And thousands of votes are still being counted as we speak. Lets go straight to the numbers in critical battleground state pennsylvania. 20 Electoral College votes. A state the president flipped in 2016. Bideen took lead the lead and we are i want waiting from counts in Allegheny County biden ahead by 14,000 votes. In georgia it bears repeating a state that has not selected a democrat i go president since 1972 but the margin is thin. There will likely and recount. Official say whats left are provisional ballots. Right now, biden ahead by about 4,000 votes. Lets go to nevadan 6 Electoral College votes. Official also count well into the weekend. A lot of focus on clark county. Home to 70 of the population and las vegas. 88 reporting biden leading 50 to 48 . President trump continues to hold onto a lead in North Carolina as well, and as the numbers continue to come in, we know the Trump Campaign filed a series of lawsuits in several states related to alleged illegal votes, and the tabulating process. Cases that are making their way through the courts some have been thrown out by judges and in one case poll monitors were allowed access. The president claimed widespread fraud and continued to commit to a legal fight. He said in part, we will pursue this process through every aspect of the law to guarantee that the American People have confidence in our government. I will never give up fighting for you, and our nation. Joe biden is watching numbers roll in from his home in delaware. Reports from the campaign are that they remain confidence dent but urge patience. Again, we will hear from biden and harris this afternoon. This morning, we heard from Election Officials in some key states about the status of the counts, and pushing back on the allegations of fraud. The final tally in georgia at this point has huge implications for entire country. The stakes are high. And emotions are high on all sides. We will not let those debates distract us from our work. We will get it right. And we will defend the integrity of the elects. The votes will be count until every ballot is counted. While some including the president spew baseless claims of fraud, claims for which his team has not produced one iotaa of evidence, what we have seen here in philadelphia is democracy pure and simple. In arizona thats a state that fox news and ap called, but many have their eyes on. It is smaller and has to be within. 1 of a margin and nevada, margin doesnt matter but the party requesting the recount must pay for the recount. So these are things that are in play that we will continue to see. In addition to the legal issues that we continue to watch as they make their ways through the court system. Lot of possibilities. Heres a look at the current numbers. Joe biden with a 51 of the popular vote more than 73 million votes compared to 70 million for President Trump there. Another one of the hotly contested states in the race for president , is the state of arizona where the vote counting continues at this hour. These are the current numbers out of arizona right now. Joe biden in the lead. You can see there, but its a lead that has shrunk over the last couple of days there, as President Trump has eaten into the margin. We get live coverage from arizona. Fox ben brown joins us live from the Maricopa CountyElections Department headquarters in Downtown Phoenix with more on whats going on there. Ben, we have seen demonstration over the past couple of days. How does it look now. Reporter yeah, good afternoon, well the drama continues for the Third Straight day. There are about 50 or so Trump Supporters outside the Maricopa CountyElections Department and a Large Police Presence that they have shut down the street in Downtown Phoenix on the corner of lincoln and 3rd so we will be monitoring that as that situation progresses. We expect a ballot drop around 7 00 p. M. Local time 70,000 ballots. And as you showed i want to update viewers in terms of where we stand, joe bidens lead dwindled and trump cut into it 40,000 votes or so but he needs about 60 of the remaining votes if he hopes to take the lead in arizona. And he is performing under that so again with the ballot drop around 7 00 p. M. Local time, it will be a big indicator to see whether or not joe biden can pull away with this, or if trump can continue to cut in the margins. We will watch that tonight alex. All rightch yeah, so a lot of votes yet to be counted. One of the questions being asked in arizona and some of the key states across the country is why is it taking so long . What are Election Officials on the ground saying about you know the slow pace of the vote count. Reporter yeah, thats a great question. So lot of early ballots were dropped off on election day, and those couldnt be counted on election night. They had to go through a verification process checking the signatures before they go through the machines to get at that. Lathed and thats the reason for the delay. They got early ballots and like across the country, its been an unprecedented amount like arizona like much of the country. Thats the reason for the tie up and the Trump Supporters are chanting for more years and make their presence felt and we expect the crowd to grow as we get toward the ballot drop at 7 00 p. M. Local time and maybe a couple hundred people. Thats why we had the police presence. We are making sure that it is safe. I been out here for a couple hours and they have been rowdier than the previous nights so thats also something to watch as it develops here. But it appears as though the party will remain its retain rather the majority. But with fewer seats than it has right now. Republicans exceeded expectations and picked up 5 seats. They need to flip 21 to gain control. And we are waiting for results in 29 races. Now some democrats are blaming House Speaker pelosi of San Francisco for the parts failure to pick up more seats during the election. And reportedly some are now hoping that caucus chairman jefferies will challenge pelosi for speaker of the house. The entire house votes for speaker coming up on january 3rd. She is the best vote counter and knows what it takes to get to the needed number. Now back in 2019, you may recall, 15 democrats voted against pelosi when she ran for speaker after democrats regained the majority in the house. Now to the u. S. Senate, and four races have not yet been decided. Two are in georgia. And both of those races now appear headed for a run off. Right now, democrats and republicans have both claimed 48 seats, and democrats added one seat after winning in colorado and arizona but losing a race in alabama. The housing with a egged and sprayed with a graffiti and suv parked in the driveway had the windshields smashed. A hundred people protested over the political display. Many of the protesters said they live in brentwood and some posted signs outside the house that read, violence is never okay and black hope. To see that all of these people that it got around that quickly, and all of the people came out to support black people and just kind of protest that this is not okay, but no one wants to see this in this neighborhood. And even seeing these signs that it is like, you know, not in my neighborhood. Now police asked the home owner to remove the mannequin and he did. We have yet to hear from him. And investigators say the display was not criminal and that no charges would be filed. I want to give you live look of whats taking place outside of that house there in brentwood. Along with a protest thats planned later today, a barbeque is also set to take place there as a sign of peace and community unity. The new penalty phase of Scott Petersons murder trial is moving forward in San Mateo County. Peterson appeared remotely earlier this morning from san quentin prison for a hearing in redwood city. The judge decided the case is going to be heard in San Mateo County where the first trial took place and not in stanislas county. The judge set monday as the next hearing date for defense motion on claims of juror misconduct. Peterson was convicted in 200 for killing his pregnant wife lacey and their unborn child. Petersons defense lawyers wants the conviction to be overturned. Joining us now to talk more about what we can expect moving forward here is ktvu legal analyst michael car dosa. Good to have you on here. So things are going to stay in San Mateo County and sounds like petersons legal team, today, essentially waives the waiving the right for the penalty phase to see if the conviction is going to be overturned. A jury trial will not be held as reported in january. The january court date is a mere status hearing. This wont go to trial until probably midsummer. So when people say they are going to try it within 60 days, thats not exactly true. In fact, its not true. It will be held sometime during the summer. Remember, the first part is the a motion that will be heard in San Mateo County. And that will decide whether juror misconduct affected the first trial and whether Scott Peterson should be given a new trial on the guilt phase. The Death Penalty phases have been overturned. But the San Mateo County court, the judge there, will now decide did your misconduct affect the jury so that there may have been a different verdict or a hung jury. Once that decision is made, and i assume they are going to find that it did not affect the trial, then it has to go up appeal. So you are looking at a jury trial, i would guess, sometime in july or august. This is moving a two parallel tracks. The penalty phase issue and then the issue of whether or not the conviction is overturned. On the issue of whether Scott Peterson gets a new trial, this is going to be up to the judge as you said in San Mateo County, looking at this jury misconduct. The jury who didnt reveal that she had obtained a restraining order. And at that was not revealed during the proceedings there, and so, what is the judge going to have to consider when deciding whether or not peterson deserves a new trial . Well, actually they will have a factual hearing where they bring witnesses on and they also say the issue will be did that jurors misconduct in lying to the court when she said that she had no db and Domestic Violence involvement before, that got her onto that jury, did that fact that she remained on the jury, would that have changed the jurys decision either going to not guilty or perhaps hanging that jury. So theres Trial Court Judge that has to make the decision. Now, my guess, is the Trial Court Judge will say no, it didnt affect the vergedic verdict and i say this will have a Chilling Effect on judges but i cant help to think its in the back of the mind of the judge that hears this because if she reverse this is and says lets go back for the guilt face reversing that, and you imagine what might happen to that judge. I am not saying she is going to let it affect her, but it will be in her mind. That scares me, so, but, think she is going to find that it didnt affect jury, and then it goes up to the applate court and as you know, those are life too many appointments, so they will have to make the ultimate decision in the case. Then, after finding the guilt portion, if they have to retry it, then they go to the penalty phase. You can see it would make no sense to try the penalty phase, the Death Penalty and. Of course. That part of the guilt has to be tried and then they move to the penalty phase of the trial. Right. So, no matter what, this is going to be an extremely long and drawn out process. With just a slim margin separating President Trump and joe biden in the state of georgia, that state expected to have a recount and other states expected to do the same thing as well, potentially. Over the last half century, the record of recounts is crystal clear. Recounts rarely change the final outcome at least lets say for a statewide race. Reporter National Elections expert law professor David Schultz also holds a doctorate in Political Science and says, a recount is nothing more than rerunning the ballots through the counting process. Period. Some states have automatic recalls for razor thin elections and others require the candidate to ask for a recount. They can request that but it will cost them, not the government, but its going to cost the candidate to do that. Reporter in all of the still undecided battleground states, it has been more than 20 years since a losing candidate has become the winner by recount. Back in 2016, there was wisconsin recount of the trump election that trump won by 20,000 votes. The recount went in trumps favor by just 131 more votes reconfirming his victory. And in arizona a decade ago, a local judicial race changed by 66 votes, no change to the actual outcome as was the case in georgia six years before. There have been other recounts in pennsylvania. North carolina, and wisconsin all with unchanged outcomes. As to the current president ial race, though the law man dates elebs must take place on a certain date, the president asserts that anything counted after that date is invalid even if state law allows it. Lower courts have not been sympathetic and i down the the Supreme Court will be sympathetic either. Courts will almost never, ever overturn an election unless the evidence is so overwhelming that the election was corrupt. Data from the secretary of States Office shows that Los Angeles County the most populous in the state, has the most uncounted ballots as of this morning at about 618,000. Locally, about 345,000 ballots have not yet been tabulated in alameda county. California leaders are considering making voting by mail a permanent option for all registered voters. This year the state required county elections offices to mail a ballot to all registered voters and that cost the state 65 million dollars. And nearly 60 of registered voters cast ballots before election day. It could become a permanent plan if the state figures out how to pay for it. Santa clara county is about to break a record for the number of people who voted in tuesdays election. Right now, voter turnout there is at 84 of the 1 million registered voters in the county. Thats just short of the 86 record that was setback in 2008. Mailin ballots are being counted, so the turnout number is expected to get bigger. There is an urgent need for blood and plasma donations. You know, its been a challenge since the pandemic started. We have been trying to balance collecting enough red cells platelets and plasma to treat patients undergoing surgery or chemotherapy with collecting convalescent plasma to keep patients recovering from coronavirus. One of the big of the challenges. What are. However. Sorry. Go ahead. With people working from home and schools not in session particularly the college, that cut back on the amount of places we can do mobile blood drives. Yeah, and i think people can sort of look at whats going on right now and understand how donations are down. What are the consequences, though, of this . Well, we have been able, with Creative Solutions to, manage to keep up with the demand for all of our Hospital Partners and patients in need. And this is included increasing the amount of appointments at Blood Centers even though we move the donor beds farther apart to maintain social distance and keep our donors safe. We have also part nerd with so many new organizations which is encouraging to have. We are having mobile blood drives. They are not able to be healed in the bus or a contained unit as in the past. Yes, so youve been able to make changes and thats kind of been able to fill the gap. What other changes have you made to make people feel a little more comfortable about making a donation like this . Well, the first thing is when you show up to a blood drive, we will take your temperature. And we dont let anyone who is running a fever enter the blood drive. Then donors come in and register and we have instituted deep cleaning every night. We are doing multiple wipe downs throughout the day and we have added, sanitation stations, so you can sanitize your hands either with hand wipes or foam sanitizer. We are keeping donors 6 apart and, of course, everyone donors and staff are Wearing Masks at all times. Yeah, and for folks at home, who might be thinking, okay, with all of those changes i feel comfortable with making a donation. How critically important is it for people to step up to the plate here . As we are going into the holiday season, especially between thanksgiving and christmas, it is really crucial. Normally, the fall is when we have a lot of campus blood drives bushes college are not in session. And people start to think about getting busy with doing other activities, and we traditionally would see donations slum. So now more than ever, its important to come out and donate, and make a commitment to do it sometime between now and the holidays. Again Pacific Northwest and Northern California seeing a little more than we are and over the sierra, we are seeing some snow that will continue to accumulate over the weekend. This system will continue to make the path along the coastline just skirting us as it moves through closer to the Central Coast and we will move across California South of us. But we are seeing just a little bit of rain right here just south of halfmoon bay. So, perhaps a little there up over the Coastal Range and into the sierra, snow levels to 4,000 feet later tonight. By the end of the weekend, into the foothills, so, again, an unseasonably cold storm for this time year. Heres futurecast, tomorrow or tonight, we have just a few scattered showers that continue to push through. And could get a few sprinkles in the overnight hours, and that looks like about it. Police in San Francisco have arrested a man who is described as a prolific bike thief. Investigators launched a two monthlong undercover operation at the end of august. And they say they were able to trace 4 bicycles that led them to the home of 48yearold Israel Hernandez in burlingame. Place say they found 18 stolen bikes at his home. In the search of mr. Hernandezs home, they discovered various stolen bicycles as well as one stolen motorized scooter.
