A little bit of congestion or i would say congestion, cloud cover coming over the bay. You see the san mateo bridge in the background. We have to continue to follow the news out of hawaii where its now been one week since the deadly fires broke out in maui. And crews are continuing to sift through the ruins of lahaina. The confirmed number of deaths has now climbed to 99. And keep in mind, hundreds of people are still unaccounted for in a city where about 12,000 people did once live. As jake kerr, alexis tells us only about 25 of the burned out area has been searched so far. A week after the deadliest wildfire in modern american history, crews are still sifting through the ruins here in maui. The confirmed number of dead climbed to 99 monday with hundreds still unaccounted for. In lahaina, a town where about 12,000 people lived before the wildfires. The numbers there are staggering. More than 2200 structures destroyed, 86 were residential, meaning thousands are now homeless. And its not clear when residents will be allowed back in. The search for victims has been complicated by the condition of the remains. Its going to take time. Its going to take a lot of time as they go through all of the territories in lahaina. They have to be very careful. As of now, only 25 of the burned out area has been searched and some residents are starting to demand answers from local officials complain about a lack of communication and basic resources to help fight the fire. Its a kind of disconcerting feeling when the fire guys show up and they dont have water. Its got to this point where its like, who are these people watching us . Do they even properly care for us . Meanwhile, much needed aid continues to pour into the area, but some residents say its not enough and they wont be able to move forward until theyre able to return to lahaina. Were just camping it out over here like just waiting for them to give us the okay to go back in and help clean up, you know, just do whatever we can. Hawaiis goveor says the goal is to have at least 90 of lahaina searched by this weekend in maui. Jake alexis, ktvu, fox two news. Im james torres, ktvu fox two news. James thank you. Donald trump is facing another criminal indictment. His fourth indictment this year. The Fulton CountyDistrict Attorney in georgia accuses trump and 18 other people of conspiracy to unlawfully change the outcome of the 2020 election to try and keep President Trump in office. The indictment alleges that rather than by abide by georgias Legal Process for election challenges, the defendants engaged in a criminal racketeering enterprise to overturn georgias president ial election result. Trump has denied wrongdoing. Joining us now for inside is david levine from the university of California College of law, San Francisco. David, thank you so much for joining us. Of course. All right. So, david, were talking about a 98 page indictment here. 41 charges, 19 people first. Id just like to get your thoughts when you when you heard the details finally come down last night. Well, im calling this one the midnight pain from georgia. Since the midnight pain from georgia, since they released it so late. Its interesting, the contrast with what jack smith did when we were talking a couple of weeks ago, jack smith with that indictment in washington, dc, went narrow. He only went after mr. Trump. He peeled away some of the more difficult parts of the case and he just went in with this narrow, sharp case. Now, fani willis has decided to go broad. 19 defendants, 41 counts. Its a different strategy and a rico case. On top of that, what do you think her reasoning is . Something this is a law thats commonly used to go after mafia groups that is being used with the former president of the united states. Now, what are your thoughts on that . Right. Well, its been around a long time, more than 50 years. It was indeed passed to help defeat the mafia families. Rudy giuliani, who is a new defendant in this case himself, has used the criminal rico case against mobsters in new york. And mr. Trump has had a civil rico case against him already. In the Trump University case. So what happened is, while the original target were mafia families, it has never been limited to that. So any sort of a criminal enterprise. So what you need is an agreement among people to engage in this goal. And here in this particular goal, it was to overturn the election, overturn the election, and specifically in georgia. And it allows you to go in a very wide way. And in georgia in particular, its a very pro prosecution statute, the way it was written, not every state has it and not every state is quite as generous to the prosecutor as this one is. And fani willis is an old hand with this. She has used this many times before. She has interesting that you just mentioned a moment ago, rudy giuliani, its been around rico has been around for a long time. But he really pioneered it when he was he was attorney going after the five families, the mafia, five families in new york, and really was successful in that case. It became, well known during his time. And now the irony is he is getting charged under the rico rico act here right . Any drawbacks, though, for fani willis using rico to go after to build her case against trump and the 18 other people involved . It isnt so much rico itself because rico is very powerful and the specter of a five year mandatory minimum sentence is going to weigh heavily on a lot of those defendants. But really, its the whole structure is that she said last night she wanted to have a trial in six months and she wanted to try everybody together. Well, imagine 19 defendants with all of their lawyers in one courtroom. Its hard to believe that that actually could be done in any sort of an efficient way. So i assume were going to see it morph. But thats what i see is the danger of the way she did this is that its so amorphous. You you could lose sight of what the goal is. But isnt it when their case when the mafia, they tried everyone at one time with at the same time. I seem to remember a case like that many, many decades ago. It can be done. And in gang cases it can be done. Theyve been done here in the bay area as criminal gang cases. It is possible, but its kind of unwieldy and in a situation like this where youre telling several stories, youre telling the story of electoral interference, where mr. Trump had made that famous call to mr. Raffensperger. You have interference with equipment down in Coffee County a couple of hundred miles south of atlanta, and you have the fake electors. Its a complicated story to tell. So it could be done, but it would take a long time and it could be unwieldy and i should say here, if we could put up the statement from President Trump, he says, quote this politically inspired indictment, which could have been brought close to three years ago, was tailored for placement right smack in the middle of my Political Campaign, where i am leading all republicans. I also want to ask you this one question here. Youre talking about the Coffee County case here. We had a lower level person named scott hall. He was caught on camera messing around, apparently with a voting machine. Its not clear that theres a direct connection between scott hall and President Trump. But does there have to be a connection in these rico cases like that . Well, it doesnt have to be a direct connection that mr. Trump does not have to have telephoned mr. Hall but its a to b to c to d, there are Text Messages between people in georgia and people connected with the campaign. So there are connections that would be adequate if proven to connect everybody up in this enterprise. Its because these get complicated. You never have one meeting like in a movie. Everybody is sitting around a table deciding youre going to do this, youre going to do this , and so that it isnt necessary to prove that all you have to do is show the connections, show the people where generally on board and that they committed the requisite number of acts in georgia, its only two. We can we can dive deeper into this, but unfortunately, weve run out of time. We could say the grand jury, fani willis, she wants everyone, all 19 people to turn themselves in by next friday at noon, there are arrest warrants issued for them. Happening today, the San Jose City council is going to vote on whether to create the citys own Utility Company. Mayor matt mehan says thats just the first step in what could be a long process. Even if it passes, the city is not committing itself to having a san jose power or a municipal utility. Like many bay area cities, san jose gets its power from pg and may or mehan says one of the things the city council will debate today is if creating a city operated utility will eliminate some of the delays in new Construction Projects which could also lead to saving money. What were looking at in the short term is interconnection rates. How quickly can new housing and jobs get connected to the grid so that we can continue to facilitate Economic Development in san jose . Pkg is seeing a greater demand for power and the state is putting up new transmission lines in the south bay. If the plan is approved, san jose could ask to tap into those lines. Mehan says the city must also consider that cost. He doesnt want to put an economic burden more on san jose taxpayers. Pga has not commented on that proposal. Well todays plans strike by thousands of San Jose City workers is on hold representing lives from the city. And the two unions have been meeting regularly. One of the unions tells us it has reached conceptual terms that will go to the city council today for review and approval. Workers, including libraries, emergency dispatchers and will shelter text engineers and airport employees, have been working without a contract since the end of june. The workers are demanding better pay, parental leave and improve staffing. Californias robert is among 22 state attorney generals opposing a recent settlement in a case involving socalled forever chemicals in drinking water. Thats the name given to potentially hazardous compounds that can exist for many years. The small city of stuart, florida, played a major role in a 10 billion settlement with the Company Three m back in june that followed a nationwide legal battle involving more than 100 local communities that claimed three was contaminating water supplies. With its forever chemicals in this case, the evidence was pretty overwhelming that by no later than 1983 and knew this chemicals were toxic. The epa has determined exposure to these chemicals can cause cancer or other Serious Health problems. Bonta is among the state attorney generals who is calling on the federal courts to step in and reject the settlement. Well, President Biden is scheduled for a visit to lake tahoe starting friday. So, jamie, maybe it was some kind of sixth sense President Biden better take some rain gear because it looks like its going to be a big show up in the mountains here over the next few days. Weve had a little bit of activity. Calm down, move out. Theres still plenty more. Upper low is off. Southern california is going to lift northward as it does, itll put us in the window for more rain, i think later in the week, maybe even on friday, had some activity towards the lake county. It looks like its pushed east, though. More out to the sacramento valley, but its close. And look at the activity. See this and trying to build there, losing a little bit of steam. Again, we get some breaks in the clouds today versus yesterday when we had the overcast. You get some breaks that allows a little lift, but the air aloft is warm, really warm. The placement of this will change every six hours for about five days. I promise. And were talking about former President Donald Trump, who has been indicted again. And this time it was in Fulton County, georgia. Political analysts say what makes this case different from the others is that the former president could face jail time even if convicted and even if he becomes president again, he would not be able to pardon himself for a state crime. Weve got ktvu ali rasmus looking into this latest legal case against the former president joins us now with more ali. Yeah clayton the state of georgia has some pretty strong and even broad racketeering or fraud laws on its books. And the District Attorney in Fulton County, georgia, relied on several of those laws to make this case. A grand jury indicted former President Donald Trump on 13 criminal counts. They include violating the states racketeering act, soliciting a public officer to violate their oath, conspiring to impersonate a public officer, conspiring to commit forgery and conspiring to file false documents. Now also, whats unusual about this indictment is the scope of it. There are 18 other peop charged with helping trump, including rudy giuliani, former white house chief of staff mark meadows, and attorneys john eastman, Sidney Powell and kenneth cesaro. Specifically the participants in association took various actions in georgia and elsewhere to block the county of the votes of the president ial electors. There are Text Messages between people in georgia and people connected with the campaign. So there are connections that would be adequate, if proven to connect everybody up in this enterprise. It isnt necessary to prove that all you have to do is show the connections, show the people were generally on board and that they committed the requisite number of acts. In georgia, its only two legal experts say there are benefits to charging so many people as part of the same conspiracy. For example, it might be easier for the District Attorney and investigators to convince some of those 18 people to turn against trump and testify against him in order to save themselves and get a less jail time. But because this is a state level criminal case, trump would not be able to pardon himself even if he were reelected president. Even the governor of georgia wouldnt be able to do that. Only a specific pardoning board at the state of georgia could. Now, before this indictment was filed, trumps attorneys tried to disqualify the District Attorney and her office from even investigating this case. They took that claim all the way to the Georgia Supreme Court and lost. The state Supreme Court said trump didnt have the legal standing to stop this investigation. The Fulton County da says she wants the judge in this case to set a trial date in the next six months. Back to you. All right. Thank you, ali. Well, we have new details about a deadly shooting outside of oak lake. Oaklands lake merritt bart station. The alameda County DistrictAttorneys Office has charged 45 year old one martinez in connection with the Fatal Shooting outside of the lake merritt bart station on august eighth. Now, according to police , the shooting stemmed from a dispute over an electric scooter. Martinez is currently in custody at the santa rita jail. Hes being held without bail. He faces charges of murder , felony criminal threats and an additional sentencing enhancement. San francisco leaders hope diversion programs will help reduce the number of Overdose Deaths and help drug addicts get clean. Law enforcement, the courts and drug treatment counselors are working together to run alternative programs for offenders instead of going to jail. Theres more support and more therapy. The Womens Resource Center in San Francisco helps about 20 women with drug addictions every day. It means everything to me. Its giving me that crutch and that stability and that comfort. I come in here every morning super happy. Im like, hi, everybody. Why are you smiling . Because im happy im alive, im sober. I learned that last year in San Francisco, 7200 people were screened at the jail for Mental Illness or substance use. More than 5000 of these inmates received Behavioral Health care or were offered treatment. Figuring important for individualized treatment plans, and that really is the key. Theres no one size fits all. I think we have an access problem when people want to get sober. Were asking them to go to detox and lay on a mat and on a dirty floor at the worst time of their life. People have to like beg to get into spaces issues facing the diversion programs include lack of funding and limited space. Some people have been on waitlists for one year. And show a strong showing. Im not. I dont know about me. I know its a captivating exploration of resilience and community empowerment. I am hope is a documentary that sheds light on the first yoga and mindfulness class in middle schools. It was a feature film in the bamboo d fest thats going on right now in oakland. Was it a challenge selling this idea, though, to the School District . Well,chool district ae institute who trained me d my 200 hours certification to come in and do the classes. Oh, this is fantastic. You know, ive heard actually documented studies that show mindfulness helps students in the classrooms. Right . Yeah. So what are you seeing . And talk to us a little bit about that part of things. Well some of the studies show that at least 15 minutes, three times a week will increase the focus clarity, relieve stress of the students. So we started working with just more of a mindfulness type approach. And then we added mat based yoga to it. The principal had was brought into a teachers beginning by then. Most importantly, the students began to buy in. So how many students do you have participating now . Oh, sometimes classes would be small as 2 or 3 kids. All the way to 60, a full, you know, pe class or assembly and are you finding that the educators are seeing differences in the children that are participating . Yes definitely. Yeah. What are they telling you . Well theyre saying that they will find a kid saying, hey, i just need to take a break and breathe. Thatsayins a really big deal to have children saying, hey, i got to take a moment, take a deep breath and reflect on what just happened before i move on to do my next thing. Right . Definitely. And one of the key aspects of it also is that when the students learn, they pass it on to other students, some of them even take it home and share it with their family members. So you saw the documentary on this. Tell us a little bit about the documentary and what people that see it will learn. So the documentary is a feature. Documentary. Is 65 minutes long. It just got accepted to the mill valley Film Festival. Oh, wow. And this doc, you will see how the children were introduced to yoga, how they resisted it, and then how they took it on as their own resistance. What was the resistance about it . Im curious about that. Some of them were like, what is this . Yeah, you know, theyre 12, 13 and some of them have never heard of yoga, right . So we actually tell them what it is and why we do it. Were the schools that youre doing this. I mean, are these in areas that just never hear of things like this . Well, this documentary takes place precovid since covid, we havent been able to reinstate it. But with this documentary coming goal is to bring it back to osd and expand it onl over a bambi on sunday said yes, it just screened on sunday. On sunday, yeah. We had a packed house up in there, say, 1540 broadway. But were also going to be having other screenings going on this week. Yeah, have another screening. You have one called dope as death. Tell us about that one. Thats screening tonight. Yes that one is directed by mia donovan. And its about dr. Mottola shakur, tupac shakur, stepfather who led the Acupuncture Program in new york to help people get off of heroin. Wow. And this documentary, youll be able to see what he did. And that program that he put on there. Theres another Interesting Program coming up, too, thats going to be happening tomorrow. And its a tupac documentary. Yes, that one. Just call it tupac shakur. Life in ten pictures. It also features myself and Attorney John Burris. All right. And that one shows tupacs life from the perspective of photographers or people that were in those pictures from the time he was a young kid in new york all the way to that famous iconic picture of tupac and shug night on the las vegas strip. This is just amazing here. There are a lot of things happening. So this Film Festival thats happening at bam. Bd how much does it cost to attend the event . Sliding sn 10 and 100 a portion of the proceeds goes to the tupac shakur foundation. Dr. Mutlu shakur family and also the bam house, which is newly inaugurated by dr. Elderly word slinger and zynga, who is the inaugural poet laureate of oakland. Yes okay. Bambi, the black Arts Movement is what it stands for. What do you guys do there . I just want to know what it is that youre about. We share all type of arts coming from black culture, whether its film, music, poetry, theater, everything is going to be showed there. And even political thought. So were going to have Attorney John Burris coming in tomorrow night to talk about the film and his experience in defending tupac. So there will be a panel in addition to the film that youre going to be watching. Theres more than just watching the film. Youre kind of getting an education in certain things. Yes. And the work that youre doing in the schools, hopefully youre able to get that going again one of these days. Those kids i know theyre liking it because the studies have shown that it does help students learn better and deal with their emotions and their feelings better. So its fantastic. A federal judge monday tossed out a lawsuit from two groups saying the president doesnt have the authority to write off loans. Shortly after that ruling, emails alerted borrowers. Theyll have at least some parts of their loans forgiven because of what the Biden Administration is calling an administrative failure. President biden writing in a statement, quote, over 804,000 borrowers never got the credit they earned and never saw the forgiveness they were promised, even after making payments for decades, i was determined to right this wrong. The administer nation shelling out nearly 40 million to help borrowers who enrolled in income driven repayment plans, which allows student loan debts to be forgiven after 20 or 25 years earlier this summer, the Supreme Court struck down the president s original 400 billion Student Debt Relief plan , saying the president lacked the authority to move forward with it. But biden has repeatedly said they will find another way. We have clear guidance from the president and the secretary that our goal is to provide relief to as many borrowers as possible. Critics call the push for relief a political move. Its about pandering. Absolutely buying up as many votes as you can. And i also will do on student debt. Not going to have some truck driver pay the debt of someone to a guy who got a degree in gender studies. According to the department of education, the Biden Administration has handed out nearly 117 million in Student Debt Relief to more than 3 million borrowers. In washington. That Program AllowsHigh School Students in the oakland unified School District to gain the necessary skills and knowledge to embark on careers in the Health Care Field and right now, applications are open. They opened up for this next cohort. And joining us now here in studio, we have joseph peters, whos the health path program manager, as well as harvey vascular, velasquez, lopez and nisei chao, who are both interns. Thanks so much for coming in to studio. So glad to have you here. All right, joseph, tell me about this program and really what its planning to do. I mean, Health Care Needs great people in it. This is a great way to get people started. Well health path represents Alameda Health systems, investment in community and so the long term objective of health path is to diversify the workforce of access and hopefully bring these young people in to be the future doctors and nurses of our organization. And its amazing. They get really get a full lookn our department. So in the emergency room, maternal child health, some of our students have even had the opportunity to witness surgery, childbirth, things of that nature. Thats amazing. All right, harvey and now you guys are both interns. Finished up your summer internship. What year are you in school, harvey . You graduated all done. Im a senior, and you guys both want to be nurses, right . Yes. Okay so tell me a little bit about what you saw in this program, because its very cool. Now, i want to start with you. You got to see life being brought into the world. Yes, i did. So it was a really amazing opportunity. We got to shadow a lot of medical professionals. Specifically, i was in the maternal and Child Health Department and i got to shadow a nurse where i could witness a live birth. And during this birth, i was actually able to hold the patients leg during her contractions so that she was a little bit more comfortable during her birth. And what did you get out of that experience . Because it really kind of amazing. Its a very vulnerable time for a patient, a really amazing time to watch a baby being born. A valuable lesson i really learned from that was that no matter how small or big the role is in the medical field, its extremely important. And it really emphasize sizes how we can improve the quality of health care for patients. No matter how small the role is. Thats amazing. Made you want to be a nurse even more. Yes all right, harvey, i know for you, i love this. Diversity in health care is so important, right . And how we interact with patients, how we understand kind of the place that were in. Tell me about your experience. I was able to translate for of all patients because a lot of people, a lot of nurses dont speak spanish. So i was able to translate and i watched. I also watched multiple procedures like blood transfusions or and i was able to shout out multiple nurses and doctors. Was it what you thought it would be . No better. It was very hands on. And it was like i felt like i was part of the team. You said you got more access than you thought you would. The language thing is very important because being in the hospital i went to , the patients really changed when they know someone could explain it to them in spanish. It did. You see it . Just calm them. When you are able to do that. Yeah, they calmed down. They were more comfortable and theyre able to understand more and thats a profound moment in someones care. Did you expect that youd be able to have that big of a role . No, i didnt think i would have that much of an impact. I felt like i brought a lot of things to the table. Absolutely. Would you guys, you know, do it again . What would your best advice be for someone who wanted to get into the program . My best advice would just be to take the opportunity if its given to you, because whether you like the medical field or not, youre able to take this as a learning experience into your future. Your best advice, i would say take the opportunity to theres nothing but benefits, nothing but benefits. Absolutely, joseph. I mean, thats going to make you feel good. I mean, this is amazing, the whole point, right . It benefits them. But really for the patients to see i mean, you know, whether you have someone in this very vulnerable moment where youre youre scared and youre doing this amazing thing, whether you just dont understand kind of what care youre getting, maybe, you know, and there is language barriers. This is part of the experience. Absolutely. I mean, what we know is our students come in with a lived experience that provides them the social and cultural context that allows them to serve our Patient Population in a way that our current staff may be our challenge with. And so what we need to do is diverse in our health care workforce, and were working upstream to do that at Alameda Health system, theyre surprised by how much access they had as young people kind of going into the space. What do you tell people who are looking at this program and saying, oh, is this for me . And what am i really going to learn . Am i going to stand in the in the corner and not do anything . It sounds like theyre really in it with people who are excited to kind of teach them whats next. It is truly an immersive experience and i mean that our students get to see surgery. They could see everything that the doctors and nurses that theyre shadowing get to see. And it really helps them make an informed decision as to whether theyre going to pursue a career in health care. So important. So if someones watching this, theyre like, okay. Or their parents because maybe theyre already at school, theyre watching this. And when my kid comes home, im going to make sure that they know how to apply for this. Or your parents pushing you to do this. That was good. Its a joint effort. They were motivated, motivated, yes. What how do they do this . What path to this path.
