Is she dragging her . Dorina bernstein is the students aunt. She says it happened monday at elite Public Charter School in vallejo. It was very disturbing. The man in the video is a substitute teacher. She basically has a knot on her head and shes kind of bruised up a little bit, but her neck, she keeps saying her neck hurts. She says her niece, just 13 years old, is traumatized because its like somebody youre supposed to trust. Actually throw you around like that. This is a school where youre supposed to be safe at. Thats not okay. At the end of the video, the man is seen lunging toward the camera trying to take the phone. Bernstein says it was initiated by a disagreement in which the teacher told her niece she was not supposed to be in that classroom. The school says a conflict ensued, and the substitute teacher physically removed her, the School Spokesperson saying in a statement, we are deeply troubled by the occurrence they fail to give me the teachers name and i was like, so, so baffled because how would you protect this guys innocence . And you clearly didnt protect my niece being attacked by this grown man. Bernstein says the school did not call Law Enforcement. Instead, the family had to file a report, the School Spokesperson saying following the incident, immediate, Decisive Action was taken, resulting in the prompt removal of the substitute teacher from the campus and the performance of a thorough investigation. They went on to say the sub will not be reinstated at elite Public Schools in any capacity. Vallejo police say he was arrested tuesday and the investigation is ongoing. New at six tonight, a little sparring between San Franciscos mayor and one of her rivals for office at this afternoons board of supervisors meeting, supervisor asha sapphire asked the mayor about a 3. 6 million sober Housing Project near chinatown that stalled after community pushback. Help me to understand, what role are you looking to play in this operation and how does this have anything to do with your responsibility as the district 11 supervisor . Im just interested in understand that. Well, respectfully, madam mayor, im also a citywide supervisor. We are citywide as well, and we are responsible for the charge of the entire city. So as i did with the trp site in union square, nob hill area, we were directly involved in working with adult probation, working with the nonprofit, working with the Property Owner to try to collaborate to make it happen. The Alameda CountyDistrict Attorneys office is suing several Insurance Companies, accusing them of violating state law protecting homeowners. Ktvu tom vacar has a look at the claims. District attorney price says insurers use preprogramed computer formulas that deliberately undervalue the homes they insure, and these Insurance Companies have utilized a Software Application that allows them essentially to defraud homeowners by charging them premiums for insurance that does not adequately insure her. The Software Says price lowers the initial premium cost to induce customers to buy. Consumers then believe theyre adequately insured, but in reality, says price, the software calculates excessively low replacement costs. Then, when there are major losses, such as a wildfire, the payout is inadequate to rebuild by offering these lower premiums based on inaccurate estimates, the Insurance Companies gain a competitive advantage at the expense of proper coverage. Consumer watchdog says its a direct violation of california law. Its leader, harvey rosenfield, wrote the law. So for them to turn around after the fact and say, hey, yeah, yeah, you didnt, you dont have enough coverage. And we were not going to pay the claim in its entirety. Thats an outrage. Thats why rosenfield is battling the Insurance Industry to forbid them from using new Artificial IntelligenceRating Software at the end of the day, you walk away with far less than youre entitled to under that policy. Its a massive rip off, a accomplished by technology. This is another form of software that, unfortunately, could be used to build upon the fraudulent software that we have already identified. Farmers responded saying the allegations in the complaint are simply incorrect and we do not seek to provide low replacement cost estimates. Last month, price sued auto insurers over the software they use to appraise the value of cars that have been totaled. Price alleges that insurers and Software Developers design the software to essentially undervalue the car refused to negotiate in good faith, which resulted in lower payouts. The former president did not take the stand. Foxs arthur chen was inside the courtroom and has more on why the defense team stood down after calling just two witnesses. The defense rested after calling just two witnesses to the stand and not calling donald trump to testify in his own criminal trial. The former president , ignoring questions from reporters asking why he chose not to take the stand. Mr. Trump, why wont you testify . Before the defense wrapped up their case, prosecutors continued their crossexamination of lawyer robert costello, who tried to represent Michael Cohen in 2018 as the feds were closing in. Cohen never signed a retainer or paid. Costello, concerned that costellos close ties to trump and Rudy Giuliani meant his best interests would take a back seat. Jurors listened intently today as Prosecutor Susan Hoffinger confronted costello over an email in which he wrote his mission was to quote, get cohen on the right page without giving him the appearance that we are following instructions from giuliani or the president. We have a judge thats extremely, lets say, complicated, but lets also say conflicted. Demonstrating the complexity here. While hush money payments are legal, prosecutor have to prove the cover up was to conceal or commit a second crime, in this case, election interference. Its not a simple, straightforward robbery case for example. It has nuances. It has aspects of election law. It has aspects of falsifying business records. These are the official National Weather service highs from today. And youll see we got nearly to 90 degrees in santa rosa at 89 degrees. Thats the warm spot 88 in fairfield 88 and concord highs tomorrow. Just take 5 or 6 degrees and subtract it from the. In the inland temperatures like tomorrow were in the mid and low. Low 80. It will be a really nice day. Just wont be quite as warm. And then we get a significant cool down as we go to the weekend. And its an air mass thing. Its not like a wind flow off onshore breeze, offshore breeze. Its just this big cool air mask. Its close to us. Its coming down off from the off the northern part of the of the west coast, and itll sit down and its going to get cold. But most of us are going to be like in the mid 70s right through saturday and sunday. So this is right now much warmer in napa and in santa rosa than it was last night at this time, palo alto is 13 degrees warmer. So boom, big difference. Beautiful out there. A little bit hazy as you might look out across the bay. Theres no fog. Fog will probably come back tonight and tomorrow to some extent. And then it fills in significantly towards the weekend. But the fogs fogs having a tough time existing because these this low. Thats coming in now. Thats one of the reasons for the cooling. But the High Pressure is shifted towards the west. And as it shifts out this way the High Pressure doesnt allow for the fog to form easily. You need you need High Pressure to get fog. And its there. But not not a lot. Okay. Wednesday morning, tomorrow morning theres some fog and low clouds and it burns back. Thursday morning. Nothing really in terms of fog. Thursday afternoon. And then friday comes back again. And then friday afternoon, saturday, sunday the fog stays, the clouds come in and we have that air mass swap out. So really what i just said here is its going to be more of the same. And then the weekend it cools down and youll notice the nice thing about today and tomorrow. And so in the last couple of days is the fog hasnt really been just brutal out at the beaches. So youre seeing clear skies out at ocean beach. Youre seeing. And so thats even though temperatures are on the mild side, well be on the mild side. Tomorrow at the main library on larkin street and runs until 6 p. M. All right. Coming up next in sports with jason the 49ers back on the old practice field. Were going to hear from nick bosa on why hes attending these voluntary workouts for the first time in five years. Activities this week, better known as otas, and they have quite a new. A few new faces, some of them rookies like first round draft pick ricky pearsall, the physical wide receiver out of florida, and isaac guerendo. Hes number 39 from louisville, the fastest running back in this years draft class. The niners also added a few veterans, among them back up quarterback joshua dobbs and defensive lineman leonard floyd, who had ten and a half sacks with the bills last season. Now, these are voluntary workouts, but that didnt stop veteran wideout deebo samuel from showing up as well as, you guessed it, quarterback brock purdy, who missed otas last year while he recovered from shoulder surgery. I mean, hes definitely ahead of where he was last year at this time, but i mean, it was just real cool being able to go through a whole year of cut ups just like we did last year and just starting in phase one. The command he had of going out there with the drills and everything and really trying to apply the stuff we had just been watching in the meeting rooms, that really happened all off for 2023 tape last year. He had to do it, and then it would just be frustrating for him because he couldnt really go work on it. You no longer one of the young guys. Yeah, man. Im a vet now, i dont know, man. Im still just trying to get better every day. And i still understand that theres such a long road ahead of me in terms of Getting Better and what i need to do to get better. So thats where im at. But its crazy. You got guys that are younger than me now on the team and i its just new. Its different okay. Also new and different is nick bosa participating in his first otas since his rookie season. Now hes missed the last three due to covid injuries and contract negotiations. Everythings great. Im feeling as good as ive felt. Im excited to actually get some practice in. Last year was kind of tough getting thrown in, week one after a walk through. I mean, its sweet, man. You can tell it means something to him. So for all of us to see that, its like, all right, boss is taking it serious. Then we all should. But, i mean, come on, theyre all going to take it seriously. But it is. Its nice having the veterans like nick bosa there. Not in camp Brandon Aiyuk of course. Everybody was asked about aiyuk and they all said, well, its out of my hands. But of course we want him in in town. Hes the wide receiver for the 49ers who obviously wants a new, new big contract. So hes not in camp. Its just nice to see everyone out there. Yeah, it is nice to see you and its football season. Were still three and a half months out but but you know theyre practicing. And also to see brock purdy say look, you know im not the rookie anymore. You know, i like to be the leader in that in that locker room. That was cute. Glad hes healthy. Not hurting. Healthy. Its his third season. And you know, there were a couple of people were asked like, you know, now that youve got a little bit of celebrity, anything going to change. And nick bosa talked about him and said i cant see him changing at all. Well he just is so good. He ys, i an alleged scheme in arizona designed to undermine the 2020 president ial election. And today, 11 trump allies, including Rudy Giuliani
