If the past is any indication he is absolutely going to be using the third indictment as a key part of his Campaign Messaging in the coming weeks and months and the way that the legal calendar is lining up with the election calendar, primary calendar, it is going to be fairly easy for the former president to soak up a whole lot of oxygen, which is going to make things pretty difficult for his primary opponents. Youve already got him posting on truth social that he just needs a fourth indictment to secure his election, and some of his allies are saying indeed, three or four indictments are actually politically not legally, but politically better for the former president than just one because it muddies the waters and makes it difficult for the broader public to focus on the details of any one of these indictments. Who is going to read 40 some pages when there are three or four major legal cases and he can continue to do what he did yesterday on the tarmac and hammer the message this is a political weaponized system that is out to get him and if youre looking at the polls, a whole lot of Republican Voters are buying that message. Now, were talking republican primary voters and that is the focus now. What does that mean for the general election . Thats a different story. But thats not at issue right now and when looking at the legal calendar and primary calendar, this is why youre having his lawyers trying to delay, delay, delay these trials so that they can try to run out the clock and hope he could get into office and if he does it is possible that all of this can go away. Again, weve seen in the past each time the legal troubles have increased for the president so have his fundraising numbers, so have his poll numbers, and so far theres no indication that this will be any different. Dasha burns, thank you for that. Alexei navalny, the jailed russian Opposition Leader has been sentenced to another 19 years in prison. Matt bradley is following that story for us. What more can you tell us, matt . Reporter well, chris, the short answer is i cant tell you very much because like so many of these trials, especially involving opposition figures, this was a closed door proceeding and even apparently navalnys parents who havent seen their son in person for more than a year, even they werent allowed to attend. This was actually the fact that this is being done in secret is among a list of things that u. S. State department condemned when they condemned this ruling earlier today. The frultsz today, they werent a surprise to anyone, least of all to navalny himself. The russian judicial system rarely acquits those accused and prosecutors had already called for navalny to spend two more decades in jail, so in addition as you said the nineyear sentence hes serving. He released a statement yesterday through his organization saying that the sentence will be a long one. He knew this was going to happen. Hes going to be serving more than a lot of rapists and murderers in russia and said the sentences main purpose was to intimidate. The list of charges look like they were trumped up. He was accused of a bunch of different things. Creating an extremist group, inciting extremism, creating a Nonprofit Organization that infringes on the rights of citizens involving minors in committing dangerous actions and then this unique charge at the end, of rehabilitating naziism. Thats a criminal charge that was only put on the books in the last ten years and russian human Rights Groups say its vague and specifically designed to silence dissent. Of course, we havent seen much in the way of evidence during the closed sessions. This is something that State Department brought up when they condemned this decision. The charges dont resem whabl navalnys organization has been focused on and that is the thing that has probably terrified the kremlin creating this draconian reaction. Navalnys group the anticorruption foundation, mostly researches and exposes highlevel corruption in russia and the group has been outlawed and navalny and his supporters have in the past faced punishments worse than imprisonment. Navalny nearly died when apparently poisoned with a nerve agent. Many suspected the kremlin was behind that, it was an assassination attempt. I have to tell you, navalny willingly returned to russia after he had recovered, essentially giving himself up to russian authorities who were watching and waiting to arrest him upon arrival. So, hes a brave plan. Without a doubt. That Justice System is nothing like a Justice System. Matt bradley, thank you. Investigators have identified another victim in the infamous Gilgo Beach Murders. Ron allen following that for us. So how does this play into the prosecution of the suspect connected to these murders or does it at all . Theres no connection between the identify of the woman found today, the womans remains found and the suspect in the case rex heuermann. He is charged with the murders of three women. This is a case, the woman identified as Karen Bergada that dates back to 1996, her remains found with the remains of the others who are part of this gilgo beach murder case. There are in total 11 sets of remains found and so far, there are only three that have not been identified. So again, they were able to match the dna of the set of remains with a family member. Heres how the d. A. Describes how they were able to identify this woman. In September Of 2022 the fbi was able to was able via a Genetic Genealogy Review to identify miss bergada as fire island jane doe. In october of 2022, using a swab from a relative of karen, we were able to definitively identify her. So theyve been using the genealogical research, sophisticated technique we see more and more in Law Enforcement and thats why they were able to identify the remains and this woman 27 years after she went missing. The connection to the Gilgo Beach Murders is her remains were found around the same time in 2010, 2011 or so. The investigation into all of this continues. Chris . Ron allen, thank you. So the u. S. Labor market is showing signs of cooling. Thats the headline. Last month the economy added 187,000 jobs. This was a solid number, but compared to the breakneck pace of hiring weve seen in recent years this is a number that represented the fewest hirings since december of 2020. Over the last year job gains have averaged about 312,000 per month, so to put that number in perspective, job gains for the previous two months were revised lower as well. Nonetheless the Unemployment Rate ticked lower to 3. 5 , hovering near a historic low. Wages grew more than expected up 4. 4 over last year and for the federal reserve, the slowdown in hiring is likely a welcome sign as it looks to cool the labor market. Its the wage gains that will be in focus. Those may signal that additional Interest Rate hikes could be needed to staunch Price Pressures since the Central Banks does see labor costs as a contributor to inflation. Another metric in focus, Labor Force Participation stood at 62. 6 for the fifth straight month now. He walked into court with his lawyers. He pled not guilty. But there was one moment our team of nbc News Reporters noticed that stood out as something different. When the Magistrate Judge looked at the former president of the United States and said, quote, finally, sir, i want to remind you that this is a crime to try to it is a crime to try to influence a juror or threaten or attempt to bribe a witness or any other person who may have information about your case or to retaliate against anyone for providing information about your case to the prosecution or to otherwise obstruct the administration of justice. Ken, you checked with your sources about the Admonition Trump received. What did they tell you . They said Everything Else the Magistrate Judge said to mr. Trump in explaining the conditions for his release was standard including her warning that he should not commit a crime while free, but this one stood out to them and its not something that is typically said to a defendant in washington, d. C. , according to multiple lawyers i spoke to, and to me, it puts on the table whats going to be a devilish and ongoing question in this case, how much will this court and this judge let donald trump get away with in terms of attacking the prosecutors and the judge and the process publicly . At what point does that verge into potential Witness Intimidation or other misconduct . Its a really tricky problem because donald trump is running for president. He has a First Amendment right to speak, including to criticize people, who he deems is political opponents. Normally a defendant cant just go out and trash the judge and prosecutors. Theres local rules in washington, d. C. That say you cant talk about the evidence in the case, for example, the lawyers or the defendant. This sets the stage for whats going to be an ongoing drama when the judge Tanya Chutkan picks things up in august and then ongoing as to, you know, how they will regulate, if at all, mr. Trumps conduct on social media. This is not the first time hes gotten a warning from a judge at an arraignment. In new york in april, the judge advised trump please refrain from Making Statements likely to incite violence or civil unrest and avoid rhetoric that would jeopardize the rule of law. That same night at a rally, i have trump said i have a Trump Hating Judge with a trump hating wife and family. So where is the line her . What is the standard that a judge is going to use to decide if hes gone too far . Thats really not clear. I think thats the Perfect Place to pick up where ken left off, when you think about what happened here in new york, when he had the first indictment in the alvin bragg Hush Money Case with stormy daniels, the judge was very clear but there were so many different questions going into it about what donald trump would be able to say and whether that judge would issue a gag order, as weve already discussed, the First Amendment does allow donald trump, as it does any other citizen, a pretty wide amount of latitude in terms of what they can and cannot say, so theres been a huge question about how do you set boundaries around someone who is not only trying to create a public narrative around what is happening to them from the purposes of the actual court case but has an even greater incentive around that public narrative actually taking shape to support theiro be president again . This is unchartered territory in so many respects. Theres another thing i thought was particularly interesting about the judges admonishment here. A lot of people forget that one of the things that apparently that donald trump had listed in the target letter, although it was not part of the indictment was the notion of Witness Intimidation. Its telling the judge even without that having been charged, still felt the need to reach out to donald trump during this Arraignment Hearing and otherwise what would have been a standard pedestrian hearing, insert that which i will add myself to the name of many attorneys who have said, weve never seen anything like that in this sort of proceeding before. Theres that much concern about Donald Trumps ability to shape the public narrative that you do have to start putting in guardrails as early as possible. What does the law say about Witness Intimidation . There are very overt things that have been done, very overt personal threats that have been made, but again, what is the law saw . Youre not number one, youre not allowed to contact witnesses or other parties directly when represented by counsel. Thats a huge nono. Following that youre not allowed to get around that rule by sending someone a third party, if you will, to try to contact them or otherwise influence them or take other activity, for example, if you know that you are in a restaurant where they were eating to begin talking loudly or speaking loudly as if you know the things that youre saying are going to get back to them. None of those things are permitted or permissible. With someone who has such a wide platform as donald trump does, these are unchartered waters because what he can do by his truth social platform and other things he can do is basically engage in a way that energizes them to focus on juror, witnesses or others of the court and thats what i think is the difficult part of trying to create a rule in this space for donald trump because weve never seen someone who has such a devoted following and is in this type of trouble who is willing to put that on the line by basically influencing his followers to try to put pressure on witnesses or other people who are involved in the Court Process . Jack smith, if you want to talk about just the indictment, he went to great tloengs say im lengths to say im not going after trumps free speech but it becomes an argument on the other side what is his free speech versus was does that cross the line of Witness Intimidation and endangering anybody else. Some of it is going to have to wait until the threat or the risk of the threat gets higher. There have been threat assessments by fani willis who hasnt even filed case yet, jack smith has done several and alvin bragg as well. Unfortunately, until there is a threat thats deemed viable, which is a very dangerous standard to have if youre someone who is potentially going to be victimized by his rhetoric, until that threat becomes viable most of the judges are going to stick to verbal rep panneds in court. If it comes to the point where it is believed theres a viable threat to the witnesses, prosecutors and so on, i suspect that the notion of a gag order will actually be on the table. Phil, we have heard these officers speak many times about how the attack changed their lives. Why was it so important for them to be in the courthouse for this arraignment . Well, chris, because i think for many of them, there was a feeling that there was finally some justice here for their role that former president played in perpetuating the lies about the 2020 election, which is, of course, what motivated so many people to show up at the capitol that day and commit the violence they did in front of the police officers. And i think, you know, being there at court, seeing it happen, its not just any courthouse, remember, its a courthouse thats physically very close to the capitol, its a courthouse where so many january 6th rioters have gone earlier to face justice, to see this happen, you know, may have been an emotional sort of moment for these officers as they were saying in the interviews. Charles, youve worked with local Law Enforcement in your time as a prosecutor. Many of those officers have spoken about accountability. Your thoughts on the fact that they wanted to be there yesterday and how strongly they felt about it . Chris, in a case like this, it just so happens that harry dunn andry close personal friends. Weve known each other for years. One thing i can say about harry and the other officers is they have been extremely consistent in terms of their level of investment and engagement around the trauma that they experienced on january 6th. And who is responsible and how Everyone Needs to be held accountable. It is important for viewers to understand this is particularly important for them because this day was not guaranteed and what i mean by that is, the January 6th Select Committee In did not have the power or authority to bring about Donald Trumps arrest, arraignment or indictment. When harry dunn and others testified in front of the January 6th Committee there was a question of how far is this going to go. When the Republican Congress takes shape, and this committee is done away with, is this going to be the End Of The Road . Will we see accountability . The fact that this materialized and actually came into fruition on a day like yesterday, where they were actually able to go in and see this take place, and be a part of that, was a very big deal because as i said, this was not promised to them and they have been engaged from the very outset in terms of wanting to get accountability for those responsible. Phil, i want to play some of what officer harry dunn had to say earlier today here on morning joe. It was refreshing, so to speak, to see frpts treated like any other criminal who violates the law sitting in that courtroom going through the judicial process. It isnt closure. I wish it would have happened. He should have been charged or arrested on january 7th, its not closure, but it is a necessary step to get that closure. Accountability hes being held accountable for your actions happening now, but justice looks to me justice looks like a guilty verdict. We should be clear, phil, those charges dont accuse donald trump of inciting what happened at the capitol, but i wonder if it is a hard pill to swallow for the officers who have been vocal about blaming him. Yeah. Look, the indictment that jack smith and the team of federal prosecutors brought this week, youre right, it does not accuse trump of inciting the riot, but it does make clear the pattern of lies and sort of the broad conspiracy at work by the former president in the weeks after the 2020 election to try to perpetuate this lie that he had won the election when there was no evidence to support it. Thats the very foundation of what led to january 6th. So these were connected and i dont think, you know, that the events of this week or frankly any of the events in the trial to come can bring closure to an officer who experienced january 6th in that way, but i certainly can understand how surreal it must have been to see a former president and somebody who is actively now running to become president again, treated as a criminal defendant in a court of law and to witness that firsthand must have been an incredibly powerful experience for those officers. The building where the rampage took place has been fenced off and unchanged since then. A somber monument to the tragedy, now awaiting demolition. The ap describes it like this, there is greeken glass with wilted roses, deflated books, open textbooks and Laptop Computers on students desks, at least those that werent toppled during the chaos. The building has been a key piece of evidence in multiple court cases and the halls will be filled with the sound of gunfire once again due to a Court Ordered reenactment of the massacre, part of a lawsuit accusing a sheriffs deputy of failing to respond on that tragic day. Can you even put into words what it was like to be back in such a familiar place on such an emotional mission . No. I cant. Thanks, chris, for having me and talking about this. No. I cant put it into words. That was the idea of going there and bringing a bipartisan delegation to go do this because we can talk about this until were blue in the face and look at video like you showed that, you know, shows the building a thousand feet away, but to go through it with the Family Members, to walk through shot by shot victim by victim, the building is a time capsule. Its exactly as it was the day of the shooting. Every piece of homework that a student was working on, every essay, every textbook, every shoe that fell off, every backpack you saw where 15 kids tried to hide behind a desk and one or two that were sticking out died, and so its horrific and i think thats why its so important for members to come and i think were going to try to do this again if we can, to get more members to come on a bipartisan basis to see what happens when a school is turned into a war zone. What do you think it can help them to understand . What do you maybe know now that you didnt know before you saw the inside of that building . Well, im hoping what they understand is that the status quo is not accessible. Theres going to be areas we disagree. But if we can agree that the status quo is not acceptable and doing nothing is not acceptable we can fig out where we can work together. When i was in the State Legislature the way we got the Marjory Stoneman douglas act passed working with republicans in charge at the time raising the age to buy a gun 21, threeday waiting period Red Flag Laws we had to put politics aside, realize that the perfect cant be the enemy of the good, and that both sides were going to get some stuff and both sides werent going to get stuff. If we can do that in congress, we can make more progress. Theres not one thing to fix this. Its constant mitigating of the situation. One thing that i learned going through the building that was just so stark, is that the building had Hurricane Glass because of the Building Code in florida. All the windows were Hurricane Glass. When the shooter tried to kill students as they were fleeing out of the building the bullets wouldnt go through the Hurricane Glass. The glass saved students lives but the shooter never went into a classroom. He just shot through the glass window every door had which wasnt Hurricane Glass and thats how he killed all those students in the classroom if they werent in the hallway. To see the difference in what Hurricane Glass did 15 feet away versus the glass window, it just its a shocking because a lot of those kids would be alive if that very same glass on the window was on the door. Of course that brings us back to an ongoing debate, right. Is it about doing things like putting Hurricane Glass in interior doors or getting guns out of the hands of people who maybe shouldnt have them and i wonder what your conversations were like . I know you had a roundtable with families who in this case and so many others im astonished by their strength, so many people who have lost loved ones, who have lived through these kinds of circumstance, have not given up hope for change, but did they have hope for change . Do you see a realistic path in congress to do what was able to be done in florida . First of all, these Family Members have crisscrossed the country the last five years lobbying elected officials like myself and colleagues for the obvious and no, their strength is unbelievable. It encourages me. The students that made it out of the building that took this up as a cause, not just for their community but other communities that suffer with this around the country, gives me strength. But no, look, were we still believe that there are things to be done and that we can do it. We have made progress, you know, not just here in the state of florida but Passing The First Gun Violence Prevention Legislation Last Year in the last congress that was the first bill in 30 Years Congress has done to address gun violence legislation. When asked what can we do the answer is all of the above. Its Mental Health, school safety, its Law Enforcement, its gun violence prevention, its all of it. Right. Just doing one thing isnt going to solve the problem. But we have to mitigate the situation. We have to realize that were not going to stop everything.
