It is undeniable that we are in a position now with that stunning 45page indictment with six coconspirators work crimes against democracy as well as four specific crimes against laws on our books, that may or may not be adjudicated before the country has to go vote again, and im not sure that we have a way to learn as a public why that is, right . I said this on my show i dont know that ive ever agreed with trump except for yesterday when he announced his own second federal indictment, and he said, they waited two and a half years to do this. They did. That may be an inconvenient truth, an understandable truth. We dont know why as a public that is the fact, but it is true that we waited two and a half years. I know some of your brilliant coverage has drilled down at the specifics. They dont get better from what congress was able to gather without all the Justice Department. It gets worse. His criminality gets more abundant apply clear. So when youre turning over rocking and looking for trump, you never find something that excuses the behavior. Where were you . Perhaps you were watching live when the news broke about 25 years ago or maybe you saw an i the lert on a phone or on social media and checked to see if he got indicted for january 6th. By the time Special Counsel jack smith spoke this was about 24 hours ago, the wheels of justice were in motion compelling defendant donald trump to come to court thursday. The first time trump will face a judge on accusations of crimes committed while he was in office, which is a big singular difference. The first charge is for attacking american democracy. The first charges that tie him and his top aides and lawyers to january 6th itself. We dont know if this case will result in the conviction of donald trump or do so before the election, as discussed with nicolle. He is legally presumed innocent. We dont know if the Unindicted Coconspirators will be indicted or not. We dont know if they may fortify this case against trump with their own testimony. What we do know tonight, and i want to get into this with you, is that this case changes everything. We know the past parade of Trump Scandals and probes and even some indictments are now dwarfed by this Coup Conspiracy Case that jack smith unveiled. Prosecutors can charge someone with very basic evidence and leave the wider story, the extra details, the testimony until trial. Or they can use the indictment as an opening salvo. Breaking news in one of the Special Counsels investigations. The 45th president of the United States has been indicted by a grand jury in washington, d. C. On four criminal counts. Here it is right here. The United States versus donald j. Trump. Donald trump has been indicted. The largest investigation in our history. The attack on our Nations Capital on january 6th, 2021, was fueled by lies lies by the defendant. We talk about a Speaking Indictment . This is something more like a shouting indictment. Yeah. This is incredibly detailed. This shows a singular focus for jack smith on speed. A Federal Grand Jury has now criminally indicted the former president. Jack smith wants to get to trial and he wants to get the trial quickly. The new indictment of former president donald trump. Perhaps the most consequential case in the history of the Justice Department. This is a grave day and a serious one for our country. Grave, serious, a case and a process that will test this nation. And i know we have lived through a lot and people dont like the hype and hyperbole, and if you watch this program you know we try to keep it on the level, but ill put my name on the following statement this is the most important case the Justice Department has ever brought. Period. And what happens now will matter, either way. The indictment builds on of course the findings from the January 6th Committee. It adds new evidence. And in your Special Report now, one day out from the indictment dropping, we are going to dig into the revelations with you, because the evidence backs up the charges trump conspired to defraud the u. S. , Obstruction Proceeding and. Now, some of the thwarted attempts were stopped. Some of the plots worked up to a point. But remember and smith uses this in the indictment trumps efforts did delay the certification of President Elect bidens win on january 6th. It did not happen at the appointed time. Smith exposes that Trump Officials within the government, including one you see on your screen, were ready for violence in advance, including a chilling exchange with Jeffrey Clark, an Unindicted Coconspirator. He worked at doj and tried to hijack that entire department, which, again, interestingly is now charging donald trump and lists him as an Unindicted Coconspirator. He tried to overthrow his bosses, a white house lawyer told clark the legal fact that trump would vacate for biden and any coup would be met with protests and riots. Smith says clark responded, thats why theres an insurrection act. Think about what that means tonight. Thats coming from inside the government. Trumps doj hack, one indicted coconspirator, raising the idea that then President Trump might use Military Force to hold on to power, to crush protests. Thats incriminating. And there were signs that the military National Guard would not follow any attempted illegal orders by the outgoing president. Indeed, there was reporting on that, you might recall. By the end of january 6th, those forces were called in to halt the fans of donald trump and their now convicted crimes, not to help trump illegally stay in office. That new evidence suggests smith has notes or testimony from the person on the other end of that conversation, the same path to new details on how trump tried to issue a legal demand to Vice President pence as the charges cite contemporaneous notes by pence, which means like comby, figured out when trump makes sketchy demands you need receipts. Think of the tantalizing detail of the conversation. This was days before the riot, pence telling investigators how trump was beraing pence by phone, and when pence stated the obvious fact, trump responded, quote, youre too honest. Everyone saw the danger pence faced from trump fans. Security video showed opinions fleeing from the mob. His boss unleashed. Now, the indictment shows late into the night after pence fled, after Law Enforcement restored order, after everything went down, trump and his aides continued their plot to hijack the certification. They used that violence and pressed on. It shows trump trying to reach two senators as late as 6 00 p. M. That day. Thats after everything went down. And smith ends the Speaking Indictment with that as the damning climax, showing while the nation saw the senate reconvene on the floor ransacked by trump fans, the convicted seditionists, horror at the insurrection that just unfolded that sent them fleeing and running and scared, that Word Insurrection was first used on the floor that night by republican mitch mcconnell. This was after pence fled for his life. The plotters were still trying to demand he would join them in the plot hatched against him. Thats what they wanted, those ten days. Listen the this trump ally in the context that we have tonight asking for what . A tenday delay. Weve seen in the last two months unprecedented allegations of voter fraud. Conduct a tenday emergency audit. Consider the evidence. That was the floor of the senate, jan 6th, tenday audit. Thats how the night ended. Theyre lying to their hard core fans for the loing president , losing to the President Elect. In another state, they didnt have litigation may sound like were getting into the details. These details are a difference in whether youre dead to rights or have the defendant or not. Expose the nature of the fraud and how because they had been assuring the trump focus had been assures their fans, hey, were only going to do this if this peppeding litigation works out. In some states they didnt have litigation so they ginned up a fake case, filing a suit in new mexico six minutes before the noon deadline for the electors votes so there would be pending litigation at the time the Fraudulent Electors voted. In reality, the trump team, team coup knew they already lost most cases. Knew the fake case was designed as a pretext. The real plan was to push the Fraudulent Electors no matter what, which they did, all the way through january 6th. Typically you see evidence like this, defendants own words that convict him when it involves just money. This is an indictment telling a compelling story that shows fraud and deceit in the worst possible way for the worst time, to interfere with our electionsing to undermine our democracy. Jurors are going to care about it. It also has violence, because the January 6th Attack was the ultimate culmination when mike pence made clear he wasnt going to do this. Lets show the quote on the violence. On the evening of january 6th, trump and Coconspirator One attempted to exploit the violence at the capitol by calling lawmakers to convince them, based on lies, to delay the certification. I show there that people like senator cruz were saying, before, give us ten more days. After the january 6th night he was on the floor of the senate still saying ten more days. Ten days takes you out into that constitutional crisis. These folks werent any more serious about a tenday investigation than they were about the elector fraud being real. They thought if they got close enough to the 20th and as, jeffly clark put it, Military Force on the home front, that they might stay in power. Or that the Supreme Court wouldnt want to come in on the 18th or 19th. They understood that aspect of creating panic and chaos. Does jack smith have to show to a jury that it could have been even worse . How does he use that information . I thought the stuff about the doj official musing about a coup was chilling, although we have this misleading tradition of american exceptionalism that say it wouldnt happen here. They dont have to prove any of that. All they have to show, it was an attempt to interfere with the certification of the vote, that he involved in knowingly engaging in fraudulent means. The whole scheme with the fake electors, misleading people, making false representations, that shows the crime. The fact that it wasnt successful has nothing to do with it. Attempts are charged every single day. What it does show, what you highlight, is how real and serious this is. While its not an element of crime, motive is important to show the motive of the defendant, but also to make sure jurors care about this. In a criminal case to show how real this was and this defendant not only tried to weaponize the powers of the presidency this he controlled and the denial dj and alike to take over the election, try to force these senators to do certain things, to try to interfere with the certification is one of the most powerful cases you said that you could imagine and they have the evidence that lays it out. I think what the indictment does so well is by walking it through the story, the narrative, and january 6th is the culmination. So the fact that it wasnt successful shows while the scheme was so brazen, ultimately there were forces in place and guardrails that prevented the interference with the peaceful transfer of power for the first time. But it got close, and donald trump would not take no for an answer. When mike pence said no, doj said no, the state people said no, his lawyers, he said, im going to do more. Every time they said no, he escalated. When he sent that first email out to his constituents or first tweet, come to the capital january 6th, it will be wild, that was just after his council, his Chief Council told him that these schemes to seize Voting Machines would not work. Then when mike pence said hes not doing it, he sent out another one to remine his craw to come. Theres a powerful story of desperation to ininterfere with the election at any costs. When the nation woke up on january 7th, 2021, most people felt like they knew what happened, what we saw, and we heard a focus on that day. Republicans cast it as a riot that day that got out of control. Top democrats impeached trump for inciting an insurrection that day. There was actually a shared premise there that it was all about the events of that day. Indeed ive mentioned on this program before that the democrats who fought to have a January 6th Committee do the investigation broke down what the goals were, and initially it was about getting to the bottom of what happened that day. If youve watched coverage on this program, youll recall weve followed the evidence and pushed well beyond what was that shared premise. We said at the time those views were shared to suggest that was too narrow a view. Even i told you the impeachment was at the time understandably a focus on what the president said at the rally, it was too narrow. As a matter of fact of law, here they are. We counted eight plots to overturn the election. What youre looking at is from a report we first aired over ten months ago, which tracks them across time. You can see lawsuits and electors and getting the states to overturn votes, some of the things you were first trying. You are allowed to file lawsuits. Then they turned to desperate, extreme criminal measures. We voted most ended one things that were unconstitutional or possibly criminally indictable. You might have said what if . And will we ever know . Tonight we do. This is about facts, not emotion. The facts im sharing are gleaned from reporting from government probes and now we can say tonight for the first time from the digital facts and evidence that we can report on base on new charges against trump for those plots. So now, as we look through this together, lets update that chart with these new developments, because while jack smith does not accuse trump of sedition or insurrection, he does indict trump and cites the coconspirators actions for plots we count here for the first time tonight, nail five of those original plots the Fraudulent Electors. You see that, indicted. The plot to get the state lnlers or other officials to steal their own citizens votes. Indicted. The pence plot, that he would somehow help overturn the votes, indicted. When you look at the electors, a trump aide who was intimately involved, boris epshteyn, toll us about it on the beat. I was part of the process to make sure there were alter mat electors when channels to the seated electors would be everything was done legally by the Trump Legal Team according to the rules of the Trump Legal Team and giuliani. We got that admission to giuliani. The indictment says they ultimately used the certificates of the Fraudulent Electors to deceitfully target the election. Then we go out to the states. Trump lied to the georgia Secretary Of State to try to get him to alter georgias vote and question the validity of the biden vote. It also says trump and Coconspirator One were calling the arizona speaker of the house, lying about false claims of Election Fraud aimed at interfering with arizonas electors. If you follow this coverage you understand those references. They dont state the name. They dont have to, but Everybody Knows the House Speaker is rusty bowers. We asked him about all of this earlier this year. According to your testimony, the evidence in the report, at late as january 4th was still calling you, urging to, quote, hold a vote. We just said, john, is there any ever, ever been anybody tried to do this . He said, no. I saiding you want me to put my state through this . He said just do it and let the courts figure it out. Thats one more person who declined to join the plot, and you can see today why. As for the Vice President i mentioned before earlier in the show, he didnt want to be the unindicted or indicted coconspirator number seven. New evidence he sought to enroll him. That is language for steal the thing. That didnt just come out of nowhere. There were a small number of hard core people ive called the members of team coup. Tonight they are several of them in undine itted conspiracy land, and there are others who may yet get into more trouble. This is the beginning not the end of the process. We questioned one of them, trump aide peter navarro. He was subpoenaed by congress and later indicted. The remedy was for Vice President pence as the quarterback in the green bay sweep to remand those votes back to the six battleground states. Do you realize you are describing a coup . No. It was one of those arrows arc a plot to get his political hacks or allies in the jobs to overthrow the election. We have Jeffrey Clark allegedly lined up by trump to take over the whole department. Clark basically accepted but it didnt come to fruition. Trump relented. He was told it would lead to mass resignations, that it wouldnt work. The final plot with alleged new details in the standing indictment is of course Sabotaging January 6th itself. There was no sedition charge. This is a key part of the criminal evidence that trump pushed on using the violence to try to get the delay and then eventually wanted the delay to keep him in office well into the night on january 6th. Trump Coconspirator One who weve identified as giuliani, attempting to exploit the violence based on knowingly false claims of Election Fraud. This is where the arrows analysis im sharing with you now overlaps with some of the reporting earlier in the hour, that trump attorney john eastman was still emailing and lobbying that pence violate the law.
