And by the way, if you are a longtime viewer, i know some of you are, you might recall about a year ago, we broke down trumps efforts to overturn the 2020 Election Results along that grid, how his desperation and his plotting grew as all the legal challenges lost in court and he turned to plots feeding his criminal exposure. You can see them there, some of them are what turned him into a defendant this week. We documented eight total plots. Now dojs jack smith has indicted five, count them, five of those plots out of the eight that we first identified in our reporting for you. Were going to go through all of this for you tonight. It is a special, a live friday night special brought to you here by msnbc and the beat. Meanwhile, were going to get to all that. We have the breakdown. We begin with the news developments. The 45th president of the United States has been indicted by a grand jury in washington, d. C. On four criminal counts. A Federal Grand Jury has now criminally indicted the former president. Jack smith wants to get to trial, and he wants to get to trial quickly. The new indictment of former president donald trump, perhaps the most consequential case in the history of the justice department. That is how all of this began through this week, Tuesday The News broke, thursday the arraignment, tonight here we are. As i mentioned, later im going to go through that Special Report. I want to catch you up on what the very latest is right now because Donald Trumps lawyer is admitting one of the damning facts in the new indictment against his own client. Jack smith notes that headings into midnight, there was a coconspirator named in the indictment not named literally, but we can figure out who it was, and his lawyer has confirmed that john eastman is one of the coconspirators. Now, that night of the 6th, he was pressing mike pences lawyer in writing, defraudulently claiming some legal violation and pence could use that. This is after the violence, after the chants of Hang Mike Pence. Use that to try to get the senate to adjourn for ten days to allow the legislators, he put it, to finish these investigations in the states. This is offered in the United States versus donald trump as evidence against donald trump. So its interesting that trumps own defense lawyer, one of the new ones weve seen emerge more recently this week over this case, on television, basically admit thats part of what trump was demanding. At the end, he asked mr. Pence to pause the voting for ten days, allow the State Legislatures to weigh in, and then they could make a determination to audit or reaudit or recertify. But what he didnt do is, you know, send in the tanks. And thats where we are. Donald trumps lawyer admits to what, at least according to jack smith, is evidence of the conspiracy. And then pretty darkly argues that the outgoing president s decision not to try to illegally order tanks into the street to advance the coup is some kind of saving grace. Well, number one, that wont help the defendant in court. Number two, worse, theres also evidence that trump did try a plot to use the military to get the pentagon to seize voting machines. So not tanks, but the same illegal and covert act. Thats a lot. I want to bring in former federal prosecutor John Flannery as we get into a friday night at the end of quite a week in america. Welcome back, sir. Good to be here. Quite a week is right. Yeah. Im telling viewers, this is our special, we have so much coming up. We wanted to of course start with the latest developments coming out of the arraignment, which we covered last night. Im curious your response to this lawyers i dont want to call it a defense. Ill just call it this lawyers words. And wonder whether you see it as the out of court thing of trying to launder everything if you just talk about this stuff enough, maybe they think it loses shock value. Or do you see any legal or incourt strategy here . Well, send in the tanks is something that should send anybody to a point of just silently thinking such a thing, not saying it. Send in the tanks is third world kind of stuff. You know, if i cant have my way, im going to have tanks. You know, im going to use the insurgent act to suppress the people if i decide to stay in the white house. That kind of thinking. So i dont see that working in or out of the courthouse. The second thing is to, as he said in some places mr. Laurel that this was plan d. Like plan dumb. That he would say, well, he had to do something else. So he does concede exactly what is charged against his client as happening. Then on top of it, he ignores the fact that the president was given the former president was given two choices. One was, lets accept these alternate electors immediately, or lets send it off for ten days. Then the next day they talk about it again. And trump says he wants the First Alternative to follow. So alternative d was never really serious. Alternative d is a confirmation that trump was told, considered, and wanted to do one or the other, but did not want to do nothing. And all those choices were based on fraud, that is to say, there was no fraud in the election, which is the predicate for it. The electors were fraudulent. Then the legal theory was admitted to trump and trumps counsel that eastman said, i dont think any judge would ever accept this. How do you get around that . Right. And that i think laurels put his own position in a dangerous place to be continued as counsel. Right. Youre Talking About the Current Trump defense lawyer. And lets be clear. You have a process under the constitution where you certify the results. At that point in the real world in the actual reality we live in, it was president elect biden preparing to come into office, about two weeks out. And when they say we wanted to stop that, right, if you wake up on the 7th or 8th or 9th and congress has not done that final check mark certification, youve stopped the certification. So they seem to be using delay, 10day pause, we need more time to investigate these seem to be cover words that are bureaucratized as way to cougher what theyre actually doing, which is saying, well stop it so the president elect will be missing that one last, generally technicality, but that one last thing thats required in the process. Now were seeing again, with the benefit of the investigation and the hindsight, you have a lot of people who were talking openly even before the 6th. Senator ted cruz, whos Known Eastman from back to their clerking days, was one of the most vocal in that related plan, take a look. What does it say to the nearly half the country that believes this election was rigged if we vote not even to consider the claims . Conduct a 10day emergency audit. Consider the evidence. John . Well, were Talking About, quote, claims. Theyre gossamerthin, nonexistent, fluff. They dont exist. What hes basically saying is, if we really had fraud, maybe we should do something here, but we dont, but im going to say it anyway, so im really part of the facilitation of this attack on our very foundation, notion of government, which is democratic, based on real facts, based on the constitution, so forth. And its not very complicated in the constitution. You count the electors, and whoever wins, wins. And thats the end of the day. At least the Vice President understood that. But that was inconvenient to those who wanted to take over the government starting with trump and running down a whole bunch of mini mes who would do anything he said. And its such a tragedy. And its amazing that we survived it, which i guess does Say Something about the goodness of people who moved out of their positions to succeed and to force this to go on. I have to give credit to the Vice President for not leaving the hill, for staying there, knowing that he was under risk, and there was a scent of violence in this whole period. Because you had people saying, well, you know, i, trump, am going to talk about you tomorrow, and im going to be critical. And then his staff is concerned, well, that means violence. He got concerned and alerted the head of the Security Detail about it. We had the scent of violence for a long time. We had an increasing pressure that pushed us to that point. And it was predictable, it was stated, and it happens. No surprise. Yeah, it happened. John flannery, ive mentioned this before. You have been with us from the start. Welcome back to our special. After this weeks arraignment, we have reporting on jack smith Indicting Trump with a coup conspiracy. This Special Report begins now. The accountability for trumps effort to steal the election was not automatic. First, no president has ever been indicted before, for any actions taken as president. Second, doj did wait two years with really no signs of getting close to charging donald trump. Then the attorney general appointed jack smith, which seemed to change things. Third, january 6th was widely viewed initially as a oneday crime spree committed by the people onsite. Not necessarily as a longerrunning conspiracy. Even when democrats impeached donald trump over it, they focused on alleging that trumps speech that day incited violence. If you follow that, if you remember the senate trial, it was all about, what is incite, what is speech, when does it cross over . Which necessarily meant focusing on what you see on your screen. What donald trump fundamentally said that day. Not a focus on the wider efforts which actually ran for months. Turned out that was not the full, accurate story. Other evidence emerged from the house probe, from journalistic accounts, and as John Flannery and i were discussing, from a legal report we put together over a year ago which indicated all of this together constituted a multimonth, multipronged conspiracy. Heres how we first reported that a year back, as eight distinct plots to overturn the election. You can see them there. We documented how some started out legally. Upper left. November, lawsuits. Fine. Even frivolous lawsuits, even lawsuits with false information are something that you can legally do in america. But then over time we showed you how most of the plots then involved accounts that were at a minimum unconstitutional that means not allowed, dont work, whether or not anybody goes to prison. Then some were actually appearing to be indictable as a criminal conspiracy. So this is what we showed you. This runs back over a year. People say, do facts matter . Does reporting matter . I dont have to prove to you this week, yeah, sometimes it really does. Because for the first time, we can now update this same report to show you that thedojs jack smith indicted defendant donald trump on conspiracies across five, five of those longrunning plots that we first reported. Thats one of the things we learned this week. Doj and the Special Counsel found facts supporting this conspiracy view of the case and determined that it is provable in court. While the defendant remains legally presumed innocent and will get his day in court. They did not bring a Sedition Case against trump or his aides. The bad news for donald trump is that many plots means more than one charge. And some of the strongest Smoking Gun Evidence is in that early starting electors plot that you see there. Second on your screen, highlighted. Started in november. Theres Smoking Gun Evidence in the fraudulent electors plot because they did the fraud in writing. It involved a ton of people. And Donald Trumps aides admitted it before, during, and after. Today, an alternate slate of electors in the contested states is going to vote, and were going to send those results up to congress. Something that rudy and the team have worked on, the trump slate of electors are showing up today in the state capitols. We fought to seat the electors. There has been an alternate slate of electors voted upon that congress will decide in january. Yes, i was part of the process to make sure there were alternate electors. Everything that was done was done legally by the trump legal team, according to the rules, and under the leadership of rudy giuliani. That last admission is from trump aide boris epstein, pointing at giuliani as the number one leader of the elector plot. This week, giuliani became the number one coconspirator in this indictment. It details how he and trump allegedly used the certificates of these fraudulent electors to deceitfully target the government function. Heres how that worked. In the real legal world, the actual electors from every state met on December 14th as they always do and made it official as the ap reported. Electoral college makes it official, biden won, trump lost. Now, on the conspiracy chart, thats middecember there. But over in fraudulent world, the indictment recounts how those fraudulent electors convened sham proceedings, pretending to be the real Electoral College meeting. Why the indictment dedescribes it, one of those actual meetings on video. This is what you see here now criminal evidence. Arizona republicans met on the same day as the real Electoral College, but they held a sham, fraudulent proceeding. Doj has evidence that six other states pulled off this same fraud and told on themselves because they didnt just do it and hold meetings, they even posted their fraudulent certificates on the internet. So that fraud played out in the open. And lets be clear. Unlike, say, a politician giving a speech or even lying in public, what i just showed you crosses well beyond speech, which we all are supposed to respect under law, and if you really want to get in the weeds, before i did that job, i practiced First Amendment law, care a great deal personally and professionally about the First Amendment. Speech and your free speech does not protect fraudulent conduct. You have the right to say you drive a porsche. If you dont, you have a free speech right to lie about it. You dont have a right to fraudulently make a certificate claiming a car is a porsche and selling it to someone else. Thats just plain old Business Fraud if you found someone gullible enough to fall for it. Fraud is not free speech. That is so well established, its barely a big deal in court or among lawyers who focus on this kind of thing. One former prosecutor walked through all of this in detail. This week in the context of all this, as a little bit of a tutorial, it happened, for fox news viewers. He has a right to file lawsuit after lawsuit claiming that the election was stolen. However, where he got in trouble is when they assemble these electors, i can say im elon musks longlost son, im entitled to inherit his billions when he dies. If after elon musk passions away i walk into probate court, hand up a document that says, hey, this is elon musks will. Its not his will. It says im his son and i get billions of dollars. Then ive committed fraud, ive committed forgery. Jack smith is going to make the argument thats where they werent acting in good faith. When they active false certificates prepared and ask pence to accept those rather than the real certificates, thats where theyre going to argue fraud. True. And beamed there to fox news viewers. That was new. Its strong evidence in the indictment. Its also striking to see where jack smith draws a line. Some fraudulent electors have been indicted in michigan and different local cases, for example. Others have not. We know now what we didnt know last week. Why at least Special Counsel smith thinks justice sometimes means not charging some of those Grassroots Trump fans. Because he concluded that some of them were just naive pawns. Deceived by more powerful and informed trump coconspirators. Indictment noting that some of trumps fraudulent electors were tricked into participating in the scheme. I point that out because it shows the dojs precision here. It also is bad for the coconspirators and the leaders of the plot because it adds the evidence that they knew in advance they were committing crimes. They were so clear on that point, they were even hiding and lying the full plan from the very people they recruited into it. The electors plot was fundamentally about lying as a pretext. The idea was not that the Real Eelect Toerl College would implode over random people pretending to be electors in various Conference Rooms. I showed you the ap headline. At the time that day, the news was about the actual elect toerl college. But the plot was it would somehow add confusion and another pretext for the other plots, to ultimately hijack the January 6th Certification. Thats why trump tried to install his own political hack at doj who would issue fraudulent announcements claiming there were election problems. It was another pretext. Remember, trumps own republican appointees who replaced bill barr who were leading doj wouldnt go along with that. He explored installing the nowindicted doj plant jeffrey clark. Mass resignations would set his coup plan backward, something detailed in january 6th committee hearings. Cipollone said, this is a murder suicide pact. I resigned immediately. The president turned to mr. Engel, steve, you wouldnt resign, would you . He said, absolutely, i would, mr. President. You have hundreds and hundreds of resignations of the leadership of your entire justice department, jeff clark would be left leading a graveyard. A graveyard warning. Echoing Richard Nixons infamous Saturday Night Massacre. We have to remember this is what investigators do. They dont use hindsight, they go back to contemporaneous scenes, what it felt like in the moment. Trump at the time knew what he was cooking up for the future january 6th proceeding. Most of the nation did not. So trump feared that that kind of scandal, that kind of Saturday Night Massacre resignations over jeffrey clark, would actually put more people on notice of what he was cooking and hobble the coup plan. So he backed down from that. But even the attempted plan was in writing. We have the draft letter. Its now criminal evidence. That coconspirator, mr. Clark work, claim the doj Wanted Georgia to convene a Special Session to steal bidens win there. Here you can actually see the three plots, getting the states or doj involved to push the elector fraud. So on the map youre looking at, number three states, doj interference there in the middle, elector fraud up top. All of those are interrelated. Im showing you how to think about a conspiracy. What the investigators found, what a jury will ultimately decide. Because all three of those are in the new charges. Smith citing the letter i just mentioned as illegally trying to abuse Doj Authority to falsely present the fraudulent electors. And as trump hoped the doj would shake down georgias legislature, he personally hammered the states top election official in that recorded call. It was a lot of plotting. As you know, some of those plans just fizzled. The doj thing totally died. Georgia officials did not jump in and try to help trump steal the race from their own constituents. By late december, that elector plot might have seemed like a misfire, which was fading away. It certainly wasnt getting a lot of public political or press attention at the time. But that plot, which is now one of the worst Smoking Gun Evidence pieces of the indictment that could now land trump in prison, it kept coming back. It was the zombie scene in this nowindicted conspiracy story. So even when other people beat it back or warned trump against such obvious fraud, Zombie Electors kept coming back. It continued from those earlier on gins as i showed you on the upper left of this chart, all the way through the January 6th Certification itself, tet a pen preside, we can see in the new indictment this week smith busts the zombie elector plot coming back to life. He pins it on trump and coconspirators, saying they caused the fraudulent electors to transmit their false certificates now to the Vice President. They really did that. They took it all the way from those weird Conference Room meetings and their little internet postings all the way to the floor of congress on january 6th. This is part of the indictment. That day, again, the investigators go back to the scene of the crime. Nobody knew, other than those participants, that as pence on the right walks in to preside on january 6th around 12 58 p. M. , as hes walking in, within the same hour, republican senator ron johnsons aide pushing the fraudulent elector certificates, the zombies back to life. Were lining up the video with their secret nowexposed texts. Replying there, do not give that to him. Theyre Talking About the zombie elector fraud. What did pence know that day . Way more than everybody else. He knew all about trumps plots. How many there were. He knew that his own lawyers, longtime stalwart conservatives, had concluded those plots were illegal. And pence didnt want to become a coconspirator to it, indicted or not. Pence knew trump had plans for a bloodless coup. Thats what it would have been if they worked this all out through all that paperwork and fraud. With lawyers and these government hacks trying to take over. And within a few hours, pence knew trump fomented and embraced a bloody coup. As trump fans literally attacked the government, staged an insurrection, nowconvicted sedition, and publicly demanded and worked toward the assassination of then Vice President mike pence. Hang mike pence, Hang Mike Pence stop and take it all in, we lived through that. As of last week, no one in government, nobody at the top had been even bothered about it. Let alone indicted about it. That all just changed this week. So if you feel that, if sometimes you kind of stop and you take a breath and you get goosebumps and you say, maybe were on the road to some accountability. By accountability, i mean the Justice System process. I do not mean prejudging the defendant. He will get his day in court, hes legally presumed innocent. But we have a system where an interest Special Counsel, who historically has prosecuted democrats like john edwards and republicans and others. Jack smith has gathered this evidence together, and this is what he says accountability looks like. He will bring it to court. He will work across the plots. I just showed you a couple, not all of them. We showed how some of these Coup Conspiracies weve been tracking over time, and specifically we looked at the electors along with others, have now been indicted. Your view of what we sort of learned this week big picture how jack smith is approaching these conspiracies . So i think we learned a lot this week, ari. Not so much about the facts, which we already pretty much knew from the january 6th committees work and from news reporting. We learned a lot about how jack smith and his team view the facts in a legal context. In other words, what crimes they charged. And so we have this threepart speergs structure. A conspiracy that talks about defrauding the United States. A conspiracy that talks about Obstructing Congress and trying to prevent it from certifying the vote. And then i think sort of a heartfelt conspiracy. The civil rights conspiracy. Trump in advance said that the government had told him he was a target on this charge of depriving people of their civil rights. And we had talked a lot and speculated about what that conspiracy might look like. When we get the indictment, we see its a conspiracy to deprive us as voters of our right to vote. And so the legal structure for these facts that the Special Counsels team has put together is a conspiracy writ large against the country. One focused on congress. And then one in which you and i and the rest of the American People are victims too. What does it tell you that smith has lined this up in the way they intersect . So we just walked through how what was really a sort of arcane or bizarre thing we showed some of it had seeped out in public. The electors and trump aides discussing it. That what might seem over here in the cor a i put it, like a zombie resurfaces on the 6th, and thus clearly was part of a highlevel plot. It really was. I think youre exactly right. This was less about january 6th and more about an ongoing course of conduct designed to make sure that trump won the election. Whether he won the vote or not. And it started early. It started well before the election when trump was saying things like, well, ill only accept the results if i win. I wont acknowledge that i will accept a loss. So that was how this was structured from the getgo. Only a win by the former president would be legitimate. Anything else would be the result of fraud. And something that its so easy for to us take for granted now is that we understand the fake electors scheme. That none of that came wrapped up in a package with a bow on it and a tag that said donald trump ran a fake electors scheme. We heard these reports early on, right . Dribs and drabs. And it was up, again, to the media and prosecutors to put it together so that what we see now is, as you say i think very accurately a Zombie Scheme that trump keeps trying new things to make sure that he wins. Ultimately, we get the full story in this indictment. Yeah, we happen to have mike pence take his approach to it. Donald trump has picked many other people. We showed some aides who were backing this. Mr. Bannon once had a very highprofile position. If mr. Bannon had been Vice President , he might have been standing up there waving around the electors certificates and saying, up is down, the fraud is real, at a minimum, were not going to certify this, well take another 10 or 15 days. Push the country there. So i thought smiths indictment also gives us sort of a sweeping understanding, as you say, legally analyzing the underlying some of the underlying evidence that we had.
