A busy day, and well begin this morning with President Bidens speech on defending the nations democracy. The president delivered the address in tempe, arizona, to celebrate a Library Being built in honor of the late republican senator, his friend john mccain. It came just one day after the second republican president ial primary, and gop frontrunner Donald Trumps speech in michigan where he attacked the president including his electric vehicle push. While biden didnt respond to that specific criticism, he did call trump and the Maga Movement a direct threat to American Democracy. It was bidens most forceful condemnation of the former president since the current president took office. Ive come to honor the Mccain Institute and library because he was a proud republican who put our country first. Our commitment should be no less. Theres something dangerous happening in america now. Theres an Extremist Movement that does not share the basic beliefs in our democracy, the Maga Movement. Not every republican not even a majority of republicans adhere to the maga extremist ideology. I know because ive been able to work with republicans my whole career, but theres no question the days Republican Party is driven and intimidated by maga republican extremists. Their extreme agenda is carried out fundamentally in all the institution of American Democracy as we know it. Theyre pushing a notion the defeated former president expressed when he was in office and believes applies only to him. And this is a dangerous notion. That a president is above the law, no limits on power. Trump says the constitution gave him, quote, the right to do whatever he wants as president , end of quote. Ive never heard a President Say that in jest. Not guided by the constitution or by Common Service or decency towards our fellow americans but by vengeance and vindictiveness. Some of the president s strongest words yet. A spokesperson for the Trump Campaign issued a statement on bidens Speech Writing in part this, the radical left democrats are the greatest threat to democracy. Well have more on the president s speech throughout the morning. We turn now to the possibility of a Government Shutdown. And with less than two days to go Congress Still has no guaranteed plan to stop it. As of this morning the Senate Looks Like it will pass its Stop Gap Bill that will fund the government through November 17th and provide billions of Disaster Relief aid to fema and to ukraine. However, that bill appears dead on arrival in the house as farright republicans have vowed to tank it. In the lower chamber, speaker Kevin Mccarthys plan to gain leverage in future negotiations bypassing segmented Funding Bills failed yesterday as nearly 30 republicans shutdown the vote on one section. Mccarthys only option now is to bring a Stop Gap Bill to extend Government Funding to the house floor by this evening. That bill has even steeper spending cuts than the levels agreed to in the mccarthybiden deal made back in the spring. It also has hard line border and Immigration Provisions that simply stand zero chance of passing in the senate. Regardless of that, House Freedom caucus members have vowed to torpedo any extension of Government Funding over concerns of national debt. Now, the house did pass the Defense Spending Bill last night and in a separate vote cleared the way for additional aid to ukraine. Members voted 311117 to approve an additional 300 million for the war torn nation. Every single novote came from republicans. In a separate vote the 826 billion defense bill passed by a near Party Line Tally of 218210. All but two republicans voted in support of the bill while all but two democrats voted against it. Again, this defense bill stands no chance of passing in the upper chamber. Thats thanks in part to contentious proposals by republicans include Agan Amendment introduced by Georgia Congresswoman Marjorie Taylor greene that reduces defense secretary lloyd austins annual salary to just 1. Meanwhile the Washington Post has new reporting on a plot a group of House Republicans to remove Kevin Mccarthy as speaker, and that could come as early as next week. According to the newspaper some farright members of the party are considering tom emer of minnesota as a possible replacement for mccarthy because they think he will be more responsive to their concerns and will better deliver the Hard Line Results they so desire. Now, the minnesota congressman is a member of mccarthy Leadership Team and dismissed the idea in a statement to the post saying, quote, i fully support speaker mccarthy. He knows that and i know that. I have zero interest in palace intrigue, end of discussion. Republican congressman matt gaetz of florida whos emerge as a real thorn in mccarths side hes threatened on the house floor to bring a motion that could threaten mccarthys removal. Gaetz could move as early as sunday triggering a 48hour process to hold a vote on mccarthys future. Joining us now cofounder of punch bowl news, jake sherman. Hes an msnbc political contributor and probably not getting much sleep these days. Jake, thanks for joining us this morning, so lets start with the government shutten down. Give us an update on that, and give us an update on mccarthys hold on power. Ill give an update on the Government Funding first which is government is in peril. The story is this. The senate is working on a bipartisan stop gap which is going to come to a vote at some point today, not today but sunday, monday, Something Like that depending on who gives up time and how they collapse time in the senate, the time needed to pass a bill. Mccarthy has rejected that. House republicans have rejected that. Theyve all rejected that. That will was going to probably go nowhere in the house. So the question is two fold. Number one, mccarthy is going to put a stop gap on the floor today. Well have to see. Maybe theres some momentum now they passed three of their four bills last night. Maybe theyll give mccarthy a break, im not entirely sure. But at some point theyll have to get out of the shutdown and what is the policy they want thats achievable that the president will sign, the senate will pass and the house can deal with . That is the question here, john. I mean this is not a complicated puzzle. Republicans control one leg of this very complicated stool, and democrats controlled two. And really they have a powerful tool because Senate Democrats and Senate Republicans are mostly united. Jake, as if that wasnt enough there are other matters going on in the house right now, and it seems like for many republicans their focus was the oversight committee, which held its first hearing yesterday in the republicanled Impeachment Inquiry into President Biden. And it seems that major take away that not a single witness called by republicans confirm any evidence that President Biden has committed any crimes. In fact, none of the witnesses during the sixplus hour hearing was involved in the investigation into Hunter Bidens business dealings. Still, they suggested more bank records are needed from the president and his son hunter to determine whether any crime might have been committed. Im not here today to even suggest there was any corruption, fraud, or any wrongdoing. In fact, i do not believe the Current Evidence would support articles of impeachment. You mention in your oral testimony that you had written a commentary entitled youd go to prison for what biden did. That was youd go to prison for what hunter biden did, isnt that thats exactry right. I was cutting down words to stay within my five minutes. Yeah, thats an important word, though, that you left out, right . Democrats doubled down on the lack of evidence and slammed republicans for trying to impeach the president for retribution in the house of course having twice impeached former president trump. Jake, i heard some real rumblings from republicans who believe theres a there there. What happened yesterday and where does this inquiry go from here . Now, republicans defended this, john, saying some republicans, a very small number of republicans defended this saying this is an inquiry, this is to decide if they have evidence to impeach President Biden. But this was seen by most in the House Republican leadership as an abject disaster, a kind of unruly hearing which republicans lost the narrative, and they followed this up quickly by Subpoenaing Bank Records belonging to hunter biden and joe bidens brother so theyre trying to get back on track to the extent there is a track, and i think well see more of that kind of activity in the coming weeks. I mean its crazy to have somebody come in just strategically and undermine the Central Point of your argument which is that joe biden deserves to be impeached because there are most of these republicans who are chairing this, thats jamey comer, jim jordan, and jason smith believe biden should be impeached. So its very it wasnt great for republicans to be honest with you, and the leadership realizes that. Yeah, the optics of it at the hearing and also their attention seems to be on the hearing as opposed to keeping the government open when its about to show. Busy day. In a Surprise Move trump will not trial to push his Fulton County Election Interference case to Federal Court. Trumps legal Team Announced their decision in a new court filing yesterday. This comes weeks after lawyers told the Presiding Judge that they might try to move the case. A number of codefendants have tried to relocate to Federal Court including trumps former chief of staff, mark meadows. Now, a judge denied that request earlier this month. Meadows is appeal. A spokesperson for the trump team did not respond to request for comment on if their decision was at all influenced by the meadows ruling. The District Attorneys office there declined to comment as well. Here in new york, new yorks attorneys General Office has released its prospective witness list for trumps upcoming civil court trial. Yesterday prosecutors gave the judge li of 28 names they plan to call to testify when the nonjury trial begins early next week. Among them no surprise the former president himself, also his three oldest children, former Tru Oanization cfo allen weisselberg, and trumps former attorney michael cohen. The defense also gave its own list of 127 witnesses, a number that will surely be challenged by the judge. On tuesday the judge ruled that the former president , his sons, and his company were liable for fraud, so next weeks trial will actually determine the punishment in that case. The new york a. G. s office is seeking a fine of 250 million. The trumps could also lose control of all of their new York Properties and be barred from ever doing business in the state again, The State Trump called home for so many decades. The attorney general confirmed yesterday to nbc news that they will call him to the stand. The trials expected to last three months, but because of tuesdays decision, i dont think it will last thaton now, tuesdays decision is incredibly damaging. It says hell loseis business certificates, his business could be dissolved, he could have to sell to some assets. And his attorneys said what does this all mean . Its a little confusing for legal analysts. Even a judge said he needs to think about it. We could find out maybe some time next week once the trial starts on monday what it all means. How much of mr. Its suing tesla for allegedly allowing widespread racial harassment of black employees. The u. S. Equal Employment Opportunity Commission Also alleges tesla has retaliated against those workers who have spoken out against this. The federal agency is responsible for enforcing civil rights laws against workplace discrimination, and its not the first time tesla has faced accusations like this. This weeks republican primary debate, which of course took place without donald trump on the stage was the least watched debate since before trump jumped into the president ial race back in 2015. According to neilson about 9. 4 Million People tuned in wednesown from the 12. 8 million who watched the first debate last month. In 2015, which was the last time there was an open primary for theepublican nomination, the first two debates attracted more than 24 Million Viewers each. This weeks Nielsen Ratings do not account for streaming views. And as expected trump is not going to appear at the next debate either. The third republican president ial primary debate is scheduled for early november in florida, and a Trump Campaign advisor confirmed to nbc news yesterday, quote, he isnt going. So far there is no word on whether trump will try to Counter Program the event with a separate interview or campaign rally. Hes done that for the previous two. These low ratings are they a product of trumps not there, people dont care because theyre so interested in watching him because they either like him or dislike him . Or do people think this primary race is already over, so therefore if trumps going to be the nominee, why watch . I think its really both. I think if donald trump was there but also ran people would tune in because hes also intertaping, hes going to Say Something interesting and noteworthy. Obviously if it was a competitive primary people would be tuning in to watch that, and neither of those things are true. Donald trumps not even there, and so i think were back to a debate thats really irrelevant featuring people who are not as charismatic or entertaining as donald trump. And look, trump has already pivoted to the general election. This is really an afterthought. I think hes up by, what, 40 points so the ratings are reflecting that. So if hes already pivoting the general election and hes saying hes going to skip the next debate, too, where does that leave us right now in terms of this race, but in particular where does it leave the other candidates . Yes, a few of them took swipes at Trump Last Night mostly because he skipped the debate, nothing about his criminal indictments or policy beliefs. Is there any way you see any of these candidates have the ability to make some inroads here . I know nikki haley has probably best buzz coming out of that, but shes still nearly 50 points back. The first question i would raise is the counter factuals. Like what if ron desantis had gotten in sooner, run a different sort of race instead of when the first indictment was handed down, instead of attacking, you know, the the system if he had actually gone after donald trump . Even in the debate the other night not only did the moderators not really ask about donald trump but, you know, chris kristie, ron desantis they are they had glancings of donald trump, but i wonder what have happened had they done that. Right now i think everyone is running for something other than president , right . Theyre running but theyre running for a cable news show. Theyre running to build their email list. Theyre running to be an ambassador or maybe even to try to be Vice President although i think thats a fruitless endeavor if youre going to try to get there by running against donald trump. So, yeah, i mean i think some people can help themselves. I think nikki haley and Vivek Ramaswamy theyre all going to be a little bit more famous than they would have been if they didnt run. But at this point the notion that they can win hinges on kind of an outlandish theory where maybe like ron desantis somehow wins iowa, someone else wins new hampshire, and the National Polls dont matter at all. Its all about the momentum from the early states. That is as good as it gets if you want to imagine how trump could possibly lose the primary. So you mention Vivek Ramaswamy. He is the subject of your latest piece which is entitled Vivek Ramaswamy tried to go nice but gop debate rivals wouldnt let him. Every cycle theres one candidate on the stage the rest just actively dislike. Theres no question its ramaswamy this time around for the republicans. Tell us about it. Youre right, its interesting. I remember when mitt romney was the guy everyone hated because he just didnt fit in. He wasnt one of the guys. I think in the case of vivek, its partly because as he himself acknowledged hes a young man in a hurry. Youve got candidates on that stage who are veteran, you know, political players here. Theyve been, you know, sort of working in these fields for a long time, and this young whippersnapper comes along and his first move out of the gate in that debate was to attack all of his opponents and to imply theyre all bought and sold by special interests. This second debate i think he wanted to pivot. I think he want today be mr. Nice guy. He kind of benefitted from the first he wanted to pivot. I think he wanted to be mr. Nice guy. He kind of benefitted from the first debate out of the attention he got and the splash. This time i think he wanted to pivot to being a kinder, gentler vivek, and his opponents would not let him get away with that. I do not think it worked for him, at least in terms of making that pivot. Well find out in the coming days if any of these candidates receive any sort of bump in the polls after the debate. Hes delivered a few of those now. Congress has less than two days to pass a funding bill and the white house is telling federal employees to be prepared for much of washington to come to a halt. Joining us now is nbc news capitol hill correspondent julie sircen. How are federal agencies preparing for a potential shutdown . What will it mean for both workers in washington, but Everyday Americans if the government shuts . Well, federal agencies from the Treasury Department to Homeland Security are sending plans to their workers telling them in mostases that theyre essential and still have to come in, but theyre not going to get paid. They planned, according to something i obtained from the Treasury Department, for example, for various operation to go into effect and continu despite the shutdown taking place, but more than that, it will affect mills and millions of americans asoure seeing on your screen. Low income americans will lose access to food programs, critical child care, National Parks will be closed. Medicare and Social Security will continue but if the shutdown goes on, those services can be halted and paused as well. This will have a real impact on americans and congress is dysfunctional, its a mess, and the house will continue today taking up potentially this stopgap spending measure. Really its not clear if it has the votes to pass. If it does its not going to pass the senate in time and vice versa. Lets talk there. Give us a preview of what this weekend will look like . Will there be aroundtheclock negotiations . Any rays of optimism or threads that can be pulled that might prevent this . Or everyone at capitol hill looking at each other and resigned to a shutdown . Negotiations are taking place, but in the words of senator Lindsey Graham i talked to yesterday trying at the 11th hour to add Border Security provisions for the senate which includes funding for ukraine, he says have you ever studied for a test the night before . This is whats happening. Lawmakers in the house and senate are trying to prevent a shutdown from taking place. Everyone ive spoken to almost universally among republicans has said they needed to start their work much earlier. Theyre on very different pages. You have the house right now moving a stopgap funding measure, its not sure if it will go 30 days, 45 days. Speaker mccarthy says they want Border Provisions in there that will fund the border wall. That will not fly with a democrat controlled senate. Youre seeing a group of republicans, those who want ukraine aided to remain in the package in some way, trying to add some Border Security provisions to theirs. Senator sinema im told is working with republicans as the democrat trying to back channel with Speakle Mccarthy as well. The government shuts down at the end of the day tomorrow. The time for these conversations is long past, so at this point its not if a Government Shutdown will happen, its how long it will last and how will they get out of it . This comes as most republicans deemed disaster in the first Impeachment Hearing yesterday and questions about Kevin Mccarthys ability to hold on to power. Theres reports that matt gaetz may try to call for a vote to oust mccarthy in the coming days. Give us the latest reporting as to what mccarthys future might look like . Mccarthy is privately concerned about that. Publicly hes remained defiant. He said put the motion on the floor, try it out, go for it. And certainly gaetz has continued to say this is something hes going to do. I talked to someone like nancy mace, a moderate republican, who told me shes frustrated by the Promises Mccarthy told her, The Ag Appropriations Bill failed in part because of Myth Pris Tone and the fda decision to allow the Abortion Pill to continue to be mailed to americans. Its sort of a perfect storm for mccarthy because he made these promises not just to the hard right and conservatives, but moderates and other republicans to try to secure the gavel. Now theyre turning against him, especially if hes going to have to work across the aisle and lean on democrats to prevent the government from shutting down or reopening. Youre going to see more challenge come to fruition when it comes to the conservatives who dont trust his ability to lead. Privately and publicly.
