To stay in the 2024 president ial race, even if he gets convicted. It has been just over 24 hours since we learned the Justice Department added three new criminal charges against him in a classified documents case. Tonight trump was in iowa for the first big gathering of gop candidates, and he claimed the governments allegations were really about his race for the white house. If i werent running, i would have nobody coming after me, or if i was losing by a lot, i would have nobody coming after me. Trump is now facing a total of 40 counts related to his handling of classified material after leaving the white house. Nbcs Garrett Haake has more on the case against the former president. In the new charges the Special Counsel alleging mr. Trump sought a coverup to conceal classified documents at his maralago home by deleting Surveillance Video. Now charging a new defendant, maralago property manager Carlos De Oliveira with two Obstruction Counts and with making false statements to the fbi. In the indictment, prosecutors say on june 23rd last year, the day after the government subpoenaed Surveillance Videos from her his home, the former president spoke by phone with de oliveira 4 24 minutes. The next day mr. Trumps personal aide, walt nauta, who has also been charged, allegedly changed his travel to go to florida. On june 25th, prosecutors say nauta and de oliveira look at Surveillance Video at a maralago Security Booth and walked through a tunnel with flashlights pointing out cameras. Two days later, de oliveira spoke with an i. T. Staffer identified as employee 4, who told him the server retained Camera Footage for 45 days. De oliveira allegedly said the boss wanted the search for deleted. The employee said he would not know how to do that if you did not believe he would have the rights to do that. De oliveira allegedly insisted that thats what, quote, the boss wanted, asking, what are we going to do . The indictment does not say if any footage was deleted. New data and also charges mr. Trump with possessing a Top Secret Military document he has denied existed. But is heard on an Audio Recording discussing it with aids in journalists. Its highly secretive. [laughter] both trump and nauta have pleaded not guilty to that the charge of the initial indictment. Meanwhile the Washington Post on the new yorker point out that this Case Highlights the lessons from the high water gates candle, and every time teenagers get themselves on a hot mess, which is that the coverup is always worse in the crime. One former white house lawyer, who advised trump during the mueller investigation, believes the feds have a very strong case. I think the original indictment was engineered to last thousand years and now it will last, the superseding indictment will last till antiquity. This is such a tight case. The evidence is so overwhelming. Again, thats trumps old lawyer. We are also keeping a cools eye on Special Counsel jack smiths next move in the 2020 Election Interference. Case this week his office met with trumps attorneys but so far there has been no indictment. With that, lets get smarter with our lead off friday night panel. I want to start with the next National Editor of the Washington Post, pulitzer prizewinning journalist our friend phil rucker, glenn thrush joins us, Justice Department reporter from the new york times, an msnbc legal analyst, mary mccord, former acting assistant attorney general for National Security at the doj. Mary, youve got to help us here. Looking at this new indictment, what do you notice about jack smiths case there wasnt so obvious before . I think theres two main things. The first indictment recounted this incident in bedminster where, which we just played in the trial, where trump was apparently showing or flashing some documents to two rioters, a writer and a publisher, who were working on an autobiography of mark meadows. He was claiming these were about iranrelated attack plans. The first indictment talked about that incident. I think as a way to really show the dangerousness of trumps lack of care toward highly Classified Information. But the first indictment didnt actually charge a crime related to that particular document. In this indictment, the 32nd count, it is 32 counts of mishandling of Classified Information, and that 32nd count is in fact the documents that the indictment alleges is the document that mr. Trump showed to those two people who were not authorized to seek Classified Information. This puts the lie to Everything Trump has been saying about there was no document. He may be headed chief of papers, but there was no classified document. I think it also shows that jack smith wouldnt have put it in the indictment and claim that it was in fact the document shown that day. He doesnt have the goods. He didnt have the proof for that. It also means it will be easier to get information about that exchange in as evidence at trial. So thats the first thing. The second thing is what you also alluded to. The coverup just keeps getting deeper and deeper deeper. We all remember as kids, if you tell one line to your parents pretty soon that tangled web of lies become something you cant extract yourself from, and thats what we keep learning. It also looks like there is likely a cooperating witness. Trump employee number 4, who, to his great credit, it is alleged in this indictment, said no, im not going to destroy the server that has a Surveillance Video on it. Surveillance video that, by the way, as you indicated, the government had subpoenaed. So its very powerful if this evidence can be proved. The one thing i would say, though, is that this is a case where im not going to necessarily agree to the coverup is worse than the crime because i dont want to detract from the significance of the fact that mr. Trump is alleged to have mishandled many hundreds of highly classified, highly sensitive government secrets, and we still dont know the full extent and fall out of that. Not only with respect to vulnerability to our natural secure security but i relationships to our allies in the safety of our sources and methods. Mary, could these new charges impact the timing of the trial . Because for trump, right now his number one defense is delay, delay, delay. He is hoping the judge Aileen Cannon will do that. I certainly think it could. Were adding another defendant, another Defense Lawyer, that Defense Lawyer is going to say he needs more time. I do think this particular defendant, mr. De oliveira, hes not charged with anything related to the Classified Information, so i dont think the case will be complex with regard to him, in terms of the Classified Information procedures act. I think if i were the government i would argue that he doesnt need any access to classified, and so there should be delay with respect to the Classified Information procedures act hearings. But even taking that aside, theres a voluminous amount of discovery here. I think its likely that if mr. De oliveiras attorney requests more time down the road, and in fact even as the other attorneys do, that judge cannon might give him that extra time. We are already at a trial date in may, so even a month or two, we start getting closer to the 2024 president ial election. Failure spent a lot of time talking to trump. You literally wrote a book on how his mind works. How do you think this Indictment Tracks with what you know about him . Whats he thinking . A couple of things stand out in this indictment that are reflective, i think, of the patterns of trumps behavior. One is micromanaging the situations, the Route Petered references from the aids to what the boss wanted, the 24 minute phone corners asian, the signs, again and again, that trump not only wanted an outcome but was deeply engrossed in trying to see that outcome become a reality, just the degree to which he allegedly was involved in orchestrating this alleged coverup i think is very much in keeping with how he ran his white house in frankly how he ran his businesses and his personal media profile in the years before he entered politics. Phil, no surprise, trumps been on the attack today, thats how he rolls. But what is his inner circle saying this behind the scenes about this case . Phil . Oh, thats for me, im sorry. The Trump Campaign is trying to politicize this moment, and theyre trying to use it as further leverage in this republican campaign, but his lawyers and spokesman, and even the former president himself, have publicly said that they fully expect to see more charges on january 6th investigation to come and that they realize this is not necessarily the end of what the government may bring, on the classified documents case. Theyre just trying to show that with every Additional Charge its a sign of some kind of witch hunt or an effort, rather, to get him to prosecute him because he is leading the pack in a republican primary. They believe, i think politically that works to his advantage among Republican Voters, because it shows hes a target and he gives the Republican Base voters something to rally around. Glenn, maybe you could decode this for us. I want to share what one fox news host said earlier today about the charges and his codefendants. Why are they going after these guys that, their boss might have said were not gonna hand over the video, or whatever, and they just did with the boss said . These guys just worked for him. You feel sorry for them. Now theyre trying to charge these guys. Will they flip on donald trump . They just did what the boss said. Whats reaction to that . Well, my reaction is, history. People doing the allegedly illegal building of a boss or a leader have committed crimes, period. And if you stop Holding People accountable for criminality, regardless of who told them to do it, one can almost argue, its worse if youre doing something that you know was wrong just because someone told you to do it. That said, whats interesting about this dynamic, as mary has said, and ty cobb said very colourfully, is that this was a really strong case before yesterday. It is a much stronger case today. Its really all you defended other than donald trump, any other circumstances, we would be talking about a plea deal being negotiated. This is from conversations with former prosecutors and also defense attorneys. He is in a very difficult position. He has said categorically he will not negotiate a plea deal. It is the centerpiece of his political campaign. Grievance in vengeance. So he is literally a brick wall when it comes to a plea agreement. The other two folks, walt nauta and mr. De oliveira are not in the same position. Walt nauta is closer to him, has a tighter relationship with trump, and would be presumably less likely to flip. But the new defendant, the third defendant, is not as close to trump. Hes an older guy. He somebody who has been working at this place, in maralago, for a long time. The question is, he clearly has had interactions with prosecutors. He has been given an opportunity to tell the truth. The accusation is that he hasnt. So that, to me, in addition to the issues involving Presentation Evidence and what it might have to do in terms of the trial date, i think thats going to be an active space in terms of looking at whether or not he continues to be a defendant or if he himself engages in a pre Plea Arrangement that could be detrimental to the former president. Glenn, do you see these two guys, these codefendants, as potentially being the key to what happens to trump next in this case . It always is. This is the way it works in all of these cases. Yes, i certainly do. And the other thing i think that is very important to understand is this is an ongoing investigation. I have heard from former doj folks opine that if you add more complexity to the case youre only going to delay the case. But as this rolls along, they are accumulating more and more evidence. We havent even started, by the way, on the january six stuff, but i foresee, from talking to folks who are in this general space, that were going to see perhaps not another defendant, but were gonna see more evidence produced, and were going to get more clarity in filings as it comes along. I dont think this is the last two to drop. Mary, this case also raises a ton of questions about attorney conflict of interest, what problems do you see there . So, it has been widely reported that mr. Trumps pack is paying the legal bills for mr. Nautas attorney, now mr. The olivia recess tierney, and in fact for the attorneys of many people who are in trumps orbit. That, it is not unethical, or unlawful for a third party to pay legal fees for someone, in Fact Corporation to that frequently, if their employees are subject to investigation and their employees cant really foot the legal bills, that would be required to defend, and the lawyers, they have their own ethical obligations that they are mandated by their bar license to comply, with which is that their obligation is to zealously represent their clients. That means the person they are representing not whoever it is that is paying for them. That is what the rules are. The reality is, somebody like mr. Nauta or may feel very very indebted to donald trump, partly because he has given them a job for many years, and partly because he is paying for their attorney fees. So regardless of how the attorney responds to this, the attorney as well may feel some obligation towards the Trump Campaign. These are the kinds of things that can really infect these relationships, and we saw that with cassidy hutchinson, who was being paid, having heard legal fees be paid, and an attorney supplied for her. So there are a couple things that need to happen, here it needs to be clear that the person who is having that attorney supplied for them is choosing their own counsel, they are comfortable with their council, they are not just taken whoever is given to them. It is something if i were jacques, mitt and i were worried about, it i would consider at least raising with the court that the courts have an inquiry of mr. De oliveira and mr. Nauta to understand they understand their rights, and make sure they are comfortable with these attorneys so we dont run into some problems down the road. But this is not his party, and he does not belong in this, race and for will hurd, and Chris Christie, you have your own Journey Towards personal acceptance that there is not a rule for you on this party, i do think it is curious though as will hurd and Chris Christie, maybe a bit of asa hutchins and continue to prosecute this case against donald trump from within the Republican Party, i think the more effective thing would be to prosecute the others in the race, for their inconsistencies around donald trump, because ultimately what you are able to, do is show the fragility of the entire field, if the goal of republicans to be joe, biden you have a bunch of candidates in waiting trying to go up against the incumbent president , what will hurd said the truth tonight, this is the wrong room, the wrong race, he really doesnt belong in this race for the republican nomination. Okay, but, david that is the thing i really dont, get right all of these republican nominees, nate would like the nomination. The clear front runner by a mile is donald trump. So if the majority of the unwilling to go after him, what is the point of them running at all . They are on an ego, i think where will hurd and Chris Christie can go with, this mike hurting Chris Christie in one desantis and other ones would be the first one to say he would be bus cute if they thought that would help him get to the white house. The everyone else is that because the politics of the Republican Party continue to support and insurrectionist that is donald trump, the president is likely to be indicted, again theyre willing to go along with, this so the lack of leadership in the entire republican field is the case that should be prosecuted, everybody but donald trump is in the race to do their own vanity ego and ambition, which exist in all industries including, politics but when youre asking to hold the public, trust these people who lack the ability to hold public trust need to be called to account. I think what will hurd did is not going to get him, votes because the people are with former president trump, right now the bases with former president trump. And so you have to differentiate in a way that does not attack the president , which people like, mud shows them a different path. Okay, but the thing is, they are not even going after one another, which is what david suggested, ron desantis ray, he is running in the republican primary, tim scott who is also running in the republican primary, has been criticizing desantis for his florida education policy. What does desantis . New does he take a swing back at him scott . No. Heat it goes after kamala harris, how does that strategy work . Well it shows you who they are really scared, of and concerned about. I watched a number of those speeches tonight from the lincoln dinner, and a lot of folks on that stage mentioned the Vice President. I think, frankly you know, tim scott did barely strong words for one desantis, and his policy, i think that they could have been and should have been stronger, this comes on the trail, but everything that all the people in they are going to have to get support on the debate stage. You hit back that on the first debate, i do believe fox news whatever folks was moderating that debate, they are going to come with questions, and the questions are going to be based on all the things they, said things that are happening in their state, news of the, day and ron desantis policy is essentially doing what he, says he does to have and doctrine aiding them with lies about our nations history, it is definitely going to be on the table. They are also out, there these candidates, shaking, hands kissing babies, one desantis is currently on a bus tour of iowa, and i want to share an interaction he had with a child who is at the state fair. I also think in addition to fitness, capacity, and judgment, important to consider whether or not a legislator, or president ideology, is contemporary with the times.
