Forcefully pushing back today against a federal indictment for the second time in a decade. This time over he and his wifes alleged acceptance of hundreds of thousands of dollars in bribes, a mercedes and help with their mortgage. The senator and his codefendants including his wife are schedule today appear in a manhattan courtroom wednesday morning for their arraignments. Menendez speaking moments ago in union city, new jersey, proclaiming his innocence and condemning attacks from his fellow democratic lawmakers. Remember, prosecutors get it wrong sometimes. Sadly i know that. Instead of waiting for all the facts to be presented, others have rushed to judgment because they see a political opportunity for themselves or those around them. All i ask for in this moment, in my colleagues in congress, the elected leaders and the advocates of new jersey that i have worked with for years, as well as each person who calls new jersey home is to pause and allow for all the facts to be presented. Capitol hill consider correspondent ryan nobles joins me now. Theres clear push back there. Reporter yes. Bob menendez is clearly defiant and pushing back on any political pressure to step down from his office any time soon. The question he left open during this Press Conference this morning is whether or not he plans to run for reelection, his seat is up for reelection in 2024. The democrats are facing a very difficult map in order to keep control of the senate. That has a lot of democrats concerned about having menendez as the candidate on the ticket in terms of giving republicans a potential opening. Thats why youre starting to see a smattering of democrats calling on menendez to resign. Among them the first latina person to do that, representative alexandria ocasiocortez. Listen to what she had to say. The situation is quite unfortunate. But i do believe its in the best interest for Senator Menendez to resign in this moment. Consistency matters. It shouldnt matter whether its a republican or a democrat. The details in this indictment are extremely serious. They involve the nature of not just his but all of our seats in congress. As a latina there are absolutely ways in which there is systemic bias but i think what is in the indictment is quite clear. Her being forceful calling for menendez to step down was significant because part of What Menendez is arguing is hes unfairly targeted because of his latino heritage, a cuban immigrant and why he feels its so important to fight back against the accusations. As for his future the only hint he would give is that he said that after all the dust settles in terms of the legal issues hes facing, he still intends to be the senior senator from new jersey. This could take a while so it would seem to indicate he does plan to run for reelection but we have to wait for him to give us the ultimate clarity on that. I want to bring in National Police correspondent Steve Kornacki and former federal prosecutor paul butler with me in washington. So steve, Senator Menendez has faced a lot of legal jeopardy and long odds before. Last time there was a mistrial and so prosecutors dropped the case. This is different. His hold on voters may not be what it once was. And this indictment, which is a Speaking Indictment has some of what experts say are shocking details. The political situation is already extremely different because you have the democratic governor, phil murphy calling for menendez to resign. You have fellow members of congress, the house calling on him to resign. The Democratic State chairman calling on him to resign. The party was united top to bottom behind him when this played out between 2015 and 2018. The last time around. A completely different response this time. So yes, i was interested too. He didnt directly say hes seeking reelection in 2024 in that statement, as ryan said. What he said about he intends to remain the senior senator when this process ends given how long this process is expected to take through the 2024 election that would seem to indicate an intent to seek reelection. If he is indeed running for reelection, then new jerseys Democratic Leaders have serious decisions to make here. Basically, heres where things stand. The majority of them have called for menendez to resign. If he doesnt resign and hes going to run for reelection, hes already drawn one democratic primary opponent thats congressman andy kim, from south jersey outside of philadelphia. Do those Democratic Leaders now, take the kim candidacy and unite behind it. In a one on one race, menendez is in trouble even in 2018, a no name candidate with no money and Media Attention got 40 of the vote in the primary. Thats how much distaste there was for menendez in the rank and file voters. So Democratic Leaders unite behind one candidate and theres a congressman, andy kim putting himself out there. What menendez is hoping for, if he does run here is that others will get in the race. Im hearing Congresswoman Mikey may be interested it. Congressman donald nor cross may be interested in it. And if more and more candidates get into the race and you get a divided field and menendez is still running then with his name recognition and retains his Political Base in hudson county, 10 of the state, a big if there. Then menendez could have a chance, a route and a primary to win with like 30 of the vote. Again i say, i agree, he didnt clearly say had hes running for reelection there. The implication seemed to be that he is. And if he is, those same leaders who came out against him have a serious decision to make about whether to unite behind a candidate. Lets play more of menendezs remarks just this last hour. For 30 years i have withdrawn thousands of dollars in cash from my personal Savings Account. The fbi, as part of the investigation, executed a Search Warrant at the senators home in new jersey, they found 500,000 in cash money. So the senator has to have a story to explain that. We all know people who cash at the home, theyre afraid of banks, i think its crazy but a lot of people do that, so it sounds plausible. The problem for the senator is that some of that cash money has the dna and fingerprints of the alleged briber. So i dont know how he explains that. We should also talk about the fact that hes the chairman of the Senate Foreign relations committee. And senate rules are you have to step down if youre indicted for a felony. But that is such a hugely important job. So the suggestion even he was involved with egyptian intelligence. He was careful about emails and texts but his wife, nadine was not. You know how important the Foreign Relations chair is. This is someone at the center of every effort of United States diplomacy around the world. Someone who represents the United States on foreign trips with other members of congress. And someone considered among his democratic colleagues as being an expert in the field when it comes to Foreign Relations. So the idea that he would be consorting with egyptian officials and perhaps putting his thumb on the scale when it comes to finding ways to get them additional aid maybe in the face of Human Rights Abuses is a real problem. Because, you know, not every member of the senate is constantly paying attention to whats happening with Foreign Policy they expect to learn about the issues from an expert in the field like bob menendez. When i look at the list of charges and accusations made against him, i have to think this is the most serious given the role he plays on the Foreign Relations committee. Hell step away from that position as you pointed out, its compulsory he has to do that. But he still remains a member of the United States senate, hell have a vote for the foreseeable future so these are questions in front of Senator Menendez as we move closer and closer to the outcome of his legal troubles. President biden facing Voter Concerns about his age and the economy. Back with us Nbc News National Political correspondent Steve Kornacki and joining us is Political Editor and poll expert mark murray. Steve first to you at the big board. Walk us through the numbers on the republican side and the potential matchups. You mentioned it in terms of the republican race itself. Heres the new numbers nationally trump nearly at 60 among republicans. Ron desantis his nearest and use the term nearest adviseedly there, 16 . Everybody else in single digits. It comes after trump skipped the first debate, on the verge of skipping the second debate. Several indictments of criminal allegations against him. All things his opponents, republican rivals thought would cause Republican Voters to reconsider their interest in a trump candidacy, instead his numbers went up and up. In the start of the spring, trumps lead over ron desantis was 15 points. Its exploded now to 43. Basically tripled. Trumps advantage over desantis from april until now. And again with nobody else there popping into double digits. Trump nearly at 60 . If it is what republicans go with, trump for a rematch against biden how does that look in our poll . We have a tie. Biden at 46 and trump at 46. We also tested a couple of other possibilities here. Heres an interesting one, ron desantis, again, sort of the unspoken premises of the Desantis Campaign was to offer republicans a more electable version of donald trump. Yet, in a headtohead against joe biden, desantis is doing a point worse in our poll that trump does. We tested a third candidate, nikki haley she leads biden, 46 to 41 in this poll. But one key point we found just under half of all voters know who she is and have an opinion of her. Shes unknown by a lot of voters and it may be some of the advantage over biden because shes so unknown some voters may view her as more of a generic republican alternative to biden. Lets see if she gets more attention, attacks, scrutiny how the numbers look. Steve what are the top Voter Concerns first about joe biden and then donald trump . Take a look at biden. The economy stands out when he took office basically the country was split in half whether they were satisfied or dissatisfied where the economy was now, now 28 , one in four voters say theyre satisfied with where the economy is. When youre the incumbent president thats an obvious vulnerability for you. We stacked these things together and asked if theyre major or moderate concerns. This was interesting because trumps indictments all of his legal issues, the pending trials. This is a significant concern to a clear majority of americans, 62 say its a major or moderate concern to them. But look at this number thats higher 74 saying that joe bidens age and his fitness are major or moderate concerns for them. That number 12 points higher and notably, joe biden is 80 years old. Donald trump turns 77 this summer. Not a lot of years between them and yet on the age question only 47 say that trumps age and fitness concern them. Thats one of the most striking numbers in this poll. First of all the president only has a 41 Approval Rating hes been bumping in the low 40s, one poll 39 that was sort of an outlier. But now he has this large number of people, 74 concerned about his age and fitness while only 47 are concerned about Donald Trumps who is arguably you know, questionable in terms of the way he speaks when hes adlibbing off prompter also. Yes. It is a tough poll for the president. And for donald trump. But as one pollster said, this is a flashing, glaring red light for the incumbent in the white house. The one Silver Lining here in the poll, if you are joe biden in the white house is that among the 74 who say i have worries about joe bidens age and fitness, 18 say im going to vote for him over donald trump. Its a smaller share for the people who have concerns about Donald Trumps multiple trials and who would say they would still vote for him despite that. So when we look at our poll and under the hood, people disapprove, latinos, african americans, young people who say they disapprove of joe bidens Job Performance but theyll still vote for him over donald trump thats significant and why the vote is tied. Theres a gap among the young voters, black and latino voters that were so important to his victory last time. Yes, this may be the roughest numbers. Not only shows republicans with an enthusiasm high voter interest over democrats but it also shows that african americans, latinos and particularly young people arent as fired up as they were in past election cycles this same point in time in the 2020 race, 2016, 2012, 2008. 13 months to go still a long time but they have work to do. I heard Chris Christie saying to Kristen Welker about the negative support for all of the challengers to donald trump. This is a National Poll and its the states and the primaries and the caucuses that matter. Absolutely. As weve seen. If you win iowa, New Hampshire you can change the nationals numbers but the National Polls give us a taste of where the american electorate is right now. We need to see how the general populous, and dont forget that actually contests like we have on supertuesday or other big primary days get beyond iowa and New Hampshire. Time is running out to avoid a Government Shutdown just this coming Saturday Night and House Republicans are still feuding amongst themselves over a temporary resolution to extend Government Spending with speaker Kevin Mccarthys future still hanging in the balance. Joining us now is garrett haake. The speaker signalled there was quote some progress with the hard liners in his caucus today. How do we judge that . In all the votes hes lost badly with defections not letting him bring things to the floor twice last week zblsh theres certainly movement but whether it amounts to progress is something well see tomorrow when the house is back in session. The plan as i understand it right now is to try to pass the full year funding bills individually negotiated by House Conservatives and republicans amongst themselves and you can think of those as a down payment if those bills pass you might see easing up of the opposition to pass a shortterm Government Funding Bill that would keep the lights on for 40 or 60 days to allow negotiations to take place between the house and senate and everybody goes on about their business. The problem here is its not clear as you point out, the same House Conservatives who have been involved in tanking other Appropriations Bills and blocking considerations of a cr thus far are willing to go for that. Mccarthy argued anything that trips this plan up and shuts the government down weakens the House Republican position. Heres what he told us today. You have to keep the government open. People want to close the government makes it a weaker. Why do they want to stop paying the troops, the border agents, or the coast guard. I dont understand how that makes you stronger. I dont understand what point youre trying to make. Thats the argument that democrats will make, senators will make in a bipartisan basis if a shutdown happens except theyll be blaming it on republicans without the distinction that mccarthy is making between the meat of his conference and the dozen or so members that refused to let him move on anything so far. Even if they come up with a short term continuing resolution, theyre talking, the rebels if you can, those Against Mccarthy right now and what hes trying to do. Theyre talking about it at levels below the july agreement between mccarthy, mcconnell and the white house. Thats right. Thats a nonstarter in the senate. Reporter thats right. What you may have. Again, even if this plan works as designed, a bill the senate will never pass going to the senate side of the chamber with little time left to spare and the senate sending their bipartisan negotiated bill back to the house and a staring contest between Party Leaders across the building over whos signing what and whether theyll do anything before the government shuts down. As i stand here now its likely we tip into a shutdown and answer the questions while were in one than avoid it at the last moment. The end of the Writers Strike appears in sight as the Writers Guild of america and hollywoods Top Media Companies reached a tentative deal. They have to ratify it still. It comes nearly 150 days after writers hit the picket lines. Theyre agreeing to a tentative three Year Agreement with the streamers and the studios including nbc universals parent company, comcast. While specifics are not known the deal likely promises higher residuals from streaming, higher wages and some protections against a. I. From day one weve been hopeful a deal will be reached. Theyre still haggling over some of the language and we saw it in a statement from the Writers Guild of america last night that they are working through issues we know from two sources part of the negotiations over the last five days, it comes down to wording around Artificial Intelligence but once this goes into effect and once this ban is lifted on working, which could even happen from the wga, andrea, before this is ratified, we could see writers being given the green light from the union to go back to work. I think what youre saying is the right thing. You cant really have shows without the actors. You might see day time and late night come back but when you have scripted and film, writers is only half of the battle. Sagaftra that represents over 100,000 writers they havent started negotiating since going on strike in july. Were hoping to see them come to the Bargaining Table now with streamers in studios. Thousands of additional members of the United Auto Workers are joining the picket line as talks between the Union Leaders and to and two of the auto makers have stalled. Still no deals, yet. He announced that after former President Trump said he would be rallying supporters wednesday in motor city. Counter program while his republican challengers are on the debate stage at the same time in simi valley, california. Jesse kirsch is in michigan. What are we hearing from the uaw and workers about trying to get gm and stellantis to make progress . Reporter on andrea, the union sending a clear message its hearing more of what it wants from ford rather than the other two automakers. When it expanded it did not expand against ford. It omitted that company and said that it was making quote Real Progress with ford. So now were watching this continuation, this stalemate is ongoing. As you mentioned, president s current and former are coming to down in the days ahead. Itll be interesting to see if that applies any further pressure as well. Weve spoken to numerous workers about the visits from president s as well as other issues. What they want to get out of this, there are a range of issues the union has been pushing for, health care, pensions, retirement benefits. And i want to share with you what i heard from one worker over the weekend. It sounds like pay is your top issue. Pay for everyone else. I want a raise too because of inflation but i want to see everyone brought to the same level so were on equal footing and everyone is taken care of. Reporter and thats been one of the big pushing topics for the union, andrea, is this idea of tiers. They want to see everyone get paid the same for the same work. What about Electric Vehicles. Theyre afraid when the switchover takes place, there will be fewer jobs for union workers. Reporter that makes this whole situation very politically challenging for President Biden because he is pushing for Electric Vehicles but also calling himself the most prounion president and hell be joining those on the picket line. And the work i just talked about is the underlying concern around Electric Vehicles, something that former President Trump has been pushing President Biden on. So interesting to see how they navigate that this week. No question its part of the talks and underpinning this because theres concern from the workers and the companies arguing we can only give so much to the workers because we need to save money to invest in the ev future which is not fully here yet. Roselyn carter, she drew some criticism and some praise. She sat in Cabinet Meetings and her issue was mental health. And i learned only after they left office just how extraordinary deep she was involved. And deeply involved she was. Hillary clinton was controversial because she had an office in the west wing. That was breaking ground too. And got so involved with health care which was such a big part of the economy. Which the president gave her to do. And he campaigned on that. The two for one, you remember that. You covered the campaign. He wanted to tap into her Policy Prowess as well as her political savvy. The country wasnt ready for it. I think thats something we examine too. There is a Tipping Point on what americans will accept of how deeply engaged their first ladies get. But they do expect them to be involved. One of the things that was so important for me to watch was laura bush in afghanistan. We went to the American University in kabul, the first coed, she was the first patron of it. The white house cannot be happy that threequarters of the voters say that the president is too old and not mentally capable compared to a much smaller percentage than think that of donald trump who is only three years younger. I get very frustrated by that. If you try to track Donald Trumps cognitive issues over the years, you diagram his sentences from today versus where he was 20 or 30 years ago, you can certainly map out some change there. Hes clearly not the same as he was when he was younger, but he presents with physicality thats a little different. His volume i think, his bomb bassity, the energy he projects at these rallies means there are fewer people questioning his age, even though hes only three years younger than President Biden who physically shufales and appears a little older than he did just a few years ago. I think thats a challenge for the white house. When push comes to shove, when people are forced to choose, in the end Donald Trumps vote is at a ceiling beyond which he probably cannot raise.
