This afternoon. Im alex savage and im cristina rendon. Lets get right to our political reporter greg lee, who is monitoring the latest developments as the political world shifts its focus to that federal courtroom. Greg and alex, the former president s arraignment on these latest charges scheduled for 1 p. M. Our time tomorrow. This is the third criminal indictment for mr. Trump in just over four months. Hes pleaded not guilty at the two previous arraignment, and he is expected to do the same tomorrow. He has the option to appear virtually and at this point, it is not clear if he will take that option or show up in person. Prosecutors will outline the four conspiracy and obstruction counts he faces related to the alleged lies and misinformation pushed by him and his team to remain in power. Law enforcement in d. C. Coordinating with several agencies to prepare for that appearance. Trump continues to maintain his innocence, blasting the justice department, calling the actions political. His Defense Team Preparing their arguments as well. Hes being indicted for free speech. Hes being indicted for objecting to the way that the 2020 election was carried out, that someone is running for president cant be used as an excuse for criminal conduct. If that were the case, anybody charged with a crime would just file for office. But i do think that the sooner this is done, the better. I spoke to south bay congresswoman there, zoe lofgren , today, who was part of the house january sixth select committee. She and other members said the charges filed are in line with their year long investigation into the attack on the capitol in fact, they recommended two of the charges conspiracy to defraud the us and obstruction of an official proceeding. And this, of course, on the backdrop of trump leading the pack of republican candidates running for the white house in 2024. Kristina, alex, and greg. To that end here, obviously one of the overarching questions is how are these upcoming trials for the former president and the pending charges likely to affect his campaign . Yeah, in the short term, alex, hes fundraising off this indictment and hes likely to see a bump off the attention in the long term trial dates have been set for march 2024 and may 20th, 24. So far, thats smacked ab in the middle of the primary season and we could very well see trump flying between Campaign Rallies and courthouses. A series of civil and criminal trials going on which are going to hurt him with a general election electorate despite his absolute ownership of the republican primary electorate. What all of this means in toto is, look, this is an inflection moment in american politics. This is a foundational shift in our body politic as weve been saying, the latest polls have shown trump leading the republican pack by more than 30 points and in a dead heat when put head to head with President Biden. Well, greg, how are President Biden and the white house reacting, maybe as well as some of his republican challengers . Yeah, the white house sticking to their playbook from the two previous indicted, which is to say nothing. They continue to refer everyone to the justice department. As for republican means, many lawmakers have stood in support of trump. Many house gop members echoing his comments that they believe this is politically motivated. Some of the other candidates in the republican primary shared the sentiment, while others denounced trump, like Chris Christie and asa hutchinson. Today we heard from trumps former Vice President and running mate, mike pence. Speaking to reporters, he said he wishes it didnt come to this, but again condemned trumps actions. Sadly the president was surrounded by a group of crackpot lawyers that kept telling him what his itching ears wanted to hear. Look, our country is more important than any one man. Our constitution is more important than any one mans career. We will watch closely tomorrow. And now theres potentially more legal trouble for mr. Trump on the horizon. A georgia prosecutor is expected to seek a grand jury indictment in the coming weeks related to his alleged efforts to overturn his election loss in that state. So more to come live in the newsroom. Greg lee, ktvu fox two news. All right, greg, thank you. Us Capitol Police responded to a report of an active shooter at a Us Senate Office building today that appears to have been a false alarm. Authorities say they first got this 911 call around 230 this afternoon as you can see, armed officers responded. They went door to door to clear the area. Some staffers inside the complex were evacuated, escorted out by police officers. Others were told to shelter in place where they were. Police say no suspect was found and there is no evidence of a shooting. The senate is currently on recess right now. Tulsa is looking into complaints that some of its cars are losing Steering Wheel control. According to the national highway Traffic Safety administration, about 280,200 and excuse me, 2023 model threes and model ys could be affected. The agency has received reports from 12 drivers who say they lost steering control and power steering while driving this investigation is one of several currently underway into possible problems with tesla vehicles. Other complaints include phantom braking and Steering Wheels falling off while the vehicle is being driven. And a new investigative report now from reuters is shining a light on additional complaints against tesla. These concerned the driving range of the companys fleet. A study from, say, mobile is focused on 21 different brands of electric vehicles. It found on average, electric vehicles fell 12. 4 short of their advertised range for highway driving. But of the three tesla models analyzed, researchers found those vehicles averaged 26 below their advertised range. That data is at the center of a report spearheaded by steve steckler. The Global Investment reporter at reuters. Steve we appreciate you taking the time today to talk about this report. According to your reporting, these discrepancies in the driving range were part of a broader effort by tesla as a company to, in essence, sweep complaints from drivers about poor driving range under the rug. The Company Created what was called a Diversion Team. What what did this effort look like . Yes, thats right. What our reporting found was that tesla for years has exaggerated the driving range of its vehicles. This is how far you can drive before your battery runs out and you need to recharge it. And what were talking about here is what you see on the screen when you get in the car. And what we found was that about a decade ago, elon musk directed and hes the ceo of tesla that they rigged the software in the car to provide what was described as a rosy estimate of what youre seeing as to how far your car can go. And it wouldnt be till the till it was about 50 that it would become more accurate, although not perfectly accurate. And over time, this resulted in a large number of tesla owners complaining that their cars werent achieving the range that that had been advertised. So they started complaining, looking service appointments. And as you point out, they created this Diversion Team last year in the state of nevada who sole purpose was to cancel as many of these appointments as possible. And they would rate the employees based on how many on average, how many appointments they canceled a day. And when that every time they canceled the appointment, they would they put their phones on mute. Someone would strike a xylophone phone with metal keys. They would stand on their chairs and applaud and celebrate the fact that they had canceled these appointments. Its interesting, seattle based ev Analytics Company recurrent looked at data from 8000 teslas and found that the estimated range on the dashboard did not adjust based on temperature. Teslas models calculated that they could travel more than 90 of their advertised epa range estimates, regardless of external temperatures. How does that external temperature factor into the discrepancy between the advertised driving range and the range that customers were actually getting . Right . Its a big factor. What a lot of people may not realize is that when youre driving in either very cold weather or very hot weather , it really affects the range of your cars and what the recurrent data showed based on, i believe, several thousand teslas was that that what you were seeing in terms of the range in your car, it wasnt affected at all by the by the temperature when in fact it was and by the way, this year , south korea regulators fined tesla 2. 1 Million Dollars in part for failing to disclose that. How cold weather could affect the range which they found could be as much as half the range would drop because of the cold weather. So. So last month, tesla was required to post on its websites in south korea a statement admitting to false advertising over a period of several years. And at the bottom was several tesla executives, including ceo elon musk. So that action was taken in south korea. And we know here in this country as well, the epa a few years back, back in 2020, did begin to require tesla to reduce the advertised range on its fleet by an average of 3 across several different models. Do we expect there is going to be any additional action taken by by the federal government in this country . Again tesla, when it comes to these discrepancies in the driving range, i cant make any predictions and we havent heard any regulators or you know, in terms of that. But, you know, the fact is, has there have been a number of studies. Theres a new one that just came out last week from Consumer Reports and there are others that we cite that all show that teslas overall dont dont meet the range that that customers are told they can expect to get quickly before you let you go we know you did reach out to elon musk yourself any word from him or tesla in response to his report as we do with any story, whether its an investigation or anything . You know, we try to get comment from who were writing about. We sent the long list of questions and as until now, we havent heard anything. So, i mean, in essence, steve, its sort of buyer beware. As we wrap up here, what would the advice be that you would give to folks out there shopping for electric cars right now, whether they be teslas or other vehicles . Well, i think people need to be aware that the range can can be affected by all sorts of factors. The way you drive the temperature outside the type of wheels, tires you have on the car, all of that kind of thing. So you cant really expect that , you know, when you go shopping and it says you can get 350 miles that youre really going to get 350 miles every time. Yeah, take that. Take that estimate with a grain of salt. It sounds like. Appreciate your reporting and appreciate you taking the time today. Steve steckler, Global Investigative reporter at reuters, appreciate you coming up. Thanks my pleasure. Thank you. All right. Some people here in the bay area may have gotten a scare overnight after the National WeatherService Posted a flood alert on its website. Ktvu south bay reporter jesse gary is live along the Los Gatos Creek in los gatos. Jesse, why was there this warning despite sunny skies and no rain . Yeah, a lot of people are asking that question. Christina including our friend and colleague, roberto gonzalez. We were talking today and what flooding . A picture perfect day. Lots of sun. And as you can see behind me, the creek levels are normal. The National Weather service saw it. Theyre used to this. They say its not uncommon for faulty sensors or things like that. You know, all across california. So they gave us a call just to let us know that there was obviously some missing data points. They looked at the data and was clearly, you know, inaccurate and valley water spokesman matt keller says the problem was caused by his agency. Was recalibrating flood sensors along the Los Gatos Creek near lark avenue. Water level reporting times are typically adjusted when its not raining. Season to better protect trouble when it is raining. In this case, one sensor signal an alarming increase in water height from one foot to 1800 feet, which is ocean level depth, triggering an automatic flood alert on the National Weather service website. This also happened for a sensor along the santa rosa creek. That reading reflected floodwaters at 77ft, which is not true. So why would they do that . I guess thats the question. I mean, why would they put something out that i mean, if theyre going to put an announcement out like that, maybe they should have some justification or some reinforcement and information on that. So why would the nws automatically put an alert out on its website when the data is so far off, what the actual conditions are . Well have that story that part of the story for you coming up at 5 00, guys. Okay. Well, before we let you go, jesse was there any panic or confusion within those affected communities that got that erroneous information . Well, valley water Officials Say the information was posted only say only to the nws website. Right. It was not sent out as an alert to individual cell phones or to homes and First Responders in the south bay. So unless you were up during the overnight hours and happened to be looking at the National Weather service website, you would have missed it. The reason why we caught it is because we monitor those types of websites. 24 hours a day. And we saw flood alert and that rang alarm bells as in what arent we what arent we . What are we missing . And is roberta holding back something . Maybe theres a monsoon on its way and thats what led to this. All right. Well, well check in with you at five. Thank you so much, jesse gary live in los gatos. Thanks up next on the four. A woman in oregon escapes from a cinderblock cell after being abducted. More on the suspect in custody and the disturbing allegations that have the fbi now searching for additional victims. Plus help wanted ahead of the school year. Oakland Unified School District requesting all hands on deck to fill open crossing guard positions across the city. Okay. For the record, i would never hold anything back. Hi, everybody. Good afternoon to you. Take a look at that right there, right now. See that gray slate . The sun did not shine in the city of San Francisco or oakland today. Well tell you when that sun will make an appearance. And how long its going to cool down your bay area forecast is coming up right after this brief commercial breaks stay with us this afternoon. Beautiful shot, though. Meteorologist Roberta Gonzales joining us now from our Weather Center with the latest. And it did look pretty foggy where were looking for that sun. Yeah and we found it. We found the sunshine. But you had to head to the Santa Clara Valley monument peak. Were looking out past san jose, fremont, union city, cooper, chino and campbell were currently at 72 degrees, according nicely to the abundance of sunshine. But check out San Francisco now at 60 degrees. A recipient of no sun, half moon bay, 59 degrees, otherwise full on sunshine east of the bay. Were talking 77 degrees in concord, 74 in livermore. Wow. These are very Cool Temperatures for this time of the year. Then you toss in this breeze up to 21mph in fairfield, 16 buchanan field in concord, 30 mile per hour wind currently. Thats at oakland international. Look at novato and napa at 18 mile per hour winds. Lesser in santa rosa and throughout that san bruno gap are experiencing a 28 mile per hour gusts at sfo 23 in Mountain View. So youre getting the feel its a bit on the breezy side, brisk winds all associated with this enhanced marine layer. And our Storm Tracker is placing it correctly here. You see that the Golden Gate Bridge is totally socked in richmond, sunset bayview district, same story. There we go, east of the bay. And we did see some clearing, albeit overcast most of the day in oakland and then north bay santa rosa began the morning with limited visibility. Now clear skies with the sunshine. So we take you to the peninsula now. Edge ma south San Francisco. No sunshine experienced today. So your temperatures were adversely affected. Sunshine fine now at the boardwalk in santa cruz. So heres the deal. We do have that monsoonal moisture just east, the bay area trough still hangs well to the north. And as it does so, it has enhanced our marine layer. Boy, it was 3000ft deep overnight. So that kind of deep fog bank is not going to allow any kind of clearing. And when you see the blue on the screen, that is the condensation that is the drizzle that you will wake up to tomorrow with this marine layer. Official sun up tomorrow is at 613, not going to see it in throughout the tri valley. We will see some hint of fog in throughout napa. Also, santa cruz, morgan hill and in gilroy. So bottom line is tonight with the clouds spreading onshore, there will be some locally sized drizzle Area Temperatures into the 50s across the board. Even antioch tumbling out of the overnight lows in the 66. Tomorrow. Your daytime highs unseasonably cool and it will pan out to be the coolest day of the workweek. Were talking 60 pacifica to only 82 degrees. Our outside number, fairfield and antioch. But wait, because next time around i will feature when it will top off in the triple digits. Yes, thats right. Christina and alex. Wow. The heat making a return. Roberta thank you. The fbi this afternoon is looking for more possible victims of a violent sex offender whos lived in at least ten states, including here in california. Investigators say a washington woman escaped santa today from a homemade cinderblock cell in the mans garage at his home in klamath falls, oregon. The suspect, 29 year old nagase zubiri, was taken into federal custody the next day in reno, nevada. According to court records, he abducted the woman in seattle while posing as an Undercover Police officer. He then traveled roughly 450 miles with the woman sexually assaulting her during the trip. Hes charged with interstate kidnaping, with intent to engage in criminal sexual activity. Nearly a week after an american nurse was kidnaped in haiti, efforts are still underway to secure her release. The search goes on for the woman as well as her daughter and as foxs molly lyon shows us her abduction may affect much needed aid to that region. Its been six days since new hampshire. Its been just over two weeks since Army Private Travis King crossed the border into north korea. A shocking act that left the pentagon. The white house and much of the world wondering if it was a defection or a tragic accident. And now, for the First Time Since he left a tour group and sprinted across the border, pyongyang is acknowledging the incident. The need for crossing guards is growing in the east bay as parents and kids prepare for the Upcoming School year. In fact, the oakland Unified School District is looking to fill positions across the city and the urgency is increasing as a school year gets underway in just less than a week. Heres a list showing more than a dozen schools that are most in need of helping hands. For more on this, we are joined by osd spokesman john sasaki this afternoon. John, thanks so much for being here. Good to see you. Talk to us about how great the need is for crossing guards and how many positions does the district need to fill . Well, to be clear, were not filling the positions, the crossing guards are actually filled by the city of oakland. Theyre the ones will hire them. But you know, our crossing guards are incredible partners for us to help ensure that our kids, our families, our staff even get to and from school safely. So we really need them at our schools to ensure that that those streets are kept safer because, you know, as we all know, there are times there are some folks in oakland who who dont really obey traffic laws like the way we would like them to. And that can be a threat to the safety of our schools, to the safety of our students and our families and staff. So just want to make sure that we get this word out. Anybody can come and do this work. Its Pretty Simple job that is, you do a couple of hours in the morning, a couple of hours in the afternoon. Hey, as far as i know from the city of oakland is pretty good. And so a lot of retired folks do this. Other folks who are just looking for some extra money, i think that you can make some pretty good money doing it. So we just want to get the word out, make sure people know that these opportunities are there and we do need the help. What kind of person specifically looking for you say anybody who can really do this. But i mean, it would help if they have a love for kids or or have that Public Safety aspect in mind. Its Public Safety. Its a love for children. Its a love for your community. Its about making sure that the people who are there are are people want to be with our kids and want to welcome people to our schools. And you know, as youre showing right there, you know, they serve such an important purpose, just putting up that stop sign, making sure that everybody gets across the street safely. So we want to get this across to people who are ready to do a little extra work maybe maybe as a second job, maybe as as a job that they they wouldnt otherwise have because theyre retired. So there are a lot of folks i know in oakland who could use this money, could use the getting outside, working with our families, having a little fun in the process and just feeling good about making a difference in the community was there a difference from last year to this year, or have there always been a need for crossing guards in the city . Well, you know, crossing guards are something that were always looking for. I mean, just just like staff and across the school , were always looking for good people who want to help. We want to make a difference. So that goes for teachers. Right now, were looking to hire some teachers as well. So along with crossing guards for the city, we have openings that were looking to fill as well. So it is about finding the right people who are there for the right reasons. Obviously, the money is important, but i think that this is the kind of job that you really have to be someone who really cares about their environment, cares about the people in it, and wants to make sure that people are safe. Yeah, absolutely. Okay so then what happens if these positions go unfilled . Yeah well, obviously well make do you know, well partner with the city of oakland and find other ways to make sure that our School Communities are safe. But, you know, obviously, this starts with with the residents of oakland. And this goes for any city across the bay area, you know, with schools starting next week for some and in the coming weeks for most, you know, we just want everybody to be really cautious around schools just really cautious in any city where they are really because, you know, cars, trucks , all traffic can be really dangerous to people who are pedestrians. People on the sidewalks, even in you know, obviously in the streets, crossing guards or in crosswalks. So we want everybody to be really conscious that, you know, now school is starting again and people need to be very, very careful as theyre driving around their cities. No doubt that keeping kids safe is a top priority. John sasaki with osd, thanks so much for joining us here on the floor. We hope that people do apply and hopefully you guys get some help with those kids on the streets. Thanks so much. First day of school, monday. Thats right. Good luck. Well, the hours for crossing guards are part time. Two in the morning, two in the afternoon at a starting hourly rate of 1875 per hour. Uniforms, equipment training, all provided if you want more details, you can head to oakland cargo keyword crossing guard. All right. Hopefully a lot of folks step up to help out. Up next on the four today, well talk live with a scientist at the group bay keeper t and how it compares to what we saw last year in the waters of the bay. 103 degrees. Thats right. 103 degrees. Ill show you where and when your bay area forecast is coming up. Try the roast beef or pastrami french dips today only at togos of the bay one year after a similar red tide killed thousands of fish and other marine life. This is new drone video showing the reddish colored bloom near the berkeley marina. Officials are also tracking its spread off the shores of albany, richmond and emeryville. So far, there have been no reports of fish deaths this time around. But officials are warning people and pets to stay out of the water as they continue to monitor the algae bloom to get more on this, were joined now live by ian wren, staff scientist and algae expert at baker and Environmental Group here in the bay area that works on improving conditions in the waters of the bay. Ian thank you for the time today. We appreciate it. Explain to everyone what type of algae is it that is spreading right now in the bay and whats causing it to bloom at this moment . Well, early identifications have indicated this. A species called hetero sigma akasha, which is known from all over the world and as you said earlier, it is the same species that caused the massive bloom last year that resulted in widespread fish kills. Its still pretty early in the in the phase of the bloom. We just started seeing it really last week and for context last year, it took over a month until we really started to see fish kills and other other Water Quality issues. So were really not sure if this is just an ephemeral thing that might just pass naturally or if its going to go into something bigger and more, more cause for concern. Yeah. And thats sort ofuch wore is this particular bloom going to get . Is it is it necessarily a certainty that we will see fish and marine life dying as a result of the bloom this year, like we saw last year . No, its far from a certain. It could very naturally just fizzle out on its own and go away. And but this is really a cause for concern because before last year, we hadnt really seen this bloom in 20 years. And it wasnt anywhere near the size of what we saw last year or this year. And so this is just a sign that these things might be coming, becoming more frequent and based on what we saw last year, these could be really catastrophic for the bays ecosystem. And just the overall bay health. What does this have to do with with the conditions in the waters of the bay and the temperatures in the water, the waters of the bay . Yes, we know that this organism can basically sit dormant at the bottom of in the sediments, in the bottom of the mud for many years. And its not really known why its triggered. But we do know that when it gets warmer and when theres more sunlight and less turbid conditions, thats kind of the overall recipe for any kind of algal bloom. And this one is just been really well suited for the bay in the last two years. All right. So the monitoring work continues on on behalf of your organization and others to track this particular algae bloom certainly hoping that it doesnt continue to spread like we saw last year. We have to leave the conversation there. Ian wren with bay keeper, great to have you once again. Thank you. Thank you. Some monsoonal rain and thunderstorms rolled into the Las Vegas Area today, knocking back that record heat. At least temporarily. The High Temperature there back down into the 90s.
