Trumppence filed a lawsuit calling for an end to the counting of mailin ballots in pennsylvania. North carolina meanwhile as one of several states where trumppence claimed victory but the results are still too close to call and mail in ballots postmarked by election day are accepted until november the 12th. Georgia now and no results from georgia either. Donald trumps initial lead has been steadily falling. Most remaining votes are from atlanta and it suburbs, which lean democratic. Of the five remaining states, biden would only need to cling onto nevada to claim victory. Nevada as six Electoral College votes, which will take a biden to 270. He is not leading in nevada with 80 sick 86 of votes tallied so far. This is the state of the races right now. And they say they did not have adequate access. The attorney general of michigan said they did have adequate access and had to pull observers in detroit. Some of them today were so disruptive the police were called in. Ultimately with 97 of the vote in and counted, joe biden is 1. 2 Percentage Points ahead, a significant amount and it is more than 60,000 votes. How significant is that . In 2016 Hillary Clinton lost by 10,000 votes. At this is more than six times that. She did not challenge the election but the green party did. At the state of michigan said she did not have standing to carry out that challenge. It would be an uphill battle for the president to do that. He started in 2016 saying he was going to build a wall but it looks like it is joe biden building that blue wall of democratic states back one state at a Time Starting in wisconsin and michigan and hopes to edit pennsylvania to that still. We heard joe biden calling for everyone to be patient, calling for calm but republicans are anything but calm. Now that we have abiding in the lead, is the democratic cant dashcam going to be changing its strategy . Reporter the Biden Campaign and democrats throughout these contests and states have been actively opposing republican legal actions. Normally it has been on a state basis, county basis, but democratic representatives have been actively opposing a number of these republican legal moves. A number of judges in a number of cases have already thrown out republican request. In one example, clark county, nevada, there the Republican Campaign brought an injunction to stop counting of votes. At the judge and county throughout the construction, quoting the Supreme Court instruction that in nevada votes can be counted up until november the 10th if they are postmarked on or before november the third. Results have to be released by november the 16th. There are legal processes being countered by democrats and individual democratic committees a particular areas. The 12 campaign as threatened to take this to the Supreme Court. That is a difficult process and not one that happens automatically. In the bush v gore case in 2000, that took weeks before the Supreme Court took out that gays and that only followed legal action case and that only followed legal action in florida. This does not happen automatically. There was one final point critical to all of this. Courts rely heavily on what is called the reliance interest. That is a legal term which assumes voters for example who have followed instructions they believed to be lawfully given are protected. The Supreme Court and particular as referred to this a number of times and it certainly does protect the reliance interest as a very important factor. As long as the voter operated in a way that they believed to be legal and that they were advised to operate in that way upon a legal basis. The Trump Campaign facing an uphill struggle to try to invoke the Supreme Court but also an uphill struggle to persuade individual judges or courts in individual areas to take up their cases. It is a strong struggle but the democrats are countering at every turn and it would appear joe biden as taken a position that he is not going to get involved in the legal minutia. Biden clipped at the state by 20,000 votes. He edged ahead of trump as absentee ballots were counted in the cities of milwaukee, green bay, and kenosha. In 2016, trump won wisconsins electoral votes by 20,000 votes are earning in the distinction of being the first republican president ial candidate to win in the state it more than 30 years. That was clearly something democrats did not want to have a repeat of. It was a bruising loss for them. In the intervening years, they dumped a lot of money into the state. Biden campaigned heavily here. So did drug. Are we headed for a long battle . I do not think about it will be as long as it is purported to be. When you look at the last few states to come in, pennsylvania, michigan, wisconsin, the states came in the way that they did because yet to be counted vote speak came from democratic strongholds. It stands to reason joe biden would overtake work could overtake trump in those states. It is not over. It is possible though not likely joe biden could end up winning georgia, which in addition to some conversation of arizona and nevada would make this break even larger in terms of a biden victory. Host everyone of course, when we hear lawsuits and demands for a recount all that you cannot help but think about florida in 2000 and and there is a general conception the republicans out lawyer the democrats. Do you think democrats have learned from the experience of 2000 and will be more aggressive in their strategy Going Forward one of the major criticisms in 2000 is that al gore did not, quickly enough to stake a claim to the presidency and the margin of victory in 2000 was so much more than that it is now. Last night when Vice President biden came out and again today, he did two things. She sent a message to the country he would continue to proceed as if you won. At the other part of it was more so strategic and legal. He will not stand on the sidelines and let things evolve on their own as what happened in 2000. My expectation is democratic lawyers and all states in question will be very aggressive protecting his position. Host President Trump has had a pretty controversial term. All of the polls were predicting a landslide for biden, because of the coronavirus pandemic, the way the president handled the crisis but we have not seen that landslide. We have not seen that blue wave everyone talked about. Why is that . I think there was an exuberance among several people who sought the polls and thought it would be a landslide. For those of us who watch this closely knew it would be pretty close. I do not think anyone thought it would be as close as it is. I do not think studious of her observers were surprised. There was an enormous turnout in this race. It looks like there will be 25 million more votes cast in 2020 event in any previous election. When you get that kind of turnout, the polling becomes much less reliable because it is likely not capturing people that will vote on election day.
