NO LONGER A STATE PRISON INMATE. >> IT IS TERRIFYING TO BE HONEST. >> THE SAME JUDGE WHO CONVICTED HIM OF KIDNAPPING AND ABDUCTION HAS RULED THAT HIS CONSTITUTIONAL RIGHTS WERE VIOLATED AT TRIAL BECAUSE HE HAD INEFFECTIVE COUNSEL. THE JUDGE ORDERED A NEW TRIAL AND RELEASED HIM FROM PRISON, THAT DECISION NOT SITTING WELL WITH NEIGHBORS WHO LIVE ON BLANCHESTER CENTRAL AVENUE AS HE STILL OWNS THIS HOME. >> MY CONCERN IS THE PEOPLE WHO LIVE HERE AND THE KIDS WHO RUN ON THE STREET, THEY PLAY, THEY ARE ALWAYS OUTSIDE. >> THERE ARE AT LEAST 15 KIDS A DAY ON THE STREET. >> THIS IS VIDEO FROM HIS ARREST IN APRIL OF 2017. INVESTIGATORS SAY HE KIDNAPPED HIS NEIGHBOR JENNIFER ELLIOTT AND HELD HER CAPTIVE IN A PIT INSIDE A SHED IN HIS BACKYARD. ELLIOTT TESTIFIED AGAINST HIM. >> AT TRIAL HE SAID HE PUT HER UNDER HIS SHED BECAUSE SHE ASKED HIM TO HIDE HER FROM A COLD AND A PROSTITUTION RING. >> I WAS HELPING HER AND SHE WAS TAKING ADVANTAGE OF ME. >> AFTER SERVING FOUR OF HIS SEVEN YEAR SENTENCE, HE GETS A SECOND CHANCE AT HIS DEFENSE. >> ELLIOTT’S MOTHER IS TERRIFIED. HE WILL NOT BE RETURNING TO HIS HOME, HE HAS MADE ARRANGEMENTS TO ELSEWHERE, HE IS ON GPS MONITORING AND WILL NOT BE ALLOWED TO LEAVE THE HOUSE
