In the last several months, the investigative committees in the house have been engaged in an impeachment inquiry for Donald Trumps efforts to solicit foreign interference in our elections. Throughout this inquiry he has attempted to conceal the evidence from congress and from the American People. Our president holds the ultimate public trust, when he betrays that trust and puts himself before country, he endangers the constitution, he endangers our democracy, and our National Security. The framers of the constitution prescribed a clear remedy for president s that so violate their oath of office. That is the power of impeachment. Today in service to our duty to the constitution and to the country, the House Committee on the judiciary is introducing two articles of impeachment charges the president of the United States donk j. Trurp with competing high cries and misdemeano misdemeanors. The first is for abuse of office. Obtaining a profit while ignoring or injuring the national interest. That is exactly what President Trump can did when he solicited and pressured ukraine. Thus damming our National Security and undermining the integrity of the next election, and violating his oes to the American People. These actions more over are county with these, and when he was caught, when the thousands investigated and opened an impeachment inquiry he engaged in unprecedented, indiscriminant compliant. Here, too, we see a familiar pattern in President Trumps misconduct. He declares himself above accountability, above the American People, and it is meant to protect threats to our democratic institutions, a president that sees himself as above the law, we must be clear that no one, not even the president , is above the law. Elections are the corner stone of it democracy and foundational to the rule of law, but the next election is at risk from a president that already sought interference. And who consistently puts himself above the country. That is why we must act now. I want to turn now to chairman schiff who explained the evidence that supports these articles and the need to act with such urgency today. Thank you mr. Chairman. The framers of the constitution recognized that some day a president might come to office that would abuse that office, betray the public trust, and undermine National Security. And would seek denial of the power of congress. It is an extraordinary remedy and one that i have been reluctant to recommend until he left us no alternative. We stand here today because the president s continuing abuse of power left us no choice. To do nothing would make us come police sis in the president s abuse of his high office, the public trust, and our National Security. Soliciting a foreign nation, ukraine, to announce investigations into his opponent and a baseless theory promoted by russia to help his campaign. He abused his office by holding aid that a country needed, and he under mined our National Security and jeopardized the integrity of our next election and he does so still. The evidence of the president s misconduct is overwhelming and uncontested. It could not be ignored when he said i would like you to do us a favor, though. And when the president got caught, he committed his second impeachable act. Obstruction of congress, the ability to make sure that no one is above the law, not even the president of the United States. The evidence is every bit as strong that President Trump has obstructed congress fully, without press secedent, basis, law. Leaving this president and those who followed to be free to be as corrupt, mall malfeasant. Some say why dont you just wait. Why dont you just wait until you get the witnesses that the white house refuses to produce. Why not just wait until you get the documents that the white house refuses to turn over, and people should understand what that argument really means. It has taken us eight months to get a Lower Court Ruling that don mcgann has no right to defy congress if it takes another eight months to get a second court or Supreme Court decision, that is not the end of the process. The president and his men say you cant keep it and americans should just get over it. Americans dont get to decide american elections any more, not by themselves, not without foreign help. For the members of congress, this is not a question of fact because the facts are not seriously contested. It is rather a question of duty. The president s oath of Office Appears to mean very little to him but the articles today show that we will defend the constitution and that our oath means something to us. Thank you, mr. Chairman. Does the senate trial bring in mueller and mcgann, does the scope widen in any way . Possibly we need to see how the articles are actually written. On my point earlier what does that mean . Imagine in a federal criminal trial you have an indictment and articles of impeachment are an indictment, and it would list the thing that we think you did, and then it would describe how you did, or how we allege you did whatever crime youre charged with. The devil is in those details, it is not enough to say that the president obstructed congress or abused his power. They need to detail how they did those things and they need to prove what they detailed. We have to read the articles of impeachment, precisely what the house is alleged that the president did in all of its detail, and at the senate trial i mag the hou imagine they wi keep their allegations. Thats how you prove a case in court and thats how they will prove their case in the United States. Which is the stronger article here . Well, you could have rolled all of this into one article or abuse of power because if you look at it, there is a con t continuation. I dont think anyone can deny the facts that the white house and this president have blown off congressional subpoenas, there is no dispute over that, the dispute is whether or not he is justified and has the authority or not to do so. That is a compelling article. Im struck by the number of times references were made to National Security, i lost count when we got into the double digit references. Theyre painting a picture of the president as a National Security threat, the other thing they painted in terms of the second article of obstruction, is that she a threat to our democracy, constitution, and specifically theyre referring to our three equal branchs of government that are really disappears before our heidi, yo in evidence. In the abuse of power charge democratic lawyers i spoke to believe that the best evidence is the public evidence and you saw nadler and schiff point that out. We have clips of the president himself on the south lawn calling for not only ukraine, but the chinese to get involved in our elections. We have the call transcript, we have mulvaney saying get over it, so a lot of the abuse of power evidence will be presented in terms of the public evidence that is already out there. Lawyers tell me among all of the charges, blanket obstruction of charges in congress, and they have something special, the early october letter that announced to congress that they would not only be cooperating with any of this investigation, but that the investigation was constitutionally invalid. And that completely flies in the face of the law and the facts. And that it is a slam dunk and the facts that no one in the white house or in this administration, who directly in trumps inner circle who is alleged and is cooperating. A slam dunk, claire, is it because half of the country is watching a different flavor of news that is telling the exact opposite . Take a to missouri, do people there think it is a slam dunk . I dont think any republicans should be looking for that and looking for battle, and i dont think anyone shouldtriumph. This is a bad day. What p is your expectation for how the process moves forward . Professional, fair, and consistent with your oath. Thats all you can do. We should all remember our moms advice, just do the right thing. Sometimes you just have to do what is right. And what were going to do that is right is were going to move this case over to the senate . A way that is thorough and compelling in terms of the facts and the evidence. I think in many way its is a model of how to do something in an expeditious way that has clear and convincing evidence, we have done this without the cooperation of the white house. We had an unprepared and that is the important standard. Can we put it before the American People. You talk about this like it is an open and shut case. That being the case, why havent we seen more of the public get on board with your decision to impeach pmt. I represent a district that the president won. Im not naive about the difficulty in persuading americans that are skeptical, listening to your competitors at fox news spin a very competitive narrative, but i do distinguish that project from doing what is right. For us watching it seems like more. Im not surprised because they leaked last night that is where theyre going to go. I do think it is generally surprising to leave out all of the material from the Mueller Report volume two of which was focused not on obstruction of congress but general obstruction of justice, and i think there is something odd about investigating you crepe, but not an attempt to stop bob mueller from investigating the matter. I think theyre doing this because there are not enough democrats to snaer easy pass of of the mueller stuff that makes some democrats from swing states uncurrent. I think that is peculiar about what congress is willing to go nuclear over. They are willing to go nuclear over the investigations but not the integrity of criminal investigations. Is it possible to not go into the Mueller Report. It appears they will at least try to avoid it because it did not resonate with much of ameri america. And i think it will be by reference. And you talked about a pattern of con duck. A pattern of obstruction that predates the obstruction of congress and thats where well see it resurface, but not in a way that can be attacked and well look atle mueller debate again. Lets talk about the upcoming trial. How big of a wild car is chief justice roberts. The rulings, in other words what is admissible and what is not, the senate will hold the ultimate power, stephanie. They can vote to override a decision by the chief justice as he is adjudicating the trail in the senate. And the chief the is there to make sure the that rules agreed on are followed. The role of the chief justice in the senate are quite unlike the role of a federal judge provip d precried presiding over a case. It is not something that with we have not seen before. We saw there was a great deal of consensus between the democrats and the republicans about how to proceed. So this is something new territo territory. Im not exactly sure that that is likely. I think it is likely that we will see a longer possibly negotiation period but they will be about to reach some consensus, they simply have to in order to get this behind them which quite frankly i believe the democrats and republicans will have incentive to get it done quickly. You have new information on the Mueller Report . Yeah, were seeing why r how it is included. It is because of the evidence, and democrats say in the case of ukraine, im going back to that letter, you have the president s lawyer taking pen to paper saying were going to obstruct. Theyre still adjudicating whether or not don mcgann, the star witness, if he will testify or not. They dont want any doubts here about republicans taking the argument down a rabbit hole about the Mueller Report. Like chuck says, this is not a regular trial, this is making a case to the people. They want to have a very clear cut case and you saw in the document that was released by the Judiciary Committee, a lot of quotes from the founders that they feared a return of a king president who specifically betrays our president to foreign powers, they want to keep the public focused on that and not a rabbit hole over the Mueller Report and whether or not they can get the start witness to testify or not. And you have written that the fight overevidence seconddegree a huge part of the senate trial. Does that mean the stone walling for the white house is going to come to an end . It doesnt necessarily mean that. I agree with everything that has been said before about about what happens if people can come to an grumt about the rules of the trooifl, but theial, but th default set of rules, and this is the ground rules unless they can come to another set of agreements. And under those rules both sides get to present their witnesses unless the 51 members of the senate vote to prevent it. And that means that actually while a lot of power is about Mitch Mcconnell if he can hold his caucus together, if he can not, you could imagine the senate forcing a bunch of people to testify who the house has not been able to get to testify. And by that i mean mick mulvaney, john bolton, rudy giuliani, charles kupperman. So i actually think the parameters of a senate trial are very murky at this point and they will really depend on the question of who can count to 51, the republicans to stop things from happening, or maybe to change the subject to be about burisma and joe biden, or for the democrats to present the fullest possible version of the story that they have just passed in these or proposed to tell in these articles of impeachment that theyve unveiled. Claire, if youre President Trump, Mitch Mcconnell is going to be running the show in the senate. Wouldnt you want, if there was no wrongdoing, mick mulvaney, rick perry and your boys to testify and tell a side of the story that would look good for you . But im not sure they can. What does that say . That says the reason that they are blocking the testimony of all of these witnesses is because they dont have good news for the president. And i think the important thing to remember here, and to bens point about how this is going to come down, if the republicans decide they dont want to hear from certain witnesses, then whats going to happen is theyre going to try to block those witnesses from testifying. And then there will be a vote. And thats where Mitch Mcconnell gets in trouble with his members that have tough elections. Because do you think Susan Collins wants to vote to not let someone testify . Do you think she wants to vote to keep witnesses from saying what they know about this important event in our nations history . So what youre going to have to do if youre Mitch Mcconnell is figure out a way to avoid these 51 margin votes that are going to look like youre trying to shut down the process just like the president has tried to shut it down over the last months. And chuck rosenberg, can the president do that . Once we get to the senate trial, does the president have grounds to continue to block people and information . Well, stephanie, he can continue to litigate, and even if we think that what hes doing is frivolous, the courts of the United States as we know are not moving as swiftly as we would like. So yeah, in a sense he can continue to block through the courts and politically, because the republicans control the senate. Can i just add one point . Please. I think something said earlier today was really important. All of us have been following this very closely. Its our job to do so. In a regular criminal case the jurors walk in off the street and they know nothing about what you have been investigating for the last year or so. The public will serve that role. They know virtually nothing about the things weve been discussing on this show or others for the last year or two. So the way the case is presented by the house managers to the senate and to the public, to barretts point, is absolutely crucial. If you try and prove too much it gets confusing. If you leave out too much then the case seems empty. Its a really important and difficult line to walk. I know barrett has done it as a prosecutor, ive tried to do it, too. But that presentation not just to the senate, but to the american public, has to be crisp and clear and you have to walk the line between too little and too much. Frank . Yeah, i think weve just illustrated why the house is keeping this so simple. Because theyre going to go with the witnesses that have already voluntarily come forward. Theyre not going to engage in a long, protracted battle about executive privilege or attorneyclient privilege. Theyre going to say weve got the evidence, its a limited number of witnesses, here they are. And theyre going to stay away from what could be a protracted mess with the white house and senate battling over witness selection. Claire, you were in one of those seats not long ago. The evidence might be clear, but how difficult will this be for democrats to stick the landing . I dont think its going to be theyve shown good discipline so far. I think adam schiff by the way, the last impeachment trial that happened in the senate, i was the judge, along with orin hatch as my partner, and we had the hearing in committee in instead of in front of the full senate.
