Fox news and the Associated Press already called arizona for joe biden, but a quick look at the numbers, bind holding on to a slim need, 94 reporting, 50 to 49 . Sure. If the race is not called tonight, you expect to hear from former Vice President biden that hell talk about unity, hell talk about the process, and hell talk about patience. Its itch important, also, that really if you think about it, the president is paying attention to whats happening, as well, as frustrating as that might be within the white house. So in some ways, joe biden is communicating past us, past the media, directly to donald trump, as well, sending these messages. Joe biden has to also make a short statement, but he has to talk about we, not me. He has to talk about us, not just myself. That is the test for him. Unity, if you will, and, at the same time, the process and patience, and then get out. Its clear that the president plans to fight this in the courts as well as asking for recounters. What do we know about the history of recounters and if they move the needle at all . Right. If you look at the history of recounts, they dont move the needle. Weve had two president ial recounts. 2000, your veers will remember, hanging chads in florida, and in 2016, but it was only in two states in 2016 when it was supposed to go to five states total. Senate races and gubernatorial races, though, in those races in recounters, the field has not moved. Its a political hail mary. Its really a legal strategy, its a political strategy. We were texting last night as we saw big swings toward biden in georgia and pennsylvania. About the areas where these votes came from, tell us about this race and what they might mean for binds gains from where clint was in 2016. If you think about it in 2016, Hillary Clinton lost the burbs. She didnt do well in what we call these emerges suburbs. Donald trump cleaned up there. He won 46 of college edge indicated white women in 2016. He improved on that number this particular election. He improved on vote share with africanamericans, and his vote share in milwaukee from 2016. He improved all around, and his vote total went up, although joe bidens vote together went up as well, because he cut into the lead that donald trump had in those areas. So what happens is joe biden did just a little bit better, a little bit better, a little bit better all over, and thats why all day long, hour by hour, he has walked more slowly, but consistently up in a tooth 270 through pennsylvania, the state of his birthplace. Dave, we all continue to watch and wait on pins and needles. I want to ask you very quickly, if you can, its not unusual for us to wait this long, right . No, its not unusual at all. And actually nevada can go up in counting the votes until the 10th. Youve got a lot of people overseas, a lot of people deployed, and because of that, you have to wait to get those votes. Thats a totally normal process. The votes have been past. Now you have to tally them. Thats legal and appropriate. Well, for a Third Straight day, protests did continue all across the country as america watches and waits for an outcome in the 2020 president ial election. And this was the scene earlier today in washington d. C. You can see a large crowd of count every vote demonstrators gathered downtown. They played music, danced, and held signs. The demonstration remained peaceful throughout the day. There were rallies that happened in philadelphia. Crowds are growing there, and the protests are heating up outside of the convention center. President trumps supporters are calling for the count to be stopped, and theyre casting doubt on the legitimacy of philadelphias tally. Activists on the other side have been demanding that Election Officials count every vote. And in arizona, President Trumps supporters demanding officials stop counting votes. A crowd gathered outside of the Maricopa County election department, waving trump flags. Yesterday, a socalled freedom of speech fence was put up to keep protesters away from exceed and the folks who are counting the ballots. Several ballot counters have said they have felt threatened by the crowd. Demonstrators in San Francisco spelled out their opposition to lawsuits over the election results. Today the group painted a large street mural wet the words count every vote on montgomery street as the intersection of california, right outside the 555 california highrise. That building is partially behind President Trump. You may remember it as the former bank of america center. Organizers say their message is simple. Either side will need 51 seats to have a majority. The judge decided that the case will be heard if samantha county where the first trial took place, and not in stanislaus county. The judge set next monday as the next hearing date for defense motions on claims about your misconduct. Peterson was convicted in 2004 for killing his pregnant wife laci and their unborn child. The judge also set january 21st as the next hearing date for the prosecutions retrial of the Death Penalty phase of the case. Two men from the east backup face federal charges for allegedly extorting underage girls for sexually explicit photos and videos. Police fear that there are more victims out there. Reporter San Francisco police say their investigation started in the fall of 23019, when an administrator at a school in the city reported that a number of students had been bullied and blackmailed into sending sexuallyexplicit photos and videos via social media. Tonight Justice Samuel alito granted the gops request to separate votes that arrived after election day. Election officials said they were dollar ting that. Is there any significance to this ruling . Very, very little. They were not only already doing this, but they were already doing this because of an order that was issued before the election. Justice alito essentially said you need to keep doing what we already told you to do. He referred the matter to the full Supreme Court and asked for a reply on the issue by i think tomorrow at 2 00 p. M. Eastern time, but i dont expect this to be a big game changer litigationwise. I think for your viewers, its important to remember, i dont think were talking about enough ballots that could flip the outcome either way, and thats, of course, what were looking for when it comes to these legal challenges. Jessica, on the topic of recounts, we know that the Trump Campaign has said they would request one in wisconsin, and georgia is expecting one as well. What can we expect from that, and why this not a bush v gore 2000 . What we can expect from the recounts is it will probably not change the margin enough to flip the vote. Now, its really, really close in some states, and so, you know, it is but historically speaking, its unlikely that when you have a recount, it change this winner. Now, its 2020, and i feel very uncomfortable saying its unlikely and its all but assured, but in the past is pro log, its unlikely and all but assured. Bush versus gore, i dont see it right now. I think we all have a little bit of collective ptsd, because there was this huge election case that essentially decided a president ial election, but that happens once in well, it happens one every 15,000 blue moons, really, essentially, and so what you need for a bush versus gore is you need to have litigation in a state that matters. The one state that everything comes down to, like florida in 2000, and then you need to have the litigation surround enough ballots to flip that state. I just dont see that case coming down the pipeline right now. Jessica weve got about 30 seconds, but i want to ask you something a few viewer asked, why are the rules be so different in every state . In 30 seconds, because the u. S. Substitution said states you determine the rules in each state, and sometimes counties. And we have, like, 100,000 sets of rules. Deputies thought the driver was a car thief when, in fact, the man was driving his own car. Reporter former Sonoma County sheriffs Deputy Charlie blount is now a criminal defendant inguide grand jury for this death in david ward. Here video of david ward being confronted by Law Enforcement at the end of a chase. Police and deputies thought he was a car thief. Police say during the struggle he bit deputies and refused to obey their community. At one point, Deputy Blount can be seen smashing wards head into a car while a second officer tasered him. Ward later died. Blount retired after she sheriff announce head wanted to fire him. The grand jury indicted blount on charges of involuntary manslaughter. He turned himself on monday and was released after posting 50,000 bail. I wouldnt say that im surprised, because this is a particularly egregious case, and theres no disputing what happened. I just wish my brother and father was here to see it. They wished so badly to bring him home. Well, firefighters tonight remain at the scene of a big fire burning at a wood chip processing facility that started about 3 30 this morning at the dmc recycling plant in hole lester. Its burning about 100,000 tons of compost. Firefighters from several counties, including santa clara, are working on this fire. Its expected to burn for at least three days.
