The Montana Supreme Court has overturned a man’s conviction for raping a 16-year-old girl in Great Falls, dismissing the case against him.
On January 9, 2019, a jury found Malcolm Joseph Newrobe, Sr., 57, guilty of sexual intercourse without consent (the Montana statute for rape) and bail jumping.
Deliberation took 30 minutes.
It was Newrobe’s second trial. The first, on Dec. 10, 2018, was nearly over when a question arose over whether the charge of incest applied to Newrobe’s relationship with the girl.
