In new hampshire, heckled with names like traitor, just days after the doj revealed he took careful notes on trumps coup attempt. You didnt uphold the constitution. You committed treason. You committed treason you committed treason hey pence on the fence. Rolling stone reports, the attacks on pence are even more extreme online. A popular farright forum discussing, in graphic terms, how to murder pence. One user writing, quote, the main execution should be off the table. Joining me now, msnbc legal analyst and former u. S. But this began friday night, alicia, when the government filed a motion, asking for a protective order. Fairly routine in certain kinds of cases, just asking that donald trump not be permitted to disclose witness statements. Not a gag order. Just that he not disclose this, which is routine and standard practice. But in light of the kinds of things hes been saying and going after witnesses, very necessary in this case. They filed it and asked that he entered immediately. The judge said, im going to give the trump team until monday to file any response and i will consider the response, then i will decide the motion. The trump team came back and said, we need more time. This should be brief, there should be an oral argument on. This we want three extra days. It seems that every opportunity you are going to see to delay, delay, delay. And the judge wouldnt have any of it. She said, im going to give you till monday, that deadline stands, then im going to make my decision. This is routine. Frankly, the fact shes giving him this much time is going out of her way, i think, to give them the benefit of due process is met and the appearance of due process. Barb, during the judge warned him not to intimidate witnesses, which is remarkable in and of itself that that even needed to be issued as a warning. Talk to me about the consequences trump could face, if he were to disobey that order. Well, i think in a case like this, its really difficult for a judge to rein in somebody whos running for president. But ordinarily, if someone violated the terms of their condition, especially about harassing or threatening, or talking to witnesses, that there would be escalating types of penalties. I would imagine the first thing would be in order to show cause why should not in contempt and come in and explain it, probably get a warning, then be released. But if somebody were to then violate that again, you can bet there would be revoked and it would be sitting in jail while they are awaiting trial. In a case where weve got a candidate for president , i imagine the judge will treat it with matt, i spoke to Biden National campaign director, julie chavez rodriguez, about running against a thrice indicted, twice impeached former president , the unique challenges that poses. Here is what she told me. Its about making sure that we are really in talking to the American People about the issues that matter most. We know that these court cases will continue to move forward and they will take their course of action. But for us, again, its really making sure that we are talking to voters about, you know, lowering Prescription Drug costs, lowering energy costs, really focused on what matters most to them right now. And continuing, again, to ensure that they understand the choice thats in front of them and the clear contrast of the kind of, you know, again, extremism that were seeing from trump, from desantis, from sort of the entire field, versus, you know, what we are delivering right now for the American People and really investing in our communities. Heres the thing, matt dowd. Whenever you are running a president ial campaign, it is a campaign that has never been run before, there are unique dynamics to every race. But i think we have to be honest about the fact that though the biden, Harris Campaign is up against is unprecedented in innumerable ways, right . There is no Strategy Book to pull from when you are going to run against a thrice indicted, twice impeached former president , who you have already beat. Yeah, i mean, there is no book for this. I mean, every campaign is different on its own, but i will say, i dont envy her position in this, having gone through a First Campaign where you win and climb the hill. The second Reelection Campaign, where you try to hold the hill is a much more difficult election campaign, or Reelection Campaign is, no matter who youre running against, because the problem you have is one, its emotionally different because youre just trying to hold ground. In this case, that campaign in the white house. But in the other case, youre dealing with all these extraneous events as president of the United States that you have no control over as a campaign person in the midst of this. I would say her last part of that answer was probably the most apt part of it, which, is there going to want to make this a contrast campaign. Its going to be very difficult to have a debate on the issues in this campaign against donald trump. One, because of the character of donald trump and who he is, how hes going to operate in a chaotic fashion. Thats going to sort of throw a Monkey Wrench into that. But also, the moment we are in. The moment we are in, while the level of cost and Prescription Drugs is important, while Social Security is incredibly important, whats more important is the state of our democracy and do we survive as a Constitutional Republic . That, ultimately, will be the contrast upon which this campaign is divine on. Let me ask you something to sort of get into the mechanics of campaigning. According to fcc data, one of trump super pacs has shelled out 20 million, just in legal fees, over the past six months thats two thirds of the pacts total spending. I do want, we talk a lot about sort of the legal woes hanging over him, as it relates to public perception, as it relates to taking up oxygen among republicans who are also vying for the nomination. Just this piece on spending, right . I wonder how much of a challenge that becomes for the trump campaign. Yeah, they are raising this money, but the money is also quickly going out the door. Well, my guess is, and my assumption is, that donald trump has the great capacity to grift at the highest possible levels, no matter what its doing for. So, i think hes going to have enough money in this campaign and the problem that donald trump, as he gets constrained along the way, before he gets next year, is not so much about advertising and paying for ads, which i believe has had diminished use over the course of the last ten years, Television Ads on campaigns. But its how do you support a structure in all of the states you need to win in this Electoral College . And joe bidens campaign seems to have that capacity right now. Donald trump seems to be a singular campaign, which is, the care feeding and support of donald trump personally. That is what his campaign seems to be all about. Whats left on the vine to wither is all of the structure you need in state by state, to win it. Right, all of the things that are an sexy, but fundamentally when campaigns. Tea, trump now boasting he needs, quote, one more indictment to win. I wonder what you make of that rhetoric, when he could get that wish out of georgia. Well, what trump is looking at is the polls that show, after each indictment, there is a big segment of the Republican Base that becomes even more supportive of him, even more loyal to him, even more convinced that these indictments are a, quote, Political Witch Hunt against donald trump. So, for him, each indictment kind of solidifies his position as the leader of the Republican Party. So, in a lot of ways, they are good for him in a primary. I dont think hes thinking yet how these indictments might play out in a general election. They are good for him in the context of a primary. We should know in the next two weeks what the indictments out of that Fulton County investigation in georgia will be and if trump will face indictments there. All signs kind of point to some major news that kind of indicates that perhaps trump might be indicted. But we expect we could know in the next couple of weeks. Barb, you know, trump trying to exempt the Election Interference case with a speedy trial. Can you talk to me, what timeline does that loss set and what chance does trump have of slowing things down . Well, he is certainly trying to slow things down. That seems to be his strategy, but the Speedy Trial Act says that the trial should begin within 70 days of arraignment. Now, its rare that that actually happens because a defendant wants and needs time to review all of the discovery, file motions, and other things to get ready for trial. But a judge has to physically stop the clock to make sure there is an articulate a factual reasons that shes extending that deadline, because its not just the defendant, but its also the public that has a right to a speedy trial and thats because the public has an interest in Holding Someone accountable if theyve been charged with a crime. They have an interest in making sure that witnesses are available and that evidence is available. And so, she has to balance both of those interests. So, i imagine that on august 28th, when she gets together with the parties, they will look at whats needed in this case, they have adequate preparation, but no more than is necessary. , so that the public can get that speedy trial that it has a right to as well. And so, we will see i think its absolutely reasonable to try this case. Sometime in the next year, spring, summer of 2024, and certainly not passed november of 2024. Tea, this week, we had the a fani willis on camera for the first time answering questions about whether or not she had read the jack smith indictment, whether or not she felt it was going to change at all the nature of contours of her own case. I wonder, reading between the lines, as someone who has followed this case very carefully, what you made of what she chose to say. Well, you know, what she basically said was that she read the indictment, but shes kind of doing her own thing. Shes not, not particularly close in contact with jack smith. I think to me, that indicated that her investigation was pretty far along. And so, therefore, they were kind of on their own tracks already. We know there has been some level of communication, if nothing else, information sharing, between the District Attorney, the house january 6th select committee, and perhaps even the department of justice, just to share information perhaps request documents that may come up from time to time, perhaps in the medium related to one investigation or another. But at the end of the day, what d. A. Willis is saying is, shes running her own race. Her investigation is her investigation, shes not necessarily allowing it to be influenced by what the Department Justice was looking into. He is not thinking that they have to be in concert with each other. She, and again, her investigation, she said, its been two and a half years. I think what shes also saying is, i put in the work myself. I dont necessarily need a copy jacks mitt. Barb, matt, tea, as always, thank you so much for getting us started. House democrats want americans to have a Front Row Seat to the former president s proceedings. This as it stands now, cameras are not allowed in Federal Court rooms. For more than three dozen lawmakers have signed a letter to the Federal Court system, requesting the proceedings in florida and washington, d. C. , we broadcast live. Their requests reads, in part, quote, if the public is to fully accept the outcome, it would be vitally important for them to witness as directly as possible how the trials are conducted. The strength of the evidence the credibility of witnesses. It is not a stretch to say that Washington Mills will be of massive interest to the American People. Lets take a look at how many people turned into the january Six Committee hearings. More than 10 million americans watched each hearing. Thats according to joining me now, marcus childress, a former investigator for the January 6th Committee. Marcus, thanks so much. First, i need to get your reaction to the judge in d. C. Denying the trump teams request for more time to respond to the doj asking for protective order. Yeah, this is, i think, pretty par for the course. I cant remember a criminal case where it wasnt a protective order in place. I think its just part of the criminal process and the defense is entitled to having evidence, so that they can properly prepare for trial. The government has an interest making sure that that evidence doesnt just get fully released to the public. Thats one of the key differences between a criminal investigation versus a congressional, where, you know, a lot of evidence does get out to the public during the course of an investigation. As i understand, it there are obviously two pathways for allowing cameras in the courtroom. Either for a judicial conference which, of course, is run by chief justice roberts, to vote for an amendment on row 53, or for congress to pass a law. Does either path seem plausible to you . I wish i could look into the future and tell you. Im not quite sure. Look, i know that the American Public probably wants to see this trial. I know members want to see this trial. Transparency is one of the great aspects of a congressional investigation, that there is some level of transparency and i think it makes americans feel comfortable with the evidence thats being collected and being presented. But look, i wish i knew just as much as you did. You know, whether one of those were plausible, but i guess we will see it play out soon. Let me ask a question that you can answer, marcus, which is, do you think it makes a difference, right . The Core Argument is that if people get to watch it for themselves, if they get to see the evidence presented for themselves, if they get to see the way that hes treated, then it will build trust in the process, itself. And i wonder, as someone who has already been through this, to some extent, given that the 16 hearings were televised, whether or not you believe that to be true with. Look, i do think its true. If we look back at our January 6th Hearings, i think its the evidence that we put forth, the theories that we put forth, that has even made this indictment believable, right . Its not a surprise to the American Public because of the way that we were able to publicly tell our story. So, i think thats a fair statement, right . That there is some trust in transparency. But theyre also our core rules, and we have to follow those rules. And, so itll be interesting to see how that plays out. All right, whether or not the trial is televised which, of course, is this huge issue of the moment. The Justice Department is going to have to present a clear story to the jury. Again, as someone who has done this work and thought through these challenges, i think we got a glimpse of it with the indictment, right . The case that they are going to lay out, the story that they are going to lay out. What do you think you learned from your work doing that for the one sixth committee thats applicable here . The main thing that jumped out, to me, from the indictment, from our hearings, and what i anticipate will be in the trial, is that as you just said, its such a clear theme and theory, and that is what matters when youre presenting it to a jury, right . We can talk about charges or factual nuances, First Amendment objections all we want, but its that theme and theory that matters, and in the Special Counsel laid it out. I mean, he said that, one, President Donald Trump lost the 2020 president ial election and to, despite that, he was determined to remain a power. That is the case right there. Thats where all the facts are going to flow through. These pre Trial Motions that we are going to be reading. During jury selection, during opening statements, all the way through closing, and thats exactly what we presented during our January 6th Hearings in our report. Its the same theme that President Trump lost the election, but he was determined to stay in power. And so, i think we saw it play out during our Summer Hearings last summer, and i think were going to see a very similar theme play out during the preTrial Motions and during the trial as well. Marcus, i only have about 30 seconds left, but i do want to ask you why you think the Special Counsel decided not to bring one of the charges that the Committee Recommended inciting an insurrection. Look, i will go back to my day as a prosecutor and i think you really want to keep charges as clean as possible. I think a clean narrative and presenting a straightforward story without distractions is always best for our jury, and look, i dont know what evidence the Special Counsel has collected. I dont know if their analysis is, but i didnt do know this indictment reads relatively clean and i think that a jury will be able to digest the narrative that the Special Counsel put forth during trial. The center of Donald Trumps latest indictment, a desperate scheme to hang on to power. When all else failed. Talk about the plot to use Fake Electors to try to steal the vote in seven Battleground States that he lost. A 45page indictment explains that when trump tried, but failed, to persuade State Officials to swing the election in his favor illegally, he looked up another plan to attempt to undermine the Electoral College. Nbcs Hallie Jackson breaks it all down for us. You probably know how a president ial election works. Voters in all 50 states head to the polls to choose who they want as president. If enough voters back a certain candidate, that candidate gets Electoral College votes from that state. The winner needs 270, thats the magic number. Here is the road to 270. So, thats what you see on tv. You typically dont see what happens next, because its usually a formality, as members of the Electoral College pick it up from there. Those members, called electors, are selected by State Parties months before election day. After every president ial election in december, each state gathers together electors from Whichever Party won the popular vote in that state. Those folks meet and said an official certificate to the National Archives and to congress. They look like these and they basically say, okay, this is who gets our states Electoral College votes. Its pretty ceremonial. Except in 2020. Thats when the former president and his allies got to work, convincing loyalists in seven states that they should back republican electors in key battlegrounds won by the democrat in the race. Joe biden. The focus, on arizona, georgia, michigan, nevada, wisconsin, new mexico, and pennsylvania. Some of those socalled Fake Electors showed up at State Capitals where the real electors were meeting. The even created phony certificates, like the ones you see here. The goal . Apparently so ten through this fake slate of electors to congress, where the Vice President presides over the official count. The thinking seemed to be that then Vp Mike Pence could grant mr. Trump the disputed electoral votes or send the issue back to the states, opening the door to keeping mr. Trump in power. You probably know what happened next. Pence rejected the scheme, citing the constitution. Donald j trump. And mr. Trump, on the national told his supporters, the election was being stolen. It was not. We fight like heck and if you dont fight like hell, youre not going to have a country anymore. Remember, at that time, most of trumps election challenges had been thrown out in court and his own Attorney General had declared no evidence of widespread fraud. Hallie jackson, nbc news. Now, the big question, how do we secure the upcoming president ial election . Lets ask Msnbc National Security analyst, frank figliuzzi. Hes a former Assistant Director for Counter Intelligence at the fbi. Author of the fbi way, inside the bureaus code of excellence. Frank, fresh off his latest indictment, you have trump just a short time ago, you actually emailed this firing off a new threat on truth social, writing, quote, if you go after me, im coming after you. Prosecutors in the Election Interference case, then requested a protective order saying, his use of evidence obtained in discovery, quote, could have a harmful, Chilling Effect on witnesses or adversely affect the Fair Administration of justice. In this case. I mean, hes being warned not to do the thing that he then goes on to do, which is to threaten a witness in this case. Publicly, in front of all of us. Indeed and just since we have been on the air, it looks like hes done it again with another posts that needs to be confirmed, of course, from truth social that seems to target former Vice President pence, specifically. And of course, we know, from reading the last indictment in this election case, that pence is likely cooperating, appears to have turned over his notes to the grand jury, and may be a star witness in the case. So, this is only just begun and i think that the judge chutkan, in this case, is going to really have to rule with an iron fist. Shes going to have to make it quite clear, with a stern warning, and then the very next violation that looks like its intimidating a witness or threatening a prosecutor, is going to result in severe action, even being held and detained, as has been warned previously. But you are raising the question in this environment of an even larger issue, which is, in this high risk, Threat Environment that the nation is going to have to go through now, Law Enforcement really having to get it right every single time, where a former president , currently a candidate for president , is going to be calling out witnesses, calling, inciting for violence. We are in an environment where weve already seen, as reported by Rolling Stone just a couple of days ago, a group, a website called the donald, that was actually where folks gathered online to plan violence for january 6th. Now it resurfaced, now calling for killing of grand jurors in the election case. Armed violence against jack smith and prosecutors. So, how do we protect the election, the 2024 election in this environment . With great difficulty. Heres the thing. There is what we imagine can happen and then there is what we know is already happening. This week, you had georgia District Attorney fani willis opening up about the threats shes received, already, for investigating trump. Take a listen. All of the typical racial slurs that you can imagine. They are very grotesque things. You know, we are on family television, i dont even know that i would like to say all of them, but slave horror is one of them. But i probably called been called the nword the last time in the last two and a half years than most 100 people combined. Yosort of know its happening when you hear it from the person. It is directed at and you understand the Chilling Effect that its intended to have, the way that the harassment is intended to complicate the process of Holding Trump accountable. My question for you, as i watched that was, if you are the fbi, right . To what extent are you tracking some of this language, some of this rhetoric, some of these threats . And then at what point do those verbal threats escalate to something even worse . Yeah, great question. So, to the extent they can, Law Enforcement, led by the fbi, is absolutely trying to monitor violent extremist groups, right . We are still facing this understandable dilemma between free speech and civil liberties, which we must preserve. Yet, finding the needle in the haystack, the guy or gal who is moving from aspirational to wanting to execute on what he or she is saying online. Really difficult task, but a couple of things. Consequences must come to the people who are crossing that line and they must be swift and severe. So, dont be surprised if we start seeing, in the weeks ahead, people arrested for violent threats against prosecutors, the as, jury members, and witnesses. We need that to happen and also, i expect the fbi to engage in what they call knock and talks. A lot of knocking on doors of people saying, look, we are on to you, we understand you are talking violently online here, and if you do it, we are going to have a Search Warrant or an arrest warrant next time we visit. Both justices gained National Attention when republicans kicked them out of the tennessee General Assembly for participating in a Gun Safety Protest on the house floor. I believe the Special Session is an opportunity for us to prioritize the voices of our communities, our children, our parents, our elders who want to see action taken. The status quo of listening to the tennessee association, firearms association, and the american firearms association, the National Rifle association and the Republican Party in tennessee, the speaker leader William Lambert has only lead to more tragedy, more heartache, and more pain. And i wonder what you have learned about the promise of democracy, about the power of voters in these last few months. We should all be concerned about the state of our democracy because the reality is, we have people who are turning our democracy into a mobocracy, for the mob rules, and not the people. We havent realized, it was the exposure of myself and representative jones, but it was 140,000 peoples voices. People who went to the polls, people who had advocated for the candidate, people who use the letter of democracy for us to be there in the first place. We had their voices taken away because of the abuse of power of the republican supermajority in tennessee. We should all be very concerned, the people who use their power to silence the voice of the minority. And to kick out to black, two of the youngest black lawmakers in the state of tennessee, that should worry us because the Decision Making and power making that is happened here is all skewing to white supremacy, is all screwing toward patriarchy, and its all skewing toward policies that hurt the last those who have been made poor, those who are lgbtqia. Our democracy is not serving all of us in the state of tennessee and we have to be in the fight and on the battlefield to change it. That is the hope, right . Its that people who march, the people who protest, and the people who even after the representative gets expelled, say that, im coming back. In district 86, we saw more people go to the poll this time than ever before in the special election, to make the statement clear to the Republican Party of tennessee, that you cannot expel the movement. Representative pierson, i got about a minute left, but i want you to i believe it was representative jones who said something paraphrasing here but, you know, weve heard the south will rise again. I say the south will rise a new, that this is a moment of generational and cultural shift in the south. I wonder what sort of the lesson is from tennessee thats applicable in other states in the south that want to move in the same direction . We cannot give up on the south. The future for america, the litmus test for americas progress, is whats going on in the south. If the south is not progressing, the people are not free here, then nowhere in this country are people free. If we cannot elevate the voices of the folks who are in the south and who have been most marginalized, we are not going to have a country where liberty and justice for all rings true. So, we will work for creating justice, the work for creating and building a multiracial, multi ethnic, Multi Socioeconomic Movement Of Justice thats going to have to happen in the south and we will build that out across this nation. They murdered him because he was gay, because he stood up for his friends. He may be gay, but we exist.
