council, basically, when a former supervisor crawled into city hall through a window, bearing a gun, and shot to death both the mayor, george visconti, and supervisor harvey milk, an icon of the gay rights movement, as the first openly gay person elected to Public Office in california. It was feinstein who found milks body and tried to revive him before he was pronounced dead. This is the body of her supervisor harvey milk as it was taken from me city hall. Milken oppose the reappointment of me in the total confusion after the shooting, the president of the board of supervisors, Diane Feinstein, spoke. Both mayor moscow knee and supervisor higher female have been shot and killed. Miss jesus christ quiet. Quiet. The suspect, the supervisor after the assassinations, assassinations by someone they worked with, a supervisor had served alongside them. Weinstein became acting mayor and she went on to win two elections to that seat. She was, in fact, the first woman member mayor of San Francisco. In 1992 she and her california colleague Barbara Boxer became the first woman elected in california to the United States senate. Dianne feinstein served for 30 years, the longest tenure for a woman in the United States senate history. You can imagine, the assassinations of 1978, which launched her political career in some ways, or at least pusher is the mayor of the city, haunted her four years. Feinstein recalling later how she was at her desk that day when she heard gunfire, ran toward it. I found harvey on his stomach, she said. I try to get a pulse and put my finger through a bullet hole. He was clearly dead. From that experience, find stan became a fierce proponent of gun reform. She was integral in a passage of Assault Weapons ban in 1994. One senate debater, republican senator, challenged feinsteins credentials on the issue. So the gentlelady from california needs to become a little more familiar with firearms and they are deadly characteristics. And i say that because it is a personal privilege for a moment, please. Yes, certainly. I am quite familiar with firearms. I became mayor as a product of assassination. Im aware of. That i found my assassinated colleague and put a finger through a bullet hole. Trying to get i proposed gun control legislation in San Francisco. I went through a recall on the base basis of it. I was trained in the shooting of a firearm when i had terrorist attacks with a bomb at my house when my husband was dying, when i had windows shot out. Senator, i know something about what firearm or firearms can do. Diane feinstein indicted her home in washington last night. She was 90 years old. Today she was honored by her former colleague in the senate, president biden, former members of her california delegation of the house and in the senate deceit Dianne Feinstein occupied for three decades was draped with velvet and adorned with a visa of red roses. Well have so much time to talk in brag about Dianne Feinstein. Her legacy will be a long one that we will all be inspired by. But today, at this time, just hours since her passing, rather than talk about her, let us just pray that she rests in peace. In that regard, mister speaker, i would like unanimous assent that all members and staff on the capitol in all members in the house would rise in silence and remember delayed honorable senator Diane Feinstein. My this morning nancy pelosi gather the california house delegation before the chamber for a Moment Of Silence to honor the passing of senator Diane Feinstein. Congressman burglaries a democratic member of the delegation representing oakland and surrounding area. She is also declared herself as a candidate for senate in california. Congressman lee joins me now. Good to have you, congresswoman. Nice being with you, chris. Congresswoman, you obviously have served alongside in a different house Dianne Feinstein for decades, representing californians. You know her well and loved i would love to hear reflections on how your feeling on the day of her passing. Well chris, today is really a very sad day. I was in the Senate Chambers when members of the california delegation honored her and also on the house floor. We are really mourning and grieving but also we have to celebrate her life. And what a remarkable life. Senator feinstein was an icon. She led on so many issues as a woman before anyone was leading on issues, men or women, for example on the lgbtq struggle. She was there. On issues around gun control and the footage you had about her on the senate floor. That was classic Dianne Feinstein. And here we are in a moment where we have to pass this Assault Weapon Ban because Dianne Feinstein fought for safe communities. She saved lives through legislation with the Assault Weapon Ban. Finally, i would just say, on a personal note, right after the authorization to use Military Force came forward in 2001, Senator Feinstein, of course i was the only one who voted against that. Everyone else voted for. It Senator Feinstein, it shows you how kind she was. She was a painter, and she knew i loved orchids and she painted a beautiful orchid and send it to me and marked the date and signed it for me. And it was a gesture of kindness and love, even though she disagreed with me. But that was her. And i have that hanging in my place here in d. C. And every day i look at that, because she really brought forth what a true Public Servant is, could be, and also wise, but also a kind of and gentle spirit. Thats a fascinating story. When you wrote it against the authorization of Military Force you were the lone vote in the house, and the lone vote in both houses, if im not mistaken. It passed unanimously in the senate as well. And its interesting you talk about that and that gesture of hers. Some who have looked at your career and her career would say you have different politics or have come from different parts of the democratic party. But it sounds like you feel profound sense of respect for her. I do. And we worked together on many issues. I represent oakland, berkeley, california, the 12th congressional district, and she helped me with delivering federal funds to my district in the entire state. We worked on issues together, and not everyone agrees with everyone all the time, but i think because of who she wise and being able to get the job done, you can see her legacy, working with republicans, working with moderates, where he with progressives. She cared about people. She cared about her state, and she would work with anyone as long as we were committed to doing the right thing. Also, let me just say, she had a keen sense of wide diversity matters. We were on the senate Floor Listening to the with how he had worked in her office. He was an African American named percy who she tasked representing her in the black community. He did a phenomenal job. Percy was her representative. We knew and percy was there Senator Feinstein with here where the concerns were and that she would act on it. And so today my thoughts and prayers go out to her family. I know its a very difficult time. Condolences to her friends and extended family. We have to take a moment to, yes, mourn and grief but also celebrate her wonderful life. Congresswoman, well i have you, hear you talk about issues that were to Cross Party Lines or across lines within the democratic party. Since i have you here in the shutdown is happening, let me hear about one other issue, the global fund that was started under the bush administration, an amazing coalition of left and right folks to fund lowcost and free Aids Medicine in africa. It has saved probably millions of lives. Its probably the best thing that came out of the bush administration. There is a targeted Campaign Among your House Colleagues on the right in the Republican Caucus to attack that. To go after it as these Appropriation Bills come through. I just wanted to get your response to this, which has been a wildly successful intervention, bipartisan effort . Thank you, chris, yes, pat i was actually my idea. I brought that idea to President Bush in a meeting. We put forth and i worked with him in the white house and everyones, secretary colin powell Condoleezza Rice and we put together what was known as and we saved lives. Senator fruit, senator benson, Me Congressman Lantos we all Work Together to keep this and keep it a bipartisan initiative. We extended it with just a clean extension for five years, every five years and now we have those in the house. Smoked of which are the maga extremists who are trying to derail us by trying to insert language that they know would be a poison pill. So right now im negotiating. With republicans to try to get extended. We will stay on this issue. Barbara lee, thank you for joining us tonight. I appreciate it. Thank you. Farxiga guilty plea in Fulton County georgia District Attorney election r. I. C. O. Case, lowlevel coconspirator scott hall, who plead as part of his deal to testify truthfully if he is called in future trials. He might not we need to wait long to hear from him. The first trial set to begin 41 days. The idea that don trumps codefendants might be cutting deals in exchange for testifying, its something we know scares the ex president. There have been multiple reports the trump worries out loud about prison cells, Orange Jumpsuits. But could that actually happen . I talked about this very thing with the hosts of the prosecuting donald trump podcast, mary mccord and andrew weissmann, from the first stop on the in austin texas on saturday. Theres something thats really hard to remember the trial of the century to consider the kinds of people that are going to be on the stand in what is going to be the most significant criminal trial in, again, in the countrys history. I dont think its even that arguable. Thats right. Good question. That brings up the fact that were in federal court, so unless the Supreme Court decides to change the rules, we will be no cameras in the courtroom. So theyre gonna have to be relying on journalists who are in their reporting throughout the day about what is happening. That is raising a lot of debate about whether the rule that has been part of the federal rules for a very long time is a good rule. I have somewhat mixed feelings about it. I think the whole American Public ought to be able to see this trial. I think they ought to be able to see almost all trials. Its transparency. Talk about the double or more than double standard, there is no better way to test out how the criminal system works and by having people see. It particularly because peoples perception of the system are so skewed by either television representations, law and order, and things like that, or the news at night or big trials like the og Simpson Trial that was televised. Yeah, its actually full transparency, seeing whats happening. On the other side, trump, he and his attorneys are trying to, well try to use it as part of the campaign stump speech. Then you have this concern about, its just giving them a free platform. So i come out on the side of transparency, because i think for the betterment of of the system as a whole the rules to change. The Georgia Trial will be televised. Its going to be a very different set of trials. Already we know theres going to be multiple. The first one is right around the corner, a month away. Theres a Rolling Stone story about hes asking him, hes asking his confidence in advisor, youre not gonna make me where my Orange Jumpsuit . And [laughter] i dont know why thats so funny. Its amazing that hes not pounding diet cokes and calling one person after another saying and im gonna have to wear the jumpsuit . I dont think, the likelihood of him being convicted in these trials, particularly after four, is relatively high. Hes obviously running for his freedom. But thats a high leverage bet. If you if he were to win or to have an allied to win, the two federal cases will go away. It doesnt even involve a pardon. To your point, whoever the president is, the executive can Gels Department of justice, drop, at the case is over. It doesnt matter if there has been a trial and a conviction, ceg, michael flynn. Hes done that playbook. At the state level, if those havent gone theyll be told. Hell make the argument and there is some reason to think the Supreme Court would back him up. Theres a wait until after hes out of office. You cant, obviously, you cant have the president United States sitting in Fulton County courthouse every day. While hes being president. Part of the experiment there is, if you had, lets say you had someone in texas who escaped an impeachment here, deciding im going to now indict the democratic president , the rule would be that that could happen but its going to be told when the person is finished so we dont have a. G. s running around trying to interfere. That would mean it would all happen whenever. He is thinking, he has enough of a day today survivor, hes not gonna think longer term than that. I guess the prison jumpsuit story, which launched in my head, was just because its impossible, understandably, for me to conceive of a world in which he ever does a day in prison. Not because i dont think he is guilty of the crimes that he has been accused of. I think he is and the likelihood of his conviction is pretty high. Particularly i would say the two federal cases. Particularly, i mean, we didnt even talk about maralago. The evidence there is so strong. Oh, its strong. Before we found out about the new witness, the case was already what is known as a rock crusher. As a former prosecutor you look at this, and people are saying, do you think jack smith is going to indict . I was just like, on no planet is that not going to happen. Of course he is. The case is so strong. The new witness was an executives assistant who, got new lawyers and the detail that came out, which maybe you saw, he was writing to do lists on the back of classified documents. Like, he had done just around because he has this Weird Neurotic obsession with them, my boxes. Shes the one that called him, call them, jokingly, in a captured email, his Beautiful Mind boxes, this is the woman who is now cooperating. Because he was so obsessed in having them like garlands ring, i have to have it near me, if he needed to, like write something, he could just i have a classified dark and rated to do list on the back we. So yes, the evidence on that case is rocksolid. Thats the kind of case where in any, any other circumstance, would plea. You would never take that case to trial. Impossible. Thats why most cases go to trial or actually harder cases because the cases where evidence is that solid always get resolved. Yes. You want, as a prosecutor to go to trial on that case. This will be fine, yeah right. As i said, that was just the first stop on our four part Live Tour Ofwhy is this happening, the podcast.
