The plaintiff, a 29-year-old newly married man employed by a hazardous materials abatement contractor, suffered catastrophic spinal injuries when a large overhead tree limb fell on him at a job site. The limb fell as a result of being struck by heavy equipment operated by an employee of the defendant.
