I think this is really relevant today given the fact were about to go into a hearing where a judge in the January 6th Case is going to rule whether or not a standard protective order should be placed around the information that donald trump is able to see and receive and how hes able to use it. The timing on that not lost on any of us. Yeah. The twitter files that the Justice Department wants to retrieve clearly relate to that time period right around the election. All of those materials could be relevant. Its fairly typical for prosecutors to obtain social media from the platforms like twitter, like facebook and others. I think the only reason this is getting so much attention is they resisted in this case and it had to go to the Appeals Court to get timely compliance. But clearly there is evidence here that is important to jack smith and the investigators. So im sure well see pieces of that during the trial. Barbara, help us understand what you think that evidence might be. Because to state the obvious, trumps tweets are there for the world to see. You do not need a subpoena for that. What then do you think it was that jack smith was looking for . Well, to authenticate those documents, getting them right from his account is probably the best way to do that. To get documents into evidence, you have to show they are authentic. To just show a screen shot that somebody grabbed, it could open you to a defense of that wasnt my really my tweet, that was somebody elses, that was an imposter, some other fabrication. You have to show a whole chain of foundational evidence to show this is The One And Only donald trump who communicated this. If you can so hes the owner of that account and obtained that document directly from twitter, you can even put a twitter official employee on the stand to say, yes, i keep the records at twitter, this is the account of donald trump and this came from that account, that is the chain of evidence that you would need to show authentication of this exhibit in court. I know it seems obvious that weve all seen it and we know its donald trump, but in court under the rules of evidence, you have to actually show that chain for foundational purpose. Thats something that may actually be the big push Trump Supporters need to say this is it, its now or never. You better understand some, son, you better understand something. Based on what weve already seen from previous events, i think trump is absolutely correct. His twitter does not exist in a vacuum, right . These witnesses are going to be keep for building williss case. If you are willis, how do you deploy them in a way that tell as clear, linear narrative . Well, it appears that willis may be looking at several different schemes and maybe even using the rico statute to bring them all together. Keeping those straight could be a challenge for a jury. My guess is she would tell the story in chapters. She would talk about the fake electors chapter, the threat to poll workers chapter and threatening of the officials and Georgia State Legislature Might be its own chapter. We would hear from witnesses who could tell their stories so people could understand. I think one thing that is particularly compelling and that will give these witnesses credibility is many of these witnesses are republicans. It shouldnt matter whether youre a democrat or republican, but i think it makes it more difficult for trump and his lawyers to crossexamine them based on any political bias when you have Republican Office holders saying they were trying to sell a bill of goods to the georgia voters. And that strikes me in as much as that is true in legal court, which is most critical here, that also theres an element of truth for that in the court of public opinion, right . The fact that its not easy to dismiss anyone get up on that witness stand. These are republicans who dont want to be here, right . Who dont want to be in the middle of this standing up and doing the right thing and sharing with the people of georgia and the people of the United States what it was that happened that led to that day. Yes. And the fact that its local, Americans Trust their local mechanisms, their local institutions. According to reports half of the phony, bogus electors of the 16 have cooperated. Theyre all republican. When trump said to Brad Raffensperger that republican Secretary Of State, can you find the 11,780 votes, hes dealing with people who would supposedly support him but in the end, supported the law and supported the constitution. Well, we have learned certainly by finding out who were witnesses in the Special Grand Jury Investigation and then again who was being duplicated in this investigation exactly what kind of strings and strands of a story line fani willis may be polling. We look at bea wynn on the end of Rudy Giulianis testimony. County officials were called, thats going to be an important part of this as well. It was an incredibly dangerous time and i think that fani willis is trying to show that this wasnt just an effort to move around pieces of paper. This was not a victimless crime. There are people whose lives were just completely turned upside down and whose lives were put in serious danger by the acts of the former president and many of his associates. Weve learned it goes very deep, very wide, in some cases across the state and multiple story lines learned itself to the concept of a Racketeering Charge as well. Today there is brand new reporting that fani willis could be seeking justice for them in her expected indictments next week. Quote, the grand jurors approved several summons for people who visited her home and convinced her to falsely implicate herself. Several jurors recommended they were on the same page of people. Talk to us about this reporting and what it is that justice might look like. What we know from our own reporting and also from people inside the process that there were multiple people reaching out to ruby freeman and shaye moss. One gentleman was inside her home, was intercepted by deputies. He said i just want to talk to miss freeman and tell her the truth, im not going to hurt her. Other people, they werent so sure. So they were being surveilled, they were being in many cases harassed. They were, as we discussed, getting Death Threats. They had to move out of home and they were in real specific danger and peril. And so that goes beyond harassment. That certainly looks like it could be something that puts their lives in danger. And so we dont know exactly what the charges would look like but we do know that thats a significant piece of what fani willis is pursuing, again to demonstrate that this was not a victimless crime, this was not about submitting pieces of paper to a federal agency. This had very real world consequences in a way in a could have gone yes, very badly. We all saw Gabe Sperling come out in front of the cameras very famously. He was the deputy Secretary Of State here in georgia and he said, mr. Trump, you have got to call off your people, someone is going to get shot, someone was going to get killed. That was the environment in realtime. That was also sweeping up dominion Election Security workers, as long as anyone who was known to a poll worker. It really was a very dangerous time. Theres a sense from what we know from interviews with the special grand jurors that they would like to see some kind of punishment for that behavior, if only not just to punish for what happened but to prevent it from happening again in the future. It was bad and it could have been worse. Giuliani lied about freeman, lied about moss. They became public targets of trumps attacks. Speak to giulianis exposure. Giuliani we know was recorded talking about the exchange of information. Here they are passing what clearly is voting data on a usb drive, turns out to be a ginger mint. So the charges could be anything from conspiracy to violate election law to something more specific about these individual targets, threats, harassment, cyber stalking. Theres also been reporting that individuals approached shaye moss and asked her to falsely admit that she had been involved in Election Fraud. Now, if that is the case, then there could even be crimes of extortion or bribery if they were put up to that task by others. The reporting says those intermediaries have been questioned. It would be useful to know who asked them to do that, if anyone. They could be part of a conspiracy or bribery to get shaye moss to join in a fraud. What happened to freeman and to moss was terrible. Theres also a Chilling Effect that continues to this day where its becoming increasingly difficult for Election Officials to solicit Election Workers. Why would you want to do it if this is what youre facing . You, my friend, have actually been an Election Worker. So take us through what does it look like when you are actually in there doing your civic duty . So the larger idea is that democracy doesnt go on its own. People have to volunteer to participate. I volunteered to be an Election Worker in columbia county, new york where i live. And its eye opening because its so buttoned up. High and these are people who volunteer for a long day for long hours and get paid very little. The whole system of residents asking people their birthday. Its a belt and Suspender Roach that doesnt allow for Election Fraud. Youre counting them in realtime and during the dave and i would encourage people to do it because you see democracy in action. People coming up, voting by hand in this case, voting in their community. Theres no sense of who is a republican or whos a democrat. Theyre voting for what they think is the right thing to do. Thats a good system for all of us. To the point that you made that this is not just accountability for what happened, but setting a precedents so it does not happen before. Quote, several jurors ints viewed by the Atlanta Journal constitution spoke on the condition that they not be identified said they were deeply affected by the mother and daughters testimony and found no evidence of wrong doing on their part. Its not hard to manage the two of them given the video we have seen and telling their own story, being very compelling witnesses on the stand. It was pushed over and over again in different venues by President Trump and his associates and it is certainly a piece that we know the special grand jurors were really deeply affected by because it took it out of the realm of, well, theyre elected officials, public officials, arent they signing up for this . How does she lay out the indictment and make it clear to people what it is that is at stake in this case . I think thats something that can be handled at trial. It can be in the indictment if its a speaking indictment, but i think to bring it home you have to show who the victims are in this case. One is we just said shaye moss and ruby put a face to the case so their testimony could be compelling. But all the motives of georgia are also the Federal Court. The victims are all of us. One of the things that jack smith case was to have that count four, which was deprivation of rights. All of the voters who didnt have their votes counted properly if trump had gotten his way under his conspiracy. I think in the same way framing this case as trying to victimize the people of georgia, the people who voted for joe biden and had their votes not counted. That sound you hear is the resounding no from ohio voters in yesterdays election, sending an overwhelming message to republicans, do not take our reproductive freedoms away. More than Three Million ballots were cast in the Special Election, voting 5743 against issue 1, which would have made it harder to amend the states constitution. Issue 1 would have raised the Voting Threshold for amendments. It was an admit aid tempt by republicans to head off a November Vote on a measure that would enshrine Abortion Rights into ohios constitution. About the results, the ap reports voter opposition to the proposal was widespread, even spreading into traditionally republican territory. In early returns, support for the measure fell far short of former President Donald Trump in nearly every county. Ohio joins the ranks of six other states who have had ballots on Abortion Rights since the Supreme Courts decision last year that overturned roe. And in every case, the voters chose to protect womens Reproductive Rights. The washington potion details what these votes detail about the current electorate. Including ohios shows that in 500 of 510 counties, access to abortion outperformed President Bidens 2020 results. Across those counties, including a lot of deep red ones, the margin of support for Abortion Access topped bidens 2020 margin by an average of 26 points. A significant shift to the left. Abortion rights were a central pillar of yesterdays vote, voters also sent a message about what you heard senator brown allude to, a power grab by state officials. Republicans were trying to make it harder for certain voters the get their voices heard. It was power grab that President Biden acknowledged in his statement just last night. This measure was a blate attempt to further erode the freedom of women to make their own health care decisions. Ohioans spoke loud and clear tonight and democracy one. Joining us at Georgetown Law School and author of policing the womb individual women and the criminalization of motherhood, Michelle Goodwin is here. And former deputy National Security adviser to president obama ben rhodes. It is good to see you all. Minnie, we were here. We spoke on this program just yesterday. You said to me republicans are trying to change the rules, and theyre still going to lose. Well, you are right. When are republicans going to recognize that antiabortion positions are a loser for them, not just among democratic voters or independent voters, but among their own voters . Thats the Million Dollar question, right . I think as these losses continue to pile up, you are beginning the see some republican operatives and stakeholders and donors asking tough questions. There was news recently about a mega donor to ron desantis who has decided to pause on his contributions because he thinks the candidate is, quote, too extreme on abortion. And that raised a lot of eyebrows on our side, because it sounds like the Establishment Republicans are beginning to be caution and concerned. The candidates, however, are too far out there and extremists are too much in control of the infrastructure in the states we saw. Its important to note again, franklin rhodes, who championed this prop 1 is the candidate who is going to potentially be running against Sherrod Brown. So he made himself the face of the defense of abortion sorry, this election, a Ballot Initiative we knew was about abortion, and he is not shying away from it. So its not clear to me that candidates and republicans on the ground are getting it. But their donors are beginning to Pay Attention. Michelle, here is the thing. When the Supreme Court announced the Dobbs Decision, they said they were returning the decision back to the states. If you believe that, were now seeing time and time again what it is that voters in those states want. In kansas, 59 voted to keep abortion legal. Michigan, 57 voted to enshrine Abortion Rights into their state constitution, and now, 57 in ohio voted against issue one. This is an overwhelming message from voters here, michelle, and its not just voters who might consider themselves prochoice or proAbortion Rights. It is voters who are saying what republicans are doing is extreme government overreach. Thats right. And thats the concerning part. So even though weve seen these Ballot Initiatives be very successful on the behalf of Preserving Abortion rights or blocking in some indicates like kentucky where they wanted to permanently block access to Abortion Rights, and weve seen people come out, the real challenge that Voter Suppression is also taking place in the United States. So while on one hand, we see the ballot issues that attempt to undermine reproductive health, losing, at the same Time Critical states like michigan and others where Voter Suppression is at a high in georgia and other places like that. So while on one hand, this is Great Success and its unfortunate that the Supreme Court in dobbs said that look, if you care about Abortion Rights and you have to take to it the polls, that shouldnt have been the case when the court overturned roe v. Wade, at the same time i think we ought to be cautious and concerned about what this means in states where voting is such a high hurdle for so many people who have been historically disposed from the right to right to vote. To that point, the Voter Suppression wasnt on the dl. You had republicans saying yeah, this is what were doing. Were trying to make it harder, and were doing it specifically because were afraid of what theyre going to be able to do on Abortion Rights in ohio. I want to read you something from the Washington Post, e. J. Dionne. He brings, if issue 1 defeat was a statement about Abortion Rights, it was also harsh judgment against the antimajorityian politics the republicans are practicing in many states they control. Their efforts include highly partisan gerrymanders, efforts to make it harder for some groups to cast ballots, particularly black and younger voter, and State Takeovers of Election Demonstration in cities. There is an antidemocratic effort under way, ben, by republicans. And here is the thing. Voters see what they are doing, and voters are not standing for it. Thats right there. Is a lot of positive things to take away from this. And part of what i think has happened here, alicia, there have been discussions about threats to democracy for years. Particularly since trump came on the scene in 2016 and had so little regard for democrat norms. What was so important about the Dobbs Decision is that it clarified for people just what that could mean in practice. A fundamental right was taken away from half of the American People, and they didnt like it. So all of the sudden the arguments about democracy and the need to defend democracy, they were no longer academic. It got to the most personal foundational issues for a lot of voters. So i think that combination of the concern about democracy and the concern with this right being taken away, that is what has turbocharged the electorate. And look, this is staring us in the face. There is no way the democrats should have performed as well as they did in the last election based on every historical barometer. The main thing that was different in that election was the Dobbs Decision and the sense that republicans had become too extreme and were undermining democracy. And were seeing now, that is a voting issue, and frankly, a leading voting issue in this country. So were still accustomed the economy or even particular cultural issues. This is more foundational. And it is really telling that in a state like ohio that has been trending red, after voting for obama twice, voted for trump twice and was getting deeper red as it went, those voters in such a resounding way stood up against it tells you the tenor is up among the american voter. They dont like what theyre seeing. They understand the threat to democracy, and they dont like taking away Abortion Rights. One of the things that is interesting in as much as this is a win for ohio, it has a big impact on other states. Weve already seen groups in arizona launch a bid to Add Abortions to their state constitution. You and have i talked a lot about offensive wins and defensive wins. Talk about the ongoing efforts to protect womens rights in the aftermath of dobbs. Well, i think this conversation is so important. Thank you for continuing to focus on it. To understand where we are is also to understand that this is an issue that republicans have long actually supported Reproductive Rights. Roe v. Wade was a 72 decision. Five of those seven justices were republicanappointed. And the justice that wrote that opinion, Just Blackman was put on the court by richard nixon. When we are seeing these victories and it has become a shining light and beacon for other states, its important to be mindful there are republicans that support these issues. In fact, they overwhelmingly support these issues. That may not be seen by who dominates in terms of state legislators, but i think what were also seeing are republican women quite frankly standing up privately and going to the ballot boxes and voting not only on behalf of themselves, but voting on and a half of their daughters. Lets keep in mind that there are State Legislatures that are now refusing to allow exceptions for cases of rape and incest. And any mother looking across the table at her 8 or 9yearold daughter has to wonder, will i allow myself to be governed and ruled by these men who are governing the legislature, or will i stand up for my child if someone rapes my child, will she be forced as a 9 or 10yearold to become a mother simply because of where republican politics are today . And i think there are women who are voting no. We saw that in ohio. Right. Who dont want the government involved in those decisions. Ahead of the ohio election, a superpac put out a controversial ad. So here it is to remind us, a warning to you, our viewers that it gets a little steamy. Do you a condom . Yes. Sorry, you cant use those. What are you talk about . Who are you . Im your republican congressman. Now that were in charge, were banning birth control. This is our decision, not yours. Get out of our bedroom. I won the last election. Im not going anywhere. Im just going to watch and make sure you dont do anything illegal. Minni, what is the challenge of the messaging in this moment given that in some ways youre now messaging to a broader swath of the electorate, and there are different messages that resonate with those different corners of the electorate . So that ad was definitely eyeraising. It got a lot of attention. It went viral. But actually, the core message that works with the majority of americans is talking about our fundamental freedoms. And ill piggyback off of something that ben said. The end of roe really crystallized for folks how important those fundamental freedoms are, and how vulnerable they are and how under attack they are by the trump administration, the current courts, not just the Supreme Court, but many, many extremists embedded in the courts thanks to donald trump. So whats really important, when you talk about abortion, the reproductive freedom as a fundamental freedom, the freedom to decide if, when and how to have a family, it transcends politics, and its something that all americans can connect to. Its some of the best political ads in the midterms by folks like pat ryan, a veteran who tied his service for the fight for americas freedom to the freedom to decide when and if to have a family. We encourage candidates. We know that messaging works. We know that it transcends race, class, economic background and party. And its particularly persuasive with independent voters who are going to be critical for the biden harris ticket to get reelected and to preserve a set of majority and win back the house, which is how were going to pass federal legislation to codify and protect abortion acts nationwide. Ben, to pick up on your earlier analysis, there are a lot of folks who said yes, this issue resonated during the midterm because the decision was very recent. So it was very motiving to voters. But by the time you get to 2024, its going to feel like it was in the rear view, and people are not going to be focused on it. I would argue that watching what has happened in these states, youre actually seeing the stakes and the consequences, the reality that abortion is health care become increasingly real to voters. As michelle said, perhaps not just for themselves, but for their daughters. So i think you were actually seeing this issue, which once pundits argued would lose its heat going into 2024, only gaining momentum, especially in the context of what you laid out, right . A party that has become so extreme that it is no longer recognizable or tethered to the realities of what it means to be a person living in this country. I think youre spoton, alicia. Look, ive lived through big issues that determined elections in the past. The iraq war and the 2006 midterms, or the post financial crisis and backlash to the first years of obama, and on and on we can go. This is different. This is fundamentally different for a couple of reasons. The first is this was a constitutionally protected freedom, right . Reproductive freedom is something that the Supreme Court found should be constitutionally protected. To take away that kind of right from that many americans, its not like its a tax cut that theyre going forget in a couple of years. Thats a right that they won. Thats a decision that theyre not just going to absorb. Now second, you point out exactly correctly that its not like theyve taken their foot off the gas, the antiabortion movement. Theyre passing law in state after state, that people are reading about. If you are in those states, youre losing your rights. Youre losing your access to care. If youre not in those states, you are thinking that could be me if the election goes wrong in my state or the federal government. I think were actually potentially underestimating how long this issue is going to be around. Because this is something that people are not going to stop caring about this year, next year, or the year after that. This is something that is motivating people. And it is crystallizing for people what is so dangerous about having essentially an Antidemocratic Party in the Republican Party. Again, theyre telling us what their playbook is. Theyre staying in ohio, because we know we cant win this in a fair vote among our people, were just going to start to tinker around with how many votes they need to get and who can vote. People are aware of this. So the republicans had an advantage for a number of years in getting people they wanted to Pay Attention to down ballot state legislative races that is flipping now, and i think its largely buzz of this issue. Many of the initiatives that ohio voted down yesterday, a step, a big one. I want to loop back to something you talked about and let me put a fine point on it. We have the Abortion Rights amendment on the ballot in november. What needs to happen next . So it is an offyear election. Its important to understand that those are tough. Weve got over 100 members in the state. Weve got partners. Our partners on the ground, i just want the say incredible coalition of democracy, as well as Reproductive Rights held at justice organizers on the ground who have just been pounding the pay. That work doesnt stop. It continues to build between now and november. Its essentially in the off year fullblown election. Its going to be expensive. Opponents have already committed 50 million to this race. So we are back to work on the ground, raising money to fuel a big campaign. The good news is the momentum is on our side. But i cannot understate the importance right now of citizen activists, grassroots organizers, and the folks on the ground who are really doing the hard work to preserve democracy and democratic principles in ohio, but fundamental reproductive freedom. I cannot believe it is 24 hours since i spoke to you last. So much has transpired in that time. Michelle goodwin, mini, ben, thank you so much for getting us started. Yes that was deidre reese of the ohio unity coalition, fired up after supporters of democracy and Abortion Rights won big in the state of ohio just last night. The election has yet to be finalized. The constitutional amendment to raise the threshold for Ballot Initiatives to pass from the simple majority to 60 was defeated by 57 to 43. And the turnout, especially for an off election in the middle of summer, well, it was huge. Almost twice as many people voted on then capped ballots in the statewide primaries last year. Joining our conversation, democratic congressman chantel brown. How are you feeling about last nights victory . I am feeling just like she was. I am super excited. I do want to start off by thanking you for having me and thanking the voters and the volunteers of ohio for showing up. Clearly the live they were fed up and fired up. And as a result, they showed up and showed out. This issue 1 referendum was a message to the rest of the country. As i said before, ohio has been a barometer, a litmus test, if you will, for the rest of the country, especially when it comes to politics. Weve heard the expression so goes ohio, so goes the nation. To that point, i want to get your take on some of the numbers from last night. This is the New York Times reporting this, quote, the ohio defeat was powered by a strong showing from democratic and swing voters. Opponents overperformed in some critical suburban battleground counties. In athens, for example, a democratic bastion in the form of ohio university. Voters opposed the measure by 71 . Last fall, former representative tim ryan, the democratic candidate who lost the senate race to j. D. Vance won the county by 61 . Katie paris, the founder of a group what organizes suburban women voters for democrats said she saw voters who wouldnt normally have turned into the election in the summer on an obscure political process get engaged. Abortion she said snaps them to attention. There is constant evidence of how personal she said. Its the perfect case study. I wonder for you, as someone who is familiar with watching those numbers roll in on election night, how does it feel to see voters show up like this in the middle of summer, on an off election year, for as they said, something that could seem like a Process Question . In ohio there is no such thing as an offyear election. We have elections over year. But the sad part is the Secretary Of State said the quiet part out loud. And he made this issue 1 about abortion. And what we learned and what we witnessed from the victory of this very critical election, which they the State Legislature deemed they would no longer have the Special Elections in august because people are not conditioned to vote. Theyre getting ready for back to school. Theyre vacationing. Theyre focused on their kids little league. But people were paying attention. When you talk about issues around abortion, that translates to health care. And health care does not only impact women, but it also impacts men. It does historically impact democrats. It impacts democrats and republicans and alike. This was never and it should have never been a partisan issue, right . This is a bipartisan result, and democrats and republicans and independents came together. It was a broad consistency of folks that wanted to make sure that we enshrined the right to protect peoples decisions, peoples ability to make their own health care decisions. So you talk about that Broad Coalition that came together. I am struck by Secretary Of State Franklin Rose running for senate again, Sherrod Brown. Give us his reaction to defeat. Writing, quote, now that his central issue has lost badly, rose will likely be the republican candidate challenging Sherrod Brown for senate. Blaming all the people he claims to want the represent. Im grateful that nearly 1. 3 million ohioans stood with us in this fight, but is only one battle in a long war. I wonder, are you surprised to see him continue to tie himself to an issue that voters in your states have overwhelmingly opposed . Sadly, i am not surprised. This is straight out of the, again, if you cant beat em, cheat em republican playbook. The extreme decisions of these Maga Extremist Right Wing republicans has no boundaries there doesnt seem to be any limit to where they will go. And so just like in kansas, just like in wisconsin, just like in michigan, ohio is proving that they are wrong on this issue. And sadly, they continue to dig their heels in further. But thats good news for democrats. So for us, we know that 58 of ohioans support peoples ability to make their own health care decisions. And again, thats a broad consistency. Not just women, not just men, not just democrats, republicans, or independents. Its everyone. So i think theyre going to have to change their strategy, because they should take a note from whats happened yesterday in ohio where we had over Three Million people, more than who showed up during our 2014 gubernatorial election. The percentage who prefer to instead push for further restricts on Abortion Nationwide has doubled to 34 . They now lean in favor of state level restrictions 66 to 34 . Do you think your republican colleagues are feeling pressure . Do you hear that when you talk to them to play to the base on this issue . I think we witnessed the power of the people and that issues matter and that messaging matters. So i think that republicans do need to reevaluate their strategy. I think youre starting to see some republicans come around. We had, again, some republicans, Goran Ivanisevic john kasich and bob taft who supported issue 1. Im not sure where they stand on the effort that will take place in november. But what i do know is no one wants to be on the extreme side of things. And so in a state like ohio, after the Dobbs Decision was made and roe v. Wade was overturned, we were the state that had a 10yearold rape victim who had to flee the state because she could not access an abortion here. We are also the state that has a program of Volunteer Pilots that were helping women who dont have the resources to be able to fly out of the state to get access to abortion care. So when you think about these things as it relates to state by State Initiatives and a federal ban on abortion, that is wrong. It is wrong on every level. So we need to make sure we are doing serving the people that are that elected us to represent them. And that was another thing that was key about issue one. It wasnt just about abortion, although they said that quiet part out loud. But if you wondered about protecting the one person, one vote simple majority. And that will impact. Including raising the minimum wage and ending gerrymandering in a state like ohio. This was about choice. It was also about democracy. The Washington Post reports larger School Districts in the state are dropping plans to offer the course as discussions about Sexual Orientation could violate the law. Randy, the post reports 8 of the 11 districts with the largest enrollment in ap psych are switching to alternate courses. One said it is sticking with the course. What is the actual harm done here . So what this is doing is just eroding opportunity for floridas students. And thats what thats what the governor is doing, and thats what the Department Of Education is doing. Ap sites, look, im an ap teacher. Ap psychs is one of the most popular ap courses. There is about 1800 people, 1400 kids in palm beach who were going to take it. There are 27,000 kids in florida who were going the take it. In the last few days, College Boards did the right thing. They said you cant just take a chapter out of Human Development and identity and say its ap psych. And frankly, i think those other Alternative Courses that are doing it, theyre going to be told that there is not going to be its not College Ready and its not appropriate. So the good news is today palm beach stepped up and said were giving it to our kids. And the teachers have said were doing this. And thats the pushback that weve been doing it. Brandon has been doing, that weve been doing to basically say you have a right, parents to make this decision. You have a right that your kids can go to this class. You can opt out of it. Give that class to kids in florida. You have been clear with us since the beginning, the dont say gay bill, it wasnt just about what was on paper. The consequences, the tentacles of it are ever expanding, right . And these kids, theyre not elementary children. Theyre young adults. They are living this in their life, even if they are not allowed to talk about it in the classroom. Yeah, youre absolutely right. And keep in mind, some of these students are 18, by the way. I appreciate that were getting to a solution. Im so grateful for palm beach and the other counties that have made the decision to go ahead and teach the course. But i think we need to be clear on two very specific things. Number one is that this is putting School Districts once again in an impossible situation thats being driven by the policy you just talked about. They get one set of guidance, no ap psych allowed from the Department Of Education, and a second later different guidance from the commissioner of education. Meanwhile, they have the careers of thousands of educators and the Class Schedule of Tens Of Thousands of students that are hanging in the balance. And they have a responsibility to do right by all of those people. So they get stuck wondering if offering the course might cost teachers their job, and also understanding that pulling the course out from under people is going to cost students their opportunity for college credits. Its no wonder that these tricks are paralyzed by this bigoted law. The second thing, this is the intended outcome. This has been the desantis mo for 4 and a half year. They use vague language and ominous threats to get communities to selfsensor so they feign ignorance. They dont get to wash their hands of this crisis. I think the School Districts should call the commissioners bluff. I think they should teach the course in its entirety. We should make no mistake that we did not have to be here. We are here because of this governors breathless obsession with queer people, a State Government that has been completely bent to his appetite for power and this War On Freedom that has put families in florida squarely in his crosshairs. But i proved to Barack Obamas florida, not ron desantis florida. And it is really heartbreaking to watch the damage that he has done to the state and its reputation. As long as im governor, it will stay that way. Joining us is the state attorney for Palm Beach County. Talk to us how unusual what the governor has done. Yeah, alicia, it really is troubling, because Monique Worrell was elected with 66. 6 of the vote. And if you read the order from the governor, it reads like a Campaign Flyer against her. Her political opponent would put out against her. They dont like that she is not tough enough on gun crimes or she hasnt filed enough charges under the mandatory minimum laws. She is maybe too slow in prosecuting juvenile cases. Okay. If you belief that, then the answer is to run against her and vote her out. But its not to remove her and take away the power of the voters to make a decision as to whats best for their own community. In fact, none of their policies was a surprise for her community. She ran as a progressive prosecutor, wanted to look at alternatives to incarceration. Although she and i may have some differences on our policies, the one thing i dont try do is to second guess the voters in a community that overwhelmingly elected her. What you saw today was undemocratic and unfortunate. I wonder, dave, as your fellow state attorneys watch this all goes down, if it impacts the way you approach your work and your job . You know, you cant run scared as a prosecutor. You cant keep looking over your shoulder to see what the governor is doing or what the polls are saying. A scared prosecutor is a dangerous prosecutor, because then they just go to the whims of the polls or just respond not based on the evidence and the law, but based on what a governor wants you to do or, you know, the political whims of the day. You cant do that. When you do that, you get in trouble. You become like nifong, the disgraced prosecutor in the duke lacrosse case. You have to focus on the evidence, the facts and the law. You to do justice. Sometimes that means youre contrary to public opinion. Sometimes youre going to irritate elected leaders at a statewide level. But you know what . You never expect that the leaders are going to remove you from office. But now weve seen it not just once, but this is the second time this governor has done that. There is a disenfranchisement of the 60 of voters who voted for her. There is also the fact that now she is being replaced with someone voters rejected. Just how chilling is that piece . Yeah, thats part of it, you know. Look, democracy has to mean something, right . But what youre seeing now is some of the leaders of the Republican Party that theyre using levers of power to do things they could not accomplish at the ballot box. It is up to the voters of her circuit to make these decisions. This is no surprise. She landed the progressive prosecutor. And now youre replacing her with someone who the voters did not vote for, and now she is going to run again in january 2025 excuse me, next november because her term extends until january 2025. But if she is voted into office again, you can count on this governor to remove her again. Dont look at the courts for an answer here, because andrew warrant went to Federal Court, and he got a judge appointed by bill clinton. And the judge said governor, you cant do this, but i cant undo it because of the 11th amendment. And so now andrew is stuck. And monique may be stuck as well. I dont think there is any good outcome for her or for andrew in this.
