Good evening once again, i am Stephanie Ruhle, live at Msnbc Headquarters here in new york city. We begin this evenings broadcast with a major legal blow for one donald j trump. A judge here in new york ruled that he committed fraud and lied about his net worth for many years. The decision comes as part of new York Attorney general tish jamess 250 Million Dollar lawsuit against trump and his company. The judge found trump, quote, repeatedly submitted fraudulent financial documents about the value of his assets to banks and other Insurance Companies, and that his Financial Statements were, quote, based in a Fantasy World and not the real world. Earlier tonight New York Times reporter suzanne craig, who has reported extensively on his finances, describe exactly what the judge told Trump Lawyers at the hearing that led to todays ruling. At one point, the judge, i dont even want to paraphrase, it was so good. He was so angry, he started pounding on his desk, looking at the Trump Lawyers and say, you cannot make false statements about the business, that is what this statute prohibits. He was furious. He was just like, shut up. They had all these excuses for why the Financial Statements were essentially worthless. This really means that the civil trial can move forward, and is set to begin next week. Meanwhile, trumps Fighting A Request from special counsel jack smith for a limited gag order in the 2020 election case. But yesterday, trumps lawyers told the court that order would silence him to take away his First Amendment rights. As a former president battles many legal starts, the current President Joe Biden was at the uaw picket line in michigan today, supporting striking autoworkers. My colleague Gabe Gutierrez was there. In a historic visit by u. S. President on the picket line, biden throwing his fullthroated support behind United Auto Workers. You gave up a lot. Now, they are doing critically well. I know hes busy and has a schedule, but i do believe because this is very huge and how it can affect the economy, that he should have been a little bit more involved. Tomorrow, donald trump will skip at the gop primary debate. He will head to michigan to speak to workers at the auto supplier. Tim, you know that i am starting with you. How damaging is this ruling for donald trump and the image of the selfmade billionaire . Damaging in a number of ways. Its damaging in terms of his own personal family legacy. The trump family was born and bred and the new york metropolitan area. He always prided himself on being a new yorker. He inherited most of his wealth early on from his file is there, and a rooted that were in new york. And this ruling its essentially, if they dont successfully appeal it, and the ruling stands, its a Death Sentence for most if not all of the businesses that he operates in new york. The judges have revoked at their certificates of operation. Most of Donald Trumps wealth is concentrated in a handful of small buildings. He talks about the Speaking Tours and the licensing, but the reality is, most of his wealth was tied up and about five buildings, and most of those were in new york, so it is essentially going to force them to start to scratch, not to liquidate the holdings, southern to people who know that there is a fire sale, because he is selling them under duress, and there is a substantial Fine Associated with. This also prohibits the children, prohibits the two sons from Operating Business in new york again. Trump had a long series of scams behind them, should have gotten them we know already about all of the things that their chair had forbidden from Operating Charities and the state of new york. All of the children, for ten years, they cannot sit on charity boards, but but then there is trump university. There is a laundry list of failed and fraudulent businesses that we know of. Along with the ridiculous stuff, trump mattresses, trump ties, trump water, you name it, but that is not where most of his money was tied up in. So its not a death blow to his entire business, but it is a death blow to the linchpin of his business based in new york. Its embarrassing, and i think it is the combination of decades of Miss Dealings that have finally caught up with him. Its obviously humiliating, but behind image, joyce, because you can always twist a story to your likeness, i want you to break down the consequences legally for donald trump. The legal consequences are severe. I think, steph, we have to acknowledge that trump will obviously appeal the judges decision here, how a three judge panel will look at it, we dont know. But this is an investigation Letitia James put together over years. It was not a flyby witch hunt like trump already suggested on social media. This was millions of pages of documents, this was talking meticulously to witnesses, and putting together this narrative about persistent pattern of fraud and under and over about over evaluation. The case appears to be one that are very strong, and the consequences for trump come to the forefront with damages that will be assessed and a trial that starts on monday. But the meat of the remedy here under the martin act is that he loses the corporate licenses, the certificates that is required by new york law to file in order to do business in new york. You know, the District Attorney here had arrived to the states Attorney General here had long tentacles. She took action last year when trump tried to create a parallel Corporate Structure in delaware to bring all of the assets that the trump entities in new york under her jurisdictions so that she could not siphon anything off. Here, we have reason to believe that she will continue to be vigilant about protecting the hardfought victory that she has won tonight. I just want to remind our audience, for people who say that this is just a big business, this does not have to do with me or he is a performer, issue border, maybe an exaggerated, here is why it matters. When he is over valuings assets, he is doing, he is lying to banks and Insurance Companies to get himself better terms so that he can get bigger loans, or he lies in other instances so that he can pay less taxes. If you think it does not have anything to do with you, it does, because you dont get to do that in your personal life, in your professional life, its not an option. The irs will come knocking. I want you to talk, sam, about tish james here. She says that she is looking forward to presenting the rest her case at trial. What is at stake for her . A lot, obviously. Reputationally she has put her career, almost, on this case. Shes obviously being targeted with an aggression and ruling by the judge was mentally appeal, but a notch one for her. Going forward, she has dabbled with Higher Office ambitions, possibly could catapult her to those types of conversations. In the interim, this is the stuff that will be hovering around the 2024 campaign and it gets at the fundamentals, elemental part of trumps biography. Remember, when he ran in 2016, it was decades of being a premier businessman with a show to boot about making money. What she is essentially doing in the case is dismantling that image, piece by piece. Now, trump has changed the image, and now his business is not real estate really, is politics. And he is turning this around on her, but one part of his biography is really being put under the microscope by her and her investigators. So far, it looked pretty well for trump. I want to stick with this notion of a premier businessman, tim, because one response from a trump spokesperson was the following. It is important to remember that the Trump Organization is an american success story. I am taking a deep breath here tim obrien, because a success story. If Donald John Trump just held on to the real state that he inherited from his father, he would actually be the Multi Billionaire He Claims to be. Instead, this man bankrupted his company multiple, multiple times. He guided everything, essentially everything he made in new york city. If you cannot make money running a casino, its hard to qualify yourself as a great businessman. There are few people that open that Cash Register door and take the money out in a casino and i also think it is charming and a little bit ironic that elina hava of all peoples talking about what a great businessman he is, when she built up her own Legal Practice around him from advising small Real Estate Firms in new jersey, including a parking lot company. Hes not an absolute observer of what makes for largescale corporate successor in the United States. Donald trump as a Self Promoter is an unmitigated success. Donald trump is a marketing wizard success. Donald trump is a hands on business operator, who creates a value for shareholders or long Term Employment for thousands and thousands of employees, hes not. Donald trump is a man born on third base and spent his life telling everyone he hit a triple. Had he not been born into a wealthy family, you not have been insulated from his business and legal mistakes, and he might have been just a but no, but for the fact that fred trumps money insulated him from a financial downfall, from a financial comeuppance for decades. Joyce, you set a moment ago, trump does plan to appeal the ruling, but that is not all. He is also suing the judge. Given both of those things, this is hard one to start next week as planned . I think its likely that we will see the pieces fall into place for this trial to go forward. A delay of a few days or a week wont be significant here. What matters at this point is that the judge has entered a motion for summary judgment. That means that there are no material, factual issues in dispute for a jury to decide, so the judge has gone ahead and and third judgment that amounts to a corporate Death Penalty in the state of new york. What is left that trial is a determination on some additional issues of the Premiere Assessment of damages. That can go forward a pace. Sam, i am giving you the last question and the hardest question, because youve covered donald trump and his universe for years. The judge also sanctioned his lawyers from Making Arguments that the judge already rejected saying, are you kidding me, youre wasting your time. Each have to pay 7500 bucks. Im not saying that is a ton of money for them, but doesnt it raise the question, yet again, why would a respectable lawyer want to represent him . There is a saying that Trump Lawyers are not lawyers, and that is true. A lot of them found themselves in real dire straits, none more than perhaps rudy giuliani. Yeah, its a remarkable thing that people continue to saddle up with trump, knowing the history of being a legal representative for him. Its not just that you get sanctioned, but he has a document history of not essentially paying his legal bills. More recent lawyers demanded money in order to join to case, that was not a smart idea. Being in that universe of being a parking lot Real Estate Lawyer and being elevated to a president ial campaign spokesperson, it can draw a lot of people. But its true that a lot of people will refuse to work for him knowing they say that comes with him. That is a factoid that amazes me every time i hear it. Just imagine, you are a trump appointed attorney, and you are asked the former president of the United States of america to represent him, and your response, sure, dude, but you have to pay me upfront. The senate just introduced the bipartisan bill to keep things open until mid november, but speaker Kevin Mccarthy is under a lot of pressure from some of the most radical conservatives in congress. Now, republicans are working on a long term funding bill and a continuing resolution. Those proposals include some really deep cuts that i want to know, potentially, slashing asing subsidies for the poor by 32 , 1 million low income others and kids will be kicked off food support, and 70 come to Heating Assistance for struggling families. And 80 reduction in funding for Public Schools that are serving the poor students. Anyone out there who wants to tell you, oh, my gosh, if the government shuts down, this is about the zoo and museums getting close for a little while. No, it is not. It is about children, food and shelter for the poorest americans. Meanwhile, on the senate side, more democrats are calling for a senator bob menendez to resign after his indictment, including his dear friend new jersey senator cory booker. Many said that was his ride or die. Joining me now, reed galen is here in person, cofounder of the lincoln project. He also worked on a number of gop campaigns with robert gibbs, former a bomb a Senior Campaign adviser and White House Press secretary. He is also one of the cohost of the hacks on tech podcast. Reed geed, is this the best republicans who can bring to the table to close this that sign said that they keep the government open . I dont know if they really want to. They being whom . The republicans. We talked about this what the defines conservative. Now, its the 20 or so members, were Kevin Mccarthy who made a deal with these people to become speaker say that i dont know what they want. I think they just want to break the whole place down. Now hes learning this. But conservative in your matt gaetz and Lauren Boebert and Marjorie Taylor greene. Also think about mcconnell cut a deal with that the republicans and democrats in the senate to get things done. Why . He even told us that Government Shutdowns were out bad for republicans, all the time. All the things that you listed, how good are those things for voters . How good are those things for people who Republicans Claim will help. We think about all of this pluralistic america that we have, the truth this, there is still more downscale white voters that would be armed by that more than anybody else. Probably, on a numerical basis. Often forgotten, often forgotten. What i am saying now is that they are hurting the very people that should they should be trying to help, like President Biden out there. Meanwhile, Kevin Mccarthy, robert, hes trying to find blame this on joe biden, saying biden could have kept the government open. Who is going to buy that . Reed geeds even Mitch Mcconnell knows that republicans are getting blamed. Stephanie, no one will buy that. I am not even sure he can sell that to the mccarthy household. Look, every time that a shutdown has happened, republicans have paid the price for this. They knew this. They knew this nine months ago. They knew this five years ago. If they sat down, this is what it would be. No, this really is a failure of the basic imagination of government. They suggested that they never passed a short term funding bill, they have to pass every single appropriations bill by the end of the fiscal year. We passed one of the Appropriation Bills for days, one out of 12, four days before the end of the fiscal year. This is an abject failure, no one will believe the politics of this, plans on anybody but Kevin Mccarthy and house republicans, its bad government, bad policy, and it is terrible politics. Lets talk about a different kind of politics, new jersey politics and senator bob menendez. I want you to watch this. Will you run for reelection . I represent the people of new jersey. Are you ready for reelection, sir . As i said, our for the people of new jersey. Why wont you resign, sir . Senator menendez . Because i am innocent. Why were there gold bar is there . Whats wrong with you guys . My colleague, ryan nobles, was doing his job. Robert, how do you think that this will play out . Poorly, for bob menendez. Look, i am not surprised that the dam broke today, when the senator showed back up on capitol hill. What you saw there is what happens when senators walk through their Office Buildings or walk to the capitol, they are not insulated from reporters. The standing right there, walking step for step with you. Its why i thought that this was the date that cory booker was almost certainly going to have to say something. He was going to be followed in the halls by reporters. Look, i am heartened by the fact that a number of democrats have come out today and set, said this is too much. Cash in jackets, and automobile in a garage, gold bars, how about googling are much is a gold barr worth . There comes a point which democrats and republicans have to call the stuff out for what it is, not based on the party, and we have seen this in texas, the texas house and senate tried to beat the Attorney General. From the moment it got to the senate, everybody knew that would not happen, because of tribalism, right . Republicans are going to protect republicans, mostly because they were scared of other republicans. So, i would say, good for democrats to have come out today and said enough is enough, this is too much to break the public trust. Quite frankly, regardless of guilt or innocence, its time for bob menendez to go. Its predominantly only democrats who are saying enough is enough. Reed, what do you make of the fact that republicans are not . I would say this, its a couple of things. One, watch the democrats figure out how to do this, because only about half of Senate Democrats say that he should go. That is one. Second, as soon as they say that bob menendez should resign, there is like a dozen republicans who got something going on. They will go, what about them, what about this person, what about them . Is that why republicans are not saying a word, because they love for menendez to be in office and say, you can point fingers at george santos. Absolutely, remember, so much of this stuff from the president on down is about equivalency. Everybody needs to be as bad as trump, as bad as boebert, as bad as gaetz, as bad as what is his name from long island . George santos. Hes not even that memorable. He just has had so many names, you cant remember them all. So my point is, Everybody Needs to be there right now. They dont want to get into it, he should do it to, because you should do it too. Mccarthy as got five or six members on their own who cant afford and should probably resign based on their behavior. Course before we leave, new topic, robert, a lot of politicians have been pro union, including joe biden. But they walk the line between unions and big business. When we saw President Biden today, we saw someone that has not seen president s before, literally walking the actual picket line. Is that the first time that weve seen . That, in a word, its historic. Look, my guess is that there was a back and forth on this. My guess is that even folks debated this today. One thing that you had to categorize this is historic. The president has put his thumb on the scale and sided with if this case striking workers from the United Auto Workers union, and its historic. But is it wise . And that is going to be a great question. I go back and forth on this. If youre a president , youre in charge of you oversee the whole economy, whether its those working or those producing. Time will tell on this, but it was a big move by the president to land on the side of working, striking workers in detroit, who are going through a big push here. This is a big negotiation for them. We have seen what happened with striking writers in hollywood and this today, President Biden officially picked a side. Robert gibbs, reed galen, good to have you both here. Elon musk can now add another line to his long resume. He is the subject of the top selling book in the u. S. , which bears his name. It is the latest biography by the great Walter Isaacson, the man who also were in the life stories Benjamin Franklin earlier this year, President Biden awarded him the National Humanities mantle. The nai am honored to have Waltr Isaacson with me tonight. Walter, i have 1000 questions. But i want to start, what surprised you the most . When it comes to Public Perception of elon musk, what did you learn that we all had wrong . There are so many elon musks. There are times when he is in an engineering mode, and im stunned by his fingertips feel for things like Stainless Steel or there are times when he is giddy or inspirational, and also a time when he really goes dark and gets really cold and brutal. And there are demons dancing in his head from childhood. We all have a few demons from childhood, but hes got a different order of magnitude. What i tried to do in the book the show how he turns some of those demons into drives, and sometimes how the demons are really unattractive, you see it with the tweets sometimes, and how that is part of a whole cloth of a complex man. He is someone obsessed with his goals, whether space travel, or electronic vehicles, but you also say in the book how he is worried that the u. S. Isnt innovating. You know we are innovating, but is it, he just wants to innovate his way . Oh, no. We used to be more aggressive and innovation. We used to take more risk. Everybody came to this country, almost, took some risk, whether you came on the mayflower or across the rio grande river. And yet he now feels we now have more referees than risk takers, more regulators than innovators. And he wants to push it further. Now, that could be bad. So, you need some regulations, you need guardrails. But sometimes i think nasa has not been able to get astronauts into orbit into the space station. No, no, spacex is able to get people to the space station. Likewise, we have not been able to have the shuttle since it was grounded. Or go back to the moon. Part of that is because we have not been as innovative as we have been in the past. And part of elon musks success is he is the only entity, the only company or country, that has built a rocket that can send things into orbit, and land, and be reused again. So, its that type of innovation we need. I dont excuse all the things that musk does. But i do think he pushes it in ways that, in some of our other companies of america, have not been able to do. Likewise, florida mgm, could go into Electric Vehicles. And now he is making 1 million Electric Vehicles every six months. But is that about risk management, right . Elon musk, in some ways, is a renegade, that he likes to do extreme aggressive things that he will leave scorcher behind him. And thats okay. Because he will get in his rocket ship and leave. But what he leaves behind could be disastrous. And the government, or other companies, have no guardrails than that. Absolutely. And thats what the book is about, which is the importance of taking extreme risk, but also having guardrails, and he doesnt, whether it is his late night postings on ex, shooting up of rockets, he also leaves debris in his wake. The smoldering rubble. So, this is a complex story and a story of a guy who you will kind of be amazed as the driven nature and getting us to mars, but also his carelessness, his recklessness. When you think about the influence he has, especially over young men, the way he behaves publicly gives license to so many people who see him as a hero, and he is youve got two kids. And then they watch him behave like a petty bully, and i they think that is cool. That is wrong. That is what the book tries to show. Does he realize that . And as he realized the good he could to . He realizes at times that he has to restrain him selves. He gets into some of these moments, where he is unrestrained. The question becomes, could he have a filter . Could he be more restraint . And the answer is, short, he ought to be. But would a restrained elon musk accomplish as much . We could be shooting off these rockets . And say, you have got to tell your kids, try to do the inspiring things, tried to do the easy thing, but dont be a jerk, but dont be so hard. That no other fortune 500 ceo does, whether theyre ford or any other Corporate Board would say, this behavior, you are out of here. How can he behave in a way to no one else can . First of all, most of his companies, including spacex are private, and that is why he wanted to take tesla private. And or he controls the board of tesla. I think the board of tesla ought to try to control him more, because he doesnt. You want to have more guardrails, as you are watching for your kids sake, he should be more careful. This is a reckless individual who is also somebody who ended up being the owner of Electric Vehicles. In america sometimes, we think hero, villain. We all have a hot take. Everybody wants to have a hot take. We are complicated people. This is complicated. We are a complicated society, and this is one of the most interesting complex persons around. What about the worry that the government has about elon musk and starlink and his potential hands, is involvement in this war in ukraine, what can you tell us about that. One of the things that even musk realized after he supplied starlink to the ukrainians, and they had no other satellite company, no other communications company. Via set. Viasat. Finally, he talks to general mark milley, talks to the u. S. Government and transfers cells, some of the starlink services, creates a star shield but turns the control over to the u. S. Government. That is the way that it should be. It took him a while to get there. One thing that stood out to me, as brash as he has, or as much bravado he puts forward, when he hosted saturday night live, he could not have been more vulnerable. He looked at the camera and told america that he has aspergers. That was a very generous and vulnerable thing to do. Was that a big thing to him . Because it was a big thing to sow many people who saw someone like that do it. Absolutely, and we cut people a lot of slack one day have psychological or other mental things, but if somebody has aspergers, or as we say, on the autism disorder spectrum, sometimes, we just say, they are a jerk, or there is a technical term that begins with a because they dont understand emotions that way. That should not excuse people who dont try to be nice, but but i think elon musk was saying, look, this is ingrained in me, the even though his brother kimball, absolute opposite. Hes got the empathy gene. He so in excess, but musk is talking about, yeah, sometimes psychologically, the there are people arent very good at being emotional receptors. We all wish they would try harder. But i think its good he talked about that. My last question, you have written about Benjamin Franklin and leonardo da vinci, two icons, geniuses, do you put elon musk in line with him in the same category . I think that he along with steve jobs and jennifer dowd, who i wrote about in my last book, about crispr and to the age where we can and it edit our own genes and maybe edit our children, for better or worse. Musk brings us into the era of Electric Vehicles when Everybody Else had given up on it, into space travel and even to a new form of real world artificial intelligence, meaning selfdriving and robots. All of these things that he has done, hes got a lot of flaws, and a lot of rubble in a way.
