President biden will actually sign three Executive Orders to undo President Trumps harsh Immigration Policies including those separated from their families at the border. Well talk to a Biden Administration official about that. And House Republican leader Kevin Mccarthy just finished speaking in texas. He didnt get any questions about what he will do with congresswoman Marjorie Taylor greene and her inflammatory statements as Pressure Mounts for Mitch Mcconnell. Well get reaction. We have a lot to unpack. Joining to us start off our coverage, cara lee is covering the white house for us. And Jonathan Swan is here as well. Great to have both of you. So lets get right to it. Run us through the key arguments made by the House Impeachment Managers and the president s legal team. Sure. Well, on the house Impeachment Manager Side of this, you have them making the argument that the president has singular responsibility for inciting this riot on january 6th in the capitol. They say he has the unique ability to provoke and quell violence saying he is uniquely suited to do that and could have tamped it down if he wanted to. And they noticed that both parties urged the president to intervene privately and publicly. Now for the Trump Legal Team side of things, they are answering this charge from the house that he reiterated false claims of Election Fraud. That that was part of what drove this. And theyre saying that is actually not factually correct. So there is a little holding on to that argument that the former President Trump had been making for all those weeks since the election. That this election was stolen from him which wasnt. They also go on to make an argument that he had freedom of speech privileges, and that what he was saying, what he was exercising his freedom of speech rights, and also that the senate lacks jurisdiction over this because he is no longer holding elected office. So making that constitutional argument that weve heard so many former president s allies make. Lets go back, they arent saying that it was stolen from him by widespread fraud but more that he believed he won. And in your extraordinary reporting, on what you call the craziest meeting of the trump presidency, reading it, thats truth in advertising. I mean, that is a key takeaway. That trump seemed to truly believe the election was stolen. But also, jonathan, he was desperate to find a way out of the loss, right . Yes. He was absolutely desperate. And he pushed his advisers so far that, what weve recorded, it almost resulted in a fist fight in the oval office with general flynn on his feet yelling at trumps lawyers. There was a lot of yelling and screaming. And it was four hours long . A couple different locations . Yes, yeah. The attempted Military Coup migrated its way to the president s personal residence, his living room, where the former ceo of overstock. Com was Wolfing Down Pigs in a blanket and little meatballs on tooth picks while he was trying to tell the president how to subvert democracy. It was quite a collection of characters. But to what carol was talking about before, there is been a really tense fight behind the scenes with trumps legal team over the language here. Trump still hasnt let this go. He was insist tent upon them arguing that there was Election Fraud. And his initial team. Lawyers did not want to do that. Their view was, this is crazy. We should make a procedural argument. And do you really want to be in court actually, sorry, not in court but you know, putting evidence forward having to prove the baseless claims of fraud . I dont think that has gone so well so far. They havent got a particularly good track record with these cases so far. So that actually was part of the reason that they quit, his first team. They have this quick Replacement Team of lawyers to do the impeachment. When you know what you know, and again, if people havent read this in axios, it goes down to who sat where in what color chair. This is a deeply reported story. What is your key takeaway as you look at the arguments on both sides with the upcoming Impeachment Trial, jonathan . I think both sides know very well that the arguments almost dont matter at this point. The sense i have from my reporting is that almost without, unless trump wheels in rudy giuliani, i dont know what else he could really do. One thing i picked up from some people who were involved in the first impeachment of trump, while theyre not happy hes been shut down on twitter, from the legal vantage point, thats quite helpful. One of the big things they were worried about in the first Impeachment Trial was trump live tweeting which was providing new exhibits of evidence in realtime. That is obviously not going to happen this time. I dont think anyone believes there are 17 republican senators willing to convict. So it becomes from the Trump Defense point of view, thats why you see these selfindulgence arguments about Election Fraud. Theyre not designed as anything to do with the case. Theyre really just appeasing Donald Trumps ego. Well, there is been a lot of appeasement going on for four years now. These come as politico reports on an election post mortem produced by Donald Trumps main pollster. It says the former president suffered from Voter Perception that he wasnt homicide or trust worthy, and that he was crushed by his dishamming of the coronavirus pandemic. The report notes that he was done in by hemorrhaging support from white voters. I mean, it is hard not to look at those cold hard facts and not see some recognition from what were hearing out of Mitch Mcconnell these past 24 hours, right . Yeah, look. The interesting thing about this is that when you look back a year ago, when the coronavirus pandemic first hit and became a big issue, people around the president , his political advisers at the time said that will be the issue on which he is elected. And there were all these efforts, if youre looking at the post mortem effort, all these efforts by people around the president to get him to take it more seriously. To get him to engage in ways that gave assurance to the public that he was on top of this. He kept showing up at the Coronavirus Briefings at the podium and undermining his own argument, his own stature in terms of his handling of the crisis. That continued to feed. And clearly from this post mortem, it was something in the end that they were right from the beginning that it would wind up doing him in. As the election went on, he started dabbling in this idea that there would be fraud in the election. Putting out all these various theories that left people scratching their heads. And it shows that he lost some of his core base of support, what put him over the top in 2016. Carol lee, with the beautiful snow flakes swirling behind her at the white house. And this was the moment where i thought everything was over. I just i mean, i thought i was going to die. When ocasiocortez came out of bathroom, there was a Capitol Police officer there. She and her legislative director ended up barricading. They in the office. Staff members pushed furniture against the doors. She said im looking for where im going to hide. I said dont worry, im a mom, im calm. I have everything here we need. She said i hope i get to be a mom. I hope i dont die today. Describing the impact of the riots, revealing for the first time that shes been a victim of sexual assault. These are the same tactics of abusers. And im a survivor of sexual assault. And i havent told many people that in my life. But when we go through trauma, trauma compounds on each other. And joining us now, democratic congresswoman jackie spear of california. Thank you for being with us. Its well known that you know about trauma, surviving an Assassination Attempt back in 1978 at jonestown. Your boss did not survive. What are your thoughts when you hear what your colleague had to say, her revelations about the siege and what it triggered in her in. Well, alexandrias description is not unlike, i think, a number of members who were caught in that. I mean, there were 30 of us in the gallery when the pounding started on the doors of the chamber. And then a shot rang out. And i was thrown back in time to 1978 when i was lying on that air strip. And shooters came and shot us at point blank range. Her description is painful and i think it is important for the American People to appreciate how painful it was for her and many others as they had to try and survive what they thought was probably the ends of their lives. When you said you went back tom day, in 1978, was it total fear . And do you agree that there is no healing without accountability . Well, first of all, i was on that Gallery Floor and told to lie down on there. And then i heard the shot ring out. Of course, it took me back in time and i remember lying my cheek on the cold marble floor and thinking, can this be happening . Am i going to die in my own country in this Sacred Temple of democracy when i survived in the jungles of guyana . So i agree that accountability has to be part of this. I cant imagine we would allow those who committed trespass, who came into the capitol, who violated the law, that somehow they should go free because the courts may be overburdened. This was a direct hit on the democracy of this country. This was an attempt to overthrow the government. To render the vote null and void so donald trump could continue as president of the United States. This was no different than the coup that was attempted successfully in myanmar. I think there has to be accountability. And i must tell you im sorry, i was going to say that leads us to impeachment. And i know you just heard this. Trumps lawyers say you cant impeach a former president anyway. And by the way, trump believed he won and therefore, it was his right to express his belief that the Election Results were suspect. Youre a lawyer. What do you make of that argument in. Well, first of all, he was impeached while he was in office. It is the trial which is taking place now. And just because he is no longer in office is irrelevant because the impeachment occurred. The trial must go on. And he must be held accountable. Now, for those who say he was basically expressing his First Amendment rights, you cannot call out fire in a crowded theater. And here he was calling out Tens Of Thousands of people to go to the capitol and to fight and to not be weak and to take back our country. So those were words like fire is prohibited in a theater. He was prohibited from calling on these individuals who are white supremacists, anarchists and antisemites to go to the capitol and overthrow the country. Thats what he was asking them to do. Before you go, i have to ask but the letter you wrote to President Biden asking he issue an Executive Order to ensure u. S. Military screens troops Social Media Lengths for extreme. I groups, any links to extreme. I groups. You point out that these groups like to target members of the military. Help us understand how big a problem this is and what specifically needs to be done about it . So first of all, we dont know how large it is. We have incidents that have taken place, many of them in 2020. Where Service Members shot and killed federal officers and local sheriffs, one of whom was a member of the boogaloo boys. There is a 2017 report that says that 73 of all the lethal Extremist Activity have happened in this country by the far right. So it is time for us to open our eyes and recognize what is going on. The fact that we do not look at social media of potential recruits into the Military Flab Flabber gasts me. That we do not have as part of the intensive review that takes place for security clearances, they do not look at social media but they will ask you questions like, have you ever had a Mental Health episode, have you ever had a financial exposure to a certain problem. I mean, its a very invasive review and yet they dont look at social media. So i believe the president needs to act and i believe the secretary of defense needs to act. They both have the authority. One through Executive Order and one through regulations to make sure that social media becomes part of the review. Private Sector Companies do it all the time. For families who have lost loved ones to the pandemic, that is a loss that they will continue to suffer for the rest of their lives. That that, i think weve already seen some very concrete changes here. The announcement of three times a week, monday, wednesday, friday briefings by scientists, not politicians, so dr. Welinski, dr. Anthony fauci, the doctor from Infectious Diseases. Those things messaging the science first and foremost to the public. I think it is a very, very concrete change. We are also seeing the cdc Ramp Up Genomic surveillance which helps us detect the new variants that are emerging from different parts of the world that we have here in the u. S. So whether it is on the science or the communication fronts. I think were seeing very tangible shifts here. We talk about those variants and weve seen them in people in maryland. The case that they had with the South African strain of it. That was a person who hadnt traveled. That suggests theres already some community spread. We spend so much time and attention now and understandably so. Is that an indication about expanding mass testing and keeping track of that. We absolutely need to use all the tools at our disposal and that includes accelerating vaccinations. It also means we need to double down on mask, on social distancing. We need to be doing mass testing, especially in places like schools where that would allow schools to reopen safely. Weve seam it has been done where the resources have been done in reopening schools. So we really are in a situation where with the rise of these variants, some of which are more contagious, some appear to be more deadly, and some may be, the vaccines we have may be somewhat less protective against them. The news comes as hundreds of immigrants have been deported under the Biden Administration so far. Despite his Campaign Pledge to stop removing those people in the u. S. Illegally at the beginning of his term. Joining us now, it is good to see you. I want to start with what the president is about to do. Look, i think a lot of the supporters of the president had the expectation that he was going to start quickly to undo some of the things that were done by the Trump Administration. These new Executive Orders though review but dont necessarily immediate reverse those orders. So what do they accomplish . Look, weve said from the beginning that changing things was going to take a little time. So we are working around all the agencies to make sure that we are reviewing the different policies, and that the things that can be done to make sure that we are reuniting our kids with their parents, to make sure that we are evaluating our policies, to make sure that we are working with our partners in Central America to discuss the root causes of migration are happening. Unfortunately what the Trump Administration did is very extensive and it will take a bit of time. We are taking action to make sure that we can take care of people and reform our Immigration System in the way that we said we would from day one. So lets talk about a specific thing thats causing some controversy about those families separated. But reunited outside the United States. They cannot return to the u. S. Under this new task force. And i want to play what lee geller from the aclu said about that on msnbc. That would be troubling to us. I think anybody that was subjected to this barbaric policy nodes to be given relief. It is one thing to stage things with people needing the most immediate relief. Families subjected to this policy are not allowed to come back to the United States, that would be deeply troubling to us. Well have to wait and see. We would push very hard on that. The United States government owes them a safe place to live and restitution. The argument as you know is that many of these families, even though they may be reunited, are waiting in dangerous, squall i had conditions. Does the u. S. Government owe these families for what was done to them . This is exactly why were putting together a task force to make sure that one, we can find the kids that were separated from their parents. There are many that we dont even know exist. So we need to figure out who these kids are. What about the families that are reunited . In order to do so, we need to make sure that we have agency representatives, and that we bring these folks together, we talk to the families that have already been reunited and to the stake holders to make sure were doing this, but the ability to address these are there. I think youve seen from President Biden from day one that hes taken action in ways he promised in the campaign, on daca, on ending the muslim ban, and this continues that same promise. It is also not the last thing youll see from this administration on immigration and you will see more down the road. But this fulfills a lot of the things we said we would do from the beginning. In terms of those families who have been reunited, waiting in potentially dangerous conditions, or in dangerous conditions, is a safe place to live back in the United States, is restitution on the table . We want to make sure that we address the harms that were done to these families. And this is why this task force will be working on the recommendations available about what are the things that we can do. We expect them to give often their report back to the president in order for us to make those determinations, and to work across agencies throughout the entire government to figure out what that looks lying. I want to give you a chance to answer to critics who say great, hes signing these Executive Orders but none of this Mat Ferries Mass Deportations are still happening. What do you say to them . We made a commitment to stop deportations the first 100 days. We are seeing this is still in motion. There is a pause on that for the time being but our commitment is there. We are also trying to work with our champions in congress. We sent a bill to congress on day one, just like President Biden promised and were looked forward to working with senate and the congress to make sure we can pass a bill that restores immigration to a place of human an, decency, justice and also the border. If i recall correctly, you worked for the campaign on bringing coalitions together. It will take one heck of a coalition to do what has been tried and failed for a long time, which is get immigration reform. We appreciate your time. Thank you. Now to what Senate Minority leader Mitch Mcconnell calls looney lies. Hes talking about conspiracy theorist marmingory taylor greene, putting pressure on House Minority leader Kevin Mccarthy to shut her down. And mcconnell didnt just issue that scathing statement. He followed it up with another statement of support from embattled congresswoman liz cheney who voted for impeachment. House minority leader Kevin Mccarthy has been vague at best about what hell do about it all. Joining us now, nbc news correspondent covering congress, leanne caldwell. Put this into context. That Mitch Mcconnell isnt just taking sides on this issue but an issue not even about the senate. Thats right. It is really remarkable that Mcconnell Last Night put out unsolicited statements about representative Marjorie Taylor greene, and then on the flip about representative liz cheney who is coming under fire from the more conservative faction of the republican conference because of her vote to impeach donald trump. What mcconnell is doing is he is seeing a huge vacuum in Republican Leadership with the president out of the picture. He sees that Kevin Mccarthy is really struggling to gain a grasp of his House Republican party. By giving a lot of mixed signals at best, by condemning, criticizing liz cheney, and staying completely silent about Marjorie Taylor greene. Mcconnell says that he was asked about it today and he said two things. The first is that he decided to put out those statements because he wanted a say in the future of the Republican Party. But then he was asked if he should have spoken up sooner about the claim of Election Fraud being put out by the president. And listen to what emto say. Sa. You spoke out about Donald Trumps conspiracy about the election being stolen much earlier than you ultimately did. With regard with the former president , were going into an Impeachment Trial next week. Well listen to what all the lawyers have to say with the arguments and work our way through it. Reporter mcconnell didnt take a lot of personal responsibility there but he does have a very different tone on impeachment than during the last impeachment saying once again that hes going to listen to the arguments and hes not ruled out convicting donald trump, chris .
